1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsThere is no single worldwide form for putting a relative’s property in your name. The correct deed, signatures, taxes, registration office and supporting documents depend first on where the property is located and then on whether the transfer is a gift, sale, inheritance, or change to co-ownership.
Start by identifying the property’s jurisdiction, checking the current title, confirming the relative’s authority and consent, and choosing the correct legal basis. Use the local land registry and tax authority for current requirements. A conveyancer or property lawyer is especially important when there is a mortgage, another owner, an estate, questions about capacity, or any disagreement.

1. Establish the facts before choosing a form
Do not begin with a generic “change of name” form. Ownership is transferred through a legally recognized instrument and then recorded by the land registry. The process can differ even between regions within the same country.
Recommended Free Tools
- Property location: Identify the country and, where relevant, the state, province or territory. The registry, tax authority and filing rules are local.
- Registration status: Find out whether the property is registered, the title or parcel number, and whether the relative is the sole registered owner.
- Transfer basis: Decide whether this is a lifetime gift, a sale or other transfer for value, an inheritance after death, or a transfer of only a share or joint interest.
- Debt and restrictions: Check for a mortgage, charge, lien, lease, court order, restriction or other encumbrance.
- People involved: Confirm the relative is living, willing and legally capable of signing, and identify every co-owner, spouse or other person whose rights may matter under local law.
- Value and consideration: Record any money, assumed debt or other value moving between the parties. “No cash payment” does not always mean there is no taxable consideration.
Without these facts, nobody can responsibly specify the exact deed, witnesses, notarization, tax, filing deadline or completion time.

2. Select the legal route
Lifetime gift or donation
A gift is appropriate when the relative intends to transfer ownership without receiving payment and local law permits that form of donation. The deed or application usually identifies the donor and recipient, the property, the relationship and the absence of consideration. A gift can still trigger registration charges, transfer taxes, reporting duties or lender issues.
In the United Kingdom, HM Revenue & Customs guidance says Stamp Duty Land Tax (SDLT) does not normally apply to a gift with no chargeable consideration. However, if the recipient takes responsibility for some or all of an existing mortgage, that debt can count as consideration and may create an SDLT liability when the relevant threshold is exceeded. A transfer subject to a charge, or a no-value transfer associated with a discharge, can also be treated as an assumption of debt for SDLT or Welsh transaction-tax purposes.
Sale or another transfer for value
If money, debt relief or another monetary benefit is exchanged, treat the transaction as a sale or other transfer for consideration unless the local authority confirms a different classification. The price may affect transfer taxes, valuation requirements, reporting and lender consent. A below-market family sale is not automatically a gift for tax or registry purposes.

After death, do not use an ordinary lifetime-gift route. The will, probate or estate-administration process, succession law and local land-registration rules determine who can receive the property. The personal representative may need authority to deal with the title before it can be registered in a beneficiary’s name. Obtain instructions from the local probate and land authorities or an estate lawyer.
Adding a joint owner or transferring a share
You may need to transfer only a percentage or add your name alongside the relative’s, rather than move the entire title. The instrument must state the new ownership arrangement, and local law may require declarations about how the co-owners hold the property. Existing owners, mortgage conditions and tax consequences must be checked before signing.

3. Compare the routes before signing
| Route | What establishes your right | Tax and debt question | Registration issue |
|---|---|---|---|
| Gift or donation | A local gift or donation instrument signed by the current owner and recipient, with required proof of relationship or other supporting evidence. | Is there truly no consideration, and is a mortgage or other debt being assumed? | The registry must record the gift and any new ownership or restrictions. |
| Sale or transfer for value | A sale or transfer deed stating the consideration and the parties’ obligations. | Which transaction tax applies to the price and any debt taken on? | The registry may require proof of payment, tax filing or lender documentation. |
| Inheritance | A will, probate or estate authority plus the succession documents required locally. | Are estate, inheritance, land-transfer or other taxes payable? | The personal representative and beneficiary may have different filing roles. |
| Share or joint-owner change | A transfer of part or all of the registered title, with the new ownership shares stated. | Does the change create consideration, refinance debt or trigger a transfer tax? | The registry must update the ownership structure, not merely replace a name. |
4. Prepare the documents and approvals
Exact requirements vary, but gather the following information before an appointment with the registry, notary or conveyancer:
- Current original title deed, title certificate or official register extract.
- Government identification for each signing party.
- Property description, parcel or title number and the registered address.
- Evidence of the family relationship when a gift concession or special procedure depends on it.
- Marriage, death, probate or court documents if they affect ownership.
- Mortgage, charge or lien details and written lender instructions where required.
- Valuation or tax assessment if the registry or tax authority requires one.
- Signed powers of attorney or authorization letters, if someone is acting for an owner.
- Tax returns, compliance certificates or municipal clearance documents required in that jurisdiction.
Check whether signatures must be witnessed, notarized, legalized or accompanied by certified translations. Do not sign a deed that describes a gift when the parties have actually agreed on payment or debt relief.
5. Follow a practical transfer workflow
- Confirm the jurisdiction. Locate the land registry and tax authority responsible for the property, not the parties’ home addresses.
- Obtain the title record. Verify the legal owner, parcel description, co-owners, restrictions and registered charges.
- Choose the transfer basis. Document whether it is a gift, sale, inheritance or share transfer and record any consideration, including assumed debt.
- Check authority and capacity. Confirm the owner is alive, willing and capable of signing, and that an attorney, trustee, executor or court has authority where applicable.
- Ask the lender and other co-owners. A mortgage or co-owner interest can change the deed, tax result and filing package. Obtain written instructions before committing to completion.
- Prepare the jurisdiction-specific instrument. Use the official form or a locally qualified professional. Include the correct parties, legal description, consideration and ownership shares.
- Calculate and pay charges. Check current transfer taxes, stamp duties, registration fees, valuation charges and document-printing fees with the relevant authority. Confirm who pays each item.
- Sign with the required formalities. Use the prescribed witnesses, notary, identification certificates, legalization and translation requirements.
- File the complete application. Send the instrument, identity evidence, title documents, tax evidence, authorizations and fee to the correct registry.
- Check the updated register. Ownership has not safely changed merely because a deed was signed. Obtain the updated title or registry extract and correct any rejection promptly.
6. England and Wales: example for registered property
HM Land Registry’s process is an example only; it does not apply universally. Its guidance says an application to change the register is needed when someone becomes a new owner or another person is added as a joint owner.
Transfer of the whole or part
Use the appropriate transfer form for the transaction: a transfer of the whole registered title or a transfer of part. The correct form depends on whether the entire title moves or only a defined portion or interest.
Identity and supporting evidence
A private individual completing the application uses the relevant identity certificate. Include the executed transfer and any evidence required by the register, lender or tax authority. Review the register for restrictions that require consent or a certificate before the application can be completed.

