The IRS can collect the balance from either spouse, even after divorce. Filing separately generally limits a spouse to the tax on that spouse’s own return for that year, but community-property rules can change the allocation. A new separate return does not erase a debt created by an earlier joint return; relief from that old liability requires a qualifying IRS or court process.
Joint and separate filing answer different questions
“Married filing jointly” and “married filing separately” are filing-status choices for a particular tax year. Liability for an unpaid balance is tied to the return that created the tax. That distinction matters when a couple changes filing status after a joint return has already been filed.

| Question | Joint return | Separate returns |
|---|---|---|
| Whose income, deductions and credits appear? | Combined income and allowable expenses are reported on one return. | Each spouse generally reports that spouse’s income, deductions and credits for the year, subject to community-property rules. |
| Who is responsible for tax shown? | Each spouse is generally responsible for the whole tax shown and for additional tax later assessed. | Each spouse generally is responsible for the tax on that spouse’s return, subject to applicable community-property rules. |
| Does a later filing choice change an old joint debt? | No. The old joint liability continues unless applicable relief is granted. | No. Filing separately for a later year does not change liability on a prior joint return. |
| What relief may be available? | Innocent-spouse, separation-of-liability or equitable relief may be requested when the facts satisfy the applicable rules. | Separate filers may have special issues in community-property states; state and federal rules must be analyzed together. |
The IRS advises comparing the tax and other consequences of joint and separate calculations before choosing a status. A lower current-year tax bill does not, by itself, resolve an existing joint-return debt.

What is joint and several liability?
Joint and several liability is the rule that makes each spouse individually responsible for the entire federal liability on a joint return. The IRS describes it this way: “When you file a joint income tax return, the law makes both you and your spouse responsible for the entire tax liability.” (Internal Revenue Service, Publication 971, Innocent Spouse Relief, December 2021 revision; see IRS Publication 971.)

It covers tax reported on the return
If the signed joint return shows $12,000 due and the couple pays only $7,000, the IRS can pursue either spouse for the remaining $5,000. It does not have to divide the bill according to who earned the income or who agreed to pay it at home.
It also covers later assessments
An audit can add tax, interest and penalties because income was omitted, deductions were overstated or another error was found. The additional amount is generally part of the joint liability, even if the item came entirely from one spouse’s business or investment activity.
Collection can target either spouse
The IRS may apply payments, seize assets or pursue collection against either liable spouse, subject to normal collection procedures. A spouse who pays more than that spouse’s fair share may have a private reimbursement claim under state law, but that private dispute does not restrict the IRS.
Does divorce make me no longer liable for a joint tax return?
No. A divorce decree, separation agreement or later promise to “take responsibility” can allocate the debt between former spouses, but it does not by itself change the federal liability created by the joint return. The IRS is not a party to the divorce case and generally can still collect from either former spouse.
The same principle applies if one former spouse receives the property, business or income that generated the tax. The decree may support a claim between the former spouses or become relevant evidence in an IRS relief request, but it is not an automatic discharge of the joint debt.

What does filing separately protect me from?
A married-filing-separately return generally reports each spouse’s own income, deductions and credits. That normally prevents one spouse’s new-year income or erroneous deduction from being placed on the other spouse’s separate return. It does not create a blanket shield from every liability:
- Community-property law can require reporting or allocation of income earned during marriage even when federal returns are separate.
- A spouse may remain liable for earlier joint returns.
- Separate filing can change eligibility for credits, deductions and payments, so it may produce a higher current-year tax even when it reduces exposure to the other spouse’s new-year items.
- State law can impose obligations that are different from the federal filing result.
Therefore, “file separately” is a prospective filing decision, not a substitute for requesting relief on a joint return that already exists.

Community-property states require a separate analysis
In a community-property state, earnings and certain other property acquired during marriage may be treated as community income under state law. Federal rules can require each spouse filing separately to report a share of community income, deductions or credits rather than simply listing only the paycheck deposited in that spouse’s account.
The exact allocation depends on the state, the spouses’ domicile, the year, the type of income and whether the couple lived apart. State rules can also affect who ultimately bears a debt between spouses. Because this article addresses the general federal comparison, do not assume that the “each spouse reports only personal income” description works in every state. Check the instructions for the current federal return and the law of the relevant state.
A new-year choice cannot rewrite a prior joint return
Consider the timing:
- Year 1: The spouses file jointly and an unpaid balance or later audit assessment arises. Both spouses generally remain liable for that Year 1 liability.
- Year 2: They divorce and one spouse files separately. That Year 2 status governs Year 2 reporting; it does not alter the Year 1 joint liability.
- After notice: A spouse who believes it would be unfair to collect may examine the IRS spouse-relief categories and file the appropriate request.
Changing bank accounts, moving to a different state or obtaining a decree does not itself remove the earlier federal liability. Relief must be established under the applicable IRS rules or another legally effective resolution.

Relief from a joint-return tax debt
The IRS recognizes three principal forms of spouse relief. They address different problems, so selecting the category that matches the facts is important. Form 8857 is the IRS request form for innocent-spouse, separation-of-liability and equitable relief.
Innocent-spouse relief
This route generally concerns an understatement caused by the other spouse’s erroneous items or omitted income. A requester normally must show that:
- a joint return was filed;
- the return understated the correct tax because of the other spouse’s item;
- the requester did not know, and had no reason to know, of the understatement when signing; and
- considering all the circumstances, it would be unfair to hold the requester liable.
Qualifying relief can cover tax, interest and penalties attributable to the understatement. Amounts that do not qualify remain subject to collection. Knowledge is evaluated in context; signing a return without reading it is not an automatic pass or automatic failure.
Separation-of-liability relief
Separation of liability allocates qualifying understated tax, plus related interest and penalties, between the spouses as if separate returns had been filed for the relevant year. The IRS generally requires a joint return and a qualifying marital or living-apart status, such as divorce, legal separation, widowhood or not living together for the full 12 months before the request.
The IRS topic guidance describes a two-year period tied to receiving an audit or tax-due notice for an error. That trigger is specific to this relief route; it should not be treated as a universal deadline for every spouse-relief request. Separation of liability does not turn amounts already paid into a refund.

