To claim relief on foreign income in India, first establish your Indian tax residence for the relevant year, identify the country and type of income, and confirm whether India has a tax treaty with that country. A resident generally reports worldwide income in India and claims credit for qualifying foreign tax; a nonresident follows a separate treaty-relief process for income taxable in India. The credit is not automatic, and paying tax overseas does not by itself make the income exempt in India.
Start by identifying the claim you are actually making
“DTAA relief” can describe two different situations. The correct form, calculation and evidence depend on which one applies to you.

| Situation | What you are trying to obtain | Main questions |
|---|---|---|
| Indian resident with foreign income | Foreign tax credit (FTC) against Indian tax on the same income | Was the foreign tax paid or deducted? Is the income taxable in India? Is there an applicable treaty, and what limit does it impose? |
| Nonresident receiving income taxable in India | Treaty relief that may limit India’s taxing right or change the applicable rate, subject to the treaty and Indian procedural rules | What is the source and character of the income? Which treaty article applies? What residence and supporting documents are required? |
| Resident of India needing treaty residence evidence | An Indian certificate of residence for treaty interaction | Have you applied to the Assessing Officer using the form applicable to the tax year? |
These routes should not be combined. A resident’s foreign tax credit claim is not the same as a nonresident’s request to apply a treaty article, and a residence certificate is not a foreign tax credit form.

Residence is determined for the particular tax year, not permanently. Your status affects whether India generally taxes worldwide income or only income that falls within India’s taxing scope. Keep the residence analysis separate from the place where the foreign payer is located or where tax was withheld.

- Determine whether you were resident, nonresident or otherwise classified under the Indian rules for the year concerned.
- Record the tax year and return year to which each item belongs.
- If residence is disputed, or you may be resident in two countries, examine the treaty’s residence article and tie-breaker provisions rather than assuming that a foreign residence document settles the Indian position.
- Use a treaty residence certificate where the relevant treaty or foreign procedure requires one. For an Indian resident, the notified Income-tax Rules, 2026 provide an application to the Assessing Officer in Form 42; after the officer is satisfied, the certificate is issued in Form 43.
Form 42 and Form 43 establish residence for treaty interaction. They do not replace the return schedules or foreign tax credit procedure used to claim credit for tax paid abroad.
2. Identify the income and read the matching DTAA article
A DTAA is not one universal foreign-income exemption or rate. It allocates taxing rights by income category and contains definitions, source rules, maximum rates and conditions. Classify each item before calculating relief.
Build an income inventory
- Country in which the income arose and country that imposed the tax.
- Income category, such as employment, business or professional income, interest, dividends, rent, royalties, capital gains or pensions.
- Gross income, allowable expenses and the amount included in the Indian computation.
- Foreign tax withheld at source, assessed later, paid directly, refunded or still under dispute.
- The Indian tax year or years in which the income is offered to tax or assessed.
Then locate the article in the India–country treaty that governs that category. The article may permit both countries to tax with a credit, assign exclusive taxing rights to one country, or impose a maximum withholding rate. A treaty limit can be lower than the amount actually withheld; tax above the treaty-permitted amount is not automatically creditable.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitches3. Choose the legal route: treaty relief or unilateral relief
For legacy-law reporting, the Income Tax Department’s schedule guidance distinguishes agreement-based relief under sections 90 and 90A from unilateral relief under section 91.
| Route | When it is relevant | What controls the result |
|---|---|---|
| Sections 90/90A | India has an applicable agreement with the foreign country or specified territory | The treaty article, Indian law, the foreign tax actually imposed and any treaty ceiling or conditions |
| Section 91 | No applicable agreement covers the income and foreign tax | The statutory unilateral-relief conditions and limits for the year |
Do not select a treaty route merely because foreign tax appears on a payslip or broker statement. Verify that the country, income type and tax are covered by the relevant agreement. Conversely, do not use section 91 when an applicable treaty governs the item.
4. Calculate a resident’s foreign tax credit under the 2026 Rules
The notified Income-tax Rules, 2026 set out the timing, source-by-country calculation, currency conversion and limitation mechanics. Check that those rules govern your particular tax year; earlier years may use the law and forms then in force.
Credit is tied to the Indian tax year of the income
Credit is allowed in the tax year in which the corresponding foreign income is offered to tax or assessed in India. If one item is recognized over several Indian tax years, allocate the foreign tax across those years in the same proportion as the income. A payment date by itself does not decide the Indian credit year.

