Probate does not automatically change the name on a property’s recorded deed. To put inherited real estate in your name, first confirm how the property was titled, then identify the probate order or other instrument your state and county accept, and record it with the land-records office where the property is located. The personal representative—not a beneficiary acting alone—usually completes the estate transfer. A county assessor filing, reassessment form, or exemption claim may also be required.

There is no nationwide packet of forms. The correct document depends on the deed’s vesting language, whether the estate used formal probate, the property’s location, and the court’s distribution order. The California examples below illustrate possible procedures, but they are not instructions for every state.

Start with the recorded deed, not the will

Obtain the latest recorded deed from the recorder, register of deeds, or other land-records office in the county where the property sits. The deed shows who legally held title and whether the decedent owned the whole property or only an interest. Read the vesting clause exactly. It may identify sole ownership, tenancy in common, joint tenancy with survivorship, a transfer-on-death arrangement, or ownership by a trust.

This distinction determines whether probate was needed at all. A survivorship arrangement can pass a deceased owner’s interest to the surviving owner. A transfer-on-death deed can name a beneficiary who takes the property under the state’s statute. Trust property is generally transferred by the trustee under the trust terms. Those routes may require a death certificate, affidavit, trustee’s deed, or other local filing instead of a probate distribution. Do not record a probate order until you have checked that the estate actually owned the interest being distributed.

Check for partial ownership and co-owners

If the deed shows tenancy in common or another fractional interest, probate transfers only the decedent’s share. The surviving owners keep their interests, and the final vesting must state how the inherited share will be held. A legal description that omits an attached parcel, condominium unit, mineral interest, or easement can cause a rejection or leave part of the estate untitled. Compare the deed’s legal description with the description in the probate inventory and final order.

Who has authority after probate opens

A beneficiary named in a will does not normally sign an estate deed simply because the will names that person. In formal probate, the court appoints a personal representative—called an executor or administrator in some states—to identify and inventory assets, obtain appraisals, pay valid debts and taxes, and distribute what remains under the will, intestacy law, and court orders. California Courts describes that sequence as the core of formal probate.

Ask the personal representative or probate lawyer whether the property was listed in the inventory, whether creditor and tax work is complete, and whether the court has entered a final distribution order. If the property was omitted, the representative may need to correct the inventory or ask the court for further instructions before a recorder will accept a transfer. When probate began in another state, the state where the land is located may require a local or ancillary proceeding. The domiciliary court’s order is not automatically a land-records instrument everywhere.

Find the document that legally transfers the property

After confirming ownership and probate status, obtain the exact distribution document for the property. Depending on local law, that may be a certified judgment or order of final distribution, a personal representative’s deed, an executor’s deed, an affidavit authorized by a small-estate statute, or a nonprobate transfer document. A will, death certificate, or ordinary photocopy of a court order generally does not by itself update the deed.

Ownership or estate route Likely controlling document What to verify
Joint ownership with survivorship Survivorship affidavit, certified death certificate, or another instrument specified by the recorder That the deed actually creates survivorship and that all required survivor information is included
Transfer-on-death deed Beneficiary affidavit, death certificate, or statutory form Whether the deed was validly recorded and whether the beneficiary accepted or disclaimed the interest within the state’s deadline
Trust ownership Trustee’s certification, deed, or affidavit required by local law That the trustee has authority under the trust and that the property’s legal description matches
Individually titled property in formal probate Certified final distribution order, personal representative’s deed, or both, as local law requires That the order is final, names the correct beneficiary, and directs distribution of this parcel
State small-estate real-property procedure Statutory affidavit or court petition approved for real estate Value, date-of-death, residency, waiting-period, creditor, and heirship requirements

Do not assume the most familiar document is acceptable. For example, California Courts says its affidavit procedure under Probate Code sections 13100–13116 is for personal property and states: “You cannot use this type of Affidavit to transfer real property (like a house, building, or land).” A different California procedure may apply to qualifying real estate, and another state may use an entirely different form.

