Whether a pre-order is refundable depends on your jurisdiction, the seller’s terms, who is cancelling, how you ordered, and whether the promised shipment or delivery date has passed. A seller’s delay or cancellation is legally different from a buyer changing their mind. The clearest rules discussed here cover qualifying U.S. online, mail and telephone orders, EU consumer guidance, and the United Kingdom; another country or a cross-border transaction may follow different rules.
What determines whether your pre-order can be refunded?
Start with five facts: where you live, where the seller operates, whether the seller or you initiated the cancellation, the sales channel, and the delivery or shipment promise shown at checkout. Keep the confirmation, product listing, payment record and every delay notice. Those records establish what was promised and what happened.

A pre-order can involve a product that has not yet been released, but that label does not automatically give the seller unlimited time or give the buyer an unconditional right to cancel. A contract may contain a cancellation policy, while consumer law can impose additional duties when a seller misses its promised timetable or cannot supply the goods.

United States: the FTC mail, internet and telephone-order rule
For covered U.S. mail, internet and telephone orders, the seller generally must ship within the time it stated. If no shipping time was stated, the default is 30 days. This is a shipment deadline, not a guarantee that the package will arrive within 30 days.

When the seller cannot ship on time
If the seller cannot meet the promised shipment date, the Federal Trade Commission says it must notify you and give you a choice: accept the delay or cancel for a full refund. The FTC’s consumer guidance states: “If there’s a delay shipping your order, the seller has to tell you and give you the choice of either agreeing to the delay or canceling your order for a full refund.” FTC Consumer Advice
The detailed rule covers how the seller gives the delay notice, how it obtains your consent to a revised date, what happens if another delay occurs, and the requirement for a prompt refund when you cancel under the rule. The regulatory text is in 16 CFR Part 435. The FTC also publishes the rule and related compliance material at Mail, Internet, or Telephone Order Merchandise Rule.
What a full refund means in this situation
When you reject a covered delay and cancel under the rule, ask the seller to return the payment method or amount required by the applicable rule. Do not treat a store credit, replacement item or a new estimated date as the same thing as the full refund you requested unless you agree to that alternative.
If the seller says the pre-order is cancelled
A seller that cannot supply the order still has to follow the rule’s notice and refund requirements when the transaction is covered. Ask for written confirmation that the order is cancelled, the amount being refunded, and the date the refund was initiated. Save that response with the original order record.

What this U.S. rule does not decide
The FTC rule does not create a general right to cancel every pre-order simply because you changed your mind before shipment. It also applies only within its legal scope. Product type, seller status, transaction method and the terms you accepted can matter. A seller’s promise that an item will ship on a certain date is therefore important, but you should still check whether the transaction is covered before relying on the rule.
European Union: delivery timing and the 14-day online cancellation period
European Commission consumer guidance says goods should be delivered on the date agreed with the trader. If no delivery date was agreed, the baseline is 30 days. That 30-day EU period concerns delivery; it is not interchangeable with the U.S. 30-day default for shipment.
If an EU seller misses the delivery date
The available EU guidance establishes the delivery baseline, but it does not mean that every missed date automatically creates an immediate refund in every member state and circumstance. Remedies after a breach can depend on the contract, the seriousness of the delay, whether you gave the trader an additional reasonable period, and national rules implementing EU consumer law. The same European Commission guidance describes a 14-day cancellation right for many online purchases. The period is a consumer-withdrawal rule, not a special promise that every pre-order can be cancelled at any time. Its scope and exceptions matter, so check whether your goods, seller and transaction qualify. A pre-order’s release date does not by itself answer when the period starts or whether an exception applies.

If you rely on the 14-day right, send an unambiguous cancellation message through a channel that creates a record. Keep the order number, the date and the text you sent. The seller may have return and reimbursement steps that must be followed under the applicable rules.
United Kingdom: reimbursement under the Consumer Rights Act 2015
The cited Consumer Rights Act 2015 says a trader must reimburse, without undue delay, payments for goods that the consumer cancels or rejects under the Act. That wording is tied to the statutory circumstances in which cancellation or rejection is available.
It should not be read as an unconditional right to cancel any pre-order before shipment. Whether you can cancel depends on the legal ground, the contract and the facts of the delay or non-conformity. When you assert a statutory cancellation or rejection right, identify that ground in writing and ask the trader to confirm the reimbursement timetable.

