Contact the landlord or mortgage servicer as soon as you know the full payment may not be possible. Explain the hardship briefly, show exactly what you can pay and when, and request a written arrangement that fits your budget. A payment plan is a negotiation, not a guaranteed right: rental protections depend on state and local law, while mortgage choices depend on the loan, servicer, hardship and eligibility.

Start before the due date or legal deadline

Silence usually removes options. Call, email or use the servicer’s secure message system when you first see a shortfall, rather than waiting until a rent or mortgage payment is already several weeks late. State the problem in one or two factual sentences, explain whether it is temporary or ongoing, and make one affordable proposal. Do not promise a payment that your cash flow cannot sustain.

A conversation does not automatically stop collection activity, an eviction case, foreclosure steps, late fees or a court deadline. Ask directly what action is pending and whether it will be paused while you meet an agreed schedule. Keep making any amount you can only if the recipient tells you how it will be credited; a partial payment may not prevent a delinquency or legal filing.

Prepare a one-page hardship file

Preparation makes the discussion specific and gives you a record if the account changes hands. Put the following on one page before you call:

  • Monthly take-home income and the date each source arrives.
  • Essential expenses such as food, utilities, transportation, insurance, medical costs and child care.
  • Cash currently available, money expected soon and any nonessential spending you can pause.
  • The amount you can pay immediately and the amount you can reliably pay on each later date.
  • The reason for the shortfall, stated briefly (for example, reduced hours, a medical bill, benefit delay or an unexpected repair).
  • Your lease and rent ledger, or your current mortgage statement and account history.
  • Any notice, demand, filing, prior agreement, email or call record connected with the balance.

Use conservative figures. Leave room for ordinary expenses and emergencies; an arrangement that fails after the first installment can make the situation harder.

How renters can ask for a repayment agreement

Tell the landlord or property manager what you can pay now, what caused the gap, and how your plan resolves the total balance. Ask who has authority to approve a plan and where to send a formal request. The Consumer Financial Protection Bureau (CFPB) renter guidance identifies several arrangements to discuss; none is automatically available in every lease or jurisdiction.

Move the due date or split the monthly rent

If your income arrives after rent is due, ask whether the due date can be aligned with payday. Another possibility is dividing the regular rent into two installments during the month. Confirm that the lease, automatic-payment instructions and late-fee rules will be updated, not merely noted in an informal text.

Temporarily reduce the payment

You can request a lower rent for a defined period, with the difference either forgiven or added to a separately documented arrears plan. A reduction is not a waiver unless the writing says so. Ask for the start and end dates, the regular rent that resumes afterward and the total balance that remains.

Spread back rent over future months

Many landlords will consider adding an agreed portion of arrears to future rent. Request the arithmetic in writing: opening balance, each installment, due dates, and the date the account returns to the normal rent amount. Make sure the added amount leaves enough for current living costs.

Ask about fees and collection activity

Request a waiver of late fees or interest if you make the agreed payments. Ask whether the landlord will refrain from filing an eviction case, dismiss an existing filing, or pause other collection activity while you comply. The landlord may refuse, and local law may impose notice or filing requirements that a private agreement cannot override.

A practical renter script

Adapt the wording to your facts; it is a negotiation prompt, not guaranteed legal language.

I am experiencing [brief hardship] and cannot pay the full rent due on [date]. I can pay [amount] on [date] and [amount] on [date]. Would you consider splitting the payment or setting a temporary repayment schedule? Please confirm the full balance, fees, how each payment will be applied, and whether collection or eviction action will be paused while I follow the written agreement.

Check a renter proposal before signing

Compare proposals by their total cost and the risk of a missed installment, not just by the first payment. Use this checklist and ask for a signed copy from the landlord or authorized manager.