Step-by-step process for recording the inheritance

  1. Identify the property’s county and state. Use the situs of the real estate, not the beneficiary’s address and not necessarily the county where the probate case was filed. Recorders maintain local land records, and a separate filing may be needed for each county containing a parcel.
  2. Order the latest deed and related recordings. Look for later deeds, liens, easements, transfer-on-death language, survivorship wording, or a trust. Save the recording number and obtain a legible certified copy if the court or recorder requires one.
  3. Confirm the probate case and representative. Obtain the case number, appointment document, inventory entry, and status of creditor and tax administration. Ask whether a final distribution judgment has been entered and whether this parcel is specifically described.
  4. Obtain a certified final order or required conveyance. Request the version bearing the court clerk’s certification or seal when the recorder requires a certified copy. If local law calls for a personal representative’s deed, have the authorized representative execute it with the exact vesting and legal description directed by the order.
  5. Compare every identifying detail. Match the parcel number, metes-and-bounds or lot-and-block description, unit number, decedent’s name, estate name, and beneficiary names against the current deed. Resolve spelling differences and omitted interests before filing. A recorder may index an instrument yet still leave a title defect if the substantive description is wrong.
  6. Ask the recorder for its current package requirements. Confirm certification, margins, page size, signatures, notarization, transfer declarations, ownership reports, return-envelope rules, payment method, and recording fee. Requirements can change by county and are not established here for the reader’s location.
  7. Submit and preserve proof. File the accepted order, deed, affidavit, or combination with the local recorder. Keep the receipt, instrument number, and a certified or stamped copy. If the document is rejected, obtain the written reason, correct only the identified defect, and resubmit rather than altering the probate order informally.
  8. Complete assessor and account updates. Send any required change-of-ownership report to the property-tax assessor, apply for an exemption or reassessment treatment only if the facts qualify, and notify the mortgage servicer, insurer, homeowners’ association, and utility providers of the new ownership. These administrative updates do not replace recording.

California example: final distribution and local recording

Alameda County Superior Court provides a concrete local example. Its administration guidance says the personal representative should record a certified copy of the Judgment of Final Distribution in the county where the real property is located. The same guidance says a deed is not necessary in the procedure it describes and directs the representative to notify the tax assessor and file specified forms. That is an Alameda County, California instruction—not a universal rule. Another California county, or another state, may require a personal representative’s deed or a different certified instrument.

Before relying on the Alameda example, verify that the judgment is final, that it distributes the specific parcel, and that the named recipient and vesting language are correct. Ask the receiving recorder whether it wants the certified judgment alone or additional forms. If the property lies outside Alameda County, follow the county where that property is located even if the probate case was administered in Alameda County.

Small-estate shortcuts are narrow and fact-specific

Simplified procedures can reduce court work, but eligibility is controlled by state law and the property’s facts. California Courts lists, for deaths on or after April 1, 2025, a $750,000 limit for the specified procedure involving the decedent’s California main home under Probate Code sections 13150–13157, and a $69,625 limit for the real-property procedure under section 13200. The court says the figures are adjusted periodically. They are California statutory thresholds, not national limits, and the main-home procedure is limited to the decedent’s main home.

Value is only one condition. A procedure may also require a waiting period, an appraisal or date-of-death valuation, proof of heirship, notice to other successors, payment or resolution of debts, and a statement that no conflicting probate proceeding is pending. Confirm the statute and the current court form before signing. A personal-property affidavit cannot be substituted merely because the property is worth less than a threshold.

Property-tax and financial follow-up

Recording changes the public title record, but it can also trigger assessor notices and tax decisions. Alameda County’s guidance identifies a preliminary change-of-ownership report and, for qualifying parent-to-child or grandparent-to-grandchild transfers, a reassessment-exclusion claim. Neither filing makes an exclusion automatic. Eligibility, deadlines, relationship definitions, property use, and applicable law must be checked for the transfer date and county.