Filing and fees
Check the current HM Land Registry fee for the application, then send the completed forms, supporting documents and payment to the address or filing channel specified by the registry. An owner may apply personally or appoint a solicitor or conveyancer. HM Land Registry cautions that “The process involves legal steps and can be complicated.”
Tax point
For a genuine gift with no chargeable consideration, SDLT normally does not apply under HMRC guidance. If you take over mortgage debt, the assumption can be chargeable consideration. Scotland and Wales operate different transaction-tax systems for relevant property transactions, so do not use an England SDLT answer for property in either country.
7. Qatar: official gift-transfer example
Qatar’s Ministry of Justice describes a gift transfer as a transfer without consideration. Its published requirements include a Qatari ID, the original title deed, an authorization letter where applicable and proof of kinship.
The service page lists a QAR 500 transaction fee, a fee of 0.25% of the property value and QAR 100 for printing the title deed and/or site plan. It also notes exemptions in cases specified in a 2026 ministerial decision. These are Qatar-specific service figures, not a general cost estimate; confirm the current page and whether an exemption applies before filing.
The Qatar example shows why a family relationship alone is not enough: the registry still requires identity, title and relationship evidence, and the transfer must fit the authority’s definition of a gift.

8. Guyana: official gift-transfer example
Guyana’s Land Registry lists a transfer, affidavits from the donor and donee, tax and municipal compliance, original title certificates and a valuation less than three years old among the requirements for a gift transfer.
The registry also lists value-based fees and duty, plus a certificate charge reported as $30. Because the amount and calculation depend on the property and current schedule, obtain the registry’s latest fee instructions before preparing payment. These requirements cannot be substituted for the forms used in another country.
9. Taxes, mortgages and total cost
Mortgage debt is not an afterthought
Ask whether the recipient will keep paying an existing mortgage, refinance it, release the relative, or take the property subject to the charge. The tax authority may treat assumed debt as consideration even when the parties call the transaction a gift. The lender may also require an application, valuation, new loan documents or a formal release.
Costs to budget
- Transfer, stamp or land-transaction tax where applicable.
- Registry or title-update fee.
- Notary, witnessing, legalization and certified-translation charges.
- Valuation, survey, plan or document-printing fees.
- Mortgage lender, discharge or refinancing costs.
- Professional fees for a conveyancer, property lawyer, tax adviser or estate lawyer.
Do not rely on an old rate, threshold or fee schedule. The HMRC guidance used for the UK tax explanation was updated in September 2022, while government service fees and exemptions can change. Check the current authority page for the property’s location immediately before signing and filing.

10. Common failure points and fixes
The wrong instrument was used
A gift deed cannot substitute for probate after death, and a whole-title form may be wrong when only a share is being transferred. Stop and have the registry or local professional identify the correct route before resubmitting.

The title contains another owner or restriction
All required owners must participate, and a restriction may require consent or a certificate. Obtain an official register copy and resolve each restriction rather than filing a deed that the registry cannot accept.
The parties call it a gift but debt or payment exists
Disclose the mortgage assumption, cash payment, debt release or other value. Recalculate the tax treatment and amend the instrument before execution.
The owner lacks capacity or someone is acting for them
Use the local power-of-attorney, guardianship, trustee or court-authority process. Do not ask a relative to sign informally on another person’s behalf.

11. When professional help is worth the cost
Use a local conveyancer or property lawyer when the title is complicated, the property is mortgaged, ownership is shared, the transfer is part of an estate, the owner’s capacity is questioned, the parties disagree, or the tax result could be material. A professional can also check whether the proposed gift is reversible, whether family or creditor claims may apply, and whether the deed matches the intended ownership shares.
For a straightforward, unencumbered transfer, some registries allow an owner to file personally. Even then, read the official instructions and obtain the updated register after completion.
