For a criminal charge that could result in incarceration, tell the judge at your first appearance that you cannot afford counsel and ask for appointed counsel or a public defender. For most civil disputes, there is no general constitutional right to a free lawyer, so start with civil legal-aid programs, court self-help services, a bar-association referral, limited-scope representation, clinics, payment arrangements, or mediation.
These options do not all provide the same help. Some give information or forms, some handle one defined task, and only some provide full representation. Confirm local eligibility, fees, conflicts, subject-matter coverage, and deadlines before relying on any service.

First, identify the kind of legal help you need
Write down four facts before contacting anyone:
- Whether the case is criminal or civil.
- The state, county, and court involved.
- The next deadline, hearing, or filing date.
- The opposing party and the result you need.
Also note facts that can trigger specialized assistance, such as low income, limited assets, age, disability, veteran status, housing instability, domestic-violence concerns, or an issue involving public benefits, employment, immigration, family law, debt, or consumer protection. Programs set their own rules, and availability differs by location.
Criminal charges and possible jail time
The American Bar Association explains: “The Constitution guarantees free legal help for people who are charged with a crime which might lead to imprisonment and who cannot afford a lawyer.” Tell the judge at the first appearance that you need counsel and cannot afford one. Ask how to apply for appointed counsel or the public defender in that court.

Civil cases
Civil legal aid is free legal assistance for low- and middle-income people with civil legal problems, but it is generally eligibility-based rather than a universal entitlement. A program may screen income, assets, household circumstances, legal issue, conflict of interest, and available capacity. A rejection from one office does not establish that no help exists elsewhere.
How the main alternatives differ
The following comparison shows what each route can realistically provide. Local rules and capacity control the result.

| Civil legal-aid or pro bono program | Qualifying civil matters | Advice, negotiation, document preparation, referral, or full representation | Income, assets, issue, location, and program capacity are screened | Many eligible applicants cannot be accepted when the office lacks capacity |
| Public defender or appointed counsel | Criminal charges that may lead to incarceration | Defense representation under the court’s appointment process | Financial eligibility and case type are determined by the court | Not a general solution for ordinary civil disputes |
| Court self-help center | People handling their own case | Procedure explanations, forms, workshops, and filing guidance | Often free to court users | Staff generally cannot give individualized legal advice or appear for you |
| Bar-association referral service | People seeking a lawyer for a particular issue | A referral, screening, and sometimes a short or reduced-fee consultation | Local referral rules and consultation prices apply | A referral is not a guarantee that the lawyer will accept the case or offer a reduced fee |
| Limited-scope representation | Cases where you can do some tasks yourself | Advice, drafting, negotiation, a hearing, or another defined task | Often less than full representation; fee must be agreed with the lawyer | You remain responsible for every task outside the written scope |
| Clinic, hotline, or advice desk | Urgent questions or people turned away by full-service programs | Brief advice, issue spotting, forms help, or referrals | Usually free; hours and subject coverage vary | Brief assistance may not include ongoing representation |
| Sliding-scale fee, payment plan, or paid consultation | People who can pay something but not a full retainer | Lower hourly rate, installments, or a one-time strategy session | Set by the individual lawyer; obtain the terms in writing | A payment arrangement does not necessarily cover all work or court appearances |
| Mediation or another dispute-resolution program | Disputes where the parties can negotiate safely | A neutral process to seek agreement without a full trial | Court programs may be free; private providers set fees | May be unsuitable where there is coercion, danger, or a major power imbalance |
Find civil legal aid and pro bono help
Start with national directories and local programs
USAGov directs people to Legal Services Corporation programs, LawHelp.org, law-school pro bono programs, Law Help Interactive, ABA Free Legal Answers, and specialized services for veterans, older adults, and people with disabilities. Use those resources to identify offices serving the county where the case is filed, then read each program’s issue and eligibility rules.
Legal Services Corporation-funded offices commonly focus on civil problems, but no directory can promise an appointment or representation. A program may serve only certain counties, accept only particular case types, impose an income or asset screen, or close intake when its staff is full.
Prepare for the intake call
Have the following information ready:
- Your full name, safe contact method, and preferred language or accessibility accommodation.
- The court name, case number, filing date, and next deadline.
- A short timeline with the key events and what the opposing party has done.
- Names of all parties, witnesses, employers, landlords, agencies, or creditors involved.
- Copies of notices, pleadings, contracts, leases, orders, bills, or correspondence.
- Household income, benefits, assets, and major expenses if the program asks for eligibility information.
Do not send original documents unless instructed. Ask how to transmit sensitive records and whether the office can communicate safely.

