Do not treat a large projected refund, a polished presentation, or a tax professional’s title as proof that a tax-credit promotion is valid. Verify the person and the promise separately: obtain the preparer’s full name and active PTIN, check credentials and representation rights, require the exact credit and tax-year authority in writing, test the eligibility calculation against current IRS instructions, and inspect the completed return before signing.
A PTIN is required for anyone paid to prepare federal tax returns, but it does not prove expertise in a particular credit or give broad authority to represent you before the IRS. The IRS directory is useful for selected credentialed professionals, yet it is not a complete list of every legitimate paid preparer. The process below is designed to uncover unsupported claims without declaring a specific arrangement illegal before its facts and current law are checked.

What verification can—and cannot—prove
There are two different questions in a tax-credit pitch:
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
- Who is allowed to prepare or represent taxpayers? This is an identity, credential, and authority question.
- Does this particular credit claim fit your facts? This is a legal, factual, and mathematical question.
A person can satisfy one question and fail the other. Someone with an active PTIN may prepare federal returns for compensation while lacking the subject-matter expertise or representation rights you need. Conversely, a credentialed professional still has to support the specific credit with the correct tax year, eligibility facts, and calculations. Verification reduces risk; it is not a government endorsement of a promoter’s product or business model.

Step 1: Capture the entire pitch before you evaluate it
Sales conversations often stay vague until you ask for documents. Save the advertisement, slide deck, email, text messages, contract, invoice, and any refund projection. Then ask for a written answer to each item below.
- Exact credit name: Ask whether the proposal concerns a credit, deduction, exclusion, filing status, or an arrangement that combines several provisions. “Tax incentive” is not precise enough.
- Tax year: Rules and forms can change. Require the year or years for which the promoter says you qualify.
- Eligibility facts: Ask which facts about your income, expenses, employees, dependents, education, business activity, ownership, residency, or filing status establish eligibility.
- Legal authority: Request the statute, regulation, IRS form and instructions, or other official authority the promoter is relying on. A citation should lead to a provision that actually applies to your facts and year.
- Calculation: Request every assumption, input, limitation, phase-out, allocation, and adjustment used to reach the claimed amount.
- Fees and incentives: Get the total fee, when it is due, and whether it changes with the refund or credit. A payment tied to the size of a claimed benefit can create a conflict that deserves independent review.
- Filing responsibility: Ask who will prepare, sign, electronically file, and retain the return, and whether the promoter is merely referring you to someone else.
- Refund destination: Confirm that any refund will be deposited into an account you control, not an account owned or controlled by the preparer or promoter.
Do not rely on a verbal assurance that “the IRS has approved” a strategy. Ask for the precise approval, ruling, or instruction being referenced and read it yourself or have an independent professional interpret it.
Step 2: Identify the individual who will prepare the return
Businesses often market a service under a company name, but the legal responsibility for a paid federal return attaches to the individual preparer. Ask for the full name of the person who will actually prepare and sign your return and that person’s PTIN. If several people will work on the return, obtain the name and role of each one.
Recommended Free Tools
An active PTIN establishes that the person has the IRS identification required for paid federal return preparation. It does not establish that the person is an attorney, certified public accountant, enrolled agent, or tax-credit specialist. It also does not grant broad representation rights before the IRS. Treat the PTIN as an identity and compliance checkpoint, not as a quality rating.
Step 3: Check credentials and representation rights
The IRS distinguishes professional credentials, program qualifications, and PTIN-only preparation authority. The practical differences are summarized here.
| Category | What it generally establishes | Representation rights before the IRS | What it does not establish |
|---|---|---|---|
| Attorney | A professional law license, subject to applicable rules | Broad rights, subject to IRS rules and the attorney’s practice status | Expertise in the particular credit or tax year |
| Certified public accountant | A state-issued accounting credential, subject to applicable rules | Broad rights, subject to IRS rules and the CPA’s status | That the CPA has reviewed this promoter’s method or specializes in the credit |
| Enrolled agent | IRS-recognized tax credential | Broad rights, subject to applicable rules | That the enrolled agent endorses a projected refund |
| Annual Filing Season Program participant | Completion of the IRS program’s specified requirements for that year | Limited representation rights | Broad authority or expertise outside the program’s scope |
| Active PTIN without one of these credentials or program qualifications | Permission to prepare federal returns for compensation when other requirements are met | Generally no authority to represent clients before the IRS | Expertise, independence, or correctness of a promoted claim |
Credential status and representation rights can change. Check the current IRS credential guidance and, where relevant, the licensing authority for the professional’s state. Ask the person to explain education, continuing training, and experience with the exact credit rather than assuming a credential answers those questions.

