Income tax appeal vs rectification: which remedy should you use after an assessment order?

By TheFinanceBase Team 12 min read

Use rectification for a mistake that is apparent from the existing income-tax record; use an appeal to challenge an appealable order on its merits. The correct choice depends on the exact order, the assessment year or tax year, when the order and demand were served, and whether the dispute requires new evidence or a debatable legal or factual decision. For proceedings relating to a tax year that began before 1 April 2026, the Income Tax Act 1961 generally continues to govern even when you file after that date. Tax Year 2026–27 and later follows the Income Tax Act 2025 route.

The short answer: rectification fixes a record error, appeal challenges the decision

Rectification and appeal are not interchangeable applications. A rectification request asks the same processing centre or Assessing Officer to correct a mistake that is obvious from the material already on the record. An appeal asks an appellate authority to examine an appealable order and decide whether the assessment, adjustment, penalty or other disputed conclusion is legally or factually wrong.

The Income Tax Department describes rectification as available where there is a “mistake apparent from record” in a section 143(1) intimation, a Centralised Processing Centre (CPC) order under section 154, or an assessment order passed by the Assessing Officer. The Department’s Form 35 guidance lists scrutiny assessment orders under section 143(3), ex-parte assessment orders under section 144, and rectification orders under sections 154/155 among examples of orders that may be appealed.

  • Rectification: the error can be demonstrated directly from the return, computation, statement, challan, previous order or another document already forming part of the record. It is typically a clear processing or record-based mistake.
  • Appeal: the authority must reconsider the merits, weigh competing evidence, make a contested factual finding, interpret a debatable legal issue or set aside an assessment that you say is unsustainable.

If you are unsure whether an error is truly apparent, do not let a rectification attempt consume the time available for an appeal. Check appealability and limitation promptly while you assess the rectification route.

First identify the governing law: the 2026 transition changes the form and procedure

The Income Tax Act 2025 commenced on 1 April 2026. That commencement date does not automatically move every later filing into the new Act. The Department’s transition guidance says the 1961 Act continues to apply to pending proceedings and to proceedings initiated on or after commencement when they relate to a tax year beginning before 1 April 2026. Appeals and rectification are expressly included.

Therefore, a filing made after 1 April 2026 can still be governed by the 1961 Act. The Department’s appeals transition FAQ states that an appeal filed after 1 April 2026 for AY 2026–27 or an earlier assessment year is governed by the 1961 Act. It also states that commencement of the 2025 Act does not revive an appeal period that expired under the 1961 Act; a condonation request under the old Act may be possible only where sufficient cause is established.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For Tax Year 2026–27 and later, use the route under the 2025 Act. The official Form 99 manual describes online filing through the e-Filing portal and gives a 30-day period for an assessment or penalty appeal measured from service of the demand notice, or from service of the order in other cases.

How to classify your order

  1. Read the assessment year or tax year printed on the order, intimation and demand notice. Do not rely only on the date you downloaded the document.
  2. Determine whether the relevant tax year began before 1 April 2026. If it did, start with the 1961 Act transition provisions even if the filing date is later.
  3. If the document refers to AY 2026–27 or an earlier assessment year, the Department’s transition FAQ says the 1961 Act governs an appeal filed after 1 April 2026.
  4. If it is Tax Year 2026–27 or later, check the 2025 Act procedure and the current Form 99 instructions.

Keep the order, demand notice and portal acknowledgement together. The year printed on each document and the service dates determine which limitation and form rules you must apply.

When rectification is the better remedy

What “mistake apparent from record” means in practice

Rectification is designed for an error that is visible without a fresh investigation or a choice between two reasonably arguable views. Examples can include an arithmetic or totalisation error, a credit or payment appearing in the existing record but omitted in processing, or an adjustment that conflicts with information already available to the authority. The exact eligibility depends on the order and the record before that authority.

The Department’s rectification FAQ states: “A request for rectification can be submitted on the e-Filing portal if there is any mistake apparent from record, in an Intimation issued u/s 143(1) or in an order u/s 154 passed by the CPC or in an Assessment Order passed by the Assessing Officer.”

