Start with the legal issuer, not the token’s brand, exchange listing or wallet. For a token that references the euro, identify the issuer, confirm that the token is an e-money token (EMT), find that issuer in the European Securities and Markets Authority (ESMA) MiCA register, and independently verify the issuer’s credit-institution or electronic-money-institution (EMI) licence in the relevant national register.
Then reconcile the current white paper, legal entity identifier (LEI), offer or admission date, authorisation date, and any withdrawal or precautionary notice. An ESMA register entry shows that a white paper or issuer has been recorded; it does not mean ESMA or a national regulator approved the white paper’s contents.

What “authorized under MiCA” actually means
MiCA uses different regulatory routes for different token designs. A euro-referenced stablecoin will generally be an e-money token (EMT) because it seeks to maintain a stable value by referencing one official currency. An asset-referenced token (ART) instead references another value or right, or a combination of assets and currencies. The classification determines which authorization and disclosure rules you must test.

MiCA Article 48 prohibits a person from offering an EMT to the public in the European Union or seeking its admission to trading unless that person is the token’s issuer, is authorized as a credit institution or EMI, and has notified and published a crypto-asset white paper in accordance with Article 51. The rule is not satisfied merely because an exchange, broker or other crypto-asset service provider (CASP) is regulated.

“A person shall not make an offer to the public or seek the admission to trading of an e-money token, within the Union, unless that person is the issuer of such e-money token and: (a) is authorised as a credit institution or as an electronic money institution; and (b) has notified a crypto-asset white paper to the competent authority and has published that crypto-asset white paper in accordance with Article 51.”
Article 48 also says that an EMT referencing an official currency of a Member State is deemed to be offered to the public in the Union. For a euro token, that presumption means the issuer cannot avoid the EU offer analysis simply by describing distribution as offshore, secondary-market or platform activity.
How ARTs differ
If the token references a basket, several currencies, commodities, other crypto-assets or another combination of assets rather than only the euro, test the ART definition and the Article 16 authorization route. An Article 16 authorization granted by a competent authority is valid throughout the Union. Do not label a token an EMT solely because its marketing uses the word “stablecoin”; read the issuer’s legal disclosures and white paper.

Write down the exact legal entity before opening a register. Commercial names are often different from corporate names, and a distributor or exchange may have no authority to issue the token.
- Exact legal name, including suffix such as a public limited company or private limited company.
- Home Member State and registered address, if disclosed.
- LEI, if one appears in the white paper or register.
- Token’s commercial name, ticker and chain or network identifiers.
- Issuer website and the name of any distributor, exchange or CASP involved.
Use the name in the legal terms or white paper rather than a logo or app-store listing. If several entities appear, determine which one creates and redeems the tokens and which one merely distributes or provides custody. The issuer’s identity must match across the ESMA record, white paper and banking or EMI licence.

Step 2: classify the token before checking authorization
Classification is a legal question, not a marketing label. Apply this sequence:
- Read the reference asset. If the token claims a stable value against the euro or another single official Member State currency, treat it as an EMT candidate.
- Look for additional references. A basket or a reference to several assets can point to ART treatment instead.
- Check the white paper and legal terms. Look for the stated currency reference, redemption promise, holder rights and reserve description.
- Resolve borderline language. If the token’s documents conflict, pause the conclusion and obtain clarification from the relevant competent authority or qualified EU regulatory counsel.
Classification matters because the underlying authorization is different. An EMT issuer must be a credit institution or EMI under Article 48. An ART issuer follows the authorization framework in Article 16, subject to MiCA’s conditions and any applicable transitional rule.

Step 3: search ESMA’s public MiCA register
MiCA Article 109 requires ESMA to maintain a public register covering ART issuers, EMT issuers, crypto-asset white papers and CASPs. Search the register using the legal issuer name, then compare every available field with your identity record.
What to match in the EMT record

| Underlying authorization | Note whether the record identifies a credit-institution or EMI authorization and the date it was granted. |
| Other services | Distinguish issuance from custody, exchange, transfer or other CASP activities. |
| Status notices | Check for withdrawal, precautionary measure or other public status information. |
Withdrawals of ART, EMT or CASP authorizations remain published in the MiCA register for five years. An old entry therefore does not by itself prove that authorization is still active; read the status and dates carefully.
What an ESMA listing does not prove
ESMA’s interim MiCA register states that the crypto-asset white papers listed there “have not been reviewed or approved by any competent authority in any Member State of the European Union.” The listing is disclosure and register evidence. It is not a regulatory endorsement, solvency opinion, reserve audit or guarantee that the token will maintain its target value.

