Income-Tax Jurisdiction vs Pecuniary Jurisdiction: What Each Means for Assessment Notices

Territorial jurisdiction asks whether the right income-tax officer or charge was assigned to you. Pecuniary jurisdiction asks whether that officer’s rank or class was authorized to handle the case under a monetary allocation applicable to the relevant period. They are different questions with different legal sources and potentially different objection procedures.

A notice is not automatically invalid because it came from an unfamiliar office, a different city, or an Income Tax Officer rather than an Assistant or Deputy Commissioner. Read the notice, identify the assessment year and statutory provision, verify the jurisdictional assignment and any monetary direction in force at that time, and then assess the available response within the applicable time limits.

What the two terms mean

Territorial or taxpayer jurisdiction

Territorial jurisdiction concerns the officer or charge assigned to a taxpayer by area and related taxpayer-allocation rules. Section 124 of the Income-tax Act, 1961 is headed “Jurisdiction of Assessing Officers.” Its framework links an Assessing Officer (AO) vested with jurisdiction over an area under directions or orders issued under section 120 to people carrying on business or a profession in that area. Where a business or profession is conducted in more than one place, the statutory text uses the principal place as the relevant connection. For other taxpayers, the connection is generally residence in the area.

That is an assignment question: which charge is responsible for this person or entity? It is not a calculation of the taxpayer’s income. An individual who moves, a company that changes its registered or principal business location, or a business operating from several places may therefore need to establish which facts controlled the assignment for the relevant period.

Section 124 also provides a process for disputes about whether an AO has jurisdiction to assess a person. The designated senior authority decides the issue, with escalation where the competing areas or senior authorities differ. The time and manner in which jurisdiction can be called into question depend on the subsection and the version of the law governing the notice. A generic deadline quoted without checking that version can be misleading.

Pecuniary or monetary jurisdiction

Pecuniary jurisdiction is about the monetary limits used to allocate work among officers of different ranks or classes. Such limits generally come from a Central Board of Direct Taxes (CBDT) instruction or another administrative direction, rather than from the taxpayer’s address alone. The direction may use returned income, taxpayer category, location, assessment year, or another classification to determine which rank can undertake particular assessment work.

A monetary limit is therefore instruction-specific and time-specific. The figure, officer categories, exceptions, effective date, and any later transfer or assignment direction must all be checked for the relevant assessment year and notice date. A historical limit cannot safely be presented as a current nationwide rule.

Side-by-side comparison

Axis Territorial or taxpayer jurisdiction Pecuniary jurisdiction
Core question Which officer or area is assigned to this taxpayer or case? Which officer rank may handle the case under the applicable monetary allocation?
Typical source Statutory territorial provisions and section 120 directions or orders, with section 124 governing AO-jurisdiction disputes CBDT or delegated administrative directions allocating work by monetary limit and taxpayer or case category
Facts to verify Residence, principal place of business, other business locations, JAO details, and transfer or assignment records Assessment year, returned-income category, officer rank, effective instruction, taxpayer type, and any later adjustment
How a notice issue appears The issuing officer may not have the relevant area or taxpayer assignment, or an objection may have been raised under the wrong procedure The issuing officer may not have been authorized for the monetary category under the direction in force at that time
Main caution Section 124’s objection rules and timing are version- and fact-dependent Old limits and isolated tribunal rulings do not establish a current universal threshold or result

Why the distinction matters when you receive a notice

Both concepts can affect who is authorized to act, but they do not merge into one test. A wrong area or taxpayer assignment raises a territorial issue. An officer who may be below or outside a monetary allocation raises a pecuniary issue. The statutory provision cited in the notice, the assessment year, the officer’s designation, and the directions in force at the time determine how the issue should be analyzed.

A notice can contain more than one procedural question. For example, the named officer might be connected to the correct charge but still be the wrong rank under a monetary allocation. Conversely, an officer with the correct rank may be assigned to the wrong taxpayer or area. Office location, the name displayed in the e-filing account, and a later change of officer are clues, not conclusive proof that the notice is valid or invalid.

