U.S. immigration rules affect an Indian IT professional’s ability to take a job, change employers, bring family members, and eventually obtain permanent residence. The main temporary routes are H-1B specialty-occupation status and, for qualifying multinational transfers, L-1 status. A green-card strategy then depends on the employment category, the worker’s priority date, and monthly Visa Bulletin availability.
For employers, immigration is also a compliance and budgeting issue: the company must document the role and worksite, pay the legally required wage, provide notice, and manage petitions when an assignment or employer changes. The examples and cutoff dates below are dated to October 2026; agency guidance, court decisions, and Visa Bulletin dates can change.

Why these rules matter to Indian IT workers and companies
Immigration status is tied to specific facts, not simply to a person’s job title or nationality. The employer entity, offered duties, work location, wage, corporate relationships, previous employment, and the worker’s place of birth can all change the available route. A worker may be fully qualified for one category but not another.

For household finances, a status problem can interrupt payroll, delay a move, prevent a spouse from working, or force an expensive change of assignment. For an IT employer, a filing error can delay a project and create liability for wages, notice, or improper deductions. Planning should therefore start before accepting a role or moving a worker between clients and worksites.

| Route | Main qualifying basis | Employer relationship | Family and work point | Primary planning constraint |
|---|---|---|---|---|
| H-1B | Specialty occupation requiring specialized knowledge and at least a bachelor’s degree or equivalent | U.S. employer petition plus Labor Condition Application (LCA), wage and worksite obligations | Dependents have separate status and work-authorization rules; H-4 status does not automatically mean employment authorization | Cap and selection rules can apply, although exemptions exist; registration selection is not petition approval |
| L-1A/L-1B | Transfer of an executive, manager, or specialized-knowledge employee from a related foreign office | U.S. and foreign entities must have a qualifying corporate relationship; generally at least one year of qualifying foreign employment in the preceding three years | L-2 spouses with the proper L-2S admission record are employment-authorized incident to status under USCIS guidance | Corporate relationship, prior employment, and actual duties must all qualify |
| Employment-based permanent residence | EB-1, EB-2, or EB-3 category requirements; some cases require labor certification | Often an employer job offer, labor certification where required, and an I-140 immigrant petition | Immigrant status and dependent applications follow separate procedural steps | Priority date, chargeability, and monthly visa-number availability control timing |

H-1B: how it works for an Indian IT professional
Eligibility is based on the job and the worker
H-1B is a temporary classification for a specialty occupation. The position must require specialized knowledge and normally at least a bachelor’s degree or equivalent in a directly related field. A computer or engineering degree alone does not guarantee approval; the employer must show that the offered duties and the organization’s normal requirements fit the specialty-occupation test.
The employer files the petition. Before doing so, it generally submits an LCA to the Department of Labor identifying the occupation, worksite and wage obligations. The DOL H-1B legal materials explain that the required wage is at least the higher of the actual wage paid to comparable employees or the prevailing wage for the occupation and intended area.
What the employer must document
- The actual U.S. employer and the worker’s offered position.
- Each intended work location, including a third-party or client site when applicable.
- The occupation’s wage level and the comparison between the prevailing and actual wage.
- The worker’s degree, equivalent education, and experience evidence.
- Required LCA notice to affected workers, in the manner and locations required by the labor rules.
When an Indian IT employee moves from an internal project to a client assignment, the company should reassess the worksite, duties and wage documentation before the move. A job title such as “software engineer” does not by itself establish compliance.
Cap numbers, registration and approval are different events
DOL materials describe an annual numerical limit of 65,000 regular H-1B places plus 20,000 additional places for beneficiaries with a qualifying U.S. advanced degree. These are statutory program figures, and exemptions mean the cap does not apply to every H-1B filing. Where cap-subject registration and selection apply, being selected only permits the employer to file a petition; USCIS must still decide whether the job and worker qualify.

Cap-exempt employers and other statutory exemptions can change the analysis. An employer should determine whether an exemption applies rather than assume that every new H-1B requires the same lottery process.
Wage protections and prohibited deductions
An H-1B worker must receive the higher applicable wage. DOL worker guidance also describes deductions that cannot be shifted to the employee, including certain petition filing costs, financial penalties for leaving, and employer business expenses such as LCA legal fees. The DOL H-1B worker page explains these protections.

The September 2025 payment condition
A September 19, 2025 presidential proclamation and the accompanying USCIS memorandum describe a $100,000 payment condition for certain H-1B employment petitions. USCIS Director Joseph B. Edlow’s September 20, 2025 memorandum says the condition applies prospectively to petitions filed after 12:01 a.m. Eastern Time on September 21, 2025, and identifies exceptions for certain earlier-filed petitions, already approved petitions, and people holding valid H-1B visas. It is not an unconditional fee for every H-1B worker or every previously approved case. Employers should check the memorandum and later USCIS or court materials before filing.
The same memorandum states: “The proclamation does not impact the ability of any current visa holder to travel to or from the United States.” That statement is attributed to the memorandum and must be read with its prospective petition scope; it does not remove the need to verify a worker’s visa validity, admission period and travel documents.

