How to Tell Whether Your Tax Professional Is Doing Tax Planning or Just Preparing Your Return

A correctly filed tax return does not prove that your tax professional is doing tax planning. Preparation applies tax law to transactions that already happened, completes the forms and files them. Planning happens while you can still change a decision: your professional forecasts tax, compares lawful alternatives, recommends actions, and follows up before deadlines or transactions.

The practical test is the engagement’s scope and workflow. Ask for the services in writing, then look for projections, scenario comparisons, estimated-tax work, scheduled reviews and a dated action list. If the first substantive contact is a post-year-end document checklist and all advice concerns completed transactions, you are probably paying for preparation rather than year-round planning.

Preparation and planning answer different questions

Return preparation asks, “What happened, and how should it be reported?” The preparer gathers Forms W-2 and 1099, brokerage statements, receipts, payroll records, business books and other evidence; applies the rules to those completed facts; completes the federal and state forms; obtains your signature; and files.

Tax planning asks, “What are you considering, and what can still be changed?” A planner works with goals, forecasts and proposed transactions. The work may include estimating the tax effect of receiving income this year or next, making a retirement contribution, changing withholding, choosing compensation, selecting an entity structure, making a charitable gift or paying estimated tax. A recommendation should state its assumptions, alternatives, deadlines and trade-offs. The exact answer depends on your filing status, jurisdiction, income, entity structure, timing and the law in effect for the relevant year.

Axis Return preparation Tax planning
Time horizon Looks back at a completed tax year Acts before a transaction, deadline or year-end
Inputs Forms, records, receipts and completed transactions Goals, forecasts, proposed transactions and changing facts
Deliverable Completed and filed return Projection, alternatives, recommendation and action calendar
Contact pattern Often seasonal, with post-filing questions Scheduled year-round or event-driven reviews
Representation May be limited by credential and scope Should state who advises and who can represent you
Fee structure Preparation and filing fee Separate retainer, project fee or clearly itemized planning work

A firm can provide both services, but they are not the same deliverable. A preparer may answer a question about a return without offering advice on future choices. Conversely, a planner may model a transaction but not include return preparation or IRS representation. Your engagement letter should distinguish each service.

Signs you are receiving preparation only

No single behavior proves the scope, but several together are a strong signal that the engagement is compliance-focused:

  • Your first substantive contact comes after the tax year ends and consists of a document checklist.
  • Meetings concentrate on entering historical income, deductions, credits and forms.
  • Advice explains what already happened or resolves a filing-status question, but does not address decisions you can still change.
  • No one schedules a midyear review, prepares a projection or recalculates estimated tax when your income changes.
  • You receive no written recommendation identifying an action, deadline, responsible person and expected tax effect.
  • The quoted fee covers preparation and filing, while advisory calls or modeling are billed separately.
  • After filing, the professional cannot say how long questions will be answered or who will handle an IRS notice.

Preparation-only service is not inherently deficient. If your circumstances are simple and your need is an accurate, timely return, that may be exactly what you purchased. The problem is assuming that a preparation fee includes forward-looking advice when the agreement says otherwise.

What genuine tax planning looks like

Planning is an observable process, not a promise that someone will “find savings.” A professional doing planning should be able to describe when the work occurs, what information is needed, what you will receive and how recommendations are implemented.

Forecasts and alternatives

The professional builds a projection using current income, withholding, deductions, credits, business results and other relevant facts. For a decision with meaningful consequences, ask for at least two lawful alternatives. Examples include changing the timing of income or deductions, increasing or shifting retirement contributions, comparing entity or compensation choices, evaluating charitable-giving methods, or adjusting estimated-tax payments. The comparison should identify assumptions and show trade-offs such as cash flow, administrative burden, risk, state-tax effects and future-year consequences.

A dated action plan

A useful recommendation becomes a checklist: what to do, by what date, who is responsible and what information confirms completion. For example, it may assign you to make a contribution by a stated deadline, your payroll provider to change withholding, and the tax professional to rerun the projection after the change. A projection without implementation steps is analysis, not a completed plan.

Reviews triggered by change

Planning should not stop at a single annual meeting. The professional should schedule a pre-year-end review and invite you to report events such as a job change, business acquisition, sale of property or securities, major equity compensation, marriage, divorce, inheritance, retirement or a move between states. A review can also be event-driven when a deadline is approaching.

