A final levy or lien notice generally offers a 30-day Collection Due Process (CDP) hearing request; a notice of deficiency generally gives 90 days to petition Tax Court (150 days in specified cases for people outside the United States). Ignoring a notice can forfeit those rights and allow the IRS to move to collection, but a threatening letter does not always authorize immediate seizure.
This guide covers federal IRS notices. State and foreign tax agencies use different procedures. Start by verifying that the letter is genuine, identifying its notice or letter number, reading the response date, and following the address and instructions printed on it.

What should you do first when an IRS notice arrives?
- Verify the sender. Use the IRS notice information and contact details printed in the letter. Do not rely on an unexpected telephone number, payment link, or email supplied by a third party.
- Find the notice or letter number. It usually appears in the upper-right corner, such as LT11, Letter 1058, CP504, CP169, CP3219N, Letter 531, or Letter 950. That identifier determines the available response and appeal path.
- Record the notice date and response date. Legal periods are measured from the date on the notice, not from the day you happen to open it. Keep the envelope and a complete copy.
- Classify the issue. The letter may propose an examination adjustment, assert a deficiency, demand a missing return, or warn of collection. Those categories have different rights.
- Respond even if you cannot pay. The Taxpayer Advocate Service says, “First and foremost, don’t ignore notices from the IRS.” A timely disagreement, payment arrangement request, or request for help can preserve options that disappear if the letter is left unanswered.
Keep your mailing address current with the IRS so future notices reach you. If the amount, tax year, or return described is not yours, say so promptly and retain proof of identity and filing.
Can you appeal an income tax notice?
Often, but “appeal” can mean three different things: an administrative protest to IRS Appeals, a CDP hearing about collection, or a petition to the U.S. Tax Court. The table shows the main federal paths covered here. The actual notice and current IRS instructions control if they differ.

| Notice or situation | Primary response | Deadline stated in IRS guidance | Payment before dispute? | What the request does |
|---|---|---|---|---|
| Unagreed examination or proposed adjustment (for example, Letter 525 or Letter 950) | Send the protest and information required by the letter to request IRS Appeals consideration. | Generally 30 days from the date on the letter; use the date and instructions on your notice. | Usually no payment is required to protest the proposed adjustment. | Moves the unagreed examination issue to an administrative appeal; it is not a Tax Court case. |
| Notice of deficiency (for example, Letter 531 or CP3219N) | File a petition with the U.S. Tax Court. | Generally 90 days from the notice date; CP3219N guidance states 150 days for a person outside the United States. | No payment is required before filing the petition. | Preserves a judicial challenge to the proposed deficiency. Missing the statutory period can leave payment-and-refund procedures as the practical route. |
| Final intent-to-levy and right-to-a-hearing notice (for example, LT11, Letter 1058, or a qualifying CP90) | Complete Form 12153, Request for a Collection Due Process or Equivalent Hearing, and send it to the address on the notice. | Generally 30 days from the notice date for a CDP hearing. | No full payment is required to request the hearing; propose a collection alternative or raise an allowed issue. | A timely CDP request generally suspends levy action for the appealed periods and permits judicial review of the Appeals determination. |
| Notice of Federal Tax Lien filing (for example, Letter 3172) | Request a CDP hearing on Form 12153 using the notice’s address. | Generally 30 days from the notice date. | No full payment is required to request the hearing. | Lets you challenge the lien action and raise eligible collection issues. Whether you may dispute the underlying tax depends on whether you previously had an opportunity to do so. |
| CP504 balance-due warning | Contact the IRS, resolve the balance or arrange payment, and watch for a later formal levy notice. | Use the response date printed on CP504; it is not itself the final CDP levy notice. | Not applicable to a CDP request on this letter alone. | CP504 warns of escalation. The IRS CDP FAQ says, “The IRS cannot levy with just this notice.” A formal Notice of Intent to Levy and Right to a Hearing must issue first. |
| CP169 missing-return notice | Send the requested signed return and any information the notice asks for. | By the due date printed on CP169. | Filing the return and paying any balance are separate tasks. | If you do not respond, the IRS may treat the return as delinquent and begin collection enforcement to secure it. |