Buyer changes their mind versus seller delay
These are separate questions:
- Seller delay or inability to supply: In covered U.S. transactions, the seller must provide the delay-or-cancel choice and a full refund if you cancel. In the EU and UK, delivery and cancellation rights depend on the applicable statutory framework and facts.
- Buyer changes their mind: The sources do not establish a universal right to cancel every pre-order before shipment. Your order terms and any applicable withdrawal rule control.
- Seller’s voluntary cancellation: Ask for written confirmation and the refund amount. The seller’s message may also establish that it cannot perform by the promised date.
Do not accept a statement such as “pre-orders are always non-refundable” without checking whether a consumer-law cancellation, delay or non-delivery right overrides that term in your jurisdiction.

How to request cancellation and a refund
- Confirm the governing facts. Note your country, the seller’s country, the ordering channel, the promised shipment or delivery date, the current status, and whether you are cancelling because of delay or simply changing your mind.
- Collect evidence. Save the confirmation email, checkout page, listing, terms, payment receipt, promised date, tracking information, delay notices and any conversation with support. The FTC specifically advises keeping documents showing expected and actual delivery dates and seller notices.
- Write to the seller. State the order number and explain whether you accept the revised date or cancel. If a covered U.S. delay applies, say clearly that you are cancelling and requesting the full refund. If relying on an EU or UK statutory right, identify the applicable cancellation or rejection basis without overstating what the law guarantees.
- Request a written response. Ask the seller to confirm cancellation, the amount to be returned, the payment method, and when the refund was initiated. Keep the seller’s reply.
- Watch the payment account. Check the original card, bank or payment account for the credit. If the seller does not respond or does not refund as required, gather the complete record before contacting the relevant consumer-protection authority or seeking qualified local advice.
Practical scenarios
The seller missed a stated U.S. ship date
Save the page showing the date, then ask whether the seller is offering a delay. Under the covered FTC rule, you can choose to accept the revised timing or cancel for a full refund. Make the choice in writing and retain the notice.
No U.S. shipment time was stated
For a covered transaction, the FTC rule generally uses a 30-day default to ship. If the seller cannot meet that deadline, the delay-notice and cancellation options apply. Do not confuse this shipment deadline with the time the carrier takes to deliver the package.
An EU order has passed its agreed delivery date
Check the agreed date and the trader’s explanation. EU guidance sets the agreed date, or 30 days when no date was agreed, as the delivery baseline. The next remedy can depend on national implementation and the circumstances, so obtain country-specific guidance before asserting that a refund is automatic.

Read the cancellation clause and check whether an applicable online withdrawal period or exception applies. The existence of a pre-order does not by itself settle the question. Send a dated request and ask the seller to identify the term or law on which it relies if it refuses.

The transaction crosses borders
Identify the consumer’s location, the seller’s establishment, the delivery destination and the governing terms. A seller may be overseas while mandatory consumer protections still apply, but the sources covered here do not establish a single cross-border rule for every country. A local consumer authority can explain which law and enforcement route fit the transaction.

Payment disputes and escalation
A card or debit dispute may be an option, but the outcome depends on the issuer, payment network, transaction details and the evidence you provide. Do not promise yourself that a chargeback will succeed or treat it as a substitute for first documenting the cancellation request. Keep proof that you contacted the seller, the promised date, the delay notice and the refund request.
If the seller ignores a valid request, contact the consumer-protection authority responsible for your location or seek qualified legal advice. Bring the complete timeline and the exact terms shown at checkout. Authorities and advisers can distinguish a contractual dispute from a statutory violation and identify deadlines that vary by jurisdiction.
Bottom line: is a pre-order refundable?
A pre-order is refundable when the applicable law or the order terms give you that right—for example, a covered U.S. seller’s failure to ship on time after you reject the delay, or a qualifying EU or UK cancellation or rejection right. It is not automatically refundable merely because it is labelled a pre-order or because you changed your mind. Determine the jurisdiction and reason for cancellation, preserve the promised-date evidence, cancel in writing, and use local consumer guidance when the seller disputes the refund.