Use specialized channels when they fit
Veterans, older adults, and people with disabilities may qualify for services designed around their circumstances. Law-school clinics and pro bono projects can take selected matters, but they often operate on academic calendars and have narrow subject-matter limits. ABA Free Legal Answers and similar online services may provide brief answers rather than a continuing attorney-client relationship. Read the service’s terms so you know whether anyone is representing you in court.
Use court self-help centers without confusing information with representation
California Courts describes a model found in many court systems: superior-court self-help programs can explain procedures and assist with forms, but staff cannot give individualized legal advice or appear in court. Other courts use names such as self-help center, family-law facilitator, legal information center, or resource desk.
Ask the clerk or check the court’s official information page for:
- Which cases the center handles.
- Whether appointments, workshops, telephone help, chat, or walk-in hours are available.
- Which forms and filing fees apply.
- Whether fee waivers, remote appearances, or interpreter services are available.
- Whether the court offers mediation or an advice desk.
Bring the case number and every court notice. Staff can often show where information belongs on an official form, but you remain responsible for the truth of your statements, filing deadlines, service requirements, and decisions about legal strategy.
Ask a bar association for a lawyer referral
Many state and local bar associations operate public-service referral services. The service may match you with a lawyer who handles your subject and location, screen for conflicts, and offer a short initial consultation. Some panels include reduced-fee lawyers, but pricing, screening, and geographic coverage are local questions.
Recommended Free Tools
Questions to ask the referral service
- Does the service cover my county, court, and legal issue?
- Is there a referral or consultation fee?
- How long is the initial consultation, and what does it include?
- Does the lawyer offer a reduced-fee panel, payment plan, or limited-scope work?
- How are conflicts checked before my information is shared?
- What should I do if no referred lawyer can take the matter?
One Illinois Legal Aid Online example describes a $25, 30-minute referral consultation. That is a local example, not a national price or a promise that another bar service charges the same amount. Confirm the current amount and terms before scheduling.

Make the consultation useful
Send a one-page timeline and a focused list of questions. Ask the lawyer to identify the most urgent deadline, the documents you must file, the likely next procedural step, and which work you could safely do yourself. Clarify whether the consultation creates representation; a brief meeting may not make the lawyer your attorney for filing or negotiation.
Reduce the bill with limited-scope representation
Limited-scope, or unbundled, representation lets a lawyer handle defined parts of a case while you handle the rest. California Courts describes lawyers helping with key parts of a case and allowing the client to do the remainder. Illinois Legal Aid Online notes that this arrangement is commonly offered at a reduced fee.
Tasks that may be separated
- One strategy or case-evaluation meeting.
- Reviewing a complaint, answer, lease, settlement, or proposed agreement.
- Drafting or editing a motion, demand letter, discovery response, or settlement document.
- Preparing you for negotiation, mediation, deposition, or testimony.
- Negotiating with the other side while you file documents yourself.
- Appearing at one hearing while you manage other hearings and filings.
Put the boundaries in writing
The written agreement should state the exact task, what is excluded, who files and serves documents, who communicates with the court and opposing party, who tracks deadlines, whether the lawyer may appear at a hearing, the fee or flat price, billing increments, expenses, and how either side can end the arrangement.
Ask what happens if the case becomes more complicated. A lawyer who agrees to review one filing may not be responsible for later amendments, emergency motions, discovery, appeals, or missed deadlines unless the agreement is expanded.
Try clinics, hotlines, and advice desks when full representation is unavailable
Illinois guidance identifies telephone hotlines, walk-in clinics, court advice desks, and online self-help information as alternatives when a legal-aid office cannot accept a case. The U.S. Department of Justice also describes workshops, telephone help lines, medical-legal partnerships, online information and chat tools, and downloadable forms as civil legal-aid channels.
These services can be especially useful for issue spotting: they may tell you which agency, court, or form applies, help you prepare for a hearing, or refer you to another provider. Ask at the start whether the service offers only brief advice, whether a lawyer will review documents, and whether anyone will appear for you.

