21 November 2026 is not a general income-tax-return deadline. The Central Board of Direct Taxes (CBDT) moved the assessment year (AY) 2026-27 return-filing date from 31 October to 21 November 2026 only for persons covered by Serial No. 2 in the table under Explanation 2 to section 139(1) of the Income-tax Act, 1961—the category linked to tax-audit cases. For those taxpayers, the related tax-audit report date moved from 30 September to 21 October 2026. Salaried taxpayers and other people outside that statutory category do not receive this extension automatically.
What exactly did the CBDT change?
In a Ministry of Finance press release dated 28 September 2026, the CBDT said it had “extended the aforesaid due date of furnishing of Return of Income from 31st October, 2026 to 21st November, 2026.” The change applies to AY 2026-27 and only to the specified audit-related class in section 139(1).

| Compliance item | Original date | Revised date | Who it concerns |
|---|---|---|---|
| Tax-audit report | 30 September 2026 | 21 October 2026 | Taxpayers whose accounts or activity require the relevant audit |
| Income-tax return | 31 October 2026 | 21 November 2026 | Persons in Serial No. 2 under Explanation 2 to section 139(1) |
The revised dates are connected: the audit report must be completed first, followed by the return for the covered category. The notification does not create a new November deadline for every type of ITR.
Who can use the 21 November 2026 deadline?
The legal test is whether you are a person referred to at Serial No. 2 in the table below Explanation 2 to section 139(1). In practical terms, this generally means your accounts, business or profession falls under a tax-audit requirement.

Businesses and professionals subject to audit
The category can include proprietors and other taxpayers with audited business income, professionals whose accounts require audit, and companies, firms, limited liability partnerships (LLPs) or other entities covered by the applicable audit provisions. The entity’s legal form is not decisive by itself; the underlying audit obligation is.
Taxpayers affected by presumptive-tax choices
The provision can also become relevant when a taxpayer exits a presumptive-taxation scheme or does not meet its conditions. The current explanation specifically discusses sections 44AD, 44ADA, 44AE, 44BB and 44BBB, including cases where income is declared below the prescribed level, provided the statutory conditions for audit are met.
Thresholds reported for 2026
A 2026 explainer published by Mint reports a business audit threshold of ₹1 crore. It says the threshold can rise to ₹10 crore when both cash receipts and cash payments are each below 5% of the relevant totals, subject to the conditions in the law. The same explainer reports a ₹50 lakh gross-receipts threshold for specified professionals. These figures are not a substitute for checking the exact section, exceptions and facts that apply to your accounts.

Does the extension apply to salaried taxpayers?
Not merely because you earn a salary. A person with only salary income is generally outside the audit-linked class described in the CBDT release. A salaried individual who also runs a business or profession could fall within the extended category only if that activity creates a statutory tax-audit obligation.
Check the return category shown in your filing records, the nature of any business or professional receipts, and whether an auditor is required to furnish a report. Do not use 21 November simply because you have multiple sources of income.
When is the tax-audit report due?
For the taxpayers covered by the extension, the specified date for the relevant tax-audit report is 21 October 2026, replacing 30 September. The report date is separate from the ITR date: a taxpayer can have the later 21 November return deadline but still need the audit report completed by 21 October.

- Submit the return by 21 November 2026 and retain the acknowledgement and audit records.
If your accounts are not audited, this two-date timetable does not automatically apply. Use the deadline for your own return type and circumstances instead.
What if an eligible filer misses 21 November?
A missed deadline does not necessarily end the filing opportunity. The 2026 explanation reports that a belated AY 2026-27 return may be filed under section 139(4) by 31 December 2026, or until assessment is completed, whichever is earlier.
The same explanation reports a section 234F late fee of ₹1,000 where total income does not exceed ₹5 lakh and ₹5,000 where total income is higher. Other consequences can depend on the return, tax payable and the taxpayer’s facts, so calculate the liability before submitting a belated return.

What happens if the audit report is late?
Missing the 21 October audit-report date creates a separate exposure from filing the ITR late. The current explanation reports a penalty under the audit provisions of 0.5% of sales, turnover or gross receipts, capped at ₹1.5 lakh, whichever is lower. Whether a statutory reasonable-cause exception or another relief applies must be assessed against the taxpayer’s circumstances and the latest official instructions.

| Your situation | Relevant date to check | Practical action |
|---|---|---|
| Business or profession requiring tax audit | 21 October report; 21 November return | Coordinate with the auditor and file the audited return within the revised window |
| Business or profession not requiring audit | Deadline for your applicable non-audit return category | Do not assume the November extension applies |
| Salary income only | Deadline for the applicable salary-return category | Use the date notified for that category |
| Audit-case filer who misses 21 November | 31 December 2026 or assessment completion, whichever is earlier | File belatedly and account for the reported section 234F fee |
Keep the audit requirement, report completion, return type and filing status as four separate checks. This prevents the common mistake of treating a targeted extension as a universal one.

Frequently Asked Questions
Can a person with freelance income use the 21 November date?
Only if the freelance or professional activity is one for which a tax audit is legally required and the taxpayer falls in the specified section 139(1) category. The label “freelancer” by itself does not establish eligibility.
Is the 21 October date the ITR filing deadline?
No. It is the revised specified date for furnishing the related tax-audit report. The return deadline for the covered audit cases is one month later, on 21 November 2026.
Where can I confirm whether my return is an audit case?
Ask the tax professional or auditor preparing the return to identify the exact section that triggers the audit and the corresponding Serial No. 2 category under Explanation 2 to section 139(1). Compare that determination with the latest CBDT notification and filing instructions for AY 2026-27.
