Act quickly, but first identify the loan. For a defaulted federal student loan, the Department of Education can use administrative wage garnishment (AWG) without first suing you and may withhold up to 15% of disposable pay. A hearing request that is postmarked no later than 30 days from the date the AWG notice was sent can temporarily pause the proposed garnishment until the hearing. That pause does not cure the default. A private student-loan company generally must obtain a court order before garnishing wages, so a private-loan lawsuit requires a response under the deadline on the court papers rather than a federal AWG hearing form.
Use the instructions on your own notice as the operating details, keep proof of everything you send, and pursue a separate plan to resolve the default. The Federal Student Aid default and collections FAQ and the Consumer Financial Protection Bureau’s guidance on federal and private student loans explain the two processes.

Start by identifying the loan and the collection process
The fastest way to choose the right response is to determine whether the account is a federal loan subject to AWG or a private loan being pursued through a court case. Do not assume that a letter from an employer, a collection agency, or a lender uses the same rules in every case.

| Defaulted federal loan | Department of Education, a federal contractor, or a guaranty agency for an FFEL loan | Administrative wage garnishment can be ordered without a prior lawsuit; up to 15% of disposable pay may be withheld. | Read the AWG notice, calendar the 30-day postmark deadline, and follow its hearing or payment instructions. |
| Private student loan | Private lender or its collection law firm | The creditor generally must obtain a court order before wages can be garnished. | Review the summons and complaint and respond by the court’s stated deadline; obtain state-specific legal help. |
Federal loans can be Direct or Federal Family Education Loan (FFEL) loans. Federal Student Aid indicates that an FFEL borrower may deal with a guaranty agency rather than the Department of Education’s Default Resolution Group (DRG). The name and contact information in your notice should control where you send a request.

Private creditors do not have the federal government’s Treasury offset authority. They may sue and, after obtaining a judgment, use the garnishment procedures allowed by applicable state and federal law. Exact exemptions, response deadlines, and defenses depend on the jurisdiction and the facts of the case.
How federal administrative wage garnishment works
Federal Student Aid defines AWG as a process in which the Department of Education can order an employer to withhold up to 15% of a borrower’s disposable pay to collect a defaulted debt without taking the borrower to court. The official definition appears in the Student Loan Default and Collections: FAQs.
A federal loan is generally considered in default after at least 270 days without scheduled payments. The same Federal Student Aid guidance describes involuntary collection activity beginning after more than 360 days without action in the circumstances it discusses. Delinquency, default, and the later collection timeline are different stages; a notice’s date and language determine what deadline applies to you.

AWG is an administrative collection action, not a judgment entered by a court. The employer receives an order to withhold the stated amount and send it as directed. Because no lawsuit is required before the order, waiting for court papers is not a safe strategy when the debt is federal and the notice is an AWG proposal.
How do I stop student loan wage garnishment?
For a federal AWG notice, take these steps in order. They address both the immediate withholding risk and the underlying default.

