Assume an unexpected tax-debt call, text, email, letter or social-media message is unverified until you check it through IRS.gov. The IRS warns that urgency, threats, requests for sensitive information, demands for immediate payment, lookalike web addresses and guaranteed debt reductions are common scam signals. Sign in to your IRS Online Account, compare the contact with the IRS notice library and use contact details you find independently. An Offer in Compromise (OIC) is a real IRS program, but eligibility depends on your finances and filing status; no marketer can guarantee acceptance or promise that you will settle for “pennies on the dollar.”
Why an unsolicited tax-debt contact deserves suspicion
The IRS does contact taxpayers about balances, but you do not have to trust an inbound caller or click a link to prove who you are. A legitimate notice can be verified through your IRS Online Account and the IRS notice library. A private collection assignment can be checked against the CP40 notice you received, including its taxpayer-authentication number.

Scammers exploit the fear of liens, levies and criminal charges. They may impersonate IRS employees, use official-looking logos, claim a short deadline or offer an extraordinary reduction if you pay a fee immediately. A tax-relief salesperson can also be a real business using deceptive claims rather than an outright impersonator. The safe response is the same: stop, verify independently and keep control of your account.

Red flags that should end the conversation
| Signal | Why it is concerning | What to do |
|---|---|---|
| Unexpected call, text, email, letter or social-media message | You cannot establish its source from the message itself. | Do not reply or use its phone number, link or attachment. Check IRS.gov and your Online Account yourself. |
| Threats of arrest, deportation, police action or immediate seizure | Pressure is being used to prevent verification and a reasoned decision. | End the contact. Verify your actual account status through official IRS channels. |
| “Pay today” demand or unusual payment method | Urgency and hard-to-reverse payments are classic fraud tactics. | Do not pay from instructions in the message. Review official payment options after confirming the debt. |
| Request for a Social Security number, bank details, login, identity documents or one-time code before verification | Those details can enable identity theft or account takeover. | Share information only through a verified IRS process or with a representative you independently credential and hire. |
| Lookalike or misspelled web address | Fraudulent sites copy the appearance of government pages while collecting data. | Type IRS.gov yourself; do not click the supplied address. |
| “Everyone qualifies” or a guaranteed OIC | OIC acceptance is based on individual facts and is never guaranteed by a marketer. | Run the free IRS Pre-Qualifier and read the official requirements before paying anyone. |
| “Settle your debt for pennies on the dollar” without reviewing your records | A promise made before examining income, expenses, assets and filing status is not a fact-based assessment. | Ask for the eligibility analysis in writing, or get independent tax advice first. |
Verify an IRS notice, call or collection assignment yourself

- Clear Print Quality: Displays high-resolution printing intended to remain legible through regular use and cleaning
- Stop the interaction. Do not click a link, open an attachment, call back using the message or allow remote access to your computer. Save the message and envelope or caller details for reporting.
- Open a fresh browser window and type IRS.gov. Do not rely on a search-ad result or an address supplied by the contact. IRS web addresses use the irs.gov domain; extra words, altered spelling or a different top-level domain are warning signs.
- Sign in to your IRS Online Account. Check your balance, notices, payment history and any available collection information. If the alleged debt or event is not reflected there, do not treat the message as proof; some notices take time to appear, so use the IRS notice library and customer-service procedures as the next check.
- Match the document to the notice library. Compare the notice number, wording, tax year, amount and instructions. A genuine notice should be consistent with the format and process described by the IRS, not merely display a seal or logo.
- Verify a private collection agency through CP40. If the contact names a private collector, compare the agency and taxpayer-authentication number with the CP40 notice in your records. Do not use a number supplied by the caller to perform the check.
- Contact the IRS using independently found details. Use the contact route shown on IRS.gov or in a notice you have verified. Tell the representative exactly what you received and ask whether the account, notice and collection assignment are real.
- Only then consider payment or representation. Review official payment options and relief programs first. A legitimate adviser should not object to your independent verification or demand that you surrender access to your account.
What an Offer in Compromise really does
An Offer in Compromise is an agreement between a taxpayer and the Internal Revenue Service that settles tax liabilities for less than the full amount owed. It is not an automatic discount, a general hardship coupon or a result that a company can buy for you. The IRS evaluates whether the proposed amount reflects what it can reasonably collect, considering your income, expenses, asset equity and ability to pay.
Basic eligibility conditions
Generally, you must have filed all required tax returns, made required estimated-tax payments and not be in an open bankruptcy case. A business with employees has additional federal tax-deposit requirements. These are threshold conditions, not a promise that an offer will be accepted. A taxpayer who has not filed returns or who has an unresolved filing obligation may need to correct that situation before an OIC can be evaluated.
Use the IRS tools before hiring anyone
The IRS OIC Pre-Qualifier can provide a preliminary indication of whether an offer may be appropriate. Your Individual Online Account can also support the application process. Neither tool guarantees acceptance, and the result depends on complete, accurate information. A promoter who refuses to let you see the official forms or discourages you from using the free Pre-Qualifier is making the process less transparent, not easier.

