How to Take Money From an Inherited IRA: The 10-Year Rule and Exceptions

For most people who inherit an IRA after 2019 and are not eligible designated beneficiaries, the account must be emptied by December 31 of the year containing the 10th anniversary of the owner’s death. A 2025 death therefore creates a December 31, 2035 deadline. That deadline does not mean every beneficiary can wait until year 10: annual required minimum distributions (RMDs) may apply when the owner died on or after the owner’s required beginning date, and different rules apply to spouses, minor children, disabled or chronically ill beneficiaries, and people close in age to the owner.

What the inherited IRA 10-year rule actually requires

The federal rule depends first on when the IRA owner died and who inherited the account. For deaths after December 31, 2019, a designated beneficiary who is not an eligible designated beneficiary generally must distribute the entire inherited IRA by December 31 of the year containing the 10th anniversary of the owner’s death. This is the core rule described in IRS Publication 590-B (2025).

For example, if the owner died in 2025, the beneficiary’s outside deadline is December 31, 2035. The beneficiary may take distributions during the 10-year period rather than taking everything in 2035. The legal deadline is a final date, not a required recommendation to postpone withdrawals.

Deaths before 2020 can be governed by earlier beneficiary rules. The account type, the owner’s required beginning date, the beneficiary designation, plan terms, and any trust or multiple-beneficiary arrangement can change the result. Confirm the applicable schedule with the IRA custodian and, for a complex estate, a tax professional familiar with inherited IRAs.

IRS Publication 590-B (2025) states: “The 10-year rule requires the IRA beneficiaries who are not taking life expectancy payments to withdraw the entire balance of the IRA by December 31 of the year containing the 10th anniversary of the owner’s death.”

Start by identifying the four facts that control your deadline

  1. Owner’s date of death. Determine the calendar year and whether the death occurred before or after the post-2019 rule change.
  2. Your beneficiary category. Establish whether you are a surviving spouse, an eligible designated beneficiary, another individual designated beneficiary, or a non-individual such as an estate, trust, or charity.
  3. Whether the owner had reached the required beginning date. That fact can determine whether annual RMDs are required during the 10-year period.
  4. Account and arrangement details. Confirm whether the account is traditional or Roth, whether several beneficiaries are involved, and whether a trust or plan document controls administration.

Do not rely solely on a brokerage representative’s informal description of the account. Ask for the beneficiary designation on file, the owner’s date of birth and death records, the owner’s RMD status, and the custodian’s inherited-IRA distribution instructions.

Do I have to withdraw from an inherited IRA every year?

There is no single annual schedule for every beneficiary. Under the 10-year framework, annual withdrawals before the final year depend in part on whether the owner died before or on or after the required beginning date.

If the owner died before the required beginning date

When the 10-year rule applies and the owner died before the required beginning date, Publication 590-B says no distribution is required for the years before year 10. The account still must be fully distributed by the December 31 deadline in the 10th year. You may choose smaller withdrawals earlier to manage taxable income, but the account cannot remain open after the deadline.

If the owner died on or after the required beginning date

Annual RMD rules can apply alongside the 10-year deadline when the owner died on or after the required beginning date. In that situation, waiting until the last year can create a missed-RMD problem even if the balance would otherwise be distributed by year 10. The exact calculation and timing depend on the governing beneficiary rule and the account’s facts, so request the custodian’s current RMD schedule and verify it against the applicable edition of Publication 590-B.

Why the distinction matters

The 10-year deadline answers when the account must be empty. It does not, by itself, answer how much must be withdrawn in each earlier year. Treat the final deadline and any annual RMD obligation as separate requirements.

Who qualifies for an exception as an eligible designated beneficiary?

The IRS identifies several eligible designated beneficiary categories that can have distribution options different from the general 10-year rule:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • The surviving spouse.
  • The owner’s child who has not reached the age of majority under the applicable rule.
  • An individual who is disabled under the applicable IRS standard.
  • An individual who is chronically ill under the applicable IRS standard.
  • An individual who is not more than 10 years younger than the owner.

The IRS describes the exception in its required-minimum-distribution FAQ as applying to “a surviving spouse, a child who has not reached the age of majority, a disabled or chronically ill person or a person not more than ten years younger than the employee or IRA account owner.”

Life-expectancy distributions

An eligible designated beneficiary may generally be able to use life-expectancy distributions in relevant cases rather than the standard non-eligible-beneficiary path. The permitted method depends on the beneficiary’s category, the owner’s circumstances, and whether the owner had reached the required beginning date. The custodian should identify the applicable life-expectancy table and first distribution year before you take money.

Minor child of the owner

A minor child receives special treatment only while the child remains a minor under the applicable rule. After reaching majority, the 10-year period applies under the governing provision. The age at which majority is recognized and the transition date should be confirmed with the custodian and a tax professional because the answer can depend on the applicable rule and the child’s circumstances.

