The label “alimony” does not decide the result. The decree or settlement must be examined to see whether the payment is a recurring income stream or compensation for giving up a maintenance right.
There is no general alimony exemption in the Income-tax Act. The safest approach is to classify the payment from its legal effect, preserve the underlying documents, and obtain advice before filing an income-tax return where the arrangement includes arrears, child support, property, shares, non-resident parties or unusual release clauses.

The short answer: monthly alimony and lump-sum alimony are treated differently
Indian tax law does not contain a provision saying that all alimony is tax-free. In the authorities discussed below, a regular monthly payment made under a divorce decree was treated as taxable income, whereas a one-time payment that diminished or extinguished the recipient’s maintenance right was treated as a capital receipt. A settlement payment for surrendering past and future monthly claims was also treated as capital on the facts of that case.
Those outcomes are fact-specific. A payment called “full and final alimony” can still be taxable if the documents show that it is merely an advance or commutation of an income stream. Conversely, a lump sum may have capital character when it is paid in exchange for releasing the legal right to claim maintenance in the future. The wording and legal effect of the decree, consent terms or settlement agreement are therefore more important than the payment label.

Why the legal character of the payment matters
Tax analysis asks what the recipient obtained, not simply what the parties called it. A recurring payment normally provides a regular return from an identifiable legal source. A capital receipt changes the recipient’s underlying rights or compensates for surrendering those rights.
Recurring maintenance right remains alive
If a spouse is entitled to receive a fixed amount every month, and that entitlement continues after each instalment, the arrangement resembles a periodic income source. The recipient has an enforceable right to another payment in the following month, subject to the decree’s terms. This is the pattern that led to taxation of monthly alimony in the Bombay High Court decision described below.
Maintenance right is released or extinguished
If one payment is made in return for giving up claims to past and future maintenance, the recipient may be surrendering a legal right rather than receiving a return that recurs over time. The cited decisions treated that kind of transaction as capital. The agreement should clearly state which claims are released and whether the payment is intended to settle accrued amounts, future entitlement, or both.
What sections 56(1) and 10 of the Income-tax Act provide
Section 56(1) is the residual charging rule. It states that income of every kind which is not excluded from total income under the Act and is not chargeable under another head is taxable under “Income from other sources.” Therefore, a receipt can be taxable even when no provision names “alimony” specifically.
Section 10 lists particular exclusions from total income. It does not create a general exemption for alimony or divorce maintenance. A recipient cannot claim that every maintenance payment is exempt merely because it arose from a matrimonial proceeding. The receipt must first be characterized under the facts and then tested against the charging provisions.

How the courts have treated monthly or periodic alimony
Princess Maheshwari Devi of Pratapgarh v. CIT: monthly payment
In this Bombay High Court decision, the recipient received monthly alimony of Rs. 750 under a decree. The court held that the monthly amount was a regular and periodic return from a definite source—the decree—and therefore constituted “income” taxable under the Act. The figure is historical: Rs. 750 per month, Bombay High Court, 1982. It is an illustration of the legal reasoning, not a current threshold or exemption limit.
The court expressed the principle in these words: “The monthly alimony being a regular and periodical return from a definite source, being the decree, must be held to be ‘income’ within the meaning of the said term in the said Act.” The key factors were regularity, periodicity and the continuing legal source of the entitlement.

A person receiving monthly maintenance should generally treat the amount as potentially taxable under income from other sources unless a current, fact-specific opinion supports another characterization. The recipient should total amounts actually received or credited during the relevant financial year, retain the decree and bank evidence, and include the amount in the return in the manner advised by a tax professional.
How the courts have treated lump-sum alimony
Rs. 25,000 lump sum in the Bombay High Court decision
In the same 1982 Bombay High Court matter, a separate lump-sum alimony payment of Rs. 25,000 was treated as a capital receipt. The court considered that payment to diminish or partly extinguish the maintenance right, rather than merely commute an existing stream of periodic income. The amount and date are historical—Rs. 25,000, Bombay High Court, 1982—and should not be read as a present-day monetary benchmark.
Meenakshi Khanna: settlement of past and future claims
In Meenakshi Khanna, the Income Tax Appellate Tribunal considered a lump sum paid in settlement of past and future monthly-alimony claims. The recipient accepted the amount in consideration of relinquishing those claims. On those facts, the Tribunal treated the receipt as capital and held that section 56(2)(vi) did not apply. That conclusion depends on the documented surrender of the maintenance claims; it is not a blanket ruling that every one-time divorce payment escapes tax.

