How to Verify Land Ownership and Property Documents in Nigeria Before Buying

Do not pay a Nigerian land seller—or sign away your negotiating leverage—until the registry responsible for the parcel confirms the title, the seller’s authority, the survey and the land’s restrictions. Nigeria has no single land-records workflow. A parcel in the Federal Capital Territory (FCT) is handled through the Abuja Geographic Information Systems (AGIS) framework; state land is administered by the relevant state authority; federal land and some special development areas may have additional records.

So the answer to “How do I verify land ownership and property documents in Nigeria before buying?” is a coordinated check: identify the correct register, obtain an official search, trace the root of title, verify who can sell, match the survey plan to the ground, investigate encumbrances and litigation, then complete the consent and registration steps required for that jurisdiction and title.

As an Amazon Associate I earn from qualifying purchases.

1. Identify the register before examining the seller’s papers

A title reference has meaning only in the register that issued or records it. Start by obtaining the parcel’s complete location, plot or file number, survey-plan number and any certificate, allocation or registration reference. Ask which public agency maintains that record.

  • FCT land: Follow AGIS instructions for title searches, searches of registered dealings and deed registration.
  • State land: Use the lands registry or ministry responsible for the state in which the parcel lies. Each state can prescribe different forms, fees, access rules and document sequences.
  • Federal land: Confirm the federal authority and register responsible for the particular holding; do not assume a state search is sufficient.
  • Special development areas: Some public or private development areas maintain additional registers or approvals. Confirm whether such a record must also be checked.

An agent’s screenshot, a scanned “deed” sent by messaging app or an online image of a certificate is not an official search. Use the agency responsible for the land and retain the numbered search report or certified record it issues. Where the agency provides a verification service, verify the report through that service.

2. Assemble a document-and-identity pack before requesting the search

Give the registry and your advisers consistent information. Ask the seller for copies for preliminary review, but insist that critical documents be checked against originals or registry-certified copies.

  • Full location, street or village description, plot/file number and adjoining properties.
  • Registered survey plan, beacon or coordinates information and any layout plan.
  • Title instrument: for example, a certificate of occupancy, registered conveyance, deed of assignment, allocation paper or court order.
  • Every document by which the seller says the land was acquired.
  • Seller’s government-issued identity information and contact details that match the transaction documents.
  • Information about mortgages, loans, family claims, notices, disputes, acquisition or revocation.
  • For a company, its legal name, registration details, directors or authorized officers and corporate approval for the sale.
  • For an attorney, the registered power of attorney and evidence that it covers this parcel and the proposed transaction.

Do not let a missing file number or vague location become a reason to “sort it out later.” A registry cannot reliably search an unidentified parcel, and a survey plan that cannot be tied to the physical land is not a safe substitute.

3. Order an official title search

Ask the responsible registry to search the title file in its prescribed manner. The purpose is to establish what the register—not the seller—says.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Submit the correct application. Use the current form, identification and payment method required by the responsible registry. Requirements and public-access rules vary by jurisdiction.
  2. Specify the parcel precisely. Include the title or file reference, survey details and full location. Ask the registry to search any linked instruments or prior entries.
  3. Request the key findings. The search should identify the registered holder, the title instrument, recorded transfers and other dealings, and any mortgage, caveat, court order, pending proceeding, acquisition notice, revocation or other restriction shown on the file.
  4. Collect the official result. Keep the numbered report, certified extract or other official record, including the issuing office and date.
  5. Authenticate it where possible. If the agency offers an online or counter-verification service, use it. Do not rely on a report forwarded by an intermediary without checking its number and origin.
  6. Compare it with the contract pack. Names, plot description, survey references, dates and registration numbers should align. Resolve every mismatch in writing before signing or paying.

Abia State’s Ministry of Lands and Survey describes its title search as checking “who holds it, what is registered against it, and whether it is encumbered.” That wording captures the purpose of a search, but Abia’s report format and portal should not be assumed to operate in every state.

A clean search is evidence about the register at the time searched; it is not a permanent guarantee. Obtain a fresh search if negotiations run on, a new dealing is suspected or completion is delayed.

4. Trace the root of title, not just the latest document

“The seller has a certificate” does not answer how the seller obtained the land or whether the chain contains an authority problem. Ask the seller to explain the acquisition route, then inspect the documents that connect each transfer.