Consider fees that match what you can pay
Sliding-scale rates
Some lawyers adjust an hourly rate based on income or household circumstances. The lawyer decides whether to offer this arrangement, so ask directly and be prepared to provide the information used to set the rate.
Payment plans
An installment plan can spread a retainer or invoice over time. Confirm the amount due before work begins, the payment dates, interest or late charges, what happens if a payment is missed, and whether the lawyer can stop work. A payment plan changes timing, not necessarily the total cost.
Paid consultations
A paid consultation can be worthwhile if you use it to build a self-representation plan. Before booking, confirm the consultation length, fee, cancellation policy, documents the lawyer will review, and whether the lawyer will provide written advice. Ask whether additional work requires a separate agreement.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Use mediation only when the process is safe and suitable
Court programs may offer free mediation, and courts often encourage parties to consider mediation or arbitration. A neutral mediator helps the parties negotiate; the mediator does not act as either person’s lawyer and ordinarily does not decide who is legally right.
Mediation is not appropriate for every dispute. Safety concerns, intimidation, coercive control, a major power imbalance, or an inability to negotiate meaningfully may make a joint session unsafe or unfair. Tell the court or mediator about those concerns and ask about screening, separate rooms, remote participation, an advocate, or an exemption. Obtain independent legal advice before signing an agreement with significant financial, housing, custody, immigration, or other long-term consequences.
If legal aid turns you down
Ask the office why it cannot take the case. Common reasons include income or asset limits, the issue being outside its subject area, a conflict, the case being in another county, a deadline that leaves too little time, or a full caseload. The reason determines the next route.

- Contact the court self-help center for official forms, procedure information, and mediation screening.
- Ask private lawyers about a limited task, flat fee, sliding scale, payment plan, or one-time consultation.
- Check whether a specialized program serves your age, disability, veteran status, housing problem, or other issue.
- If you will represent yourself, confirm filing, service, evidence, and hearing rules with the court and keep a written deadline calendar.
Do not wait for a rejection letter if a hearing or response deadline is close. Tell every provider the exact date and ask what must be done immediately to preserve your position.
Protect yourself from avoidable mistakes
- Do not assume a referral equals representation. The lawyer must agree to take the case and define the engagement.
- Do not miss a deadline while searching. Filing a required response or requesting an extension may be urgent even when you are still seeking counsel.
- Do not give confidential details to an opposing party’s lawyer. Ask who receives your information and how conflicts are handled.
- Do not sign a limited-scope agreement you do not understand. Make the responsibility split and end date explicit.
- Do not rely on forms from another state or an old case. Use the current forms and instructions issued by the court handling your matter.
- Do not use mediation to conceal danger. Tell the provider about threats, coercion, or safety concerns before any joint session.
- Do not mistake general information for legal advice. Self-help staff and online resources can explain procedure without recommending the strategy for your facts.
A practical low-cost legal-help workflow
- Map the case. Record the court, case number, legal issue, opposing party, next deadline, and desired result.
- Check for appointed counsel. If a criminal charge could lead to incarceration and you cannot afford a lawyer, request counsel from the judge at the first appearance.
- Search civil resources. Use USAGov, Legal Services Corporation programs, LawHelp.org, the relevant state or county court, and specialized programs that match your circumstances.
- Call a referral service. Ask the state or local bar about screening, consultation cost, reduced-fee panels, conflicts, and coverage.
- Price only the work you need. Ask each lawyer about limited-scope tasks, a flat fee, sliding scale, or payment plan, and obtain a written agreement.
- Use official self-help tools. Download current court forms, attend workshops or advice sessions, and track filing and service requirements.
- Evaluate mediation. Ask whether the court offers it and disclose any safety or power-imbalance concerns before agreeing.
- Create a backup plan. If one office declines, request referrals immediately and protect the nearest deadline while you continue searching.
What “free legal help” can and cannot mean
Free assistance may mean a lawyer represents you throughout the case, but it may also mean a hotline answers one question, a self-help center explains a form, a clinic reviews a document, or a referral service provides a short consultation. Ask what service you are receiving, for which dates and tasks, and whether you have an attorney-client relationship.
There is no single national eligibility threshold, success rate, or standard fee for these programs. The controlling details are local: the court, county, program rules, lawyer’s written agreement, and the time available before your deadline.

Can I get a free lawyer for a civil case?
Sometimes. Civil legal-aid and pro bono programs may provide advice, discrete work, negotiation, or full representation if you meet their financial, subject-matter, geographic, and capacity requirements. Most civil cases do not carry a general constitutional right to appointed counsel.
What should I do if I am charged with a crime and cannot pay?
If the charge could lead to incarceration, tell the judge at your first appearance that you cannot afford counsel and request appointed counsel or a public defender. Follow the court’s financial-eligibility process.
Is a bar-association referral free?
Not necessarily. Referral services set local screening and consultation rules. Some offer reduced-fee panels or short consultations; confirm the price, duration, and geographic coverage before scheduling.
What is limited-scope representation?
It is an agreement for a lawyer to handle defined tasks—such as reviewing a document, drafting a motion, negotiating, or appearing at one hearing—while you handle the remaining work. Put the tasks, responsibilities, deadlines, and fee in writing.

What can I do after a legal-aid office rejects my application?
Ask why it declined the case and request referrals. Try another legal-aid program, a hotline or clinic, a court self-help center, a bar referral, a limited-scope lawyer, or a payment arrangement. Protect any court deadline while you continue looking.
