Steve McBee Sr.—also identified in court materials as Steven A. McBee—pleaded guilty on November 5, 2024, to one federal count involving crop-insurance fraud. He admitted submitting false production, double-cropping, and planting-date information between 2018 and 2020 to obtain federally backed crop-insurance benefits for which his farming operation was not eligible. The Department of Justice said the admitted conduct caused about $4.02 million in loss.
McBee was later sentenced on October 16, 2025, to 24 months in federal prison, followed by two years of supervised release, and was ordered to pay $4,022,124 in restitution. He self-surrendered to Federal Prison Camp Yankton in South Dakota on December 1, 2025, according to later reporting. His son said in July 2026 that McBee had entered a program that could shorten his time in custody, but that early-release account was not independently confirmed by a Bureau of Prisons release notice.

The defendant is the father, commonly referred to by the family and network as Steve McBee Sr. His son, Steven McBee Jr., is a separate person. That distinction matters because the criminal guilty plea described in the DOJ announcement belongs to Steve McBee Sr.; it does not establish that his sons participated in the crop-insurance fraud.

What did McBee admit doing?
The government’s case concerned information submitted to crop insurers. According to the DOJ, Rain and Hail was the insurer involved in the 2018 conduct and was reinsured by the Federal Crop Insurance Corporation. The 2020 conduct involved NAU Country Insurance.
2018: allegedly underreporting crop production
McBee admitted submitting records that understated the amount of corn and soybeans his operation produced. The DOJ said his operation sold more than 1.2 million bushels of corn and nearly 416,000 bushels of soybeans in 2018, while its crop-insurance records reported only:
- 340,476 bushels of corn; and
- 190,171 bushels of soybeans.
The DOJ said the submitted information underreported production by approximately 674,812 bushels of corn and 155,833 bushels of soybeans. In plain English, the allegation was that the operation’s insurance records made its harvest appear substantially smaller than the crop it had actually sold. Lower reported production can affect whether an insured producer qualifies for a payment.

- $2,605,943 in federal crop-insurance benefits; and
- $552,980 in federal crop-insurance premium subsidies.
Those amounts total $3,158,923, which the DOJ said McBee was not entitled to receive.
2019: representing a second crop as the first crop
McBee also admitted providing false information for 2019 soybean insurance. The government said he represented that soybeans were the first crop planted in certain fields, even though wheat had already been harvested from those fields.
This is a double-cropping issue. Double cropping—planting a second crop on the same acreage after harvesting the first—is not automatically illegal. The alleged problem was the insurance representation: the DOJ said the applicable policy covered only the first crop planted on a tract during the crop year, yet the operation sought coverage for soybeans planted after wheat.
The DOJ’s public announcement did not provide a separate dollar figure for the 2019 conduct.
2020: allegedly falsifying late planting dates
McBee admitted that his operation planted corn after the final eligible planting date in 2020. A crop planted after the relevant deadline was not eligible for the claimed insurance coverage, according to the DOJ. The operation then allegedly submitted false planting dates to make the corn appear to have been planted on time.

The public DOJ release also did not break out a separate dollar amount for the 2020 conduct. It described the 2019 and 2020 conduct as part of the conduct McBee admitted in connection with the plea and sentencing process, even though the public announcement described the criminal case as involving one count.
One guilty count—not three separate fraud charges
The DOJ described the charging information as one count of federal crop-insurance fraud. McBee waived a grand jury and pleaded guilty on November 5, 2024. The public announcement does not clearly display the statutory citation, so it is more accurate to use the DOJ’s description than to guess at a specific statute.
The case can involve several years and several types of false information without meaning that McBee pleaded guilty to three separate counts. The 2018, 2019, and 2020 conduct describes the factual scope of the case and the conduct considered in the plea and sentencing process. It does not support calling him convicted of three separate fraud schemes or three separate charges.

