Income tax reassessment under Section 148: notices, timelines, and taxpayer rights

A section 148 notice requires you to file a return for a reassessment of escaped income. Under the Income-tax Act, 1961, it is generally preceded by a section 148A show-cause notice, but statutory exceptions exist. Your first tasks are to identify the assessment year, determine which Act governs, check the limitation period and ₹50 lakh condition, and meet the notice’s stated deadline while preserving your objections.

What a Section 148 notice does

A notice under section 148 of the Income-tax Act, 1961 starts the formal reassessment stage. It tells the taxpayer to furnish a return for the relevant assessment year because the Assessing Officer proposes to assess income that may have escaped assessment.

The notice is not the final tax demand. It begins a proceeding in which the Assessing Officer can examine the escaped-income issue, consider the taxpayer’s return and explanations, and make a reassessment order. The notice should be read with the order passed under section 148A(3), which must accompany it under the amended section 148 text published by the Income Tax Department.

For years governed by the 1961 Act, the ordinary sequence is a section 148A show-cause process followed, if the case is found fit, by section 148. The Act contains exceptions to that pre-notice process. Therefore, a taxpayer should not assume that every legally issued section 148 notice must have a preceding 148A notice without checking the statutory exception and the facts.

Section 148A and Section 148: two different stages

Section 148A show-cause notice

Section 148A is the pre-notice safeguard in the ordinary 1961 Act process. The Assessing Officer sends information suggesting that income has escaped assessment and gives the taxpayer an opportunity to respond. The taxpayer is entitled to receive the information relied on, subject to the statute and the way the material is supplied, and to submit a reply within the period specified.

After considering the material and the reply, if any, the Assessing Officer must decide whether the case is fit for issuing section 148 notice. The decision requires prior approval from the specified authority. The statutory text states:

“The Assessing Officer shall, on the basis of material available on record and taking into account the reply of the assessee furnished under sub-section (2), if any, pass an order with the prior approval of the specified authority determining whether or not it is a fit case to issue notice under section 148.”

This order is not the reassessment itself. It is the decision that permits the next stage, where the taxpayer is required to file a return.

Section 148 notice

The section 148 notice requires the taxpayer to furnish a return for the specified assessment year. It must be accompanied by the section 148A(3) order when that order is required in the applicable proceeding. The notice should state the period allowed for filing the return and identify the relevant year and statutory provision.

Filing the return does not prevent you from disputing jurisdiction, limitation, service, approval, the information relied on or other defects. Those objections should be raised in the manner and at the stage advised for the particular proceeding, while also complying with any valid filing requirement.

How the limitation periods work

The limitation clock is calculated from the end of the relevant assessment year, not from the date you discovered a possible error or from the date the Department obtained information. The Finance (No. 2) Act, 2024 substituted section 149 with effect from 1 September 2024. The official 1961 Act text as amended by Finance Act 2025 sets the following ordinary framework, subject to statutory exclusions, extensions, special cases and transitional rules.

Proceeding Ordinary window Extended window and condition
Section 148A show-cause notice Up to three years from the end of the relevant assessment year Up to five years where, according to the information with the Assessing Officer, escaped income is or is likely to be ₹50 lakh or more
Section 148 notice No notice after three years and three months from the end of the relevant assessment year Between three years and three months and five years and three months only when the statutory ₹50 lakh condition and the required evidentiary conditions are met

The extended section 148 window is not an automatic five-year power. In the period beyond three years and three months, the Assessing Officer must have books of account, documents or other evidence relating to an asset, expenditure, transaction or entries showing escaped income of, or likely to be, at least ₹50 lakh. The section 148A extension likewise turns on the statutory ₹50 lakh test applied to the information available at that stage.

₹50 lakh is a statutory threshold enacted by Parliament in the Finance (No. 2) Act, 2024; it is not a survey estimate or a general tolerance amount. Whether the threshold is met, and whether the evidence is of the type required by section 149, is case-specific.