Ask the assessor how to report the transfer and when any form is due. Separately, contact the mortgage servicer about successor-in-interest documentation and payment instructions; a loan does not disappear because ownership changes. Confirm that homeowners’ insurance lists the new owner and that any association, rental, or environmental obligations are transferred. These institutions may request the recorded order, deed, death certificate, or letters of authority.

How long it can take and what it can cost

Formal probate itself may take months. The Superior Court of California, County of Nevada, publishes an estimate of nine to 18 months for formal probate and notes that some matters take longer. That is a local court estimate accessed in 2026, not a guaranteed timeline for a particular estate or a national average. Recording after the final order may be quick, but delays commonly arise from an unresolved creditor claim, an incorrect legal description, a missing certification, an out-of-state parcel, or an assessor form.

Recording fees, certified-copy charges, notary fees, appraisal costs, publication, and attorney fees vary by jurisdiction and case complexity. The available guidance does not establish a fee for the reader’s county. Request a written fee schedule from the recorder and ask probate counsel which costs are paid by the estate and which are paid by beneficiaries.

Common mistakes and how to correct them

  • Assuming the will changes the deed. A will directs estate distribution; the land record changes only after the legally required order, deed, affidavit, or nonprobate filing is accepted.
  • Assuming every inherited property goes through probate. Recheck survivorship, transfer-on-death, and trust ownership before treating a probate order as the controlling instrument.
  • Using a personal-property affidavit for a house or land. Confirm that the statute expressly covers real property and that every eligibility condition is met.
  • Submitting an uncertified or incomplete order. Ask the clerk and recorder whether certification, a seal, notarization, or an accompanying death certificate is required.
  • Confusing representative authority with beneficiary ownership. The representative administers the estate; the beneficiary receives the interest only through the authorized distribution.
  • Treating California rules as nationwide law. Thresholds, forms, assessor reports, deadlines, and whether a deed is needed all depend on state and county law.
  • Ignoring other interests. Unpaid debts, mortgages, co-owners, title-insurance exceptions, boundary issues, and tax reassessment can affect what the beneficiary receives and how it is recorded.

When individualized legal help is warranted

Consult a probate or real-estate attorney licensed where the property is located if heirs disagree, the deed is ambiguous, the property was omitted from probate, the estate was opened in another state, debts remain, a creditor or co-owner objects, or the recorder rejects the filing. Get advice before signing a deed that changes the vesting, disclaiming an inheritance, or claiming a tax exclusion. A local lawyer can determine whether the probate court must reopen the case, whether an ancillary proceeding is needed, and which instrument protects the chain of title.

A practical file to assemble

Keep one file containing the latest recorded deed, parcel or assessor number, probate case number, letters appointing the representative, inventory entry, certified final distribution order, any representative’s deed, death certificate, recorder receipt, assessor confirmations, mortgage and insurance correspondence, and the final recorded copy. This record helps the new owner refinance, insure, sell, or transfer the property later without repeating the investigation.

Frequently Asked Questions

What if the property was discovered after probate closed?

Do not record a beneficiary-signed deed on your own. Tell the former personal representative or probate lawyer; the court may need to reopen or supplement the estate, and the land’s state may require a local proceeding before a recorder can accept a transfer.

What if several heirs inherit the same property?

The final order or deed should state every recipient and the intended form of co-ownership. Have the legal description and vesting reviewed before recording so one heir is not accidentally shown as the sole owner.

Can I record the order in the county where probate was filed?

Only if that county is also where the real estate is located or the local law expressly provides another method. Real-property records are generally maintained in the property’s county, so confirm the receiving office before filing.

What should I do if the recorder rejects my package?

Request the rejection reason in writing, identify whether the defect is certification, formatting, signatures, fees, an ownership report, or the legal description, and correct that specific issue. If the order itself appears wrong, return to probate counsel or the court rather than editing it yourself.