Compare a proposed settlement before signing it
The following framework helps identify the questions a tax adviser will ask. It does not replace advice on the final wording.

| Issue | Recurring arrangement | Capital-style settlement |
|---|---|---|
| Payment pattern | Monthly or other periodic instalments continue over time. | One payment is made, or instalments are expressly tied to a final settlement. |
| Maintenance right | The right to claim the next payment remains in force. | Past and future claims are released, reduced or extinguished. |
| Legal source | A decree or agreement creates a continuing entitlement. | The payment is consideration for surrendering that entitlement. |
| Judicial treatment in cited authorities | Monthly Rs. 750 was held taxable as income. | Rs. 25,000 and a settlement for relinquishing claims were treated as capital receipts. |
Do not assume a payment is capital merely because it is made once. A one-time amount can be an advance against future monthly income, an arrears payment, or a commutation of periodic receipts. Those details can change the result.
How a recipient should approach the income-tax return
When the payment is characterized as taxable
- Calculate the amount received or credited during the financial year, separating monthly maintenance from other matrimonial payments.
- Review the decree or settlement to confirm the legal source and payment terms.
- Report the taxable amount under the head advised by your tax professional, ordinarily “Income from other sources” when section 56(1) applies.
- Keep bank statements, payment schedules and correspondence that reconcile the figure reported in the return.
Taxability is determined for the relevant assessment year. A recipient should not copy the treatment used in an earlier return without checking whether the decree, payment pattern or law has changed.
When the payment is claimed to be capital
Retain the clause that states the recipient releases past and future maintenance claims, along with the decree recording the settlement. A capital characterization should be supported by the legal effect of the transaction, not by an informal description in a covering letter. Ask a chartered accountant or Indian tax lawyer how the receipt should be reflected, if at all, in the particular return form and whether any disclosure is prudent.
Does the person paying alimony get a tax deduction?
The cited authorities address taxation in the recipient’s hands. They do not establish a general deduction for the payer. A payer should not reduce taxable income simply because a payment was ordered by a family court or described as alimony.

Before claiming any deduction, examine the current law applicable to the payer’s income, the nature of the payment and the wording of the order. A separate analysis may be needed for amounts that are actually child support, legal costs, property transfers, loan repayments or settlement consideration. Keep proof of payment and the operative decree even when no deduction is claimed.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Mixed settlements: maintenance, children, property and shares
Divorce settlements often combine several obligations. A single bank transfer may cover spousal maintenance, child support, reimbursement of expenses and transfer of an asset. Treating the entire amount as one category can create avoidable disputes.
Spousal maintenance and child support
Identify the portion legally payable to the former spouse and the portion intended for a child. The decree should allocate amounts and describe the beneficiary. Tax treatment can differ, so obtain advice rather than applying the alimony analysis to the whole transfer.
Property, shares or other assets
A transfer of real estate, securities or other property is not automatically equivalent to cash alimony. Valuation, transfer taxes and capital-gains rules may become relevant. The settlement should specify whether an asset transfer satisfies a maintenance obligation and how the parties determined its value.

Arrears and release language
Payment of accumulated monthly arrears may be viewed differently from a payment that releases all future rights. List the period covered by arrears and state separately whether future claims survive. Ambiguous language makes it harder to defend the intended characterization.

Documents to keep for an assessment or notice
- The final divorce decree, maintenance order and any later modification.
- Consent terms or settlement agreement signed by both parties.
- The clause describing release, relinquishment or extinguishment of future claims.
- A payment schedule identifying dates, amounts and the purpose of each payment.
- Bank statements, transfer confirmations and receipts.
- Working papers showing how monthly, arrears, child-support and asset components were separated.
- Tax-return computations and written advice obtained for the relevant assessment year.
Never rely on the word “tax-free” in an agreement as conclusive proof. Courts examine the substance and legal effect of the arrangement.
Common mistakes and how to avoid them
Calling every lump sum exempt
A single payment may still represent commuted periodic income. Check whether the recipient gives up a legal right and whether the document records that surrender.
Ignoring the decree
Bank narration or a privately written receipt cannot replace the operative court order. Use the decree and consent terms to establish the source and purpose of the payment.
Recommended Free Tools
Reporting only the amount left after expenses
Personal spending, rent or legal fees do not automatically reduce a taxable receipt. Determine the taxable amount under the applicable provisions before netting expenses.
Assuming the payer’s treatment controls the recipient’s
The payer’s accounting entry or claimed deduction does not decide whether the recipient received taxable income. Each party must analyze its own tax position.
Using old case figures as current limits
Rs. 750 per month and Rs. 25,000 are the figures reported in a 1982 case. They illustrate classification principles and are not present-day thresholds, rates or exemptions.
When professional review is especially important
Obtain advice from a chartered accountant or Indian tax lawyer when the settlement commutes arrears, combines spousal and child support, transfers property or shares, involves a non-resident, uses an overseas account, or contains unusual release language. Professional review is also sensible when a return has already been filed inconsistently or a tax notice questions the receipt’s character.
Quick Recap
Practical decision checklist
- Read the decree and settlement, not just the bank narration.
- Mark every payment as monthly, arrears, final settlement, child support, reimbursement or asset transfer.
- Ask whether the recipient’s right to claim future maintenance survives.
- Separate amounts with different legal purposes and keep evidence for each.
- Apply section 56(1) and check section 10 only after characterizing the receipt.
- Prepare the return using the treatment supported by the documents and current professional advice.