How to check the jurisdiction shown for you

The Income Tax Department’s e-filing service provides a Jurisdictional Assessing Officer (JAO) lookup. The displayed information is intended to identify the charge responsible for the taxpayer and can include:

  • area code;
  • AO type;
  • range code;
  • AO number;
  • jurisdiction description;
  • office address; and
  • official email address.

Use the lookup as a starting point, then compare it with the notice and your facts. A JAO listing can change after a transfer, restructuring, or new assignment. It does not by itself answer whether a particular officer had authority for an earlier notice, nor does it establish the monetary limit applicable to that officer.

What to extract from the notice before objecting

Create a contemporaneous record of the document rather than relying on the portal’s current display. Record the following items:

  1. Issuing authority: copy the officer’s name, designation, ward or circle, digital signature details, and office address.
  2. Statutory provision: note whether the notice invokes section 143(2), a reassessment provision, a request for information, or another section. Different provisions can have different authorization and timing requirements.
  3. Assessment or tax year: distinguish the year being assessed from the calendar date on which the notice was issued or served.
  4. Issue and service dates: preserve the notice file, portal timestamp, email, and any physical-service evidence. A date printed on the notice may not be the only relevant date.
  5. Case history: list earlier notices, responses, orders, transfers, and changes in the officer or unit.
  6. Assignment evidence: save the JAO lookup result and any transfer, faceless-assessment, or allocation communication available for that period.
  7. Monetary-direction evidence: identify the instruction or order said to govern the officer’s rank, its effective date, the taxpayer category, and the income measure it uses.
  8. Response deadline: comply with the deadline in the notice while obtaining advice on any jurisdiction objection. Raising a jurisdiction point does not automatically suspend other response obligations.

Historical monetary limits: why a number cannot be used casually

Tribunal materials discuss CBDT Instruction No. 1/2011 dated 31 January 2011. In the non-corporate context described in those materials, a returned income above Rs. 15 lakh was treated as falling within the work allocation of an Assistant Commissioner or Deputy Commissioner rather than an Income Tax Officer. That is a historical figure discussed in a particular instruction and set of facts, not an established current threshold for every taxpayer, city, assessment year, or notice.

To use a monetary limit responsibly, establish all of the following:

  • the instruction or direction actually in force on the relevant date;
  • whether it applied to the taxpayer’s category, such as non-corporate or corporate cases;
  • the city, range, or other geographic classification used by that direction;
  • whether the calculation used returned income, assessed income, or another measure;
  • the officer rank named in the direction;
  • any amendment, supersession, exception, transfer, or special assignment; and
  • whether the notice was issued during a transition between legal regimes.

If any of those facts is unknown, describe the issue as requiring verification rather than asserting that the officer exceeded a fixed limit.

What the cited tribunal decisions actually show

Mintu Das v. ACIT, Circle 28, Kolkata (6 January 2025)

The reported decision discusses a section 143(2) notice issued by an Income Tax Officer in a case where the tribunal considered the returned income to be above the historical monetary limit associated with Instruction No. 1/2011. The facts also include a later transfer and subsequent notices. The tribunal’s analysis belongs to that notice sequence, instruction, assessment period, and record. It should not be converted into a rule that every section 143(2) notice issued by an Income Tax Officer above Rs. 15 lakh is invalid, or that a later transfer automatically cures or defeats an earlier defect.

Pakshal Impex Pvt. Ltd. v. ITO, Ward 5(2)(4), Mumbai (23 July 2026)

This reported tribunal decision considers whether section 124’s limitations on territorial-jurisdiction objections applied to an objection based on a monetary limit. Its reasoning addresses the distinction between those issues on the facts before that tribunal. A reported tribunal decision is not automatically binding on every taxpayer. Before relying on it, check the primary order, any appeal or later decision, the controlling High Court or Supreme Court authority, and the statute and directions applicable to the assessment year.

ITA No. 175/DDN/2025

An official tribunal document associated with this appeal also repeats the historical Rs. 15 lakh material. It is useful evidence of what was argued or considered in that matter, but it does not by itself establish a present-day monetary allocation for all assessments.

Territorial objections and pecuniary objections are not handled identically

When the complaint is territorial, section 124’s own mechanism matters. The objection may need to be addressed to the authority specified by the statute, and the applicable version of the provision may impose conditions on when the objection can be raised. Do not assume that an objection remains available indefinitely or that a delayed objection will always be heard.

