How to Stop an IRS Bank Levy or Wage Garnishment

By TheFinanceBase Team 11 min read

Act immediately: call the IRS number printed on your levy or collection notice, identify whether the action is a one-time bank levy or a continuing wage levy, and ask what the IRS needs to release it. A bank normally holds available funds for 21 days before sending them; a wage levy keeps taking part of each paycheck until it is released or the tax debt is paid. You may be able to stop either action by paying, establishing an appropriate installment agreement, proving immediate economic hardship, showing that the collection period has expired, or demonstrating that release will help the IRS collect.

Do not assume that filing Form 12153 automatically releases a levy. That form requests a Collection Due Process (CDP) or equivalent hearing only when the notice gives you those rights, and deadlines and statutory exceptions apply.

What an IRS levy is—and what it is not

An IRS levy is a legal seizure of property or assets to collect unpaid federal tax. It can reach wages, bank-account funds, vehicles, real estate and other property. A tax lien is different: a lien is the government’s legal claim against property, while a levy actually takes or directs a third party to surrender property.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A levy does not erase the underlying tax liability. If the debt remains unresolved, the IRS can generally issue another levy after releasing an earlier one. Your goal is therefore twofold: obtain prompt relief from the immediate seizure and put a durable collection arrangement in place.

What to do in the first 24 hours

  1. Read every page of the notice. Record the notice title, tax periods, balance shown, response deadline, and the telephone and fax numbers. Look specifically for a Final Notice of Intent to Levy and Notice of Your Right to a Hearing. That notice is what usually opens CDP rights.
  2. Confirm the levy type. Ask your employer whether it received a continuous wage levy, or ask your bank whether it received a bank levy. A bank levy and a wage levy have different timing and release mechanics.
  3. Call the IRS using the number on the notice or levy. Explain what has been taken or is about to be taken, the hardship or procedural problem, and the payment solution you can realistically maintain. Ask the representative exactly what documents and conditions are required for release and how the release will be transmitted to the bank or employer.
  4. Gather a complete financial picture. Prepare current income, ordinary living expenses, assets, debts, dependents and insurance costs. The IRS may request a collection-information statement before accepting an installment agreement, currently-not-collectible request or hardship release.
  5. Protect any hearing deadline. If the notice grants CDP rights, submit Form 12153 by the deadline printed on that notice even while you negotiate by phone. Keep proof of delivery and copies of everything sent.
  6. Ask what happens to funds already held. For a bank levy, determine the date the bank received the levy and the date its 21-day hold ends. For wages, ask the employer when the first affected payroll will run and what amount federal rules require the employer to leave you.

Bank levy versus wage garnishment

Feature Bank levy Wage levy (garnishment)
How it operates The bank freezes funds available when it receives the levy. The employer withholds a portion of each paycheck under a continuing order.
Duration Generally a one-time levy. Later deposits are not automatically captured by that same levy. Continuous until the IRS releases it or the liability is paid or otherwise resolved.
Key timing The bank generally holds the available balance for 21 days before sending it to the IRS. Each payroll can be affected; the employer follows the levy until it receives a release.
Immediate request Ask the IRS for release before the 21-day period ends and notify the bank that a release is expected. Ask the IRS to issue a release to the employer; a phone promise alone may not change the next payroll.
Amount protected Only funds that were not available when the levy arrived are outside that levy; exemptions and return rules can apply in limited situations. A portion of wages is exempt under federal rules, so the entire paycheck is not ordinarily taken.

The 21-day bank period is a processing rule, not a guaranteed opportunity to spend the money. Do not move or conceal assets. Use the period to obtain a documented release, prove that the levy should not have been made, or reach a payment arrangement.

When the IRS must or may release a levy

Ask the IRS to identify which release ground fits your facts. The recognized grounds include:

The balance is paid

Full payment, including any accrued interest and required fees, removes the collection reason. Obtain written confirmation and make sure the IRS sends the release to the bank or employer, not merely a verbal assurance that the account is settled.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The collection period has expired

Federal law limits the time in which the IRS can collect a liability. The calculation can be extended or suspended by events such as certain appeals, bankruptcy or collection agreements, so do not assume the date printed on an old notice is the controlling date. Ask the IRS for the current collection-expiration calculation.