Illustrative calculation

If an assessment year ended on 31 March 2024, three years and three months would ordinarily expire on 30 June 2027, while five years and three months would expire on 30 June 2029. This example illustrates the calendar method only. The actual result can change because of the applicable version of the Act, exclusion periods, special statutory rules, court directions or transitional provisions.

The deadline written in a Section 148 notice

Section 148 requires the notice to specify the period for furnishing the return. Under the amended provision, that period cannot exceed three months from the end of the month in which the notice is issued, and the provision also supplies a minimum period of 30 days. The notice itself controls the date you must work to, so do not calculate a date from memory or assume that every notice allows the same number of days.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Check whether the stated date is calculated from issue, service or another event, and preserve proof of when and how the notice was served. If the notice appears to give less than the statutory minimum, obtain prompt advice rather than simply ignoring it. A defective deadline does not necessarily make every later proceeding void, and the appropriate response depends on the facts and available remedy.

Which Act applies after 1 April 2026?

The Income Tax Department’s “Reassessment Proceedings FAQs” describe the transition to the Income Tax Act, 2025. The new Act’s reassessment provisions apply to Tax Year 2026–27 and later tax years—those beginning on or after 1 April 2026. Proceedings for an earlier year generally continue under the Income-tax Act, 1961.

Situation Likely governing framework What to verify
Tax year beginning on or after 1 April 2026 Income Tax Act, 2025 reassessment provisions The tax year, commencement provisions and the text in force for the notice date
Tax year beginning before 1 April 2026 Generally the Income-tax Act, 1961 The old Act’s limitation, approval, service and procedural requirements
Proceeding pending on 1 April 2026 Department guidance says it continues under the old Act What “pending” meant on that date and the exact procedural stage
Old-year proceeding initiated after 1 April 2026 Department guidance says the old Act may still govern The old Act’s conditions, section 149 limitation and any transition rule

The Department gives the example of a section 148A show-cause notice issued under the old Act before commencement, followed by the 148A order and section 148 notice after commencement. On that guidance, the later steps can remain under the old Act, subject to section 149. This is why the assessment year and procedural history matter more than the date printed at the top of a later communication.

Do not assume that receiving a notice after 1 April 2026 means the 2025 Act applies. Identify the tax or assessment year, determine whether a proceeding was already pending, and compare the notice with the transition provisions and the Department’s current guidance.

Your rights during the 148A stage

  • Notice of the information: The show-cause process should identify the information suggesting escaped income so you can answer the actual allegation.
  • Opportunity to be heard: You may submit a response within the time stated. Explain each item, attach supporting evidence and identify inaccuracies in the information.
  • Consideration of your reply: The Assessing Officer must take the reply, if any, into account before deciding whether the case is fit for section 148.
  • Reasoned procedural decision: The fit-case order under section 148A(3), passed with prior approval, is the document that explains why the matter proceeds to section 148.
  • Correct statutory framework: The assessment year, applicable Act, limitation provision and approval hierarchy should match the proceeding.

These rights do not guarantee that the Department will accept your explanation. They ensure that the pre-notice decision is made after the required opportunity and consideration. Keep the filed reply, attachments, acknowledgement and any technical submission showing the date and mode of delivery.

What you can examine or challenge

A challenge is not automatic merely because you disagree with the proposed addition. The available objection, writ, appeal or other remedy depends on the notice, the procedural stage and the evidence. The following are issues to examine with case-specific advice:

Limitation

Recalculate from the end of the relevant assessment year. Check whether the Department is relying on the ordinary period or the extended period, and whether the record identifies the evidence and ₹50 lakh condition required for the longer window.

Applicable Act and transition

For an earlier year, test whether the old Act continues to govern despite a post-1 April 2026 notice. A mismatch between the year, the transition rule and the section cited can be significant, but its legal effect requires analysis of the complete record.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Section 148A procedure

Check whether the information was supplied, whether you received a genuine chance to respond, whether your reply was considered and whether the 148A(3) order explains the fit-case decision. A bare disagreement with the conclusion is different from a failure to follow a mandatory procedural step.

Contents and documents

Confirm that the section 148 notice includes the required 148A(3) order where applicable, identifies the assessment year and provides a workable return deadline. Keep copies of every page and attachment; missing pages can affect how the response should be framed.