How do you request a Collection Due Process hearing?
A CDP hearing is the principal appeal route when the IRS is taking, or formally proposes, collection action through a levy or lien. It is not a general appeal of every IRS decision.
Step 1: Confirm that your letter grants CDP rights
Look for language such as “Final Notice—Notice of Intent to Levy and Notice of Your Right to a Hearing” on an LT11 or Letter 1058, or the comparable language on a qualifying CP90. A lien-filing letter such as Letter 3172 can also provide CDP rights. A CP504 by itself does not.
Step 2: Complete Form 12153
Identify each tax period you want reviewed, explain why you disagree with the proposed collection action, and choose the collection issue you want to discuss. Possible issues can include an installment agreement, an offer in compromise when eligible, innocent-spouse relief, or a claim that the tax was already paid. Follow the form’s current instructions rather than sending it to a generic IRS address.
Step 3: Mail or otherwise submit it as the notice directs
Use the address printed on your notice and retain proof of timely delivery. The IRS Appeals page on Collection due process (CDP) FAQs explains the submission and hearing process.

Step 4: Prepare for Appeals
Gather filed returns, account transcripts, payment records, income and expense information, and documents supporting any factual disagreement. Be specific about the result you want. A collection hearing is not improved by sending every financial document you possess without explaining its relevance.
What a timely CDP request protects
For the tax periods covered by a timely request, levy action is generally suspended while the hearing and any permitted judicial review proceed. The IRS can still take other steps allowed by law, and interest and penalties generally continue unless a separate rule applies. The hearing determination can be reviewed in Tax Court or another appropriate federal court when the law provides that jurisdiction.
What is different about a notice of deficiency?
A notice of deficiency is a statutory notice proposing additional tax. It is not the same as a collection letter. A recipient generally may petition the U.S. Tax Court without paying the proposed amount first. The petition must reach the court within the period printed on the notice: IRS guidance for CP3219N describes 90 days for ordinary recipients and 150 days for people outside the United States. Weekends, holidays, mailing rules, and the taxpayer’s location can affect filing mechanics, so read the notice carefully.
Do not substitute an IRS Appeals protest for a Tax Court petition when the notice gives a deficiency deadline. If you want both administrative discussion and judicial protection, obtain advice quickly about which action preserves jurisdiction. The IRS explanation is available at Understanding your CP3219N notice.
How does an examination or proposed-adjustment appeal work?
Letters 525 and 950 generally give an unagreed examination case a 30-day protest opportunity. The letter specifies what to include, which years and issues are covered, and where to send the protest. A useful protest normally identifies each disputed adjustment, states the factual and legal basis for disagreement, and attaches documents that support the position.

Send the protest before the stated date and keep delivery evidence. If you agree with some items but not others, identify the agreed portions and pay what you can; partial agreement can narrow the Appeals discussion. This administrative route is separate from the Tax Court deadline on a later notice of deficiency.

1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesWhat happens if you ignore an IRS notice?
The consequence depends on the letter’s stage. Ignoring a final levy notice can let the IRS proceed against wages, bank accounts, business or personal property, tax refunds, and certain benefits, subject to statutory exemptions and procedural requirements. IRS materials also describe filing a Notice of Federal Tax Lien. A lien is the government’s public claim against property; it can make borrowing, refinancing, or selling property more difficult and may affect credit decisions.
Ignoring a missing-return notice can lead the IRS to treat the return as delinquent and begin collection enforcement to obtain it. Ignoring a proposed adjustment can cause the IRS to assess the additional tax after the response period. Ignoring a deficiency notice can end the Tax Court petition opportunity. None of these outcomes is automatic on every letter, and a CP504 alone does not authorize a levy; the notice’s wording and procedural stage matter.
For details on the final levy stage, read Understanding your LT11 notice or letter 1058. Responding before the due date, even when full payment is impossible, gives the IRS a way to discuss an arrangement and gives you a record of cooperation.
Can the IRS levy me after a CP504?
Not with the CP504 alone. The IRS CDP FAQ expressly states that “The IRS cannot levy with just this notice.” Before a levy, the IRS must issue the formal Notice of Intent to Levy and Right to a Hearing, such as an LT11, Letter 1058, or qualifying CP90. That later notice starts the CDP period described in the table above.