Disabled or chronically ill beneficiary

Eligibility is not established merely by receiving disability benefits or having a medical condition. The beneficiary must meet the applicable IRS definition and may need supporting documentation. Ask the custodian what certification it requires and keep the records used to establish the status.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Beneficiary no more than 10 years younger

This category is based on the age difference between the beneficiary and the owner. Calculate the difference from the relevant dates of birth and obtain confirmation before selecting a life-expectancy method.

What choices does a surviving spouse have?

A sole surviving spouse may be able to treat the inherited traditional IRA as the spouse’s own IRA or remain a beneficiary. That election can change the distribution timing and the RMD rules. Moving funds or retitling the account before choosing a route can make the intended treatment harder to establish.

Treating the account as your own

Owner treatment places the account under the spouse’s own IRA framework. Ask the custodian exactly how it will retitle or transfer the account and what documentation it requires. Confirm the effect on the spouse’s RMD start date, especially when the spouse and the deceased owner are different ages.

Remaining a beneficiary

A spouse who remains a beneficiary keeps the inherited-IRA status and follows the beneficiary distribution rules that apply to the owner’s date of death and RMD status. This route can be useful in circumstances where beneficiary treatment produces a different schedule, but the correct choice depends on the spouse’s age, tax situation, and need for access to the funds.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do not make a rollover or owner-treatment election until the custodian and, where appropriate, a tax professional have confirmed which option you intend to use.

How to take money out of an inherited IRA: a practical process

  1. Notify the custodian. Provide the death certificate and the documents requested to establish your beneficiary status. The account is normally administered as an inherited IRA rather than as a new contribution account in your name.
  2. Obtain the account facts in writing. Request the owner’s date of death, the account type, the balance date used for RMD calculations, the owner’s required beginning-date status, and the beneficiary classification recorded by the custodian.
  3. Ask for the governing distribution schedule. Have the custodian state whether the account follows a 10-year deadline only, annual RMDs plus a 10-year deadline, or a life-expectancy method. Ask for the exact final distribution date.
  4. Choose a distribution method. Most custodians allow a one-time distribution, periodic payments, or a combination. Select the method that meets any annual RMD while fitting your cash needs and tax plan.
  5. Set tax withholding deliberately. Traditional IRA distributions are generally taxable to the extent they are not covered by basis. Ask how federal and state withholding will be handled and whether the amount withheld is enough for your estimated-tax obligation.
  6. Keep the transaction records. Save the distribution confirmation, year-end Form 1099-R, inherited-IRA statements, basis information, and any documentation supporting an eligible-designated-beneficiary status.
  7. Recheck the schedule each year. Rules and IRS guidance can change, and a custodian may update its calculation. Review the account before year-end rather than assuming the prior year’s amount is still correct.

Can I take a lump sum from an inherited IRA?

Usually, a beneficiary may take the entire available balance at once, provided the distribution is permitted under the beneficiary’s governing rules and any required annual RMD has been satisfied. A lump sum can simplify administration and eliminates the risk of leaving a balance past the final deadline.

The trade-off is taxation and cash management. A large traditional IRA distribution is generally ordinary income to the extent taxable and can push more income into higher tax brackets for that year. It can also affect estimated-tax payments and other income-sensitive calculations. Taking smaller distributions over several years may spread the taxable income, but only if the chosen schedule satisfies every annual RMD and the account is empty by the applicable deadline.

For an inherited Roth IRA, a lump sum may be tax-free when the distribution is qualified, but do not assume every Roth withdrawal is tax-free. The account’s five-tax-year qualification history and the composition of contributions and earnings matter.

How inherited traditional and Roth IRAs are taxed

Account type General tax treatment of beneficiary distributions Important qualification
Traditional inherited IRA Generally ordinary income to the extent the distribution is taxable. Nondeductible contribution basis can affect the taxable portion.
Inherited Roth IRA Qualified Roth distributions are generally tax-free. Earnings may be taxable if the Roth account does not satisfy the five-tax-year requirement.

The distribution deadline and the tax result are separate questions. A Roth IRA can still be subject to beneficiary distribution rules even though qualified distributions are usually tax-free. Conversely, an inherited traditional IRA can be distributed on time and still create substantial taxable income.