Equitable relief
Equitable relief may apply when innocent-spouse or separation-of-liability relief is unavailable but it would nevertheless be unfair to hold the requester responsible. It can address an underpayment shown on the return as well as certain understated tax, subject to exclusions and the detailed IRS requirements.
Factors the IRS considers include marital status, economic hardship, knowledge or reason to know, which spouse had the legal obligation to pay, whether the requester received a significant benefit, later tax compliance and physical or mental health. No single factor controls every case. The current IRS guidance contains timing rules and an exception related to contact during an audit, so use the current instructions rather than applying a single assumed deadline.

- Identify the return and liability. Gather the year, copies of the joint return, notices, account transcripts, payment records and documents showing income, assets, household finances and any agreement between the spouses.
- Read the IRS notice immediately. Note the response date, appeal instructions and the tax year involved. A notice about a proposed assessment is different from a notice about an already assessed balance.
- Choose the matching category. Use the facts to evaluate innocent-spouse, separation-of-liability and equitable relief rather than selecting a category solely because its name sounds familiar.
- Complete Form 8857. Answer fully, explain disputed items, identify hardship and attach records that support the explanation. Keep a complete copy and proof of mailing or electronic submission.
- Expect contact with the other spouse. The IRS generally informs the other spouse and may request that person’s response. Do not assume that the request is confidential from the other spouse.
- Continue current compliance. File required returns and pay taxes that become due while the request is pending. A relief request does not automatically suspend every collection action or future filing obligation.
- Review the determination and appeal rights. The IRS says review can take six months or longer. If the decision is unfavorable, follow the notice’s appeal procedure; the IRS materials describe a 30-day appeal period in the applicable determination process.
Deadlines depend on the relief type and the event that starts the period. Apply the current IRS instructions to the specific notice and year rather than relying on a general deadline remembered from another category.
Injured-spouse relief is different
Injured-spouse relief concerns a refund, not responsibility for an erroneous joint return. If a joint refund is offset to pay the other spouse’s qualifying past-due child support, student loan, tax or other debt, the injured spouse can ask the IRS to calculate and return that spouse’s share. The IRS identifies Form 8379 for this allocation.
Innocent-spouse relief, by contrast, asks whether a spouse should be relieved from tax, interest or penalties arising from errors or omissions on a joint return. A taxpayer can potentially need one remedy, the other, or neither, depending on whether the issue is a seized refund or an assessed tax liability.

Examples that show the difference
One spouse omitted business income
Alex and Jamie file jointly. Jamie’s business omits $40,000 of income, and an audit assesses additional tax. The IRS can generally collect the resulting liability from Alex or Jamie. Alex’s possible remedy is a spouse-relief request based on the facts, not a later decision to file separately.
Divorce decree assigns the bill
A decree says Jamie will pay every tax debt. The IRS may still collect the joint-return balance from Alex. Alex can use the decree as evidence in a relief request or seek reimbursement from Jamie under applicable state law, but the decree alone does not bind the IRS.
Separate filing in a later year
Alex files separately after the divorce. Alex reports the new-year items under that status, while the prior joint balance remains attached to the prior joint return. The two years are separate liabilities.
Quick wins for a faster PC:
Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Clear out junk files and repair common Windows errorsFree Scan →Scan for outdated or missing drivers - takes under a minuteDriver Scan →Refund offset for the other spouse’s debt
A joint return produces a refund, but the IRS applies it to Jamie’s old student-loan debt. Alex’s issue is potentially injured-spouse relief and Form 8379, not innocent-spouse relief.
Choosing a filing status when no old debt exists yet
Liability is only one part of the annual decision. Before filing, calculate both statuses using the year’s actual income, deductions, credits, withholding and estimated payments. Compare:
- the total federal tax and expected refund or balance due;
- loss of or limits on credits and deductions under married filing separately;
- the accuracy and completeness of information supplied by each spouse;
- community-property reporting requirements;
- state income-tax effects; and
- whether one spouse has past-due obligations that could affect a joint refund.
Separate filing is not automatically safer or cheaper, and joint filing is not automatically preferable. The correct choice depends on the year’s numbers, the reliability of each spouse’s records and the laws of the state involved.
When professional advice is sensible
Consider a qualified tax attorney, enrolled agent or certified public accountant when the case involves an audit, omitted business income, large assets, community-property allocations, domestic-abuse concerns, disputed signatures, bankruptcy, or a notice with a short response period. Professional help is not required to submit Form 8857 and does not guarantee relief; it can help organize evidence and apply the rules to complicated facts.
IRS forms and guidance can change. Publication 971 (December 2021 revision), Publication 504 (2025) and the IRS’s current spouse-relief pages should be checked for the tax year, form revision and deadline that apply when you act.
Quick Recap
Practical checklist
- Separate the year you are filing now from every year covered by an old joint return.
- List each notice, tax year, assessed amount, payment and response deadline.
- Determine whether the problem is an unpaid amount, an understatement discovered by the IRS or an offset refund.
- Check whether community-property rules affect income or deductions.
- Compare the facts with innocent-spouse, separation-of-liability and equitable-relief requirements.
- Use Form 8857 for the three spouse-relief categories when appropriate; use Form 8379 for an injured-spouse refund allocation.
- Keep filing and paying current taxes while the IRS reviews a request.
