Short answer: an income-tax reassessment notice is a formal communication that starts or advances a procedural step, while a reassessment order records an Assessing Officer’s decision. The exact effect depends on the provision cited, the tax year and whether the proceeding is under the Income Tax Act, 1961 or the Income Tax Act, 2025.
Under the Income Tax Department’s ordinary process for the 2025 Act, a show-cause notice and your response come first, followed by a reasoned preliminary order deciding whether reassessment is fit. If the officer proceeds, a reopening notice is issued, and a later reassessment order records the result. A preliminary order is not automatically the final tax outcome.

Notice and order: the practical difference
A notice tells you that the tax authority is taking, or requires you to take, a specified procedural step. It may ask for an explanation, require a return, request information or formally reopen an assessment. A notice is therefore an official communication, not necessarily a decision that additional tax is payable.

Some orders are preliminary—for example, an order deciding whether a case is fit for reassessment—while a later reassessment order records the outcome after the reassessment proceedings.

Do not classify a document only by the word in its heading. Read the cited section, tax year, date, Document Identification Number (DIN), response instruction and attachments together. The same taxpayer may receive several notices and orders in one case, each with a different legal function.
| Point of comparison | Reassessment notice | Reassessment order |
|---|---|---|
| Purpose | Communicates or advances a required procedural step, such as explaining information or filing a return. | Records the officer’s decision at a defined stage, either on whether to proceed or on the reassessment result. |
| Typical stage | Before a decision, or when a decision authorises the next statutory stage. | After considering the material relevant to that stage. |
| What you may need to do | Respond by the stated date, provide information, or file a return, depending on the section. | Read the findings and operative directions; a response or challenge may be available under the applicable law. |
| Does it itself decide the reassessment? | Usually no. A reopening notice allows the reassessment process to continue; it is not the final computation. | It records a decision, but a preliminary order is not necessarily the final assessment of tax. |
| Provision | Varies. Under the 2025 Act, the ordinary route includes section 281(1) and section 280; older cases commonly involve sections 148A and 148 of the 1961 Act. | Varies. Under the 2025 Act, section 281(3) is the preliminary fit-for-reassessment order; a later reassessment order records the completed reassessment. |
| Governing law | The tax year and transition rules determine whether the 1961 Act or 2025 Act applies. An issue date after 1 April 2026 alone does not decide this. | |
Which Act applies to your tax year?
The Income Tax Department says the reassessment provisions in the Income Tax Act, 2025 (sections 279–286) apply to Tax Year 2026–27 and later. Reassessment for a tax year beginning before 1 April 2026 remains under the Income Tax Act, 1961. The Department also says pending proceedings at commencement, and specified proceedings begun after commencement concerning pre-April 2026 tax years, continue under the 1961 Act. See the Department’s reassessment proceedings FAQs.
Consequently, a communication issued after 1 April 2026 can still cite the 1961 Act. For example, the Department says a proceeding started under old sections 147 and 148 for an earlier assessment year may continue under that Act even when a later procedural step or the assessment order occurs after 1 April 2026. It also describes an old-Act section 148A(1) show-cause notice issued before that date being followed by a section 148A(3) order and section 148 notice after that date, subject to the applicable limitation period.

- Find the tax year or assessment year stated in the communication and the return involved.
- Read the section number and Act named in the heading and body.
- Check whether the document refers to a proceeding already pending when the new Act commenced.
- Apply the transition rule for that specific proceeding; do not infer the answer from the document’s issue date alone.
Detailed limitation rules, exceptions and the validity of a particular proceeding depend on the facts and the law applicable to that year. A generic article cannot calculate your personal deadline or decide whether a notice is legally sustainable.
The ordinary reassessment sequence under the Income Tax Act, 2025
The Department describes the following route for the 2025 Act. It uses “generally” because the statute and the Department’s FAQ identify exceptions in which the preliminary section 281 process may be skipped.

1. Information suggesting escaped income
The Assessing Officer must have information suggesting that income escaped assessment. The Department’s examples include risk-management information, audit objections, specified information received through arrangements with foreign governments, information from specified schemes, findings from a court or tribunal, and survey information. The existence of information starts the statutory analysis; it does not by itself establish that extra tax is payable.
2. Show-cause notice under section 281(1)
In the ordinary procedure, the officer issues a show-cause notice under section 281(1). It should set out the information relied on and give you an opportunity to respond. This is a notice, not the final reassessment order. Your response should address the information and the relevant facts for the tax year, and should be filed through the channel and by the date specified in the communication.
3. Reasoned order under section 281(3)
After considering the reply, and obtaining prior approval from the specified authority described by the Department, the officer passes a reasoned order under section 281(3) deciding whether the case is fit for reassessment. This is an order because it records a decision, but it is a decision in the preliminary process. It is distinct from both the later reopening notice and the eventual reassessment order.
4. Reopening notice under section 280
If the decision is to proceed, the officer issues a notice under section 280. The Department describes section 280 as corresponding to section 148 of the 1961 Act. Its FAQ states that reassessment or recomputation under section 279 cannot be made without a section 280 notice. A section 280 notice therefore advances the case into the reassessment stage; it does not itself state the final amount of tax after the officer examines your return and evidence.
5. Reassessment and final order
The officer then conducts the reassessment, considering the return, submissions, records and any further statutory notices. The reassessment order records the outcome—such as the income determined and the resulting tax, interest or other directions under the applicable provisions. The Department describes a general completion limit of one year from the end of the financial year in which the section 280 notice was served, subject to extensions and exclusions. Do not use that general statement to calculate your own deadline without checking the current law and the dates in your case.