Compare the main beneficiary paths

Beneficiary path Distribution framework Final timing point Key issue to confirm
Designated beneficiary who is not eligible Generally the 10-year rule; annual RMDs may also apply when the owner died on or after the required beginning date. December 31 of the year containing the 10th anniversary of the owner’s death. Owner’s required-beginning-date status and custodian’s annual schedule.
Surviving spouse May remain a beneficiary or, if eligible, treat the IRA as the spouse’s own. Depends on the selected route and the governing RMD rules. Whether an owner-treatment election has been made and how the account is retitled.
Minor child of the owner Special eligible-designated-beneficiary treatment while the child is a minor; the 10-year period applies after reaching majority under the applicable rule. Depends on the transition to the post-majority period and the owner’s facts. The applicable majority date and custodian documentation.
Disabled or chronically ill individual May qualify for life-expectancy distributions if the applicable IRS definition is met. Depends on the qualifying status and beneficiary rules. Medical-status certification and the method the custodian will use.
Individual not more than 10 years younger than the owner May qualify for eligible-designated-beneficiary treatment and life-expectancy distributions. Depends on the applicable life-expectancy rules. Dates of birth and the age-difference calculation.

What happens if an RMD is missed?

A missed RMD can create an excise-tax liability on the shortfall. IRS guidance describes a general 25% excise tax on the amount that should have been distributed and a reduced 10% rate when the shortfall is corrected within the applicable correction window.

The reduced rate is not automatic. Correct the shortfall promptly, document the reason and the corrective distribution, and follow the IRS filing and waiver procedures that apply to the year involved. Contact the custodian as soon as you discover the error and ask whether it can provide the information needed for the correction.

Trusts, estates, charities, multiple beneficiaries, and successor beneficiaries

The simple individual-beneficiary rules do not resolve every inherited-IRA arrangement. A trust may qualify for special treatment only if its terms and administration satisfy the applicable IRS beneficiary-determination rules. An estate or charity is not handled the same way as an individual designated beneficiary. Multiple beneficiaries can require separate-account treatment or a specific deadline analysis, and a successor beneficiary who inherits after the original beneficiary’s death may face a different remaining period.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Read the beneficiary designation, trust instrument, and IRA agreement together. Do not divide or retitle an account based on a verbal instruction when a trust, estate, charity, or several beneficiaries are involved. Obtain a written determination from the custodian and professional advice before taking a distribution.

Ways to plan withdrawals without missing the deadline

Build a calendar from the year of death

Write down the owner’s death year, the year containing the 10th anniversary, and every annual RMD date supplied by the custodian. A 2025 death, for example, produces a final date of December 31, 2035 under the general 10-year rule.

Coordinate distributions with taxable income

For a traditional inherited IRA, compare the taxable income created by a lump sum with a series of withdrawals. Include wages, business income, investment income, and other retirement distributions in the estimate. A tax professional can model the years in which larger withdrawals are least disruptive.

Do not confuse a tax-free transfer with a distribution

A direct transfer between inherited IRA accounts, when permitted and correctly titled, is different from taking cash personally. Ask the custodian to explain whether the transaction is a trustee-to-trustee transfer, a retitling, or a taxable distribution before signing the paperwork.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Review withholding and estimated payments

Withholding from a traditional inherited IRA distribution may help cover the resulting tax, but the correct amount depends on your overall income and state. Revisit the estimate after each substantial withdrawal.

Common mistakes and how to avoid them

  • Assuming every beneficiary has 10 years with no annual withdrawals. Check the owner’s required-beginning-date status first.
  • Using the owner’s death year incorrectly. Count the 10th anniversary year and mark December 31 of that year, not the ninth anniversary.
  • Ignoring the spouse election. A surviving spouse should compare beneficiary treatment with owner treatment before moving funds.
  • Treating every inherited Roth distribution as tax-free. Confirm the five-tax-year qualification and whether the payment includes earnings.
  • Failing to preserve basis records. Nondeductible traditional IRA contributions can affect the taxable amount.
  • Waiting for the custodian to contact you. The beneficiary is responsible for making sure required distributions occur on time.
  • Applying an individual rule to a trust or estate. Review the governing documents and obtain a beneficiary determination.
  • Taking a distribution before deciding how the spouse account should be treated. Confirm the intended election and account titling first.

Questions to ask the IRA custodian

  • What beneficiary category is recorded for me?
  • What was the owner’s required beginning date, and had it been reached at death?
  • Is an annual RMD required before the 10-year deadline?
  • What is the exact final distribution date?
  • Can I choose a lump sum, periodic payments, or both?
  • How will federal and state withholding be applied?
  • What documentation is needed to establish disability, chronic illness, age difference, or minor-child status?
  • How should a spouse election or a transfer to another inherited IRA be documented?

Bottom line for inherited-IRA withdrawals

The general post-2019 rule gives a non-eligible designated beneficiary until December 31 of the year containing the 10th anniversary of the owner’s death, but it does not create one universal withdrawal schedule. Determine the beneficiary category, the owner’s required-beginning-date status, the traditional-versus-Roth tax treatment, and any trust or multiple-beneficiary facts before choosing a lump sum or installments. Use IRS Publication 590-B for the applicable tax year, obtain the custodian’s schedule in writing, and get professional advice when the arrangement is not a straightforward individual inheritance.