Claimed root of title Documents to request Questions to resolve
Prior purchase or conveyance Earlier deed or conveyance, deed of assignment, consent evidence and registration record Do the parties, parcel description and registration numbers match the current title and search?
Government allocation Allocation letter, offer and acceptance, evidence of required payments, survey and subsequent title or registration Was the allocation issued by the competent authority, and were conditions or charges satisfied?
Inheritance or administration Death record where relevant, grant of probate or letters of administration, vesting or transmission documents and later conveyance Who are the personal representatives and beneficiaries, and do the documents authorize this sale?
Customary or family grant Customary or family conveyance, consent or resolutions of the people required to act, and any registration or acknowledgment Which family, community or customary authority had power to grant the land, and have all necessary interests been addressed?
Gift Gift instrument, acceptance, consent and registration documents Was the gift validly made and recorded, and is the donor’s authority clear?
Court order Sealed order, judgment or vesting document and evidence of implementation in the land register Does the order cover this exact parcel and has the registry recorded its effect?

This is a framework, not a universal checklist. The responsible registry and a Nigerian property lawyer should identify the documents required for the particular title type. Compare every link for the same names, dates, parcel boundaries, survey references and registration numbers. A gap, unexplained change of name or altered description should stop the transaction until independently resolved.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

5. Confirm that the person signing can sell

Ownership on a register and authority to sign a sale are related but distinct questions. Match the proposed signatory to the registered holder and to the root-of-title documents.

Seller situation Verification
Individual registered holder Compare identity details with the registry record and title documents; inspect evidence of any name change.
Joint holders Identify every holder and determine who must sign or consent under the title and applicable law. Do not accept one joint holder’s assurance that the others agree.
Inherited land Verify the probate or administration documents and the personal representatives’ authority, plus any beneficiary or court requirements that apply.
Family or customary land Identify the family or customary body, its recognized representatives and the consents or resolutions required for a disposition.
Company owner Check the company’s corporate identity and current status, confirm that the registered owner is the same entity and obtain the board, shareholder or other authorization required for the transaction.
Attorney signing for an owner Inspect the registered power of attorney, its date and scope. It should cover the parcel and the proposed sale, and it should not have been revoked or superseded.

Ask to see original or certified authority documents and have your lawyer check execution requirements. A person who can show you papers is not necessarily the person legally able to transfer the interest.

6. Verify the survey plan against the actual land

A survey plan identifies land; it does not, by itself, prove ownership. Engage an appropriately licensed Nigerian surveyor to check the plan against official survey records and the site.

  1. Give the surveyor the registry search, title instrument and all available plans.
  2. Confirm that the plan is registered, current and associated with the claimed holder or transaction.
  3. Check coordinates, beacons, dimensions, orientation and adjoining plots against the official record.
  4. Visit the land. Walk the boundaries, locate beacons where possible and compare roads, buildings, drains, fences and adjoining properties with the plan.
  5. Ask whether the parcel falls within government acquisition, an approved layout, a restricted corridor or another planning designation.
  6. Obtain a written discrepancy report if the ground and documents differ.

Abia’s Certificate of Occupancy service uses the wording “The survey plan is registered, current and yours.” Treat this as an example of a local verification question, not a national rule or a promise that a certificate alone settles ownership.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do not accept a seller’s claim that a new survey can be done after payment if the current plan does not identify the land being sold. Resolve the identity of the parcel first.

7. Investigate encumbrances, disputes and public restrictions

Search results and professional checks should address more than the registered owner. Ask specifically about:

  • Mortgages, charges, liens or other security interests.
  • Caveats, inhibitions, court orders or pending suits.
  • Notices of acquisition, revocation or government planning restrictions.
  • Outstanding ground rent, land charges, consent fees or other liabilities that could block registration.
  • Competing applications, overlapping allocations or claims by family, tenants, neighbors or development authorities.

Check the registry entries and the relevant public authority rather than relying on a seller’s declaration. Inspect the site for occupants, fences or signs of competing possession and ask neighbors factual questions without treating their answers as a substitute for records. A pending suit or caveat requires legal advice; do not assume it will disappear when the deed is signed.