Step 4: Use the IRS directory without overreading it
The IRS directory lists selected tax professionals who have active PTINs and specified credentials or program qualifications. It can help confirm a listed person’s name, category, and participation. It is not a complete roster of all valid paid preparers.
Free tools Windows power users keep installed
One-click scans. No signup required.
Noncredentialed preparers who are not Annual Filing Season Program participants are excluded. Some otherwise eligible professionals choose not to appear. Therefore:
- A listing supports the existence of a reported credential or qualification; it does not prove the promoter’s tax strategy is sound.
- An absent listing is a reason to ask for qualifications, education, training, and licensing details; it is not, by itself, proof of misconduct.
- A company name in an advertisement may not match the individual listed in the directory. Match the individual’s full name and ask who will sign the return.
If the promoter refuses to provide a full name or PTIN, you cannot perform even this limited identity check. Treat that refusal as a serious warning and do not provide sensitive records until the issue is resolved.
Step 5: Turn a promise into a checkable tax claim
“You will get a huge refund” is an outcome prediction, not an explanation. Convert it into a set of propositions that can be tested against official material for the relevant year.
Find the governing provision
Ask which statute, IRS publication, form instruction, or regulation creates the benefit. Search the IRS material for the exact credit name and tax year. Confirm that the provision applies to your taxpayer type and activity, not merely to a superficially similar situation.
Test every eligibility fact
Write down the facts the promoter says matter and compare them with your records. Depending on the credit, the decisive facts could include earned income, business costs, dependent relationships, school enrollment, qualified wages, ownership, dates, residency, or filing status. If the promoter says a fact is irrelevant, ask for the authority supporting that conclusion.

Recalculate from source documents
Use your actual Forms W-2, 1099s, invoices, payroll records, tuition statements, receipts, and prior returns. Reperform the arithmetic with the official worksheet or form instructions. Ask how limits, phase-outs, refundable portions, carryovers, and interactions with other credits were handled. A projection that cannot be reproduced from your records is not a reliable estimate.
Separate a tax reduction from a refund
A credit may reduce tax, be refundable, or be limited by other rules. A refund also depends on payments and withholding already made. Ask the promoter to show how the claimed credit changes both your tax liability and your refund, rather than presenting one large number without the underlying return.
Seek an independent second opinion for complex arrangements
For a complicated or unusually large claim, ask an independent credentialed tax professional who is not paid to sell the promoted arrangement. Give that reviewer the written pitch, calculations, source documents, proposed contract, and fee terms. Request a written scope stating whether the reviewer is checking eligibility, arithmetic, filing mechanics, representation, or all four.
Step 6: Review the return before you sign
You remain responsible for a federal return filed in your name, even when someone else prepared it. Do not sign until you have received a complete copy and checked the entries against your records.
- Confirm the return is complete, including every schedule and attachment used to claim the credit.
- Confirm the paid preparer signs the return and includes a PTIN where required.
- Check your name, address, filing status, dependents, income, withholding, expenses, and bank details.
- Verify that the refund is directed to your own account or another account you expressly control.
- Reject invented income, expenses, withholding, dependents, business activity, or eligibility facts, even if the promoter says the change is routine.
- Never sign a blank, incomplete, or unreviewed return.
- Keep the signed return, worksheets, source documents, contract, invoices, and communications.
A preparer who will not provide a copy, refuses to sign, asks you to sign blank forms, or directs the refund to the preparer’s account is not giving you a normal review opportunity. Stop the filing process until an independent professional has assessed what happened.
Concrete warning signs the IRS highlights
The IRS warns about abusive promotions marketed with false claims of legitimacy, unusually large deductions, or promises to eliminate or substantially reduce tax liability. A claimed valuation or benefit may be false or fraudulent; the size of the promised refund is not evidence that the claim is allowed.

Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What due diligence by a preparer actually shows
For the earned income tax credit (EITC), child tax credit, additional child tax credit, credit for other dependents, American opportunity tax credit, and head-of-household filing status, paid preparers have specific due-diligence and recordkeeping duties. Depending on the claim, those duties include completing and submitting Form 8867, computing the credit, making reasonable follow-up inquiries when information appears incorrect, inconsistent, or incomplete, documenting questions and answers, and retaining required records.
The IRS’s Form 8867 guidance states: “Form 8867 shows you some factors to consider, but completing the form is not a substitute for performing all the required due diligence actions when determining a client’s eligibility for each credit or HOH filing status or computing the amount of each credit.”
That distinction matters. A completed checklist or a copy of Form 8867 is not independent proof that the taxpayer qualifies or that the amount is correct. These specific rules should not be generalized to every tax credit. IRS guidance accessed in 2026 states a $500 penalty per failure for a covered paid-preparer due-diligence failure; that is a legal penalty amount, not a statistic showing how often failures occur.

| Route | Best use | Strength | Limitation |
|---|---|---|---|
| Official self-checks | Clear, ordinary credits and basic identity questions | Direct access to current IRS rules and forms; no promoter incentive | You must interpret the rules and perform the calculations yourself |
| Independent credentialed review | Large, novel, or fact-intensive claims | A reviewer can test authority, facts, arithmetic, and filing consequences | Fees vary; a credential does not guarantee expertise in this particular credit |
| Both routes | Claims with significant financial or examination risk | Combines source verification with expert interpretation | Requires more time and complete documentation |
When selecting an independent reviewer, ask about the exact credit and tax year, relevant credentials and representation rights, experience with similar facts, independence from the promoter, written engagement scope, and fee. The official IRS directory can help locate some credentialed professionals, but it does not establish subject-matter expertise.
What to do when the claim appears abusive
Preserve the pitch, contract, payment records, return, worksheets, bank instructions, and correspondence. Do not delete messages or alter the return to conceal the issue. If you have information about a suspected abusive tax promotion or preparer, the IRS Office of Promoter Investigations directs reports through Form 14242 and its document upload tool. That office investigates promoters and enablers and may refer matters to other IRS or Justice Department offices.
The reporting route for suspected promotion or preparation is distinct from the IRS Whistleblower Claim process used by people seeking an award. Follow the current submission instructions on the IRS reporting page. Reporting does not replace obtaining advice about your own filing, tax liability, examination, or deadlines.

Proceed only when you can answer all of these questions with documents:
- Who exactly will prepare and sign the return, and what is that person’s PTIN?
- What credential or qualification does the person hold, and what representation rights follow from it?
- Which credit and tax year are involved?
- What official authority supports the eligibility requirements?
- Which of your documented facts satisfy each requirement?
- Can you reproduce the calculation from official instructions?
- What are the total fees, and do they depend on the claimed refund?
- Will you receive and review a complete return before signing?
- Will the refund go to an account you control?
If the promoter cannot provide these answers, pause. A smaller legitimate benefit that can be documented is safer than a dramatic promise that depends on secrecy, invented facts, or an unverifiable interpretation.
