Life Insurance Beneficiaries: Who to Name and How to Update Them

Name the people or organizations the policy is meant to support, designate both primary and contingent beneficiaries, and state each share unambiguously. Use full legal names, not labels such as “my husband,” and review the form at least annually and after major family or financial changes. If you own the policy, the insurer will generally require a formal written change request.

What a life insurance beneficiary does

A beneficiary is the person or organization designated to receive a life insurance death benefit after the insured person dies. The designation is part of the insurance contract, so the insurer normally follows the policy form on file rather than a later verbal instruction or a statement in a will.

As an Amazon Associate I earn from qualifying purchases.

A primary beneficiary is first in line for payment if that beneficiary survives the insured. A contingent beneficiary (also called a secondary beneficiary) receives the benefit if the primary beneficiary dies before the insured. Naming both levels prevents the policy from being left without a clear recipient if the first choice dies.

Possible beneficiaries include a spouse or domestic partner, children, grandchildren, other relatives, friends, charities, businesses, a trust, or the policyholder’s estate. The right choice depends on who the money is intended to support and whether that recipient can legally and practically receive and manage the proceeds.

Who should you name?

Individuals you want to support

Use each person’s full legal name as it appears on reliable identification. Add a relationship or date of birth when the insurer’s form requests it. A relationship label by itself can create uncertainty. For example, “my husband” could mean the spouse at the time the policy was bought or a later spouse. A precise name is easier for the insurer to match and less likely to produce a dispute.

If you name several people in the same class, state how the proceeds are divided. You can assign percentages that total 100% or instruct the insurer to divide the benefit in equal shares. Do not leave the form to infer whether “my children” means equal shares, a particular group of children, or a different arrangement.

Organizations, a business, or your estate

A charity, business, trust, or your estate can be named if that is the intended recipient. Obtain the exact legal name and identifying information the insurer requests. Naming the estate generally means the proceeds are paid to the estate rather than directly to an individual, which can change the administration process and may expose the money to probate.

Primary and contingent choices

Think of the two levels as a distribution plan:

Designation When it receives the benefit Typical use
Primary beneficiary Survives the insured and is first in line The person or organization intended to receive the money
Contingent beneficiary Receives the benefit if the primary beneficiary dies before the insured Backup recipient, often children or a trust

You can list more than one person at either level. Record each person’s percentage or select equal shares if that matches your intent. Keep the primary and contingent groups distinct; a person listed only as contingent does not normally receive proceeds while a surviving primary beneficiary remains entitled.

How to handle children and descendants

Minor children

Insurers generally do not pay life insurance proceeds directly to minors. If a child is under the age at which the insurer and local law permit direct payment, the money may need to be held and managed by a court-appointed guardian or another legal structure. That process can delay access and may not reflect how you want the funds used.

A trust can hold the benefit for a child and set rules for investment, education, housing, health care, and the age or conditions for distributions. A trust must be drafted and funded correctly; a generic beneficiary form is not a substitute for a properly created trust. Work with a family-law or estate-planning attorney and, where appropriate, a tax adviser to coordinate the trust language with the policy form. Confirm the insurer’s requirements before naming the trust, including the exact trust name, date, trustee information, and any documentation it requires.

Some families also arrange for trusted adults to make joint decisions about children’s care and welfare. That arrangement does not by itself determine who receives insurance proceeds or who has legal custody. Verify guardianship, custody, and payment rules under the law that applies to your family.

“My children” and other class designations

A class designation such as “my children” can be useful, but it leaves an important question: what happens if one child dies before you? The form may offer per stirpes or per capita language, and the result is different.

Wording Result if a named child dies before the insured Illustration
Children per stirpes The deceased child’s descendants generally receive that child’s share If two children would each receive 50% and one dies first, that child’s descendants divide the 50% share
Children per capita Surviving children generally divide the benefit; the deceased child’s family receives none under the example described by the NAIC If one of two children dies first, the surviving child receives the full benefit

Terms can be defined differently by a policy or state law, and beneficiary-option wording can be vague. Read the insurer’s actual form and ask the insurer or an estate-planning professional to explain the concrete distribution before submitting it. Do not assume that a familiar phrase will have the result you expect.

How to update a beneficiary designation

If you own the policy, the National Association of Insurance Commissioners (NAIC) says that in most cases you can change beneficiaries at any time by giving the insurer a formal written notification. The insurer’s current process controls, so obtain its form and submission instructions rather than relying on an old form found elsewhere.

  1. Locate the policy. Find the policy or certificate, insurer name, policy number, and the owner’s contact information.
  2. Read the existing designation. Identify every primary and contingent beneficiary, each percentage or share, and any wording such as “per stirpes,” “per capita,” “trust,” or “estate.”
  3. Request the current change procedure. Contact the insurer or plan administrator and ask for the beneficiary-change form, acceptable signatures, identity requirements, delivery method, and any supporting trust documents.
  4. Write the intended distribution precisely. Use full legal names, provide requested identifying details, list primary and contingent beneficiaries separately, and make the percentages total 100% in each applicable group. If equal shares are intended, select or state that option exactly as the form allows.
  5. Get help with complex language. Ask for an explanation before choosing a trust, estate, class designation, per stirpes or per capita treatment, or any other option whose effect is unclear. A lawyer or tax adviser can help align the form with your estate plan.
  6. Submit the form through the insurer’s approved channel. Keep a complete copy, the date sent, delivery evidence, and any trust or identity documents submitted with it.
  7. Verify acceptance. Obtain written confirmation or check the insurer’s online records to make sure the new designation was recorded. Save the confirmation with the policy documents and replace older copies so family members do not rely on an outdated form.