8. Complete consent, duties and registration formally

Once title, authority and parcel identity are satisfactory, have a Nigerian property lawyer review the transaction and prepare or review the deed. The final steps depend on the jurisdiction, the type of statutory or customary right and the parties involved.

  1. Confirm the required consent. Determine whether Governor’s consent, Ministerial consent or another approval is required for the interest and location. AGIS and state registries publish their own procedures.
  2. Execute the correct instrument. Ensure the deed identifies the parties, consideration, parcel, survey reference and prior title accurately and is signed and witnessed as required.
  3. Pay applicable duties and fees. Confirm current stamp-duty, registration, consent and land-charge requirements with the responsible agencies. Amounts and payment channels change; obtain an official assessment.
  4. Submit for registration. File the executed deed, consent evidence, survey and supporting documents in the registry responsible for the parcel.
  5. Collect proof of registration. Retain the registered deed, updated title record or certified evidence of the completed entry.
  6. Re-check before releasing the final balance. If the contract permits staged payment, make registration or verified completion a condition of the final instalment.

Abia’s portal describes a sequence involving title search, Governor’s consent and deed registration for the statutory dealings covered by that service. It is a local example, not a sequence to copy automatically in the FCT or another state.

9. Use professional help at the points where errors are costly

Nigerian property lawyer

A conveyancing solicitor can interpret the title search, identify a missing link in the root of title, verify execution and authority, draft protective contract terms and guide consent, duty and registration filings. Ask the lawyer to state in writing what was searched, what documents were reviewed and what remains conditional.

Licensed land surveyor

A surveyor checks coordinates, beacons, plan registration, physical boundaries and possible acquisition or overlap issues. Provide the complete title pack rather than asking for a stand-alone measurement.

Professional advice is independent of official verification. A lawyer or surveyor cannot replace the registry’s record, and a registry search cannot replace a site inspection or legal review.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

10. Red flags that justify pausing the transaction

  • The seller refuses to disclose the file number, original title or acquisition history.
  • The search is conducted by an agent who will not provide the issuing agency’s report number.
  • Names, plot numbers, dimensions or survey references differ between documents.
  • The seller says a certificate of occupancy automatically proves undisputed ownership.
  • An attorney presents an unregistered, expired, revoked or overly broad power of attorney.
  • A company cannot show current corporate identity or approval to dispose of the land.
  • Family or customary representatives cannot explain who must consent.
  • The survey plan cannot be located in official records or does not match the ground.
  • Occupants, neighbors or public notices indicate a competing claim, acquisition or court case.
  • You are pressured to pay the full price before consent, registration or a fresh search.

Put the issue and the required cure in the contract. If it cannot be independently cured, walk away rather than treating a discounted price as compensation for an unknown title risk.

11. A practical pre-payment checklist

Use this checklist with your lawyer and surveyor. Mark an item complete only when you have documentary evidence.

  • ☐ The parcel’s jurisdiction and responsible registry are confirmed.
  • ☐ Location, plot/file number, survey reference and title reference identify one parcel.
  • ☐ An official, numbered title search has been obtained and authenticated where possible.
  • ☐ The registered holder and every recorded dealing have been compared with the seller’s documents.
  • ☐ The root-of-title chain is complete for the claimed acquisition route.
  • ☐ Seller identity, joint-holder consent, family/customary authority, company authorization or power of attorney has been verified as applicable.
  • ☐ A licensed surveyor has matched the registered plan and coordinates to the physical land.
  • ☐ Mortgages, caveats, court orders, suits, acquisition, revocation, charges and competing applications have been investigated.
  • ☐ A Nigerian property lawyer has reviewed the title and transaction documents.
  • ☐ Required consent, duties, fees and registration steps are confirmed with the relevant agency.
  • ☐ The payment schedule protects you until the agreed registration or completion evidence is delivered.

12. What a safe decision looks like

Proceed only when the official register, document chain, seller authority and physical parcel tell the same story and no unresolved restriction remains. If one part is clear but another is not—for example, a registered certificate with an unverified survey, or a matching plan with an incomplete inheritance record—you do not yet have a complete title check.

Procedures, forms, charges, processing times and public-access rules can change. Before committing funds, read the current instructions of the registry responsible for the parcel and obtain a fresh search. Treat the FCT and Abia examples above as illustrations of jurisdiction-specific practice, not a nationwide promise.