- Read every page of the notice. Find the issue date, the date the notice was sent, the proposed withholding, the hearing instructions, and the mailing or fax details. Use the address, fax number, and document requirements printed on that notice.
- Calendar the 30-day period. Federal Student Aid says a hearing request must be postmarked no later than 30 days from the date the AWG notice was sent to temporarily pause garnishment until after the hearing. Count from the notice-sent date described in the guidance, not from the day you happen to read a web article.
- Collect supporting records. Assemble account statements, payment confirmations, correspondence, identity documents, and any other records that bear on the debt. If you believe the balance, the identity of the borrower, or the enforceability of the debt is wrong, ask the office named in the notice for records related to the claim.
- Send the hearing request exactly as directed. State that you are requesting a hearing about the proposed AWG and explain the factual basis for the challenge. Use the notice’s required delivery method. Keep a complete copy of the request and all attachments.
- Preserve dated proof. The Federal Student Aid FAQ describes the deadline in terms of a postmark. Keep a postal receipt, certificate of mailing, fax confirmation, or other dated evidence that matches the method allowed by the notice.
- Confirm receipt. Contact the office named in the notice after sending the request. Ask whether it was received, whether anything is missing, and what the next hearing step will be. Write down the representative’s name, the date, and any reference number.
- Address the default separately. Ask the DRG or, for an FFEL loan, the relevant guaranty agency about a repayment agreement, rehabilitation, consolidation, payment in full, or another option for which you qualify. A hearing can pause proposed AWG; it does not itself remove the loan from default.
How do I request a hearing to stop federal student loan garnishment?
Your notice is the controlling form for the submission method and destination. A practical request normally identifies you, the loan or account number, the AWG notice date, and the relief you are requesting. Explain clearly why you believe the debt or the eligibility for garnishment should be reviewed, and attach readable copies rather than irreplaceable originals.
Use the correct date
The Federal Student Aid FAQ ties the temporary pause to a request postmarked no later than 30 days from the date the notice was sent. That is different from a rule based on when you opened the envelope. Write both dates on your calendar: the notice-sent date and the last day by which your request must be postmarked under the guidance.
Build a concise evidence packet
- Copy of the AWG notice, including all pages and attachments.
- Payment history, bank or payroll records, and correspondence that show payments or a disputed balance.
- Information that supports an identity or ownership dispute if the loan is not yours.
- Documents relevant to whether the debt is enforceable, if that is the basis of your challenge.
- A cover page listing each attachment and your current mailing and telephone information.
Do not send originals unless the notice expressly requires them. Keep a scan or photocopy of everything and retain delivery evidence with your account records.
What the hearing does and does not do
A timely hearing request can temporarily pause the proposed AWG while the challenge is considered. It does not automatically cancel the debt, erase a default notation, or stop every other collection activity indefinitely. If the hearing does not resolve the issue, you still need an eligible default-resolution path and must comply with any later instructions.
What if I missed the 30-day garnishment notice deadline?
Send a request as soon as possible and contact the office named in the notice, but do not assume a late request receives the same automatic pause. Federal Student Aid’s stated temporary-pause rule is tied to a request postmarked no later than 30 days from the notice-sent date. The notice may explain whether a late request can still be considered and what happens while it is pending.

Even after the deadline, gather the same records, explain why the request is late, and ask what review or repayment options remain. Continue pursuing a repayment agreement, rehabilitation, consolidation, payment in full, or another program for which the loan qualifies. If an employer has already begun withholding, ask the collecting office how a successful resolution would be communicated to payroll and keep any written confirmation.

Can a repayment agreement prevent federal garnishment?
Federal Student Aid says a repayment agreement may avoid AWG when the first payment is made within 30 days from the date the notice was sent. The guidance describes the agreement as taking several months to complete and says a timely first payment can also prevent collection fees. The offer, required amount, and eligibility can vary, so confirm the terms directly with the DRG or the guaranty agency identified in your notice.
Before agreeing, obtain the payment amount, due date, payment method, duration, consequences of a missed payment, and the effect on the pending garnishment in writing. A verbal promise that an account is “handled” is not a substitute for confirmation that the AWG order will be stopped or released.
How do I get federal student loans out of default?
Stopping a proposed withholding and resolving the default are related but separate tasks. Federal Student Aid identifies several possible routes. Your loan type, payment history, income, and prior use of a program determine which route is available.
| Route | What it accomplishes | Timing or trade-off |
|---|---|---|
| AWG hearing request | Challenges the proposed federal administrative garnishment. | A request postmarked no later than 30 days from the notice-sent date can temporarily pause AWG until after the hearing; it does not resolve default. |
| Repayment agreement | Creates a payment arrangement that may prevent AWG. | Federal Student Aid says the first payment within 30 days from the notice-sent date may avoid garnishment and collection fees; confirm the offered terms. |
| Rehabilitation | Moves an eligible federal loan out of default after the required payments. | Generally requires nine monthly payments. Successful completion removes the default notation from the borrower’s credit history and restores access to federal student aid, but the process takes time. |
| Consolidation | Combines eligible federal loans into a new federal consolidation loan to leave default. | It can be faster than rehabilitation, but the default notation may remain. Confirm program-specific consequences before choosing. |
| Payment in full | Ends the defaulted debt by paying the balance required by the collecting agency. | Ask for a current payoff amount and written confirmation of how payment will affect collection and account status. |
Rehabilitation
Federal Student Aid’s rehabilitation materials generally require nine monthly payments for an eligible defaulted loan. When the borrower completes the program successfully, the default record is removed from the credit history and access to federal student aid is restored. The Consumer Financial Protection Bureau notes that rehabilitation is generally a one-time option, so ask whether you have used it before and whether your loan qualifies. Details are in the Federal Student Aid forms library.