When the complaint is pecuniary, start with the source of the monetary limit. Determine whether the direction governed the officer’s authority, internal allocation of work, or both, and identify the consequence that the applicable law and binding decisions attach to non-compliance. Some disputes may concern the officer’s competence to issue the particular notice; others may concern the allocation of work within the department. The label “pecuniary jurisdiction” does not itself decide the remedy.

Because the consequences differ, state the objection precisely: “the officer was outside the taxpayer’s assigned jurisdiction under the applicable section 120 and section 124 framework” is a different submission from “the officer’s rank was not authorized for this monetary category under the direction effective on the notice date.”

A practical decision path for an assessment notice

  1. Preserve the complete record. Download the notice and attachments from the portal, retain the original file metadata, and save proof of service.
  2. Classify the possible defect. Decide whether the concern is area or taxpayer assignment, officer rank and monetary allocation, statutory notice requirements, limitation, service, or a combination.
  3. Match the law to the assessment year. Use the statute and directions that governed the notice and assessment, not merely the rules displayed today.
  4. Verify the JAO and assignment history. Compare the portal lookup with the address, business facts, ward or circle, and any transfer order.
  5. Verify the monetary direction. Obtain the complete instruction, effective date, categories, thresholds, exceptions, and amendments. Do not rely on a sentence quoted in a blog or an old case summary.
  6. Check statutory and procedural dates. Record issue, service, response, transfer, and assessment dates. A jurisdiction argument can fail or change character if raised after a statutory stage has passed.
  7. Respond to the notice on its merits unless advised otherwise. A jurisdiction objection is not a substitute for preserving factual and legal defenses to the addition or reassessment itself.
  8. Obtain case-specific advice. A tax professional or lawyer can examine the complete record, identify the competent authority, and determine whether a writ, appeal, objection, or response is available.

Common misconceptions and their corrections

“The officer is in another city, so the notice is void.”

Not necessarily. Charges can be organized by directions, transfers, centralized or faceless processes, and taxpayer assignments. Confirm the applicable assignment record and the statutory authority for the notice.

“The portal shows a different JAO today, so the earlier notice was invalid.”

A current lookup may reflect a later transfer or reorganization. Compare the listing and assignment that applied when the notice was issued and served.

“Rs. 15 lakh is the current pecuniary limit.”

The amount is discussed in historical material concerning Instruction No. 1/2011. It cannot be stated as a current universal limit without the applicable direction, category, and period.

“Any pecuniary defect is governed by section 124’s territorial deadline.”

That conclusion cannot be assumed. The source and nature of the monetary allocation, the statutory provision, and the relevant decisions must be analyzed separately.

“A jurisdiction objection eliminates the need to answer the notice.”

Unless the competent authority or a court orders otherwise, continue protecting the response position and observe the notice deadline while the objection is evaluated.

Transition to the Income-tax Act, 2025

The historical materials discussed above are anchored mainly in the Income-tax Act, 1961 and directions made under that framework. For notices issued from 1 April 2026 onward, the applicable provisions of the Income-tax Act, 2025, transition rules, current rules, and CBDT allocation directions must be checked directly. The available material does not establish the current AO monetary limits, transition treatment, or definitive consequences for section 143(2) and reassessment notices under the new regime.

Accordingly, a present-day analysis should identify the governing statute first, then trace any saved or transitional provision back to the notice and assessment year. Do not carry a 2011 instruction, a 2025 tribunal discussion, or a 2026 reported decision into a post-transition notice without confirming that it still applies.

What a careful conclusion looks like

Territorial jurisdiction answers “which officer or charge is assigned to this taxpayer?” Pecuniary jurisdiction answers “which officer rank is permitted to handle this monetary category under the direction in force?” The same notice can require both analyses, but one does not prove the other.

For an actual dispute, the reliable sequence is to identify the issuing officer and statutory section, fix the assessment year and service dates, establish the assignment and transfer history, locate the operative monetary direction, and then apply the objection procedure and precedent that govern those facts. Historical tribunal decisions can illuminate the arguments, but they do not replace verification of the law in force or guarantee that a notice will be quashed.
