If your H-1B job ends, a new employer may be able to file its own H-1B petition and let you begin work before USCIS approves it. That result is not automatic. You must remain within the applicable authorized period, satisfy H-1B portability conditions, and have the prospective employer file a nonfrivolous petition. The ordinary maximum grace period is up to 60 consecutive days after employment ends—or the end of your authorized validity period, whichever comes first—and the grace period itself does not authorize employment.
What an H-1B “transfer” after a layoff actually is
People commonly call this an H-1B transfer, but the old employer’s petition is not transferred to the new company. The prospective employer files a new Labor Condition Application (LCA) and its own Form I-129 petition for the offered position. The filing asks USCIS to authorize H-1B employment with that employer and describes the proposed duties, occupation and the beneficiary’s qualifications.

If the statutory portability requirements are met, an eligible H-1B worker may generally start the new job when the new employer files a nonfrivolous petition, rather than waiting for an approval notice. A pending filing by itself is not work authorization. The filing, the worker’s prior status and admission, the timing, and the absence of disqualifying unauthorized employment all matter.

The “up to 60 days” rule
Under 8 CFR 214.1(l)(2), an H-1B worker generally is not considered to have failed to maintain nonimmigrant status solely because the sponsoring employment stopped for up to 60 consecutive days or until the end of the authorized validity period, whichever is shorter. This protection is available once during each authorized validity period.

That wording creates a ceiling, not a guaranteed 60-day entitlement. Count from the actual cessation of employment, and compare that date with the expiration of the H-1B validity period shown on your admission and approval records. The earlier deadline controls. The regulation also says, “DHS may eliminate or shorten this 60-day period as a matter of discretion.”
The grace period does not authorize work
The same regulation states: “Unless otherwise authorized under 8 CFR 274a.12, the alien may not work during such a period.” You cannot keep working for the terminated employer, begin working for a different employer, or treat the passage of days as employment authorization. Work must be separately authorized—most commonly through qualifying H-1B portability—or through another status or authorization that actually permits the work.
Calculate the deadline before making plans
- Confirm the last day of employment. Use the date employment actually ended, not the date you received a severance letter or the date a payroll system was updated.
- Confirm the authorized end date. Review your latest approval notice, admission record and passport information with counsel. The validity period may end before 60 days have passed.
- Mark the earlier date. Treat that as the practical deadline for a new filing or another qualifying immigration action.
- Allow filing time. A company still must prepare the LCA and petition, collect evidence and sign the filing. Do not wait until the final day to begin review.
The grace-period calculation is case-specific. If DHS shortened or eliminated the period in your circumstances, or if another status issue affects your authorized stay, the ordinary 60-day calculation may not protect you.
Who can use H-1B portability
Portability is a statutory benefit with conditions. Before promising a start date, the new employer’s immigration counsel should review your entire status history and the proposed filing. The commonly cited conditions include:

- You were lawfully admitted to the United States in H-1B status or were otherwise granted H-1B status.
- The new employer files a nonfrivolous H-1B petition for the new employment.
- The petition is filed before the relevant period of authorized stay expires, taking the grace-period and validity-period limits into account.
- You have not engaged in unauthorized employment after admission in a way that defeats the portability requirements.
- The offered position and your qualifications support H-1B classification and the required LCA.
A prior status violation, an unexplained gap, a filing made too late, or facts that do not support the offered specialty occupation can change the answer. A 2012 USCIS Administrative Appeals Office decision is useful for explaining the statutory conditions, but it is a non-precedential decision and does not replace current regulations or USCIS instructions.
Step-by-step: filing the new employer’s petition
1. Assemble the timeline and status record
Give the prospective employer’s counsel the termination date, every recent approval notice, your admission record, passport biographical page, prior H-1B petitions, payroll or employment evidence, and any notices involving status or maintenance of status. Explain any periods when you performed services, were paid, or worked from another location. Counsel needs the facts before deciding whether portability is safe.
2. Confirm the offered job and worksite
The employer should document the proposed duties, occupation, required degree or equivalent experience, worksite locations, wage and employment terms. Those facts must match the LCA and Form I-129 filing. A material mismatch between the petition and the job you actually perform can create later compliance and status problems.
3. Obtain the Labor Condition Application
The prospective employer generally obtains an LCA before submitting the H-1B petition. The LCA addresses the offered employment and required wage and working-condition attestations. The employer, not the worker, is responsible for the LCA filing and related compliance steps.

4. Prepare and file Form I-129
The new employer files Form I-129 with the H-1B evidence and the LCA. USCIS form editions and filing instructions change, so use the edition and fee instructions accepted on the actual filing date. A USCIS Form I-129 edition identified as 04/01/24 appeared in agency materials, but that does not establish that it remains the current accepted edition when your petition is filed.
5. Decide whether a portability start is supportable
If counsel confirms that you meet the portability conditions and the petition is properly filed while you remain in the applicable authorized period, you may generally begin work for the new employer upon filing. Keep the filing confirmation and a complete copy of the petition. If the conditions are not met, do not start merely because a receipt notice exists or because days remain in the grace period.
6. Complete Form I-9 and retain the immigration records
The employer must complete Form I-9 using the documents and procedures required for the employment authorization presented. USCIS employer guidance discusses H-1B portability and I-9 handling, but current I-9 instructions control. Keep the receipt, delivery confirmation, LCA, petition copy and approval notice together so the start date and continuing authorization can be demonstrated.