Orders and routes covered by the Department’s guidance

Document or proceeding Possible rectification route What to verify
Section 143(1) intimation Online rectification request where CPC processed the return Whether the alleged error is demonstrable from the return and records already used for processing
CPC order under section 154 Rectification request through the e-Filing account The order reference, issue raised and supporting record
Assessing Officer assessment order Rectification request to the Assessing Officer under the applicable procedure Whether the mistake is apparent in the assessment record rather than a request for a new merits review

When rectification is a poor fit

A request is usually a poor fit when success depends on introducing evidence that was not before the authority, asking for a witness or factual investigation, choosing between conflicting interpretations of law, or re-arguing every issue decided in the assessment. Those features point toward an appeal if the order is appealable.

Do not describe rectification as a general substitute for an appeal. A rectification request may be rejected even when you believe the assessment is wrong, because the statutory test is narrower than a merits appeal. If the rejection itself is an appealable rectification order, assess an appeal against that order separately.

When an appeal is the better remedy

Appeal addresses the merits of an appealable order

Choose an appeal when your objection concerns the legal validity, interpretation, computation, factual findings or evidentiary conclusions in an appealable order. The appellate authority can consider the grounds presented under the applicable statute and procedure, rather than being confined to correcting an obvious record mistake.

The Department identifies these examples for Form 35 appeals under the 1961 Act:

  • scrutiny assessment orders under section 143(3);
  • ex-parte assessment orders under section 144; and
  • rectification orders under sections 154 or 155.

This list is illustrative, not a determination that every order is appealable. Confirm the exact order type and your proposed grounds against the law applicable to the relevant year.

Can you appeal a rectification order?

Yes, a rectification order under sections 154/155 is among the Department’s examples of orders for which an appeal may be filed under the 1961 Act. The appeal challenges the appealable order; it is not simply a second rectification request. Identify whether you are challenging the original assessment, the rectification decision, or both, and frame grounds that match the order being appealed.

Appeal deadlines: count from service, not automatically from the order date

For a first appeal under the 1961 Act, the Department’s Form 35 FAQ says the general period is 30 days. For an appeal concerning an assessment or penalty, count from service of the related demand notice. In other cases, count from service of the order. The Department’s wording is: “The assessee has to file Appeal within 30 days from the date of service of order or demand as the case may be.”

Appeal type General 1961 Act trigger in Form 35 guidance Period stated by the Department
Assessment or penalty appeal Service of the related demand notice 30 days
Other appeal covered by the guidance Service of the order 30 days

For Tax Year 2026–27 and later, the Form 99 manual also states 30 days, using service of the demand notice for assessment or penalty appeals and service of the order in other cases. Apply the form and Act that govern your tax year; do not carry a deadline from one regime into the other without checking the current instructions.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What if the 30 days have already expired?

The Department says delay may be condoned in exceptional cases where reasonable cause prevented timely filing. Condonation is not automatic. Explain the dates, the cause of delay, and the steps taken as soon as the obstacle ended. The transition FAQ adds that an expired 1961 Act appeal period is not revived merely because the 2025 Act commenced; any condonation must be considered under the old Act and on the actual facts.

A pending rectification request does not, by itself, remove the need to protect an appeal deadline. If both remedies may be relevant, obtain advice on filing strategy immediately rather than waiting for the rectification response.

Form 99 for Tax Year 2026–27 and later

Where the 2025 Act governs, the official Form 99 manual describes filing the appeal through the e-Filing portal. The same 30-day service-based framework is stated for assessment or penalty appeals and for other appeals. Confirm that the order belongs to a tax year covered by the new Act before selecting Form 99.

How to pursue rectification

For a CPC-processed return

  1. Log in to the e-Filing account and open the rectification-request service.
  2. Select the relevant section 143(1) intimation or CPC section 154 order.
  3. Describe one identifiable mistake at a time and tie it to the return, computation, challan, statement or other record already available to CPC.
  4. Upload or identify the supporting record requested by the portal; do not turn the request into a new factual case.
  5. Submit and save the acknowledgement, request number and the version of the documents used.

For an Assessing Officer order

Follow the route specified for the Assessing Officer’s assessment order and the current portal instructions. Identify the exact paragraph, figure or record entry containing the apparent mistake. If your argument requires fresh evidence or a contested interpretation, preserve it as a potential appeal ground instead of assuming rectification will provide a merits hearing.

The official guidance cited here does not provide a single universal rectification deadline for every order and situation. File promptly, check the statute and current instructions for the specific proceeding, and do not allow an unresolved rectification request to conceal an approaching appeal deadline.