Approval and authority

Section 151 identifies the specified authority for sections 148 and 148A as the Additional Commissioner, Additional Director, Joint Commissioner or Joint Director, as applicable. The correct level can depend on the statutory version and the year. Do not assert that approval was absent or defective without examining the approval record.

Service and identification

Verify the date and mode of service, the statutory section and the Document Identification Number (DIN). These checks help establish the procedural history and preserve objections; they are not, by themselves, a conclusion that the notice is invalid.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What to do when you receive a notice

  1. Record the basics immediately. Note the assessment year or tax year, issue date, service date, DIN, section cited, issuing office and deadline.
  2. Determine the governing Act. Ask whether the year began before or after 1 April 2026 and whether any reassessment step was pending on 1 April 2026.
  3. Collect the complete communication. Download the notice, the section 148A(3) order, annexures, information relied on and any portal acknowledgement. Do not rely on a screenshot that omits attachments.
  4. Map the limitation dates. Calculate three years, three years and three months, five years and five years and three months from the end of the relevant assessment year, then test the statutory ₹50 lakh and evidence conditions where the Department uses the extended period.
  5. Reconstruct the original filing. Gather the return, computation, financial statements, tax audit material if applicable, challans, source documents, correspondence and earlier assessment or appeal orders.
  6. Prepare the procedural response. Address the information item by item. State where the original return already disclosed the item, attach proof and identify factual or legal errors. If the response is to a 148A notice, meet that notice’s deadline.
  7. Deal with the section 148 return requirement. If a 148 notice is issued, file the required return by the stated date or obtain advice on a protective response. Filing and jurisdictional objections may need to be handled together.
  8. Preserve delivery evidence. Save acknowledgements, portal submission numbers, emails, courier records and a final copy of the exact response submitted.
  9. Escalate promptly when needed. Limitation, service, approval, search-related exceptions, exclusions from time and judicial directions can alter the result. A tax professional or lawyer should review a live dispute before a critical deadline passes.

Common mistakes and how to avoid them

  • Using the notice date as the limitation starting point: Start with the end of the relevant assessment year.
  • Assuming five years is always available: The extended window needs the statutory ₹50 lakh condition and specified evidence.
  • Treating a post-April 2026 notice as a new-Act notice: Earlier years and pending proceedings can remain under the 1961 Act.
  • Ignoring the 148A stage: A detailed response can correct the information before a section 148 notice is issued.
  • Sending unsupported assertions: Link each factual statement to a return schedule, ledger, bank record, contract or other reliable document.
  • Missing the return deadline while researching objections: The notice deadline and the legal challenge are separate tasks; handle both with advice suited to the case.
  • Assuming a technical defect has one automatic outcome: Courts may apply different rules depending on the defect, prejudice, statutory language and procedural history.

When professional review is especially important

Obtain case-specific advice where the notice concerns an old assessment year, invokes the extended period, relies on a search or other statutory exception, follows a prior assessment or appeal, or arrives during the 2026 transition. Review is also prudent when the information is incomplete, the 148A order does not address your reply, the stated deadline appears inconsistent with section 148, or the approval and service record is unclear.

The Income Tax Department’s published texts and FAQs explain the statutory framework, but they do not decide whether a particular notice survives limitation, transition, approval, service or judicial review. Those questions turn on the complete file and the law applicable to that taxpayer and year.

Practical decision table

What you see Immediate question Action
148A show-cause notice What information suggests escaped income, and when is the reply due? Obtain the material, calculate limitation and submit a documented reply.
148 notice with 148A(3) order Is the order attached, and is the return deadline within the statutory range? File or arrange the required return while preserving jurisdictional objections.
Notice for a pre-1 April 2026 year received after that date Was the proceeding pending, and which Act does the transition guidance preserve? Apply the 1961 Act framework unless the statute and timeline establish otherwise.
Extended limitation invoked Does the record show the ₹50 lakh threshold and required asset, expenditure, transaction or entries evidence? Challenge the calculation or evidentiary basis if the facts do not support it.