Calculate separately by country and source
Compute the credit separately for each source of income from each country. Do not pool tax on dividends from one country with tax on employment income from another, or use excess credit from one source to erase Indian tax on a different source unless the governing rules expressly permit it.
Apply the lower-of-two-amounts limit
The general limit is the lower of:
- Indian tax payable on the relevant foreign income; and
- qualifying foreign tax paid on that income.
There is an additional treaty restriction: foreign tax above the amount permitted under the applicable relief agreement is disregarded. The calculation is therefore not a promise of a full offset or a refund of all foreign withholding.
Convert the foreign tax using the specified rate
The 2026 rule specifies conversion using the telegraphic transfer buying rate on the last day of the month immediately before the month in which the foreign tax was paid or deducted. Keep the exchange-rate evidence and the date of payment or deduction used in the calculation.
Handle disputed foreign tax separately
Foreign tax under dispute is generally not credited while the dispute remains unresolved. The rules provide for credit after settlement when the prescribed evidence and undertaking are furnished. If foreign tax is later refunded or reduced, reassess the Indian credit and any resulting tax or interest consequences.
5. Gather the records before opening the return
A defensible claim reconciles the foreign income, the foreign tax and the Indian return entry. Assemble one file for each country and income source.
- Foreign tax certificate, assessment, withholding statement or other official statement identifying the taxpayer, income and tax.
- Proof that the tax was paid or deducted, such as payment confirmation, withholding record or bank statement.
- Foreign income statement, payslips, broker reports, rental accounts or business records showing the gross amount and dates.
- Indian computation showing where the same income is included.
- Exchange-rate record supporting the conversion required for the relevant payment or deduction date.
- Treaty residence evidence and correspondence where treaty benefits depend on residence.
- Documents showing any appeal, refund, adjustment or settlement of the foreign tax.
Statements that show only a net amount are often insufficient. You need to be able to trace the gross foreign income and the exact foreign tax to the figure reported in India.
6. Report the income and relief in the Indian return
The Income Tax Department’s return guidance uses Schedule FSI to report foreign-source income and Schedule TR to summarize relief. The entries are designed to be reconciled country by country.

Schedule FSI: disclose the foreign income
Enter the country, the taxpayer identification number or equivalent foreign identifier, the income and the foreign tax details requested for the applicable return year. Use the same country and source classification used in your working papers.
Quick wins for a faster PC:

Summarize the relief claimed, identify the applicable provision, and, where treaty relief is used, provide the relevant DTAA article. The section 90/90A versus section 91 choice should agree with the legal analysis and the figures in Schedule FSI.
Do not report only the credit and omit the foreign income. The foreign income must be included under the Indian tax rules even when the resulting credit reduces or eliminates additional Indian tax.
7. Resident filing route under the legacy-law Form 67 process
For the Department’s legacy-law process, Form 67 is filed online to report foreign income and the foreign tax credit claimed. The form manual calls for a certificate or statement and proof of payment or deduction of foreign tax.
- Complete the Indian return computation first so the foreign income and tax agree with the return.
- Prepare the country-by-country and source-by-source FTC calculation, including the treaty ceiling, Indian-tax limit and currency conversion.
- Upload or retain the foreign tax certificate or statement and proof of payment or deduction requested by the form.
- Submit Form 67 online using the account and verification process applicable to the tax year.
- File the income-tax return with Schedule FSI and Schedule TR completed consistently with Form 67.
- Save the submitted form, acknowledgement, schedules and supporting records together.
The Department’s Form 67 FAQ states: “No, it is not mandatory to obtain a CA certificate to verify and confirm the details of the foreign tax credit claimed by you.” That statement is limited to the Form 67 requirement described in that FAQ; it does not remove the need for reliable foreign tax evidence or professional assistance where the law requires it for another purpose.
Check the deadline instead of relying on an old checklist
The same legacy guidance says Form 67 should be filed by the due date for the section 139(1) return. India is transitioning to the Income-tax Act, 2025 framework, and forms or deadlines may change. Confirm the form name, filing window and return-year instructions shown by the Department for the specific tax year before submitting.
8. Nonresident treaty relief is a different filing path
A nonresident who is taxed in India on an item may seek treaty relief under the relevant treaty and Indian rules. This is not the resident FTC process described above.

The Department’s Form 41 manual describes an online information-filing pathway for a nonresident seeking treaty relief under the Income-tax Act, 2025, with supporting information and documents. Because the Act and forms are transitioning, confirm the current Form 41 instructions and the treaty article applicable to the tax year.
Information a nonresident should organize
- Foreign-country residence evidence for the period concerned.
- Details of the Indian payer, transaction, amount and withholding.
- The treaty article relied on and the facts satisfying its conditions.
- Beneficial-ownership, permanent-establishment or other status information if the article requires it.
- Contracts, invoices, payment records and prior correspondence supporting the classification.
Do not use Form 41 merely because you paid tax in another country. The question is whether the treaty limits India’s tax on the Indian-source item and whether the procedural requirements for claiming that limitation have been met.

