A Medicaid-compliant annuity is not a special product category or a guarantee of eligibility. It is an annuity transaction whose contract terms, funding, beneficiary designation, documentation and state treatment satisfy the applicable federal Medicaid transfer rules and the applicant’s state policy. In the right long-term-care planning situation, an annuity can turn an otherwise countable asset into a payment stream. The payments may still count as income, however, and a defect can result in a transfer penalty or another eligibility problem.
Before buying, identify the exact Medicaid program and state rules, determine whether a retirement-account exception or the general annuity test applies, have the proposed contract reviewed, and preserve proof for the application or recertification. An insurer’s statement that a contract is “Medicaid compliant” is not a nationwide approval.

What a Medicaid-compliant annuity is—and is not
In this context, an annuity is a contract funded with a lump sum or other assets in exchange for payments over a specified period. Long-term-care Medicaid planning sometimes uses that structure when an applicant or couple has assets above the applicable resource limit and needs to determine whether converting assets into an income stream can receive favorable treatment under the federal transfer rules.
“Medicaid compliant” is shorthand used in practice. It is not a federal product label, certification, or promise that an applicant will qualify. The legal question is whether a particular purchase and contract meet the relevant federal statutory branch and the state Medicaid agency’s implementation. Ownership, the annuitant, the applicant, a spouse or protected child, the funding source, the payment schedule, the term, the beneficiary designation and the timing of the transaction can all change the analysis.

The rules discussed here concern Medicaid coverage for nursing-facility and other long-term-care services. A contract that receives favorable transfer treatment can still produce income or resources that affect eligibility, premiums, patient-pay amounts or cost-of-care calculations.
How the federal annuity rules work
Federal law addresses annuities in connection with applications for long-term-care Medicaid. For an annuity that does not fall within a specified statutory exception, the purchase can avoid treatment as a transfer for less than fair market value only when the required contract and beneficiary conditions are met. The conditions are cumulative; satisfying one does not cure a defect in another.
Core contract conditions
| Condition | What it means to check |
|---|---|
| Irrevocable | The contract cannot be canceled or reversed at the owner’s option in a way that would return the purchase consideration. Read the actual contract language rather than relying on a sales illustration. |
| Nonassignable | The owner cannot transfer, sell or assign the annuity or its payment rights. A transfer feature, collateral assignment or other negotiability provision needs specific review. |
| Actuarially sound | The term and payment structure must be supportable under the applicable Social Security Administration actuarial publications. Keep the calculation and the assumptions used, not just the insurer’s projection. |
| Equal payments | Payments must be level throughout the term under the applicable rule. Check the amount, frequency and every scheduled change in the contract. |
| No deferral or balloon payment | The contract cannot postpone payments and then make a large final payment. A schedule that starts later, accelerates at the end or contains a balloon feature can fail the test. |
| Required remainder beneficiary | The state must occupy the remainder-beneficiary position required by federal law and state policy, subject to the statutory exceptions and any priority for a spouse or a protected child. |
“Equal” does not mean that every annuity available in the market has the same payment frequency. It means the selected contract must meet the applicable level-payment requirement. A monthly schedule, for example, still needs to be level under the contract and state review; an increasing schedule or a deferred start should not be assumed acceptable.

Statutory exceptions are separate branches
Federal law also contains exceptions for specified retirement annuities described in the Internal Revenue Code and for certain annuities purchased with specified retirement-account proceeds. Those exceptions are not interchangeable with the general checklist above. A contract may be evaluated under one branch or another depending on its legal form and the source of the funds.
Do not assume that moving money from a retirement account automatically qualifies the purchase. Establish exactly which exception is being claimed, gather the records that prove the account type and funding path, and ask the state agency how it applies that branch.
Disclosure is mandatory
An application or recertification must disclose the applicant’s or community spouse’s interest in an annuity or similar instrument, whether or not the contract is irrevocable and whether or not it is treated as an asset. The disclosure also explains that the state becomes a remainder beneficiary through the provision of medical assistance.
Texas policy language states: “You must disclose if you and/or your spouse have an interest in an annuity or similar instrument. If you are determined eligible for Medicaid, the state becomes the remainder beneficiary of the instrument.”