Term to compare What to verify
Total amount due Current rent, past-due rent, late fees, interest and any other charges, with the calculation date.
Immediate payment Exact amount, due date, payment method and receipt procedure.
Installments Every installment amount and date, and whether it is added to or replaces the normal rent.
Fees or interest What is waived, what continues, and whether a waiver depends on completing all payments.
Future rent The normal rent amount and due date after the temporary period or arrears plan.
Default terms What happens after a late installment, whether a grace period exists, and whether the landlord can cancel the plan.
Collection or eviction action Any written promise to pause, dismiss or refrain from filing, and the conditions attached.
Payment application Whether money is credited to fees, arrears or current rent first.

Do not rely on a promise that exists only in a phone call. After the conversation, send a short email restating the terms and ask the landlord to correct anything inaccurate. Keep proof of every payment and confirmation.

Rental assistance and legal help

Apply for rental assistance at the same time you negotiate. State, tribal and local programs, local government offices, libraries, community centers and 211 may identify funds or emergency services. Processing can take several weeks and programs differ by location, so ask what documents and landlord participation are required.

Some HUD-approved counseling agencies provide rental counseling, but not every agency offers that service. Confirm that rental housing counseling is available before sharing documents. If you have an eviction notice, court papers or a hearing date, contact legal aid or a local housing lawyer immediately. A payment discussion does not extend a statutory response period or postpone a court date unless the court or a written agreement says so. Ask local counsel about rights that depend on your state, city, lease type or subsidized-housing status.

How homeowners should contact a mortgage servicer

The servicer is the company that receives your monthly mortgage payment; its phone number appears on the mortgage statement and its official website. Call as soon as you expect difficulty and ask for a mortgage-assistance or loss-mitigation specialist. If a representative cannot review hardship options, request a transfer and note the date, name, department and reference number.

Explain whether the hardship is temporary or likely to continue. Be ready to discuss income, essential expenses, assets, the payment you missed or may miss, and when your situation could improve. Ask which application is required, where to submit it, which documents are needed and the deadline. Continue sending documents through the channel the servicer specifies and keep delivery confirmations.

Questions to ask the servicer

  • What options are available for my specific loan type and hardship?
  • What is the complete application, and which documents can be uploaded or faxed?
  • What payment is due while the application is reviewed?
  • Will interest, escrow advances, late charges or other fees continue?
  • How will the account be reported to credit bureaus during review and after approval?
  • What is the foreclosure status, and what dates or legal notices should I know about?
  • Who will be my contact, and when should I expect the next written decision?

A practical homeowner script

I am experiencing [brief hardship] and expect difficulty paying on [date]. Please connect me with the mortgage-assistance team. What options can I apply for, what documents and deadlines apply, and what will my monthly payment and account status be under each option?

Understand the main mortgage options

Availability, approval criteria and consequences vary by loan type, investor rules and the servicer’s review. Request the exact terms in writing and compare the numbers before accepting.

Repayment plan

A repayment plan generally adds part of the past-due balance to the regular payment for a set period. The monthly bill rises until the arrears are repaid. The loan may remain delinquent, and the servicer may continue reporting missed payments, until the account is brought current; ask how it will report your status. If the increased payment is unaffordable, say so immediately and request another option rather than signing.

Forbearance

Forbearance temporarily pauses or reduces payments; it does not forgive them. Ask whether interest continues to accrue and how the suspended amount will be collected afterward. Depending on the agreement, repayment may involve higher payments, an extended term or a lump-sum payment. Do not assume a lump sum will be required or prohibited without reading the specific offer.

Loan modification

A modification can change one or more loan terms, such as the payment structure or term, to address an ongoing hardship. Ask for the new principal balance, interest rate, monthly payment, total amount repaid and any capitalization of missed amounts. Approval is not guaranteed, and an application may require detailed financial documentation.

Refinance, short sale or deed-in-lieu

Refinancing replaces the existing loan and may not be available when income, credit or equity has changed. A short sale involves selling for less than the mortgage balance with the servicer’s approval; ask about any remaining debt and tax or credit consequences. A deed-in-lieu transfers the property to the lender to avoid a foreclosure sale; obtain legal and tax advice before signing. These alternatives address severe or continuing hardship and are not substitutes for a manageable repayment plan when one is realistic.