Know the official fee and payment rules
The standard OIC application fee is $205 under Internal Revenue Service guidance published for 2025. Qualifying low-income taxpayers may have the fee and initial payment waived. The fee is not evidence that an offer will be accepted, and a company cannot legitimately turn it into a guaranteed government result. Before paying a private provider, compare its proposed charges with the official fee, forms and payment instructions.
| Question | What the official process establishes | What a scam pitch may claim |
|---|---|---|
| Who qualifies? | Eligibility is fact-specific and considers returns, payments, bankruptcy status, income, expenses and assets. | “Everyone qualifies” or “we already know you will be approved.” |
| How much will be accepted? | The IRS decides after reviewing the taxpayer’s financial information. | A fixed “pennies on the dollar” result before reviewing records. |
| What does it cost? | The standard application fee is $205 (2025 guidance), with a low-income waiver for qualifying applicants. | A large immediate fee presented as a guarantee or as a way to bypass IRS rules. |
| Does an application stop collection immediately? | Filing an offer does not let a marketer promise that all collection activity will stop at once. | “Pay us today and the IRS cannot levy you tomorrow.” |
Recognize an OIC mill without assuming every tax professional is dishonest
The IRS describes OIC mills as promoters that aggressively market misleading offers to people who clearly do not qualify, charge excessive fees and sometimes submit applications they know will fail. Their advertising may be polished and their staff may sound confident. The decisive question is whether the advice is based on your documented facts and the published IRS rules.
Questions to ask before signing
- What facts about my income, ordinary expenses, assets, liabilities, filing history and bankruptcy status support an OIC?
- Which IRS forms will you prepare, and will I receive complete copies before submission?
- What is your total fee, what work does it cover, and when is each payment due?
- What happens if the IRS rejects the offer, requests more information or determines another relief option is better?
- Who will represent me: a licensed enrolled agent, certified public accountant or attorney, and in which jurisdiction are they credentialed?
- Will I keep my own IRS Online Account access and original records?
A trustworthy representative can explain that an OIC may not fit and discuss alternatives. Refusal to put the scope and fee schedule in writing, pressure to sign blank forms, promises of a guaranteed reduction or a demand for control of your IRS login are reasons to walk away.