Appeal versus rectification: a decision table

Question Rectification Appeal
What is being challenged? An apparent mistake in an eligible intimation or order The merits or legality of an appealable order
What record is considered? Existing record before the processing centre or officer Grounds and evidence permitted under appellate procedure
Typical examples Obvious processing, arithmetic or record mismatch Section 143(3) scrutiny assessment, section 144 ex-parte assessment, or an appealable section 154/155 order
Filing route under the 1961 Act CPC online request where CPC processed the return, or the Assessing Officer route for an assessment order Form 35 online through the e-Filing portal
Filing route under the 2025 Act Check the transition and current portal instructions for the relevant tax year Form 99 online for Tax Year 2026–27 and later
General first-appeal period stated by the Department Not the Form 35 appeal deadline 30 days; service of demand for assessment or penalty, otherwise service of order
Best question to ask Can the error be proved without a fresh investigation or debatable decision? Do I need an appellate authority to reconsider the facts, evidence or law?

A practical decision process after receiving an order

  1. Freeze the documents. Download the order, demand notice, computation, return acknowledgement, portal messages and proof of service. Record the date each was served or made available.
  2. Classify the year. Note the assessment year or tax year and determine whether the underlying tax year began before 1 April 2026.
  3. Classify the order. Identify whether it is a section 143(1) intimation, CPC section 154 order, Assessing Officer assessment order, section 143(3) scrutiny order, section 144 ex-parte order, penalty order or another document.
  4. Write the objection in one sentence. If the sentence points to a visible mismatch in the existing record, test rectification. If it says the officer chose the wrong legal interpretation, rejected evidence, made a factual finding or assessed income incorrectly after consideration, test appealability.
  5. Calculate the appeal deadline. For a 1961 Act assessment or penalty appeal, start with service of the demand notice; for other appeals, start with service of the order. Apply the 30-day period stated in the Department’s Form 35 guidance, subject to the relevant law and any condonation issue.
  6. Protect the earlier deadline. If rectification may not resolve the issue, prepare the appeal rather than waiting for an uncertain rectification outcome.
  7. Submit through the correct form and authority. Use Form 35 for the applicable 1961 Act route or Form 99 for Tax Year 2026–27 and later under the 2025 Act, and use the CPC or Assessing Officer rectification route where appropriate.
  8. Preserve proof. Save the acknowledgement, request number, submitted grounds, attachments, payment details and service evidence.

Common mistakes and how to avoid them

Using rectification to reopen the whole assessment

A request that simply repeats every disagreement with an assessment may not satisfy the apparent-error standard. Isolate the specific record error and explain exactly where it appears. Put broader merits arguments into appeal grounds if the order is appealable.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Counting 30 days from the wrong date

The Form 35 guidance distinguishes assessment or penalty appeals from other appeals. For the former, the stated trigger is service of the demand notice, not automatically the date printed on the assessment order. Keep evidence of actual service, including portal delivery records.

Assuming the 2025 Act applies because filing occurs after 1 April 2026

The transition depends on the tax year and proceeding, not merely the filing date. Earlier tax years remain under the 1961 Act in the circumstances described by the Department, including appeals and rectification initiated after commencement.

Assuming a late appeal is automatically accepted

Condonation is discretionary and requires an explanation of reasonable cause. The new Act does not revive an expired old-Act limitation period. Address delay immediately and provide the actual chronology.

Submitting incomplete grounds or losing the record

The Form 35 manual lists the order, demand notice, fee details, statement of facts, grounds and documentary evidence among the material to prepare. A missing acknowledgement or attachment can make later follow-up harder, so retain the complete submission package.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What to prepare before seeking professional help

Professional advice is especially useful where service dates are disputed, the order contains several issues, evidence was not previously filed, a rectification request has been rejected, or the appeal period may have expired. Give the adviser a dated chronology and a complete document set:

  • the return and acknowledgement for the relevant year;
  • all intimations, assessment, penalty and rectification orders;
  • the demand notice and proof of service;
  • computation sheets, tax-credit statements and payment challans;
  • submissions and evidence previously filed with the Department;
  • portal acknowledgements and correspondence; and
  • a draft list separating apparent record errors from merits grounds.

This is general procedural information, not a determination of any taxpayer’s eligibility, limitation computation, grounds or likelihood of success. The Department’s portal routes and instructions can change; verify the current form and the actual order before filing.