Coordination with other advisers

Tax decisions often cross disciplines. A planner may need information from an investment adviser, payroll provider, bookkeeper, lender or business counsel. Coordination does not mean the tax professional replaces those specialists; it means the tax effects and responsibilities are identified before you act.

Clear boundaries and follow-through

The engagement should say what is included, what costs extra, which person performs the work and what happens after filing. It should identify who will answer an IRS notice and who, if anyone, will represent you in an audit, collection matter or appeal. A planning relationship that ends when the return is e-filed is not automatically wrong, but the end date and post-filing support should be explicit.

Credentials, PTINs and IRS representation

Credentials tell you about authorization and representation rights; they do not by themselves prove that a professional offers comprehensive planning.

What a PTIN does and does not mean

The IRS states: “Any tax professional with an IRS preparer tax identification number (PTIN) is authorized to prepare federal tax returns.” A PTIN is therefore a baseline requirement for federal return preparation. It is not a designation for financial planning, a guarantee of proactive advice or evidence of unlimited authority to deal with the IRS.

Who generally has unlimited representation rights

Enrolled agents, active certified public accountants and attorneys have unlimited representation rights before the IRS. That authority covers audits, collection matters and appeals, subject to the professional’s current status and the scope of your engagement. Other preparers may have limited rights, often tied to returns they prepared and signed. Ask the individual—not merely the firm—what credential is current and whether that person will represent you.

Why Circular 230 matters

In guidance dated February 17, 2026, the IRS Office of Professional Responsibility said that tax professionals who represent taxpayers before the IRS or otherwise engage in practice before it are “practitioners” subject to Circular 230 standards, conduct rules and disciplinary provisions. If a firm advertises preparation alongside advisory or controversy services, ask which team member is acting as your practitioner and what standards and responsibilities apply to that work.

How to verify what you are buying

  • Confirm the preparer’s current credential and legal name rather than relying on a job title such as “tax advisor.”
  • Ask who will sign the return and provide the preparer’s PTIN as required.
  • Ask who will personally advise you during the year and whether that person is the same individual who prepares the return.
  • Ask which person is authorized and available to represent you if the IRS audits, collects or appeals a matter.
  • Read the engagement letter for exclusions, additional fees, response times and the end of the service period.

Ten questions to ask before you engage a preparer

Use these questions in an interview and request concrete answers rather than general assurances.

  1. Is tax planning included in my engagement, or is this fee only for preparing and filing the return? Ask the professional to point to the relevant paragraph in the engagement letter.
  2. What planning meetings do you schedule outside filing season? Ask when the meetings occur, how long they last and what information you must provide.
  3. Will you prepare a written projection or compare scenarios before I make a major transaction? Clarify whether modeling is included or billed as a separate project.
  4. How do you handle estimated taxes and withholding changes during the year? Ask how often calculations are updated after income or payroll changes.
  5. Which decisions should I bring to you before they happen? A good answer names situations relevant to you, such as a business sale, equity compensation, retirement distribution, property sale or move.
  6. Who will represent me if the IRS audits, collects or appeals my case? Get the representative’s name, credential, limits and fee terms.
  7. What are your credentials, and are they current? Verify the individual’s status rather than treating a PTIN or firm affiliation as a planning credential.
  8. What is your fee for planning, and what follow-up is included? Ask whether the price is a retainer, project fee, hourly charge or itemized add-on.
  9. Will you review the completed return with me before I sign it? Confirm how corrections are handled and when you receive a complete copy.
  10. How long will you remain available after filing? Ask about response times, notices, amended returns and the point at which a new engagement begins.

Use the annual workflow as a practical test

You can determine the real scope by asking the professional to map your year. A planning relationship normally has identifiable work at each stage; a preparation-only relationship generally begins with records after year-end.

When Planning activity to look for Evidence you should receive
At engagement Discussion of goals, known changes, filing jurisdictions and decisions that need advance notice Written scope, responsibilities, fees and contact process
During the year Updates for income, withholding, estimated payments and changed circumstances Revised projection or calculation and instructions for implementation
Before a major transaction Comparison of lawful timing, structure or payment alternatives Assumptions, tax effects, non-tax trade-offs and a decision deadline
Before year-end Review of remaining opportunities and risks while action is still possible Dated action list naming you and the professional responsible for each step
After filing Return review, notice triage and agreed availability Signed-return copy, contact instructions and representation terms

If the response is that all work starts once the year closes, you have identified a preparation workflow. You can still request planning, but it should be added to the scope and priced clearly.

