Find and replace yours safely.Free scan · under a minuteIndia’s online shoppers are protected by two connected rule sets: the Digital Personal Data Protection (DPDP) Act, 2023 and its 2025 rules address how digital personal data is collected and used; the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020 and the Central Consumer Protection Authority’s (CCPA) Dark Patterns Guidelines, 2023 address misleading interfaces, unfair commercial practices and grievance handling. A compliant checkout needs both layers: clear, affirmative consent for data and a genuinely free choice about prices, add-ons and renewals.
Which data-protection law applies to Indian e-commerce?
The principal data-protection statute is India’s Digital Personal Data Protection Act, 2023. It supplies the statutory framework for processing digital personal data. The Digital Personal Data Protection Rules, 2025, issued by the Ministry of Electronics and Information Technology (MeitY), provide the subordinate-rules layer and operational detail.

The Act and rules should be read with their operative notifications. Commencement can be staged, and transitional provisions, exemptions and implementation dates must be checked in the notified text that is in force for the transaction. A store should therefore maintain a versioned legal register rather than assume that every provision applies from the Act’s publication date.
What the DPDP layer covers in a shopping journey
- Personal data collected when a customer creates an account, places an order, requests delivery or contacts support.
- Information used for marketing, profiling, analytics or advertising when it is not necessary to fulfil the purchase.
- The explanation given to a person about what data is collected, why it is needed and how consent choices work.
- Internal records showing when and how an affirmative consent action occurred, and how a person can withdraw or change that choice.
The DPDP framework does not turn every interface problem into a data-protection issue. A hidden delivery fee, a preselected insurance product or a misleading renewal button can also be a consumer-protection or unfair-trade-practice issue even when no personal data is collected.

Which consumer-protection rules govern an online store?
The Consumer Protection Act, 2019 is the parent statute for consumer rights and unfair trade practices. Under it, the Consumer Protection (E-Commerce) Rules, 2020 set responsibilities for e-commerce entities using marketplace and inventory models, including customer grievance redressal.
| Instrument | Year | Role in e-commerce | Authority or issuing body |
|---|---|---|---|
| Digital Personal Data Protection Act | 2023 | Statutory framework for digital personal-data processing | Parliament of India |
| Digital Personal Data Protection Rules | 2025 | Operational and subordinate-rules detail for the Act | MeitY |
| Consumer Protection Act | 2019 | Consumer rights and unfair-trade-practice framework | Parliament of India |
| Consumer Protection (E-Commerce) Rules | 2020 | Responsibilities and grievance redressal for marketplace and inventory models | Central Government under the Consumer Protection Act |
| Dark Patterns Guidelines | 2023 | Prevention and regulation of deceptive, coercive or manipulative interface design | CCPA under section 18 of the Consumer Protection Act |
These instruments overlap in practice. For example, asking for an email address to send an order receipt may be connected to fulfilment, while requiring the same address to receive a supposedly free course may be a separate marketing or data-sharing condition. The legality and fairness of the second flow depends on necessity, disclosure and the consumer’s ability to decline without losing the advertised service.
What are dark patterns in online shopping?
The CCPA issued the Guidelines for Prevention and Regulation of Dark Patterns, 2023 on 30 November 2023 under section 18 of the Consumer Protection Act. The guidelines describe dark patterns as design and choice architecture used “to deceive, coerce, or influence consumers into making choices that are not in their best interest.” They identify 13 specified dark patterns.

The official examples include drip pricing (revealing unavoidable charges late), disguised advertisements, bait and switch and false urgency. A later CCPA enforcement release also gave practical examples such as:
Rank #2
- Ideal for Gifting
- Ideal for a bookworm
- Compact for travelling
- Basket sneaking: adding a product, donation or service to a basket without an unambiguous customer choice.
- Confirm shaming: using guilt, ridicule or emotional pressure to make declining harder.
- Forced action: requiring an unrelated action, such as sharing personal data, before the advertised service can be accessed.
- Interface interference: visually or functionally steering a person toward the trader’s preferred option.
- Trick questions: wording or layouts that make a reasonable customer misunderstand what a selection does.
A pattern is not judged only by whether a customer technically clicked a button. The relevant question is whether the presentation gave a reasonable person a clear, voluntary and informed choice, with material price and data consequences visible at the decision point.
Are pre-ticked consent boxes legal in India?
They should not be used as a substitute for affirmative consent. In its 3 June 2026 enforcement release, the CCPA stated: Consumer consent cannot be assumed through pre-selected options and must always be obtained through a clear and affirmative action.
A compliant consent control is unselected by default, explains the purpose in plain language and requires an intentional action such as ticking a box or selecting an “Agree” control. The decline route should be available at the same stage, should not be hidden behind a less visible link and should not use hostile wording.
What a sound consent screen contains
- The specific purpose: for example, order fulfilment, product updates or targeted advertising.
- The categories of data requested and whether each category is necessary for the stated purpose.
- A separate choice for optional marketing or profiling rather than bundling it with account creation.
- A clear way to withdraw or change an optional choice, without degrading an unrelated service.
- A record of the text shown, the date and time, the affirmative action and any later withdrawal.
“Accept all” and “Decline” can be presented together, but the visual hierarchy should not make refusal appear unsafe, shameful or defective. A customer who declines optional processing should still be able to complete a purchase when that processing is not necessary to supply the goods or service.