Why the money figures do not all match
Coverage of the case has used several different figures. They refer to different things and should not be combined casually.
| Amount | What it represents |
|---|---|
| $3,158,923 | The 2018 crop-insurance benefits and premium subsidies that the DOJ said McBee improperly received: $2,605,943 in benefits plus $552,980 in premium subsidies. |
| $4,022,123 | The total loss claimed by the government in the DOJ’s November 2024 plea announcement. |
| $4,022,124 | The restitution amount reported as ordered when McBee was sentenced in October 2025. |
| $3,158,923 | The amount the DOJ’s plea announcement said McBee agreed to forfeit. |
| Approximately $7.2 million | A media shorthand that appears to reflect the restitution amount plus a separate forfeiture or money-judgment obligation. It should not be described simply as a $7.2 million fine. |
The one-dollar difference between the government’s announced loss of $4,022,123 and the later reported restitution order of $4,022,124 should be acknowledged rather than silently treated as an error. For a broad summary, “about $4.02 million” avoids overstating precision. The DOJ announcement and later sentencing coverage provide the respective figures.
Restitution, forfeiture, and a money judgment are different
Restitution is a court-ordered payment intended to compensate for a loss caused by the offense. The sentencing figure reported for McBee was $4,022,124.
Forfeiture is a separate remedy through which the government seeks property or value connected to unlawful conduct or otherwise subject to forfeiture. The plea announcement said McBee agreed to forfeit $3,158,923.

A money judgment is a financial obligation entered against a defendant. It can allow the government to pursue assets to satisfy the obligation. A forfeiture order and a money judgment can affect the same overall collection effort, but they are not interchangeable terms.

That is why “McBee was fined $7 million” is misleading. Some media reports have used an approximately $7.2 million figure for the combined exposure, but the public reporting does not make the accounting relationship clear enough to call that one uncomplicated bill or fine. The specific terms of the final judgment and any later collection activity control.
What sentence did Steve McBee receive?
On October 16, 2025, McBee was sentenced to:
- 24 months in federal prison;
- two years of supervised release; and
- $4,022,124 in restitution.
Reports said federal prosecutors recommended 41 months, but Judge Stephen R. Bough imposed 24 months. A prosecutor’s recommendation is not the sentence; the 24-month term is the punishment the court imposed.
The original DOJ announcement said the charge carried a potential maximum of up to 30 years in federal prison without parole. That was the statutory maximum before sentencing, not an indication that McBee received a 30-year sentence or that he was expected to serve that amount of time.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsWhat happened to McBee’s watches and other assets?
Before sentencing, McBee was ordered to surrender three watches as substitute assets toward the government’s money judgment, according to reports that reviewed court filings:
- Tag Heuer Formula 1;
- Tag Heuer Grand Carrera; and
- Rolex Daytona.
The reported order characterized the watches as assets that were not directly obtained from the fraud but could nevertheless be used toward the financial judgment. Later coverage said prosecutors received permission to seize and potentially sell them. The watches were only one part of the reported asset-collection effort and do not, by themselves, resolve the larger restitution or forfeiture obligations.
Because the details were reported through court documents obtained and reviewed by media outlets rather than a readily accessible official court page, the watch information should be understood as a report of the filings and court order. The reported watch order and later asset coverage provide the available details.
The separate civil lawsuit over alleged asset transfers
The criminal case is not the only legal matter involving McBee. In December 2025, the federal government filed a separate civil lawsuit alleging that he transferred ownership interests in family businesses to trusts associated with his sons Jesse and Cole McBee in order to frustrate collection of the government’s financial claims.
The government alleges that the transfers occurred on January 7, 2024. The complaint’s timeline, as reported by DTN Progressive Farmer, says McBee had been notified of the crop-insurance investigation in June 2023 and that his attorney met with prosecutors in December 2023.

The interests allegedly transferred were:
- a 39% interest in McBee Properties L.C.;
- a 99% interest in Rock Bluff Development LLC; and
- a 99% interest in S&K Enterprises LLC.
The government alleges that the interests were divided between trusts associated with Jesse and Cole and that McBee received no equivalent value. In the government’s view, the transfers were intended to put assets beyond the reach of collection efforts.
McBee and his sons disputed that characterization. They argued that the trusts had been created in December 2012 as part of longstanding estate planning and that the government’s complaint did not adequately establish insolvency, concealment, or fraudulent intent.
A federal judge denied their motion to dismiss in March 2026, allowing the civil case to continue. That ruling was procedural: it meant the government’s allegations were sufficient to proceed beyond the pleading stage. It was not a final finding that the transfers were fraudulent, and it was not a criminal conviction of either son.
The civil asset case should therefore be kept separate from the crop-insurance case. McBee admitted the criminal conduct described above. The claims that he moved assets to impede collection remain allegations to be resolved in the civil proceeding.
What did McBee and his family say?
After the guilty plea, McBee’s sons read a statement attributed to him. The statement said he accepted responsibility and described the matter as a failure of judgment and action. It also said the family businesses were committed to operating properly going forward.
That statement is a public family response, not a replacement for the plea documents or the government’s factual account. It is also important not to treat the family’s statements about business operations as an independently audited assessment of the companies’ ownership, finances, or ability to repay.