A request is not necessarily effective merely because it was mailed or uploaded. The contract and insurer’s procedures determine when a change takes effect, so ask how the carrier treats a change received shortly before the insured’s death or while a claim is pending.

When a beneficiary is irrevocable

An irrevocable beneficiary has a protected interest in the policy. The NAIC glossary explains that the owner generally must obtain that beneficiary’s consent to change the designation. An irrevocable beneficiary may also have rights affecting other policy actions, depending on the contract and applicable law.

Check the policy before assuming you can make a unilateral change. Ask the insurer which consent, signatures, notices, or forms are required. If the designation was made in a divorce agreement, trust, settlement, or other legal document, obtain legal advice before attempting to alter it.

How often to review the form

Review beneficiary information at least once a year and whenever a major life event occurs. The NAIC identifies these events as reasons to check the designation:

  • Marriage or remarriage
  • Divorce
  • Birth or adoption of a child
  • Death of a beneficiary or another close family member
  • Changes in the people who depend on you
  • A new job, mortgage, or other change in financial needs

A coverage review and a beneficiary review are separate tasks. A new mortgage or dependent may justify increasing or decreasing the policy amount, but changing the amount does not automatically change who receives it. During each review, confirm names, percentages, contact details, primary and contingent status, and any trust or class wording.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Does a will override a life insurance beneficiary?

Usually, no. The NAIC says a will does not control life insurance proceeds unless the policy names the estate as beneficiary. If an individual is properly designated, the insurer generally pays that person directly under the policy contract. A will can still matter for other assets and for instructions that affect a trust or estate, but it is not a substitute for updating the insurer’s beneficiary form.

If the estate is named, the proceeds typically become part of the estate administration and may pass through probate. The NAIC also notes that proceeds payable to an estate may be subject to estate taxes. Tax treatment depends on the policy owner, insured, estate size, payout method, and other facts; consult a qualified tax professional for an individual determination.

Beneficiaries may be offered different settlement choices, such as a single check or a retained-asset account. The tax and practical consequences can differ, so read the insurer’s payment options and obtain tax advice before selecting one.

What if the beneficiary dies first?

If a primary beneficiary dies before the insured, the contingent beneficiary generally becomes the recipient. If no contingent beneficiary is listed, the policy may pay the estate or follow a default in the contract, which can create delay and probate. If one member of a multiple-beneficiary group dies, the result depends on the form’s wording and any per stirpes or per capita election.

Update the designation after a beneficiary’s death rather than assuming the remaining names produce the intended result. If descendants should inherit a deceased beneficiary’s share, state that outcome using the insurer’s available wording and confirm it in writing.

Keeping beneficiaries able to claim the money

Tell beneficiaries that they are named, or make sure a trusted adviser such as an accountant or attorney knows the policy exists. You do not have to disclose the benefit amount if you prefer privacy, but someone should know where to find the records.

Keep the following information with current estate records:

  • Insurer name and claims telephone number
  • Policy or certificate number
  • Insured’s and owner’s names
  • Approximate benefit amount and policy type
  • Location of the policy, beneficiary forms, and recent confirmations
  • Contact information for an adviser who can help with a claim

NAIC consumer guidance says tens of millions of dollars in life insurance death benefits go unclaimed each year. If someone believes they are a beneficiary but cannot identify the insurer, the NAIC’s Life Insurance Policy Locator can search participating life insurance and annuity companies. A locator search does not replace keeping your own records or notifying the insurer after a death.

Common mistakes and how to prevent them

Using relationship labels instead of names

“Spouse,” “partner,” or “my children” can be ambiguous after remarriage, adoption, or a change in family circumstances. Use legal names and the additional identifying information the form requests.

Leaving out contingent beneficiaries

A primary beneficiary can die first, become legally unable to receive the money, or otherwise be unavailable when the claim is filed. A contingent designation provides a documented backup.

Percentages that do not add up

Review arithmetic before submitting. If three people are intended to share equally, select the insurer’s equal-share option or assign one-third to each rather than relying on an informal note.

Assuming a will or divorce automatically updates the form

The insurer generally follows the beneficiary designation in its records. A will, divorce, or family agreement may have legal consequences, but it does not reliably replace the insurer’s formal change process. Obtain legal advice when a court order or marital agreement is involved.

Naming a minor without a payment plan

Because insurers generally do not pay minors directly, coordinate the designation with a properly drafted trust or another legally valid arrangement. Confirm the insurer’s documentation requirements and the rules in your jurisdiction.

Choosing per stirpes or per capita by intuition

The two options can send the same policy to different people. Use the insurer’s example, write out the result for each possible family scenario, and seek professional advice if the form is unclear.

Failing to verify the update

Keep the submitted form and obtain confirmation that the insurer recorded it. Replace obsolete copies in your estate file so the wrong designation is not submitted during a claim.

A practical decision checklist

  • Who is the benefit intended to support?
  • Should one person or organization be primary, with another as contingent?
  • If there are multiple recipients, are the percentages or equal shares explicit?
  • If a beneficiary dies first, should that person’s descendants inherit the share?
  • Would a minor need a trust or another managed arrangement?
  • Is the designation revocable, or does an irrevocable beneficiary’s consent apply?
  • Could naming the estate create probate or tax consequences that require advice?
  • Does the insurer have the current legal names and contact details?
  • Will a trusted person be able to locate the policy after your death?

State law, policy language, employer-plan rules, divorce orders, and tax circumstances can change the result. For a straightforward designation, follow the insurer’s current form exactly. For a minor child, trust, estate, irrevocable beneficiary, class designation, or competing legal document, have the actual policy and proposed wording reviewed by the insurer and an appropriately qualified attorney or tax adviser.