Examples that reveal the difference

Selling investments or property

A preparer records the sale, basis, holding period and related forms after the transaction. A planner asks before the sale whether timing, installment treatment, loss harvesting, charitable transfer or a different transaction date should be evaluated under the facts and law that apply to you. The planner should not promise a result without reviewing basis, state rules, cash needs and other consequences.

Changing jobs or receiving equity compensation

Preparation reports wages and the information on year-end forms. Planning can model withholding, estimated payments, exercise or vesting dates and the effect of a job change on the rest of the year. Ask what information the professional needs before an exercise or sale and when the projection will be refreshed.

Running or buying a business

Preparation classifies completed revenue and expenses and files the required returns. Planning may compare entity or compensation choices, payroll withholding, retirement contributions and the timing of a purchase or sale. Because legal, payroll and tax issues overlap, ask who coordinates with business counsel and the payroll provider.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Charitable giving and retirement decisions

Preparation reports contributions or distributions that already occurred. Planning can compare the timing and method of a gift, or model the tax and cash-flow effects of a retirement contribution or distribution before the deadline. The recommendation should state assumptions and avoid treating one strategy as universal.

Review the return before you sign

The IRS advises taxpayers to review a return before signing, ask about anything unclear, use a preparer who signs with a PTIN and provides a copy, and consider whether the preparer will be available after filing. Treat the review as your last accuracy check, not as a substitute for planning.

The IRS also states that taxpayers are ultimately responsible for the information reported, even when a professional prepares the return. Check names, Social Security numbers, filing status, dependents, income, basis, deductions, credits, bank details and carryovers. Ask for an explanation of any entry you do not understand. Do not sign a blank or incomplete return, and retain the final signed copy and supporting records.

If you discover that you bought preparation only

First, decide whether you need planning for a specific project or an ongoing relationship. A single property sale, business transaction or retirement decision may justify a defined planning project. Recurring changes in income, withholding or business operations may justify a retainer or scheduled quarterly and year-end reviews.

  1. Request a written planning proposal that identifies the question, information required, alternatives to be modeled, deliverables, deadlines, fee and follow-up.
  2. Ask whether the existing preparer will perform the work or coordinate with another professional, and who owns the final recommendation.
  3. If you use a separate planner, authorize information sharing and define which professional prepares the return, calculates estimates and communicates with other advisers.
  4. Before acting, obtain the assumptions and non-tax trade-offs in writing; tax savings alone may not justify added cost, risk or complexity.
  5. Update the engagement letter so there is no uncertainty about notices, amended returns, audits or representation.

You do not have to change preparers to obtain planning, but you should not infer that planning is included merely because the same firm prepares your return or uses a title such as CPA, enrolled agent or tax advisor.

Common mistakes when evaluating a tax professional

  • Equating accuracy with planning: A correct historical return demonstrates compliance work, not advance decision support.
  • Treating credentials as a service menu: A PTIN authorizes federal preparation; even credentials with broad representation rights do not require a professional to offer year-round planning.
  • Accepting a vague promise to “minimize taxes”: Ask for the projection, alternatives, assumptions and action dates behind the promise.
  • Waiting until after the transaction: Once income is received, property is sold or a contribution deadline passes, many choices cannot be changed.
  • Ignoring state and non-tax effects: A federal result may differ from state treatment, and a tax benefit may create cash-flow, investment, legal or administrative costs.
  • Failing to identify the representative: A firm’s marketing does not tell you who can act before the IRS or what matters are included.
  • Skipping the final review: You remain responsible for the filed information, even when someone else prepared it.

The decision rule

Call it tax planning only when the professional is engaged before a decision or deadline, uses your forecast and goals, compares available choices, documents a recommendation and helps implement it. If the work begins after year-end, records only completed events and ends with a filed return, call it preparation. Put that distinction, the fee, the review schedule and representation responsibilities in writing before you rely on the service.