Exceptions to the preliminary route
The Department’s FAQ identifies circumstances in which the section 281 show-cause-and-order process may be skipped. These include specified information from a faceless collection scheme, certain directions of an Approving Panel, and findings or directions in specified orders of an authority, tribunal or court. The Department says approval remains mandatory before issuing the section 280 notice. The ordinary sequence is therefore a useful reading guide, not an exception-free checklist.

How older proceedings under the 1961 Act are usually labelled
For older tax years and proceedings governed by the Income Tax Act, 1961, the familiar pre-notice provision is section 148A. Where applicable, the officer may issue a section 148A(1) show-cause notice, consider the taxpayer’s reply and pass a section 148A(3) order. A section 148 notice then requires the taxpayer to furnish a return for the relevant assessment year. The Department’s FAQ expressly treats new section 280 as corresponding to old section 148 and confirms that pending pre-commencement matters can continue under the 1961 Act.
The old Act’s conditions, limitation periods and exceptions are fact-specific. A section 148A(3) order is a decision at the pre-notice stage; it should not be described as the final reassessment order. The final outcome comes only after the reassessment proceedings required for that case are completed.
What to do when a notice or order arrives
Step 1: Preserve the complete communication
Download the PDF and every attachment from the e-Filing portal, and retain the email or portal notification showing when it was made available. Do not rely on a screenshot of only the first page. The cited section, annexures and computation may be on later pages.
Step 2: Record the identity details
- Tax year or assessment year.
- Date of issue and date of service or portal availability.
- DIN and the issuing office or Assessing Officer.
- Section cited, including any sub-section.
- Response method and exact response deadline.
- Documents or information requested.
Step 3: Determine whether it is a notice or an order
Look for the operative language. “Show cause,” “furnish a return,” “explain,” or “submit information” generally signals a notice requiring action. “It is hereby decided,” “fit for reassessment,” findings, reasons and directions generally signal an order. The section number controls if the heading is unclear: for example, section 281(3) is the preliminary decision, while section 280 is the reopening notice under the 2025 Act.

Step 4: Authenticate the DIN
The Department says communications issued on or after 1 October 2019 should bear a unique DIN and provides an online service to authenticate a notice, order or other communication. Use the Department’s Authenticate the Notice/Order issued by ITD service. The Department’s guidance says a communication without a DIN would be treated as invalid. Authentication does not replace professional review of the merits, limitation or response strategy.
Step 5: Meet the stated deadline without guessing
Follow the deadline and submission route printed in the document. If the time appears inconsistent, the portal does not accept the response, or the notice is incomplete, preserve evidence of the problem and obtain qualified tax advice promptly. Do not substitute the general completion limit for the response deadline in your notice: they are different dates serving different purposes.
Step 6: Build a year-specific evidence file
Collect the filed return, computation, books or statements relevant to the issue, earlier correspondence, proof of disclosure and the source documents requested. Prepare a point-by-point response that identifies the document relied on for each factual statement. Keep a copy of the submitted response and acknowledgement.

Mistaking a preliminary order for the final tax demand
A section 281(3) order under the 2025 Act decides whether the case is fit for reassessment. It is not the later order determining the reassessed income. Read the operative paragraph and identify what stage remains.
Assuming a post-2026 document must use the 2025 Act
The relevant tax year and transition rule govern. A later-issued document can continue an old-Act proceeding for an earlier year. Check the year, section and procedural history before relying on a new-Act explanation.

Treating every “notice” as a final demand
A show-cause or reopening notice normally creates an opportunity or requirement to participate. It is not the same as an order that computes the reassessed liability. The consequences of ignoring a notice can still be serious, so distinguish the document’s role without ignoring it.
Replying to an unauthenticated message or link
Verify the DIN and document through the Department’s service, then access the portal directly rather than relying on an unfamiliar link in an email. Preserve the original communication while verification is pending.
Using a generic deadline
Response periods, statutory limitation and completion periods are separate. Extensions, exclusions and transition provisions can change the calculation. Use the dates and provisions in the actual communication and seek advice for a disputed or urgent deadline.
A quick decision framework
- Is the document asking for an explanation, return or information? Treat it as a notice requiring a response unless the cited provision says otherwise.
- Does it state that the officer has decided the case is fit for reassessment? It may be a preliminary order, such as section 281(3), not the final reassessment result.
- Does it cite section 280 or old section 148 and require a return? It is the reopening stage; the reassessment still has to be completed.
- Does it contain the final determination and computation? It is likely the reassessment order, but verify the cited provision and appeal or correction options for that year.
- Is the year before Tax Year 2026–27? Check whether the 1961 Act and its transition rules govern, even if the document was issued after 1 April 2026.
- Is the DIN missing or authentication failing? Preserve the document and obtain qualified advice; do not assume that a message is genuine or that it can safely be ignored.
What the distinction means for your next move
The word “notice” tells you that the Department has communicated a procedural requirement; it does not tell you the eventual tax result. The word “order” tells you that a decision has been recorded; it does not tell you whether the decision is preliminary or final. The provision, tax year and stage answer those questions.
For the 2025 Act’s ordinary route, the sequence to keep in mind is: information suggesting escaped income, section 281(1) show-cause notice, reply, section 281(3) reasoned fit-for-reassessment order, section 280 reopening notice, reassessment proceedings and the final reassessment order. The Department’s stated exceptions and the 1961 Act’s transition rules mean that your document may not follow every step in that order.