Compare paid help on evidence, not on savings slogans
Use the following framework for any company or individual offering tax-debt assistance. It distinguishes a credentialed representative from an impersonator or an OIC mill without declaring that every private provider is fraudulent.
Recommended Free Tools
| Comparison point | Safer practice | Warning sign |
|---|---|---|
| Verification | You can confirm the alleged notice, balance or collection assignment through IRS.gov, your Online Account or a verified notice. | The provider says verification is unnecessary or insists that only its phone number is valid. |
| Eligibility analysis | The adviser requests records and explains how income, expenses, assets, filing status and payment history affect the recommendation. | The adviser quotes a settlement percentage before reviewing facts. |
| Pricing | A written engagement lists the total fee, services, milestones and what happens if the case changes. | A large upfront demand, vague “processing” charge or guarantee tied to payment. |
| Control | You retain access to your IRS Online Account, documents, bank account and submitted forms. | You are asked for your password, one-time code, blank signature or permission to hide correspondence. |
| Credentials and accountability | You can independently check an enrolled agent, CPA or attorney and receive a written engagement and status reports. | No verifiable credential, no named professional responsible for the case or refusal to explain complaints and refunds. |
Relief options that do not depend on an OIC
An OIC is only one route. IRS Topic 202 identifies payment plans, penalty relief and temporary collection delay as possible options. The IRS “Get help with tax debt” pathway can help you identify which route fits your circumstances. The correct choice depends on your ability to pay, compliance status, the type of liability and the IRS’s assessment of your account.
Payment plans
A payment arrangement can spread an eligible balance over time. It does not erase the tax, and you must understand ongoing filing and payment obligations. Use the official IRS payment-options process rather than a marketer’s promise that enrollment alone resolves every collection issue.

Penalty relief
Some taxpayers may qualify for relief from penalties under IRS rules. Eligibility is not automatic, and the reason for the penalty and your compliance history matter. Ask the IRS how to request it and keep proof of the facts supporting your request.
Temporary collection delay
When a taxpayer cannot pay without meeting necessary living expenses, the IRS may consider a temporary delay. A delay is not forgiveness; interest and penalties can continue, and the account may be reviewed again.

If you already shared information or paid a scammer
- Secure your accounts immediately. Change passwords for your email, financial accounts and IRS Online Account from a trusted device. Turn on multifactor authentication where available. If you disclosed an IRS login code, tell the IRS through an independently verified channel.
- Contact your bank or card issuer. Ask whether a payment can be stopped, recalled or disputed. Follow the institution’s fraud procedures and document dates, amounts and recipients.
- Preserve evidence. Keep voicemails, caller IDs, emails, envelopes, payment confirmations, contracts and screenshots. Do not edit the originals.
- Check for identity-theft consequences. Review financial and credit activity for unfamiliar accounts or transfers. Follow the identity-protection steps recommended by the relevant financial institution and government agencies.
- Verify your tax account. Review notices, balance changes, payment history and filings in your IRS Online Account. Ask the IRS whether any unauthorized document or representative has been added.
- Report the conduct. Use IRS reporting channels and the Federal Trade Commission’s reporting process. If a paid representative is credentialed, ask the appropriate licensing body about a complaint process.
What enforcement tells you—and what it does not
In 2026, the Federal Trade Commission reported a nearly $10 million settlement with American Tax Service over deceptive tax-debt-resolution advertising and sales calls. That action illustrates that misleading sales practices can produce substantial enforcement consequences. It does not establish that every tax-relief company is fraudulent, nor does it provide a prevalence rate for IRS-debt scams. Evaluate the specific contact, contract, credentials and claims in front of you.
A quick decision rule before you pay anyone
- Verify first: Can you confirm the notice, amount and collection status through IRS.gov, your Online Account or a verified CP40?
- Test the claim: Does the proposed relief match the IRS’s published eligibility rules, or is it a universal guarantee?
- Price the real service: Do you have a written scope and total fee, separate from the IRS’s $205 OIC application fee and any low-income waiver?
- Keep control: Will you retain your login, records, bank account and copies of every filing?
- Plan for failure: Does the agreement explain what happens if the IRS rejects the request or recommends a different option?
If any answer is no, pause and use the IRS’s free tools and official help channels before spending money. A real tax problem can be handled without surrendering your identity, your account or your ability to verify what is happening.
