Read the transfer notice, determine whether it changes servicing or only ownership, compare the effective and payment-acceptance dates with your records, and confirm the new company and payment destination through a trusted channel. Then update your bank or credit-union bill-pay instruction, allow extra processing time, and check the next HELOC statement.
Do not assume that the federal mortgage-servicing protections commonly discussed for closed-end mortgages automatically apply to a HELOC. A HELOC is an open-end home-equity plan, and Regulation X’s mortgage-loan servicing definition excludes open-end lines of credit. Your HELOC agreement and other applicable rules control unless a qualified consumer-protection authority or the servicer confirms otherwise.

What a HELOC servicer transfer actually changes
A servicer is the company that receives your payments, posts them to the account, sends statements, handles payment questions, and performs other day-to-day administration. A servicing transfer changes that company. It does not necessarily change who owns the debt.
A loan sale is different: ownership of the HELOC is assigned to another owner, while the same company may continue collecting payments. A sale alone does not mean you should redirect a payment. Follow a new payment destination only after you have confirmed that servicing, rather than ownership alone, changed.

Why the distinction matters
- A notice can announce an ownership change while stating that the current servicer remains the payment recipient.
- A servicing notice should identify who will receive payments after a specified effective date.
- Your interest rate, draw terms, repayment terms, credit limit, or other contract provisions do not change merely because servicing changes. Any proposed contract change should be reviewed separately under your HELOC agreement.
The Consumer Financial Protection Bureau’s model language for a covered mortgage-servicing transfer says, “Nothing else about your mortgage loan will change.” That is model notice language for the products covered by the cited rule, not a blanket promise about every HELOC.
Why Regulation X does not automatically protect every HELOC
Regulation X, including 12 C.F.R. § 1024.31 and § 1024.33, defines “mortgage loan” for its servicing subpart but expressly excludes open-end lines of credit, including home-equity plans. A HELOC is generally an open-end line: you can borrow, repay, and borrow again up to the line’s limit during the draw period.
That exclusion means you should not present the federal mortgage-servicing transfer notice rules, deadlines, or payment safe harbor as universal HELOC rights. A particular HELOC could be subject to other federal or state requirements, contract terms, or a different legal classification. Check the agreement that governs your account and ask the servicer which transfer requirements apply. If you believe a transfer is mishandled, an appropriate consumer-protection authority can explain which rules cover your situation.

How do I verify a HELOC servicer transfer?
- Keep the entire notice. Save the envelope or electronic header, every page, attachments, and any follow-up message. Do not rely on a cropped screenshot or a single page that omits payment instructions.
- Identify what changed. Look for words such as “servicing transfer,” “new servicer,” “effective date,” “servicing rights,” “assignment,” or “sale.” Decide whether the communication changes the company handling payments, the owner, or both.
- Compare the notice with your existing records. Use your prior statement, HELOC agreement, online account, and bank bill-pay record. Check the account number, property address, current servicer name, and the contact information you already have. For a covered mortgage-loan transfer, a compliant notice identifies the transfer effective date, old and new servicer contacts, and the dates each servicer stops or starts accepting payments. A model notice also gives the new payment destination. Those details are useful checkpoints, but their presence does not by itself make a HELOC subject to Regulation X.
- Confirm through a trusted route. Call the number printed on a prior statement or use a secure website address that you obtained independently from your existing records. Do not use an unfamiliar phone number or payment link supplied only in an unexpected email or text. Ask the representative to confirm the servicer’s legal name, your account identifier, the effective date, the last date the old company accepts payments, the first date the new company accepts them, and the exact address or electronic destination for payments.
- Record the confirmation. Write down the date and time, the representative’s name or identification number if provided, the number you called, and the answers. Keep copies of the notice and your notes with your payment records.
Information to reconcile before you change anything
| Item | What to check | Why it matters |
|---|---|---|
| Change type | Servicing transfer, ownership sale, or both | A sale does not necessarily change where payments go. |
| Effective date | The date the new servicer takes over | It determines when a new payment instruction should begin. |
| Payment-acceptance dates | When the old company stops and the new company starts accepting payments | Sending a payment during a transition window can create posting delays. |
| Servicer identity | Legal name, mailing address, phone number, and secure online channel | Confirms that you are dealing with the right company. |
| Payment destination | Mailing address, electronic bill-pay address, routing details, or portal instructions | Prevents a payment from going to an impostor or obsolete account. |
| Account reference | HELOC account number or other identifier shown in both records | Helps the new servicer apply the payment to the correct line. |
How do I update my payment settings?
Change an existing payment instruction only after the recipient and dates are independently confirmed. The exact screens differ by bank, but the sequence below works for most online bill-pay services.
- Open your bank or credit union’s bill-pay controls. Sign in through your normal app or website, not through a link in the transfer message.
- Find the existing HELOC payee. Review the payee name, mailing address or electronic destination, account number, payment amount, and delivery date. Take a screenshot or download a confirmation before editing.
- Edit or replace the payee using the verified instructions. Enter the new servicer’s information exactly as confirmed. If the bank treats the new company as a separate payee, create the new payee and stop the old one only after checking whether an in-flight payment remains.
- Set the first delivery date with a margin. Bill-pay systems may send a check by mail or require processing time before an electronic payment reaches the servicer. Schedule early enough to meet the HELOC’s due date, while following the new servicer’s instructions about the earliest acceptable payment.
- Check recurring and one-time payments. A recurring instruction, a scheduled extra payment, and a manually entered payment may be separate. Review each one. Cancel obsolete future payments to the old payee only after confirming that none has already been released.
- Save the bank’s confirmation. Retain the confirmation number, scheduled date, amount, destination, and any delivery estimate.
Automatic debits and recurring transfers
If the old servicer pulls money by ACH or another automatic-debit authorization, do not assume that authorization will migrate. Ask the new servicer how to enroll in recurring debit and whether a new authorization is required. At the same time, review your bank account for a pending debit from the old company. A bill-pay service that mails a check is different from a servicer-initiated automatic debit; update each arrangement separately.
Mailing a check during the transition
Allow additional time when your bank sends a paper check. Keep the check number, amount, mailing date, delivery estimate, and any tracking information. Do not mail cash. If the new servicer provides a payment coupon or a special address for overnight or regular mail, use the address that was confirmed through a trusted channel.