When an annuity may help
Converting an asset into a payment stream
An annuity may be useful when a person needs long-term-care Medicaid and has an asset that cannot be retained under the state’s resource rules. Instead of holding the entire amount as a liquid account, the person may purchase a contract that pays over time. If the transaction satisfies the applicable transfer test, the purchase itself may avoid a transfer penalty even though the payment stream remains relevant to the eligibility decision.
This is a planning possibility, not an automatic “spend-down” result. The state may count the payments as income, may include them in the amount applied to care costs, and may consider resources derived from the payments. The timing of the purchase and the application matters because a contract that looks acceptable in isolation can create a problem when combined with other transfers or an earlier uncompensated gift.
Coordinating a married couple’s finances
For a married applicant, the community spouse’s interest, the owner and annuitant designations, and the beneficiary order can affect the review. A protected spouse or child can have priority under the applicable rules before the state’s remainder interest. Because those facts are family-specific, a contract designed for one couple cannot be copied safely for another.
Using a documented retirement-account pathway
Where the purchase fits a statutory retirement-annuity exception, the documentation may be as important as the contract. Account statements, rollover records and evidence of the source of funds should show why the exception applies. If the required proof is missing, the state may treat the purchase as a transfer for less than fair market value.
Why compliance does not guarantee Medicaid eligibility
There are two separate questions:
- Was the purchase treated as a prohibited transfer? This turns on the relevant federal branch, contract terms, beneficiary designation, actuarial support and documentation.
- Does the applicant otherwise meet Medicaid’s financial and nonfinancial rules? This includes the treatment of annuity payments and resources, the applicant’s marital circumstances, the chosen long-term-care benefit pathway and state-specific procedures.
Federal law permits states to consider income or resources derived from an annuity when deciding eligibility. A state can therefore accept the purchase for transfer purposes and still count the resulting payments in eligibility or cost-of-care calculations. The contract also does not resolve medical, residency, functional-need or other requirements that apply to the benefit pathway.
There is no reliable national statistic showing how many people use these arrangements or how much they save. A sales claim about a typical result is not a substitute for the state’s written policy and a review of the applicant’s facts.
State implementation can change the result
States implement the federal framework through their own manuals, forms and review procedures. The following official materials illustrate the differences; they are examples, not a nationwide rulebook.

What to check before buying: an eight-step process
- Identify the benefit and state. Write down the state Medicaid program, the long-term-care service involved and whether the application is for an individual, a married couple or a community spouse. Rules for nursing-facility services and other long-term-care pathways may not be administered identically.
- Map the people and roles. Identify the owner, annuitant, applicant, community spouse and every potential remainder beneficiary. Note whether a spouse, minor child or disabled child could have a priority that affects the state’s position.
- Trace the funding source. Record the account or asset used, every transfer into the purchase account and the date of each movement. Decide whether the proposed purchase relies on a retirement-account exception or the general annuity criteria.
- Obtain the complete contract. Review the issued contract, not only a quote or illustration. Mark the provisions on cancellation, assignment, ownership, payment commencement, payment amount, frequency, increases, deferral, final payment and beneficiary designation.
- Test actuarial soundness. Have the term and payment schedule evaluated using the applicable Social Security Administration actuarial publications. Keep the calculation, life-expectancy assumption and date used. A verbal statement that the term is “within life expectancy” is not adequate documentation.
- Confirm the beneficiary position. Ask the state or a qualified elder-law professional to confirm the precise remainder-beneficiary language and any required priority for a spouse or protected child. Do not accept a form that merely says “state beneficiary” without checking the required order and percentage.
- Model the income effect. Determine when payments start, how often they arrive and how the state will count them for eligibility and cost of care. Include the payment in a household cash-flow plan; a contract that solves a resource issue can still leave the applicant unable to meet ordinary expenses.
- Submit and preserve disclosure. Report the interest on the application or recertification exactly as requested. Retain a copy of the disclosure, the contract, funding records, beneficiary form, actuarial work and all correspondence with the agency.
Contract-review checklist
Before signing, ask for written answers to these questions and attach the answers to the contract file.
- Is the contract irrevocable from the owner’s perspective, and are there any withdrawal, surrender or commutation rights?
- Is the annuity and every payment right nonassignable?
- Are payments level from the first payment through the last, with no deferral, step-up, acceleration or balloon payment?
- What is the exact payment start date, frequency and amount?
- What term was used for the actuarial calculation, which publication supports it, and who prepared the calculation?
- Who is the owner, annuitant and payee, and do those roles match the application?
- Does the beneficiary form put the state in the position required by the applicant’s state, while preserving any legally protected priority?
- Does the contract contain a rider, endorsement or state-specific provision that changes any of these terms?
- How will the state receive proof of the purchase and funding source?
- What fees, insurer guarantees and financial-strength information apply? Product-specific prices, ratings and returns are separate questions from Medicaid treatment and must be evaluated from current, independent financial information.
Documentation to keep
Federal implementation guidance places the burden on the individual or representative to produce documentation for specified annuity exceptions. Missing evidence can cause the state to treat the purchase as a transfer for less than fair market value. Keep a dated file containing:
- the full signed contract and every amendment or endorsement;
- the application and recertification pages disclosing the annuity;
- account statements and transfer records showing the source of funds;
- the actuarial calculation and the Social Security Administration publication used;
- the beneficiary designation and any state-required acknowledgment;
- payment statements showing the amount and timing of each installment;
- written communications with the insurer, Medicaid agency and professional advisers; and
- proof of delivery or receipt when the agency requires a form or contract submission.
Scan the file and keep the originals in a secure location. If ownership or beneficiary information changes, preserve both the old and new versions so the agency can follow the timeline.