Consolidation
The CFPB explains that consolidation can be faster than rehabilitation, while the default notation can remain on the credit history. A faster exit may matter when a borrower needs to restore eligibility or stop a collection action, but the long-term credit and payment consequences must be weighed. Review the current terms with the federal servicer or collecting agency before submitting an application. The CFPB’s comparison is available at Options for repaying your federal student loan.
Payment in full or another approved arrangement
Federal Student Aid also lists paying the loan in full and discusses repayment agreements. Ask for a written payoff or agreement that identifies the loan, the amount, the due dates, and what will happen to any AWG order. Do not treat a hearing request as a substitute for completing the arrangement.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. Can student loans garnish my wages without going to court?
Federal loans can, through AWG. The Department of Education may order an employer to withhold up to 15% of disposable pay from an eligible defaulted federal loan without first filing a lawsuit. That is why a federal borrower may receive an administrative notice rather than a summons.
Private loans generally cannot. A private creditor normally must sue and obtain a court order before wages can be garnished. The private creditor’s later collection rights, exemptions, and maximum withholding depend on state and federal law. The CFPB describes this distinction in its guidance on debt collection agencies contacting borrowers about student loans.
Can a private student loan company garnish my wages?
Usually not without a court order. A private lender may file a lawsuit, and a judgment can allow wage garnishment under the law that applies where the case is brought and where you work. There is no nationwide private-loan equivalent of the federal 30-day AWG hearing deadline.

If you receive a summons and complaint
- Read the response deadline on the papers. It may be stated as a date or as a number of days after service. Do not substitute the federal AWG 30-day rule.
- Confirm the court and case number. Use the filing instructions in the summons to determine where and how an answer must be submitted.
- Get state-specific help promptly. A consumer-law attorney or legal-aid organization familiar with your state can assess defenses, service, the account history, the statute of limitations, and available exemptions. The proper response depends on the actual pleadings and jurisdiction.
- Do not ignore the case. Missing the deadline can permit a judgment by default, after which the creditor may seek garnishment under applicable law.
- Put negotiations in writing. If you negotiate directly with the lender or its lawyer, obtain a signed agreement stating the payment amount, due dates, total settlement, treatment of the lawsuit, and what happens if a payment is missed.
A federal AWG hearing form does not answer a private lawsuit. Follow the court’s procedure even if you are also discussing a payment plan with the lender.
Protect your position with employers and collectors
An employer’s payroll notice is not the same as a court judgment. For a federal AWG, it may reflect an administrative order already issued to payroll. For a private loan, it may be a notice connected to a judgment or a request for information. Ask payroll which agency or court issued the order and request a copy if you do not have one, while continuing to meet every legal deadline in your borrower notice or court papers.
Keep a single file containing the notice, envelope or transmission record, account statements, payment confirmations, hearing request, proof of delivery, and every response. Record telephone calls immediately. If the withholding amount or account identity appears wrong, raise the discrepancy with the issuing office and payroll in writing; do not rely on an informal conversation to correct an order.
Common mistakes that make garnishment harder to stop
- Waiting for a lawsuit on a federal loan. AWG can begin without a court case, so a federal notice requires an immediate calendar and response.
- Counting 30 days from the wrong event. Federal Student Aid ties the hearing deadline to the date the notice was sent and describes the request as postmarked by the deadline.
- Sending the request to the wrong address. Use the mailing or fax instructions on the current notice, even if an older letter lists a different office.
- Failing to keep proof. A copy and dated mailing or fax evidence protect you if receipt is disputed.
- Assuming a hearing clears default. The hearing addresses the proposed garnishment; it does not complete rehabilitation, consolidation, or another resolution program.
- Assuming rehabilitation and consolidation have identical results. Rehabilitation generally removes the default notation after nine payments, while consolidation may be faster but can leave the notation.
- Ignoring private-loan court papers. A private creditor’s deadline is set by the court and state procedure, not by the federal AWG FAQ.
- Accepting a phone arrangement without written terms. Request the payment amount, schedule, and treatment of the garnishment or lawsuit in writing.
A practical decision path
- Is the notice from a federal agency or does it identify a federal loan? If yes, check the notice-sent date and pursue the AWG hearing or repayment instructions immediately.
- Is the loan FFEL? Contact the guaranty agency named in the notice; it may handle the account instead of DRG.
- Is the account private and accompanied by a summons? Follow the court deadline and obtain state-specific legal help; do not send a federal hearing form.
- Is the debt or amount wrong? Gather payment and identity records, request the relevant account records, and state the factual basis for the challenge.
- Is the debt valid but unaffordable? Ask about a repayment agreement, rehabilitation, consolidation, payment in full, or another eligible option, and obtain the terms in writing.