CP504 is still a serious escalation signal. Check the balance, tax periods, and payment history; correct an IRS account error; and contact the IRS using the notice instructions about payment options. Waiting for the formal levy notice reduces the time available to prepare.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What if you missed the 30-day CDP deadline?
IRS Appeals says an equivalent hearing may still be requested within the period described in Form 12153. An equivalent hearing can address collection issues, but it does not provide Tax Court judicial review of Appeals’ decision. It is therefore not the same protection as a timely CDP request, and it is not a universal cure for a missed tax deadline.
Submit the request promptly, explain why it was late, and continue addressing the balance while the IRS considers it. If the notice involved a different deadline—such as a deficiency petition or an examination protest—use that notice’s specific rules instead of assuming the equivalent-hearing procedure applies.
What if you disagree with the amount or cannot pay?
If the amount is wrong
State exactly which tax year, income item, deduction, payment, or identity detail is incorrect. Attach a copy of the relevant return, information statement, canceled check, IRS transcript, or other proof. Keep originals and send copies by the method the notice allows.

If you agree but cannot pay in full
Respond by the due date and ask about payment options described in the notice. Depending on eligibility and the account, an installment agreement, an offer in compromise, or another collection alternative may be available. Approval is not automatic; provide complete financial information and continue making any required payments.

How should you handle a CP169 missing-return notice?
Locate the tax year and return requested, sign the return, and send it by the CP169 due date using the delivery method and address in the notice. Include an explanation and supporting documents if the return was already filed, was filed under a different account detail, or cannot be reconstructed immediately. Keep proof of filing.
Filing the return does not automatically eliminate tax, interest, or penalties. If a balance remains, address payment separately. If you do nothing, the IRS says it may consider the return delinquent and begin collection enforcement to secure it. Current notice instructions are on Understanding your CP169 notice, which reports an update dated February 27, 2026.
What mistakes can cost you your rights?
- Using the wrong deadline. A 30-day CDP period, a deficiency petition period, and an examination protest period are not interchangeable.
- Sending a response to a guessed address. Use the address or submission method printed on the specific notice.
- Calling without creating a record. Keep notes of dates, names, confirmation numbers, documents sent, and delivery receipts.
- Paying without identifying the dispute. Payment may resolve collection but does not by itself correct an erroneous return or preserve every appeal right.
- Assuming a threatening notice means immediate seizure. Confirm whether it is a CP504 warning or a formal final levy notice.
- Ignoring mail because you cannot pay. Inability to pay is a reason to request an option or assistance, not a reason to miss the response date.
A practical response checklist
- Scan or photocopy every page of the notice and envelope.
- Write down the notice number, tax year, notice date, response date, amount, and the action threatened.
- Compare the letter with the IRS notice page for that exact number.
- Decide whether you are disputing liability, requesting collection relief, filing the missing return, or acknowledging a balance.
- Prepare only the documents that prove your position or financial eligibility.
- Submit the response exactly as directed and preserve delivery evidence.
- Calendar follow-up dates and continue opening IRS mail while the issue is pending.
Official starting points include the IRS pages for appeal-eligible letters, Appeals requests, CDP questions, and the Taxpayer Advocate Service’s CDP guidance. Because IRS pages and forms can change, verify the current instructions on your actual notice before mailing anything.