If a new H-1B petition cannot be filed in time
USCIS correspondence about post-termination options has described actions that may be available during the up-to-60-day period, including seeking another nonimmigrant status. It also explains that certain qualifying filings made within the grace period can permit a person to remain in the United States beyond that period. These paths are not interchangeable with a new H-1B portability filing.
| Possible action | What it seeks | Work consequence while pending |
|---|---|---|
| Another employer’s H-1B petition | New H-1B employment with that employer | Immediate work is possible only if H-1B portability requirements are satisfied. |
| Change-of-status request | A different nonimmigrant classification | A request to change status does not itself authorize employment; the requested classification must provide work authorization, or a separate authorization must take effect. |
| Adjustment-of-status filing | Permanent-residence processing in an eligible case | Work depends on an independent employment authorization basis and its effective date. |
| Other qualifying application | A benefit or status identified in current USCIS procedures | Eligibility, stay and work consequences vary by filing and individual facts. |
The available choices depend on your immigration history, family circumstances, current status, and the type of filing. USCIS’s January 25, 2023 correspondence is historical explanatory material, not a substitute for the current instructions for the particular form you intend to file. A filing that preserves authorized stay may still leave you unable to work during the pending period.

- Current passport and admission record.
- Most recent H-1B approval notices and prior petition receipts, if available.
- Evidence of the last employer and the actual employment end date.
- Resume, degree documents, credential evaluations or experience letters supporting the offered occupation.
- Recent pay records and other evidence showing maintenance of status before the layoff.
- Detailed job description, worksite information and proposed start date.
- Any prior notices, denials, requests for evidence, status filings or periods of unemployment.
- Dependents’ approval notices and admission records if their status may be affected.
Do not conceal a short period of unemployment or an earlier filing problem. Counsel can assess whether a fact is harmless, requires explanation, or changes the filing strategy; an omission discovered later can be harder to correct.

Starting work before portability is confirmed
A receipt number does not cure an ineligible filing. Have counsel verify lawful admission or status, filing timing, the absence of disqualifying unauthorized employment, and the new job’s H-1B eligibility before you report to work.
Treating the filing as a transfer of the old petition
The new employer’s petition stands on its own. It needs its own LCA, job evidence and eligibility documentation. The prior approval notice helps establish history but does not authorize employment for the new company.
Using an outdated form or fee schedule
USCIS changes form editions, filing addresses, fees and required evidence. Verify the current Form I-129 instructions and filing location immediately before submission; an otherwise strong case can be rejected for a filing defect.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsConfusing authorized stay with work authorization
A change-of-status or other qualifying filing may support continued presence in the United States without permitting employment. Track the separate questions—whether you may remain, whether you may work, and for whom you may work.
Ignoring travel and dependent consequences
Travel can affect a pending change-of-status request and the documents needed for reentry. Dependents have their own status records and deadlines. The cited authorities do not establish one travel result for every case, so obtain advice before leaving the United States or changing a dependent’s filing strategy.
A practical deadline checklist
- Day employment ends: record the exact date and preserve termination and payroll records.
- Immediately: calculate the shorter of 60 consecutive days or the remaining authorized validity period, and ask counsel whether any fact could shorten the period.
- During the first week: provide the new employer with status documents, employment history and evidence of qualifications.
- Before the LCA: verify duties, worksite, wage and start date so the petition describes the job you will actually perform.
- Before filing: confirm the form edition, fees, address, signatures and supporting evidence under current USCIS instructions.
- Before starting: obtain written confirmation that portability conditions are met and retain the filed petition and delivery evidence.
- If no filing is ready: ask promptly about a different employer petition, a change of status, adjustment of status or another qualifying action; do not wait for the grace period to expire.
What a qualified adviser should confirm
Ask the employer’s immigration counsel or a qualified U.S. immigration attorney to answer these questions for your facts:
- What is the legally supported last day of employment and the earliest applicable deadline?
- Does your admission and prior H-1B history satisfy portability’s lawful-admission and status requirements?
- Is there any prior employment that could be characterized as unauthorized?
- Does the new position support H-1B classification, and does the LCA match the proposed worksite and wage?
- Can you start on filing, or should you wait for approval or another authorization?
- Would travel, a dependent’s status, or a concurrent filing change the strategy?
- What happens if USCIS issues a request for evidence, rejects the filing, or denies it after you have started?
No authoritative source establishes a universal approval rate, transfer volume or layoff-specific success statistic. The legally important decision is not whether someone else received a transfer, but whether your filing satisfies the current rule on the date it is submitted and whether your work start is independently authorized.