An installment agreement bars continuation of the levy

An accepted installment agreement can require release when its terms do not allow the levy to continue. Approval is not automatic: you must stay current with the agreement and future filing and payment obligations. Ask for the release condition in writing and verify that the employer or bank received it.

Immediate economic hardship

The IRS can release a levy when continuing it prevents you from meeting necessary living expenses. Explain the concrete consequence—such as inability to pay housing, utilities, food, medical care or transportation—and support it with recent statements, bills and proof of income. A hardship request is based on your actual finances, not simply the fact that the levy is inconvenient.

Release helps collection

The IRS may release a levy when doing so improves the chance of collecting the tax, for example when a different payment arrangement produces regular payments that a levy would destroy. Propose a specific, affordable alternative and show how you will make each payment.

Using Form 12153 and Collection Due Process

A Final Notice of Intent to Levy generally explains your right to a Collection Due Process hearing. Use Form 12153, Request for a Collection Due Process or Equivalent Hearing, by the deadline stated in the notice. In the form, identify the tax periods, explain why the levy is inappropriate or premature, and state the collection alternative you want—such as an installment agreement, currently-not-collectible status or another permitted resolution.

What a timely request does

A timely CDP request usually pauses IRS collection action while Appeals considers the case, subject to statutory exceptions. It does not wipe out the liability or guarantee that a bank will immediately unfreeze funds already subject to a levy. Appeals can ask for detailed financial information, including Form 433-A for an individual or Form 433-B for a business.

How to prepare a stronger request

  • Attach a copy of the notice and list every tax period involved.
  • Describe the specific procedural objection, if any—for example, a notice sent to the wrong address or a payment that was not credited.
  • Choose a realistic collection proposal and explain its monthly amount, funding source and start date.
  • Include organized income, expense, asset and dependent information; inconsistent figures can delay review.
  • Keep the mailing receipt, fax confirmation or other proof that the form was filed on time.

An equivalent hearing may be available when the CDP deadline was missed, but it generally does not provide the same judicial-review rights. Ask the IRS which type of hearing your notice permits.

When CDP is unavailable or a faster review is needed

Collection Appeal Program (CAP)

The Collection Appeal Program can provide administrative review of a proposed or actual levy, a rejected installment agreement and certain other collection decisions. Ask the IRS employee handling your case whether CAP is available and request Form 9423, Collection Appeal Request, when instructed. Publication 1660 explains the appeal rights and the situations in which CAP may be used.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

CAP can be useful when you need a prompt review of a release decision, but it is not a substitute for preserving CDP rights. If your notice still allows a timely Form 12153 filing, submit that form rather than relying only on CAP.

Taxpayer Advocate Service

The Taxpayer Advocate Service may help when an IRS problem is causing significant financial hardship, when normal IRS channels have failed to resolve the issue, or when the system is not working as it should. Explain the levy, the dates of your contacts, the hardship, and the relief you have requested. TAS assistance does not automatically stop a levy, so continue meeting every IRS deadline.

Low Income Taxpayer Clinic

Eligible taxpayers can seek help from a Low Income Taxpayer Clinic. Clinics may provide representation or advice at little or no cost under their program rules. Eligibility and service areas vary; contact a clinic promptly if a hearing deadline or payroll date is near.

Professional representation

A tax attorney, certified public accountant or enrolled agent can prepare collection financial statements, negotiate an installment agreement or currently-not-collectible status, and manage appeals. Verify the professional’s license or enrollment independently, agree on the scope and fee in writing, and give the representative every notice and deadline. Representation is especially valuable when several tax periods, business liabilities, trust-fund taxes, levy proceeds already sent, or substantial hardship documentation are involved.

What happens to money in a bank levy

During the 21-day hold

The bank generally freezes the funds available when it receives the levy and holds them for 21 days before remitting them. Contact the IRS immediately; ask for a release and ask the bank what written instruction it requires. A release issued after the bank’s processing cutoff may not prevent the transfer, so obtain the exact hold and remittance dates.

Deposits made later

Later deposits are not automatically captured by that same one-time levy. The IRS can issue a new levy if the liability remains unresolved, so do not treat a later deposit as permanently protected.

After the bank sends the funds

Once proceeds have been sent to the IRS, return requests are limited by law and subject to specific deadlines and facts. Ask the IRS which claim or refund procedure applies to your situation and act promptly. The fact that the money was needed for ordinary expenses does not by itself guarantee a return.