Step 4: verify the underlying credit-institution or EMI licence
Use the competent-authority reference in the ESMA record to locate the issuer in that authority’s current national register. The register may be maintained by a central bank, financial-services authority or another designated supervisor in the issuer’s home Member State.
- Copy the issuer’s legal name and, where available, authorization number from the ESMA record.
- Open the competent authority’s official register, not a search-engine advertisement or the issuer’s marketing page.
- Search the exact legal name and compare the registered address, entity number and LEI.
- Confirm that the permission is for a credit institution or EMI. A CASP authorization alone is not the Article 48 authorization.
- Check whether the authorization is active, restricted, withdrawn, suspended or subject to a public notice.
- Save the register result and the date you checked it, because national registers and statuses can change.
Do not infer an EMI licence from the fact that a bank processes the token’s payments, that an exchange lists it, or that a company advertises “regulated” services. Article 48 attaches the authorization requirement to the issuer.
Step 5: read the current white paper against the registers
Download the latest white paper identified in the ESMA register and compare it with the national licence record. Keep the version date and any archived or modified versions in your file.
Document fields to reconcile
- Issuer’s complete legal name, jurisdiction and LEI.
- Token name, ticker and the official currency referenced.
- Redemption terms, holder rights and any fees or limits.
- Reserve or backing description and the entity responsible for safeguarding assets.
- Competent authority and the stated authorization type.
- Version number, publication date and any amendment history.
A white paper can be present in the ESMA register while its contents remain unreviewed. Treat statements about reserves, redemption and governance as disclosures to analyze, not as a regulator’s certification. If the white paper names a different entity from the licensed issuer, stop and resolve the discrepancy.
Step 6: check dates, notification and transitional status
Titles III and IV of MiCA, which cover ART and EMT activities, began applying on 30 June 2024, subject to the transitional provisions identified in the applicable rules. A token’s launch date, a later relaunch and a change of issuer can therefore have different regulatory consequences.

EMT notification timing
Article 48 requires an EMT issuer to notify its competent authority at least 40 working days before the intended public offer or admission to trading. This is an advance-notification requirement; it is not a 40-day authorization period and does not replace the need for the underlying credit-institution or EMI authorization.
Record the timeline
- Date the credit-institution or EMI authorization was granted.
- Date the issuer notified the competent authority and published the white paper, when disclosed.
- Intended or actual public-offer and admission-to-trading dates.
- Date of any issuer, token, white-paper or authorization change.
- Date and reason for any withdrawal, suspension or precautionary measure.
For an ART comparison, Article 21 provides a 25-working-day period for the competent authority to take a fully reasoned authorization decision after receiving the required opinions, followed by five working days to notify the applicant. Those ART timelines should not be mistaken for the EMT notification rule.
Step 7: investigate discrepancies instead of guessing
A single inconsistency can change the conclusion. Pause the verification when you find any of the following:
- The ticker or token name matches, but the legal issuer differs.
- The LEI is missing in one record or does not match.
- The ESMA record says EMI, while the national register shows only a CASP permission.
- The licence is withdrawn, limited to another activity or held by a different group company.
- The white paper is older than the offer date or names a superseded entity.
- The register shows a withdrawal or precautionary measure that the issuer does not disclose.
Ask the relevant national authority to clarify the register entry or obtain advice from qualified EU regulatory counsel. Significant ARTs and EMTs may involve European Banking Authority supervision, but significance does not eliminate the issuer’s basic authorization and white-paper obligations.

Use the same evidence fields for both issuers and record the source date. A side-by-side comparison prevents a well-designed website or exchange listing from substituting for legal evidence.

If a value is not published, write “not stated” and keep the gap visible. Absence of a public field is not proof that the issuer is unauthorized, but it is a reason to seek clarification before relying on the token.
What different evidence can and cannot establish
Strong evidence of the legal route
- A matching issuer identity and LEI in the ESMA register and current white paper.
- An active credit-institution or EMI authorization for that same legal entity in the competent authority’s register.
- A current white paper that identifies the same token, currency reference and rights.
- Consistent offer or admission dates and no unresolved withdrawal or precautionary notice.
Evidence that is insufficient on its own
- An exchange listing or a wallet’s “regulated” label.
- A CASP authorization held by a distributor, custodian or trading platform.
- A white paper hosted on the issuer’s website without a matching ESMA record.
- A logo, parent-company name or bank relationship that does not identify the issuing legal entity.
- A historic authorization record with no confirmation that it remains active.
A practical verification worksheet
For each token, create one dated record containing the following:
- Token name, ticker and the official currency or other reference asset.
- Legal issuer, jurisdiction, LEI and issuer website.
- Classification conclusion and the facts supporting EMT or ART treatment.
- ESMA register entry, white-paper version, offer or admission date and status notices.
- National credit-institution or EMI register entry, authorization number, date and active status.
- Redemption, reserve and holder-rights passages from the current white paper.
- Any mismatch, unanswered question and the authority or counsel contacted.
- Date of the check and the next date on which you will refresh the records.
This file distinguishes a legal conclusion from a trading decision. Authorization does not promise a stable market price, immediate redemption in every circumstance or protection from operational and counterparty risks.

Bottom line for a “MiCA-compliant” claim
You can support a euro stablecoin issuer’s MiCA authorization only when the legal issuer is correctly identified, the token’s EMT or ART classification is defensible, the ESMA record matches the issuer and current white paper, and the issuer’s underlying authorization is active in the relevant national register. Record the dates and status notices, and treat the white paper as disclosure rather than approval. If any identity, licence or status field conflicts, the responsible conclusion is unresolved until the competent authority or qualified counsel clarifies it.