Mortgage option Immediate effect Questions that determine risk
Repayment plan Regular payment increases while arrears are spread over time. New payment, duration, total repaid, credit reporting and foreclosure status.
Forbearance Payment is paused or reduced temporarily. Interest accrual, repayment method, term extension, payment increase and any lump sum.
Modification Loan terms may be changed for a longer-term solution. New balance, rate, payment, term, total cost, eligibility and trial-payment rules.
Refinance Existing loan is replaced with a new loan if approved. Qualification, closing costs, rate, term, payment and whether equity is sufficient.
Short sale Property is sold for less than the balance with approval. Approval timeline, deficiency treatment, taxes, credit reporting and moving plan.
Deed-in-lieu Ownership is transferred to the lender instead of a foreclosure sale. Debt release, liens, taxes, credit effects, relocation and legal review.

Evaluate a mortgage offer numerically

Write the proposed payment beside your realistic monthly budget. Then compare the following items for every offer:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • New monthly principal, interest, taxes, insurance and any escrow shortage.
  • Total amount repaid over the remaining term and any added interest.
  • Whether missed amounts are capitalized, paid separately or due in a lump sum.
  • Loan term, maturity date and whether the payment changes later.
  • Credit reporting during review, trial payments and permanent approval.
  • Eligibility conditions, documents, trial-payment requirements and application deadlines.
  • Foreclosure status, required reinstatement amount and what happens if an installment is late.

Ask the servicer to identify the exact date the account becomes current, if that is possible, and to explain how payments are applied. Keep the offer, approval letter, signed agreement and proof of each payment together.

Get independent help and avoid rescue scams

A HUD-approved housing counselor can review a budget, explain mortgage choices and communicate with the servicer, often at no cost. The CFPB counselor locator can search by ZIP code, but services differ; verify that the agency handles your type of housing and hardship. If foreclosure appears imminent or legal papers have arrived, contact a lawyer or legal aid as well. The CFPB HOPE Hotline is 888-995-HOPE (4673).

Do not pay upfront for foreclosure-prevention help, trust a guarantee that a company can change your loan or save your home, sign over title, sign documents you do not understand, redirect payments away from the servicer or stop paying solely because a rescue company instructs you to. Free assistance is available through the servicer and HUD-approved counseling. Renters should likewise use local legal aid or an attorney for eviction notices and location-specific rights questions.

Document the conversation and follow through

  1. Record the date, phone number, representative’s name, department, reference number and promises made.
  2. Send requested documents in the stated format and keep copies, upload receipts and delivery confirmations.
  3. Ask for the final agreement before the first scheduled payment whenever possible.
  4. Check each statement or rent ledger to confirm that payments were credited as agreed.
  5. Contact the other party immediately if your income changes or an installment will be late; do not wait for a default notice.
  6. Calendar every payment, review date, trial period, application deadline and court date.

Decision checklist

For renters

  • Can I pay the proposed amount after essential expenses every month?
  • Does the writing state the full balance, fees, installments and payment application?
  • What happens if one installment is late?
  • Is there a clear written treatment of collection or eviction action?
  • Have I applied for local assistance and sought legal advice if a notice or case exists?

For homeowners

  • Is the new payment sustainable after taxes, insurance and ordinary expenses?
  • How much will I repay in total, and is a lump sum possible?
  • What happens to interest, escrow, fees, credit reporting and foreclosure timing?
  • Have I met every application and document deadline?
  • Have I had a HUD-approved counselor or lawyer review a high-risk option?

The strongest request is early, specific and documented: describe the hardship, propose only what your budget supports, compare the complete cost and deadlines, and obtain written terms. Use public assistance, housing counseling and legal aid when the other party will not offer a workable plan or when a legal notice is already in motion.