How to compare two annuity proposals
If you are comparing actual contracts, use the same facts and the same state policy for both proposals. A higher payment is not automatically better if it changes the term, beneficiary treatment or cost-of-care result.
| Comparison axis | Questions to answer |
|---|---|
| Legal pathway | Does the proposal rely on the general federal criteria or a specified retirement-account exception, and is the evidence for that branch complete? |
| Irrevocability and transferability | Are cancellation, assignment, collateralization and surrender rights excluded in the actual contract? |
| Payment design | Are amount, frequency and start date level and immediate enough to avoid a deferral or balloon feature? |
| Actuarial term | Which term and life-expectancy assumptions support actuarial soundness, and are they documented? |
| Beneficiary order | Does the state occupy the required remainder position, and have spouse or protected-child priorities been handled? |
| Income and care cost | How will each payment be counted by the state, and what amount may be applied to the cost of care? |
| Financial and contract quality | What fees, guarantees, exclusions and insurer-strength information apply? These should be evaluated separately from Medicaid eligibility. |
The first six rows address Medicaid treatment. Fees, guarantees and insurer strength require current financial documentation; do not infer them from an agent’s Medicaid presentation.

Relying on the phrase “Medicaid compliant”
Problem: The phrase describes a sales position, not a determination by the applicant’s state.
Response: Request the specific federal branch, contract clauses, beneficiary language and state authority the seller is relying on. Have the issued contract reviewed before funding it.
Using a deferred or balloon schedule
Problem: Payments start later, increase, or end with a large final amount, conflicting with the equal-payment and no-deferral conditions.

A purchase that may fit the general test
An applicant proposes an irrevocable, nonassignable contract with level payments, no deferral or balloon payment, a documented actuarial calculation and the state in the required remainder position. The applicant discloses the contract and supplies the funding records. This fact pattern addresses the principal transfer-test elements, but the state must still decide how the payments affect eligibility and care costs.
A contract with a payment defect
An otherwise similar proposal postpones payments for several years and then makes a large final installment. The applicant cannot treat the contract as compliant merely because the total payments equal the purchase price. The schedule must be redesigned or rejected after state-specific review.
A retirement-account proposal with missing records
A family says the purchase was funded with retirement-account proceeds but has no statements showing the source or transfer path. The family may be unable to establish the claimed statutory exception. Assemble the records before relying on that exception; otherwise the state may apply transfer-for-less-than-fair-market-value treatment.
Who should review the transaction
An elder-law or Medicaid-planning professional can review the applicant’s marital status, ownership, beneficiary order, timing, state policy and interaction with other transfers. That review is an option for individualized analysis, not a guarantee of approval and not a substitute for the state agency’s determination.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsThe insurer or agent can explain contract mechanics, but the agent’s description of a product as compliant does not bind Medicaid. Ask the state agency what it wants submitted and whether it will issue a written response or identify the applicable manual provision. Keep the professional and agency responses with the contract file.
Decision checklist
- You know which state and long-term-care Medicaid pathway applies.
- You have identified the owner, annuitant, applicant, spouse and potential protected beneficiaries.
- You know whether the transaction uses a retirement-account exception or the general annuity criteria.
- The issued contract is irrevocable and nonassignable, has level payments, avoids deferral and balloon provisions, and has documented actuarial support.
- The remainder-beneficiary designation matches the state’s required position.
- You have modeled the payments as income and considered their effect on cost of care.
- You can produce the contract, funding records, actuarial calculation and beneficiary proof.
- You have disclosed the annuity on the application or recertification.
- The current state policy and an individualized professional review support proceeding before funds are committed.
If any item is unresolved, pause the purchase. A compliant result depends on the complete transaction and the state’s implementation, not on the product name or an agent’s assurance.