9. Worked examples of the credit limit
Example: foreign tax lower than Indian tax
Assume, purely for illustration, that foreign employment income included in an Indian return produces Indian tax of ₹80,000 attributable to that income. Qualifying foreign tax on the same income is ₹50,000, and the treaty permits the full ₹50,000. The general credit limit is ₹50,000, the lower of the two amounts. The remaining ₹30,000 of Indian tax is not erased by the foreign payment.
Example: foreign tax higher than Indian tax
Assume Indian tax attributable to a foreign dividend is ₹40,000, while qualifying foreign tax is ₹60,000. If the treaty permits ₹60,000, the credit is generally limited to ₹40,000. The excess is not a general-purpose credit against unrelated income.
Example: withholding above the treaty ceiling
Assume a treaty article permits a maximum foreign tax of ₹25,000 on a payment, but ₹35,000 was withheld. Even if Indian tax on that income is ₹50,000, the amount above the treaty-permitted ₹25,000 is disregarded for the treaty-based credit calculation. The excess may require a foreign refund or correction under that country’s procedure rather than a larger Indian credit.
Example: income spread over two Indian years
Assume a foreign award is recognized 60% in one Indian tax year and 40% in the next, and the related foreign tax is ₹100,000. The 2026 rules allocate the credit in the same proportion: ₹60,000 to the first year and ₹40,000 to the second, subject in each year to the Indian-tax and treaty limits.
10. Common mistakes and how to correct them
“Foreign tax was withheld, so the income is exempt in India.”
Incorrect. A resident generally reports the foreign income in India and claims a credit subject to the applicable limits. A treaty may allocate taxing rights or cap a rate, but it does not create a blanket exemption for every foreign receipt.

Using one country-wide percentage for every income type
Interest, dividends, services, employment income, rent, royalties and gains can fall under different treaty articles. Reclassify each item before applying a rate or credit limit.
Pooling all foreign tax into one figure
The 2026 rules require computation separately for each source of income from each country. Rebuild the calculation if the working paper nets countries or unrelated sources.
Claiming tax that was only assessed, disputed or later refunded
Retain proof of payment or deduction, identify any dispute and follow the rule for postponed credit where tax is contested. If the foreign authority refunds or reduces the tax, update the Indian position.

Using the wrong form
Form 67 belongs to the legacy-law resident FTC process described by the Department. Form 41 is the separate nonresident treaty-relief information route under the 2025 Act materials. Form 42 is an Indian resident’s application for a residence certificate, and Form 43 is the certificate issued after approval. None of these forms should be substituted for another without checking the tax-year instructions.
Ignoring the currency-conversion date
Do not use an arbitrary annual average or the date on which you prepared the return. The 2026 rule points to the telegraphic transfer buying rate on the last day of the month immediately before the month of payment or deduction.
Filing inconsistent schedules
Country, taxpayer identifier, income, foreign tax, relief provision and treaty article should reconcile across the computation, Schedule FSI, Schedule TR and any Form 67 submission. Inconsistencies invite clarification even where the underlying tax was genuinely paid.
11. A practical decision checklist
- Write down the exact Indian tax year and your residence status for that year.
- List every foreign income item by country, source and gross amount.
- Identify the foreign tax paid or deducted and whether it was refunded, disputed or settled.
- Check whether India has a treaty with the country and read the article for that income type.
- Select sections 90/90A for agreement-based relief or section 91 where the unilateral-relief conditions apply and no treaty governs the item.
- Allocate income and credit to the Indian year in which the income is offered or assessed, including proportional allocation across years where required.
- Calculate separately by country and source, applying the lower-of-Indian-tax-or-qualifying-foreign-tax limit and any treaty ceiling.
- Convert the foreign tax using the specified telegraphic transfer buying rate and retain the rate evidence.
- Complete Schedule FSI and Schedule TR, then use the resident Form 67 process or the nonresident Form 41 process only if it matches your status and tax year.
- Retain certificates, statements, payment proof, residence evidence and dispute or refund records.
When professional advice is particularly useful
Consider advice from a qualified Indian tax professional when your residence is disputed, two countries claim you as resident, the treaty classification is uncertain, foreign tax is under appeal, a refund has been received, or income is recognized over several Indian tax years. Those facts can change the article, timing, evidence and amount of relief, and a generic Form 67 calculation may not resolve them.