How a wage levy affects your paycheck

A wage levy is continuing: the employer withholds each pay period until the IRS sends a release or the underlying liability is otherwise resolved. Federal rules require an exempt portion of wages to remain with you, but the exact amount depends on pay frequency, filing status and dependents. Provide the employer’s payroll department with any IRS release immediately and confirm the next payroll cutoff; an employer cannot simply stop withholding based on your personal request.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If the withholding leaves you unable to pay necessary expenses, present a hardship package to the IRS rather than asking the employer to ignore the order. Include pay stubs, rent or mortgage, utilities, food, transportation, insurance, medical costs, child care and support obligations, plus proof of dependents.

Building a payment or hardship proposal

Installment agreement

Offer a monthly amount that your documented budget can sustain after necessary expenses. Explain how you will remain current on new tax filings and payments. An agreement that is accepted on terms barring levy continuation can support release; defaulting can lead to renewed collection.

Currently-not-collectible status

If your verified income and assets cannot cover necessary living costs, ask whether the IRS can place the account in currently-not-collectible status. This status pauses active collection while the IRS reviews your ability to pay; interest and penalties generally continue, and the IRS can later reassess your finances.

Organizing evidence

  • Recent pay statements, benefit statements and bank records.
  • Housing, utilities, transportation, food, medical and insurance bills.
  • Vehicle, real-estate, retirement and other asset information.
  • Loan, credit-card, child-support and other required debt payments.
  • Tax returns and proof that required returns and estimated payments are current.

Use the IRS forms and documentation list applicable to your case. Individuals commonly provide Form 433-A; businesses commonly provide Form 433-B. Incomplete or outdated figures can result in a rejected proposal or a levy continuing while the IRS requests corrections.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Choosing the right route

Route Best use Deadline protection Typical documentation Main limitation
Direct IRS release request Immediate bank or payroll action when you can show a recognized release ground. None beyond the notice’s response dates; call immediately. Payment proof, agreement terms or hardship finances. A phone call alone may not stop the next transfer.
Form 12153 CDP Challenge the levy or propose an alternative when the Final Notice grants CDP rights. Must be filed by the date on the notice; timely requests usually pause collection while Appeals reviews. Notice, tax periods, procedural objections and Forms 433-A or 433-B if requested. Not every levy is eligible; statutory exceptions apply.
CAP/Form 9423 Fast administrative review of certain levy or collection decisions. Ask the case employee for the applicable timing. Collection history and the reason the decision should change. Does not replace timely CDP rights.
TAS or LITC Significant hardship, unresolved IRS problems or qualifying low-income representation. Continue meeting IRS deadlines while seeking help. Notices, contact history, hardship proof and income information. Eligibility and acceptance are not automatic.
Attorney, CPA or enrolled agent Multiple periods, complex finances, business liabilities or contested procedure. Representative still must preserve every deadline. Complete records and signed authorization. Professional fees and no guaranteed outcome.

Common mistakes that make a levy harder to stop

  • Ignoring the Final Notice. Waiting can forfeit CDP rights and allow the bank or employer to act.
  • Confusing a lien with a levy. A lien does not itself freeze a bank account; a levy does.
  • Assuming Form 12153 is an automatic release. It is a hearing request, not a universal cancellation.
  • Offering an unaffordable payment. A proposal that your budget cannot support is likely to default and may lead to renewed collection.
  • Giving the IRS incomplete finances. Missing assets, dependents or ordinary expenses can undermine a hardship claim.
  • Relying on a verbal promise. Obtain the release in writing and confirm delivery to the bank or employer.
  • Missing future compliance. Failing to file returns or pay new liabilities can cause an agreement to default and a levy to return.
  • Waiting until after remittance. Once bank proceeds are sent, recovery options are narrower and legally time-limited.

After the levy is released

Confirm the release with the IRS, bank or employer, and keep the confirmation with your tax records. Make the agreed payments on time, file every required return, and monitor IRS account transcripts or notices for changes. A release resolves the immediate seizure; it does not cancel the tax debt. If your finances change, contact the IRS before missing a payment so you can seek a modified arrangement instead of waiting for another levy.

The IRS does not publish a universal success rate, average processing time or dollar threshold for levy release. Results depend on the notice, tax periods, collection-expiration calculations, financial evidence, compliance history and whether you meet the applicable deadline.