L-1: when an intracompany transfer fits
Corporate relationship and foreign employment
L-1 is not a second H-1B lottery. It is for a qualifying transfer from an affiliated foreign office to a U.S. office. The entities must have the required parent, subsidiary, affiliate or branch relationship. USCIS guidance generally requires the employee to have worked abroad for the qualifying organization for at least one year during the three years before admission or the relevant petition.
The U.S. position must be executive or managerial for L-1A, or involve specialized knowledge for L-1B. Evidence should connect the employee’s actual responsibilities to the category. A person who merely worked for an unrelated Indian vendor, or whose proposed U.S. job does not match the claimed executive, managerial or specialized-knowledge duties, may not qualify.
L-2 spouses and work authorization
USCIS’s employer handbook says an L-2 dependent spouse with an L-2S admission record is employment-authorized incident to status and does not need a separate EAD to establish that authorization for Form I-9 purposes, although the spouse may choose to apply for an EAD. Employers should inspect the current admission record and follow the I-9 Central guidance.
Moving from temporary status to a green card
The employment-based sequence
An employer-sponsored case commonly involves several distinct steps. Depending on the preference category, the employer may first need labor certification from DOL to show that there is a qualifying permanent job and that hiring the foreign worker meets the labor-market rules. The employer then files an I-140 immigrant petition with USCIS. A worker may also need an immigrant-visa application through a U.S. consulate or an adjustment-of-status filing in the United States when a visa number is available.
- Choose the category. EB-1, EB-2 and EB-3 have different qualification standards. Some EB-1 cases do not require labor certification, while many employer-sponsored EB-2 and EB-3 cases do.
- Establish the priority date. In a labor-certification case, the priority date is generally tied to the properly filed labor-certification application; in other cases it follows the relevant immigrant petition filing rules.
- File the I-140. Approval confirms the petition’s classification, not immediate permanent residence.
- Watch the monthly Visa Bulletin. A visa number must be available under the applicable chart and chargeability country.
- Complete the final stage. The worker either pursues adjustment of status when eligible in the United States or consular processing abroad, with separate applications for qualifying dependents.
The State Department’s employment-based immigrant visa page distinguishes these requirements. USCIS monthly adjustment-of-status instructions and the State Department’s final-action chart are separate tools; eligibility to file is not the same as a visa number being finally available.

| Category | India final-action date (October 2026) |
|---|---|
| EB-1 | July 1, 2024 |
| EB-2 | January 15, 2015 |
| EB-3 | January 15, 2015 |
| Other workers | January 15, 2015 |
Under a final-action date, numbers are available only to applicants whose priority dates are earlier than the listed date, subject to the bulletin’s rules. A date is not a promise that a case will finish that month. The bulletin can advance, retrogress, or become unavailable as demand and annual limits change. Always use the current October 2026 Visa Bulletin as a dated snapshot, then recheck the next bulletin and USCIS filing instructions.
Chargeability is usually place of birth, not citizenship
The India column generally applies because of chargeability, ordinarily the applicant’s country of birth. An Indian citizen born elsewhere is not automatically charged to India, and a non-Indian citizen born in India may be. Limited cross-chargeability exceptions can allow use of a spouse’s or, in some circumstances, a parent’s country of birth. The individual’s birth record, immigration history and family relationships should be reviewed before estimating a wait.

H-1B portability is not a blank check
An H-1B worker considering a new employer needs a new employer petition and should not assume that a resignation, payroll transfer or client change is harmless. The new filing must describe a qualifying specialty occupation, wage and worksite. A move that changes the occupation, location or employment arrangement can require an amended or new filing. Coordinate the start date, notice period and travel with immigration counsel so the worker does not create a gap in authorized employment.

L-1 transfers stay tied to the qualifying group
An L-1 employee cannot simply accept an unrelated company’s offer on the strength of the existing L-1. A change outside the qualifying corporate group generally requires a different immigration strategy. Even within the group, a material change in duties or office can require review.
Practical checklists
For an Indian IT worker
- Confirm the petitioning employer, legal entity, job duties, worksite and wage before signing.
- Keep copies of the approval notice, LCA-related notices, pay records, degree documents and prior immigration filings.
- Ask whether the case is cap-subject, cap-exempt, or based on an L-1 transfer, and what event authorizes the start of work.
- Do not agree to repay prohibited petition costs or employer business expenses without obtaining qualified advice.
- For a green-card case, record the category, priority date, chargeability country and whether the case is at labor certification, I-140, adjustment or consular-processing stage.
- Budget for periods when a spouse cannot work, relocation costs, travel-document renewals and professional advice, without assuming a filing guarantees approval.
For an employer
- Identify the actual role, employer entity, work location and work arrangement before selecting a category.
- For H-1B, calculate both actual and prevailing wages, pay the higher amount, provide required notice and document any third-party worksite.
- Separate employer costs from employee costs and audit payroll for improper deductions.
- For L-1, preserve evidence of the corporate relationship, the employee’s qualifying foreign employment and the proposed executive, managerial or specialized-knowledge duties.
- Track assignment, worksite and duty changes so an amended or new filing can be assessed before implementation.
- For permanent residence, set expectations in writing about labor certification, I-140 timing, priority-date movement and the separate final adjustment or consular stage.
- Date every policy decision and recheck USCIS, DOL and State Department guidance before filing.
Common planning mistakes
Treating nationality as the Visa Bulletin category
Using Indian citizenship as a shortcut can produce the wrong wait estimate. Verify place of birth and any cross-chargeability option.

Confusing selection with approval
An H-1B registration selection, or an approved immigrant petition, does not by itself authorize every proposed job or deliver permanent residence. The underlying filing, status and visa-availability requirements still apply.
Using a cutoff date as a completion forecast
A final-action date is an allocation marker for a month, not an individualized completion prediction. Keep the priority date and chart type visible in every case update.
Assuming an L-1 is interchangeable with H-1B
L-1 depends on a qualifying multinational relationship, prior foreign employment and specific duties. A worker who changes companies may lose the factual basis for the category.
Ignoring the financial effect of a status change
A new filing, delayed start, relocation, or spouse’s inability to work can alter household cash flow. Build a reserve and obtain written confirmation of work authorization before relying on a new paycheck.