The investigation and its financial consequences became part of the family’s public and television storyline. Peacock’s materials for Season 2 described an FBI investigation and pressure on the farm. Season 3 focused on the family managing the business while Steve Sr. was imprisoned, according to Bravo and Peacock promotional material. Season 3 premiered on Bravo on June 15, 2026, with next-day streaming on Peacock.
Bravo and other entertainment coverage described Steven McBee Jr. as taking a leading role in running the family business during his father’s incarceration. That is a family or network characterization, not an independently audited statement about the company’s ownership or financial condition.

Where is Steve McBee now?
According to the latest public reporting available before August 9, 2026, McBee was serving his sentence at Federal Prison Camp Yankton. On July 17, his son Steven McBee Jr. said that McBee had entered a program that could reduce his time in custody. The son said McBee might be released in fewer than two months and then spend four to six months in home confinement.
That is a family statement and an estimate, not an independently confirmed release date. Prison status can change, and home confinement is not the same thing as an unconditional release. Readers seeking the latest official custody information should use the Bureau of Prisons inmate locator immediately before publication or rely on a later court filing or official BOP record.

Three conclusions should not be blurred together:
- Criminal case: Steve McBee Sr. pleaded guilty to one federal crop-insurance fraud count after admitting false reporting involving the 2018, 2019, and 2020 crop years.
- Sentence and financial consequences: He was sentenced to 24 months in prison, two years of supervised release, and $4,022,124 in restitution, with separate forfeiture or money-judgment issues also reported.
- Civil asset case: The government’s allegations that McBee transferred business interests to trusts associated with his sons remain unresolved. The sons’ involvement in those alleged transfers is not the same as a criminal finding that they participated in the crop-insurance fraud.
Frequently Asked Questions
Did Steve McBee plead guilty to three fraud charges?
No. The DOJ described the criminal case as one federal count involving crop-insurance fraud. McBee also admitted conduct involving the 2019 and 2020 crop years, but the public record summarized by the DOJ does not support calling those three separate criminal counts.
How much money does Steve McBee owe?
The court-ordered restitution reported at sentencing was $4,022,124. The DOJ’s earlier announcement cited a $4,022,123 government loss and said McBee agreed to forfeit $3,158,923. Those are different legal and accounting figures, so it is inaccurate to describe the case simply as a $7.2 million fine.
Were Steve McBee’s sons charged with the crop-insurance fraud?
The supplied public record does not establish criminal charges against his sons for the crop-insurance fraud. A separate civil lawsuit alleges that McBee transferred business interests to trusts associated with Jesse and Cole McBee to frustrate collection; that case remained unresolved after a motion to dismiss was denied.
Is double cropping itself illegal?
No. Double cropping means planting a second crop after harvesting a first crop. The alleged problem in McBee’s case was representing that soybeans planted after wheat were the first crop for purposes of an insurance policy that, according to the DOJ, covered only the first crop planted on the tract.
Has Steve McBee been released from prison?
Public reporting before August 9, 2026, said he was at Federal Prison Camp Yankton. His son said in July 2026 that McBee had entered a program that could lead to early release, but no independently confirmed exact release date was available in the supplied Bureau of Prisons results.
The Bottom Line
Steve McBee Sr. did plead guilty—but to one federal crop-insurance fraud count, not three. His admitted conduct involved false production records, a 2019 crop-coverage representation, and 2020 planting dates. The court later imposed 24 months in prison and $4,022,124 in restitution. Separate forfeiture and collection efforts, including the watch seizures and the civil lawsuit over alleged business-interest transfers, should be described independently rather than folded into a single “$7 million fine.”