What to do after the first payment
Review the next statement or secure-account transaction history. Confirm that the payment amount, date received, principal or balance treatment, interest, fees, and available credit are shown correctly. Compare the posted information with your bank confirmation and the HELOC agreement.

- If the payment destination in the notice differs from the destination confirmed by an existing statement or secure account, stop and resolve the discrepancy before sending another payment.
- Keep the transfer notice, statements, bank confirmations, correspondence, and call notes until the transition is fully reconciled.
What if I already paid the prior servicer?
For a mortgage loan covered by Regulation X, during the 60-day period beginning on the servicing-transfer effective date, a timely payment received by the old servicer may not be treated as late for any purpose. The former servicer is also directed to promptly transfer a misdirected payment to the new servicer or return it and notify the borrower of the correct recipient.
Do not assume that 60-day protection applies to your HELOC. Because open-end home-equity plans are excluded from Regulation X’s mortgage-loan servicing definition, the cited rule cannot automatically be promised for this product. Contact both servicers promptly, document exactly when and how you sent the payment, and review your HELOC contract and applicable state or federal requirements. Ask each company to confirm in writing how the payment will be credited and whether any fee, late status, or other account consequence has been applied.

Information to provide when a payment is misdirected
- The transfer effective date and the date you sent the payment
- Amount, method, and confirmation or check number
- Old and new account numbers, if they differ
- Bank or bill-pay delivery confirmation
- Copies of the notice, statement, and any message directing payment
- Names, dates, and reference numbers from calls with both servicers
How to compare multiple notices or messages
If you receive more than one letter, email, portal message, or statement, compare them side by side instead of acting on the newest message alone.
| Comparison axis | Questions to ask |
|---|---|
| Servicing versus ownership | Does the message say who will receive and handle payments, or only who owns the loan? |
| Dates | Are the effective date, old-servicer stop date, and new-servicer start date consistent? |
| Identity and destination | Does the servicer name match your independent confirmation, and is the payment destination the same? |
| Product coverage | Is this a closed-end mortgage loan potentially covered by the cited Regulation X rule, or an open-end HELOC excluded from that definition? |
| Account details | Do the account number, borrower name, property address, and balance context match your records? |
Inconsistencies are a reason to pause and call through a trusted route, not a reason to guess which instruction is correct.

Warning signs of a fraudulent payment change
- An urgent demand to pay immediately or lose access, without a matching notice in your secure account or prior statements
- A request to send funds to a person, cryptocurrency wallet, gift card, or unrelated business
- A payment address that changes repeatedly or differs between messages without explanation
- Spelling, account-number, or property-address errors
- A request for your online-banking password, one-time authentication code, or full credentials
- A phone number or web address that you cannot verify from existing records
Do not click a payment link in a suspicious message. Contact the servicer using a number from a prior statement, your existing secure portal, or another independently obtained official source. If you disclosed banking credentials or sent money to a suspected impostor, contact your bank immediately and preserve the messages and transaction records.

What the notice should—and should not—change
A genuine servicing transfer normally changes the payment recipient and the channels for statements and support. It should not, by itself, rewrite the HELOC contract. Compare the first statement from the new servicer with the last statement from the old one for balance, interest-rate terms, fees, payment due date, and available credit. A difference may reflect ordinary posting timing, but unexplained changes require a written explanation.
Do not stop making scheduled payments merely because a transfer is confusing. If the destination is uncertain, contact both companies immediately and ask for written instructions while keeping enough funds available to meet the contractual obligation once the correct destination is established.
Who to contact when the transfer is not resolved
- New servicer: Ask for a payment investigation and written confirmation of how the account will be credited.
- Former servicer: Ask whether it received the payment and, if so, when it transferred or returned it.
- Your bank or credit union: Obtain bill-pay delivery records, stop or correction options, and any return information.
- Consumer-protection authority: If the companies do not correct the issue, ask an appropriate federal or state consumer-protection authority which rules apply to your HELOC and what complaint process is available.
Describe the issue precisely: “servicing transfer,” “ownership sale only,” “payment sent to prior servicer,” “payment not credited,” or “conflicting payment addresses.” Include dates and documents rather than relying on a general statement that the loan was transferred.