Can an online store add a donation, insurance or other item automatically?
Automatically adding an optional item is a high-risk design. It can amount to basket sneaking, particularly when the customer must notice a preselected checkbox or remove an item that was never requested. The safer pattern is an empty optional control, a neutral description and a price shown before payment.
On 3 June 2026, the CCPA announced a ₹5 lakh penalty against PhysicsWallah. The case involved a preselected ₹10 donation and emotional messaging that discouraged its removal. The same release said the service advertised courses as “free” while requiring mobile-number and email sharing without clearly disclosing those conditions; the authority treated the data requirement as misleading where it was not necessary to provide the content.
Checkout controls that reduce risk
- List every paid item, donation and recurring service as a separate line before the payment button.
- Start optional products in an unselected state.
- Show the amount, recurrence and cancellation terms beside the control, not only in a distant terms page.
- Use neutral labels such as “Add ₹10 donation” and “No, continue without donation.”
- Require a final review step that reflects the exact total and the customer’s selected options.
- Retain an audit record of the interface version and the values displayed at checkout.
What rights do I have when a site pressures me to subscribe or renew?
You should be able to see whether a subscription is recurring, what it costs, when billing occurs and how to stop it before confirming. A cancellation or decline control should not be obscured, made materially smaller or described in threatening terms. If a “free” trial requires payment details, the conversion date and amount should be prominent before enrollment.
The CCPA’s 3 June 2026 release announced a ₹1 lakh penalty against McAfee. Its renewal interface presented “Renew Now” against “Accept Risk.” The CCPA treated that presentation as confirm shaming, interface interference, a trick question and forced action. The example illustrates that a technically available refusal may still be problematic when the wording frames the neutral choice as accepting danger.

How to respond as a consumer
- Pause at the order or renewal screen and expand price, recurrence and data-use details.
- Untick or decline optional items only when the control is genuinely optional; do not assume a preselected choice reflects your wishes.
- Capture screenshots showing the page, total, selected add-ons, consent wording and date.
- Save confirmation emails, invoices, cancellation attempts and support replies.
- Use the seller’s and marketplace’s grievance channels and state precisely which charge, data condition or interface choice you dispute.
- If the issue is not resolved, keep the evidence for a consumer-protection complaint or other available regulatory remedy.
How should product teams distinguish compliant and risky choices?
| Decision point | Lower-risk design | Risk indicator |
|---|---|---|
| Legal basis and purpose | Purpose is stated before collection and is connected to the requested service. | Data is requested for an unexplained or unrelated purpose. |
| Consent | Optional consent is affirmative, separate and revocable. | Preselected boxes, bundled consent or no practical withdrawal route. |
| Price transparency | Total price, fees, recurrence and add-ons appear before payment. | Charges appear only at the final step or after a commitment. |
| Accept/decline neutrality | Both choices are readable, available and neutrally worded. | Decline is shamed, visually buried or framed as accepting harm. |
| Necessity and proportionality | Only data needed for fulfilment or the chosen optional purpose is required. | A supposedly free or necessary service is gated by unrelated data sharing. |
| Seller and platform responsibility | Marketplace and inventory roles, seller information and support routes are clear. | The customer cannot identify who is responsible or how to complain. |
| Evidence and enforcement readiness | Versioned screens, consent logs, seller disclosures and grievance records are retained. | No record exists of what a customer saw or how a complaint was handled. |
What should an e-commerce compliance review check?
Map every customer-facing flow
Review account creation, search, product pages, cart, checkout, payment, delivery tracking, returns, support, subscriptions and account deletion. Test logged-in and logged-out journeys, mobile and desktop layouts, regional variants and returning-customer flows. A dark pattern can appear only in one device layout or after a failed payment.
Test the data questions
- Is each requested field necessary for the stated transaction or optional purpose?
- Can a customer buy without accepting unrelated marketing or profiling?
- Does the notice explain use in language a customer can understand at the point of choice?
- Can consent be changed or withdrawn without searching through an obstructive maze?
- Do records show the exact notice and interface version presented?
Test the commercial choices
- Are optional products, donations and insurance unselected?
- Are fees and recurring charges visible before the customer commits?
- Are urgency claims factual and supported rather than invented countdowns?
- Are advertisements distinguishable from editorial or product information?
- Can a customer decline, cancel or continue without emotional pressure?
Check grievance handling
The E-Commerce Rules expect responsibilities and grievance redressal for marketplace and inventory models. Publish a usable contact route, assign ownership for each complaint type and measure response and closure. Preserve the original complaint, transaction record, interface evidence and final response so the business can explain what happened.
What is the standard for online consumer reviews?
The Bureau of Indian Standards (BIS) notified Online Consumer Reviews — Principles and Requirements for their Collection, Moderation and Publication on 23 November 2022. The standard is voluntary and applies to online platforms that publish consumer reviews. Its principles are integrity, accuracy, privacy, security, transparency, accessibility and responsiveness.

What did the 2026 CCPA enforcement show?
The 3 June 2026 release is a practical warning that interface design, pricing claims and data collection can be assessed together. The PhysicsWallah matter combined a preselected donation, emotional removal messaging and undisclosed personal-data conditions attached to “free” courses. The McAfee matter concerned a renewal choice whose wording and layout pressured acceptance. The announced penalties were ₹5 lakh and ₹1 lakh respectively.
These cases do not establish a universal penalty amount for every dark pattern. The appropriate exposure depends on the facts, the applicable instrument and the authority’s assessment. Businesses should not infer a fixed tariff from these two outcomes.
What should shoppers remember?
- Look for an unselected default on every optional paid service, donation and marketing choice.
- Read the total price, recurrence and cancellation terms before paying.
- Treat “free” claims cautiously when access is conditional on sharing a mobile number, email address or other data.
- Do not let guilt, fear or a countdown replace a clear explanation of the choice.
- Keep screenshots and receipts when a choice, charge or cancellation path appears misleading.
For businesses, the practical standard is straightforward: collect only what is justified, obtain a clear affirmative action, show the full commercial consequence before commitment, present decline neutrally and preserve evidence that the flow worked that way.
