Before depositing money, verify the operator’s legal identity and registration in regulator records, follow the app link from that operator’s own website, and read the complete event-contract rules. Treat guaranteed profits, “risk-free” picks, celebrity endorsements, unsolicited direct messages, and pressure to send money to a personal wallet as scam warnings. An app-store listing or a price that looks like an election probability does not prove that a venue is licensed or that you can withdraw your funds.
Election contracts are legally and geographically unsettled in the United States. The Commodity Futures Trading Commission (CFTC) regulates registered derivatives venues, but federal and state authorities are contesting how some election products should be classified. Check the specific product, your location, current regulator records, and any court orders immediately before trading.

Use this five-minute screen before you open an account
Do not fund an election-betting or prediction-market account until every item below is clear. If one answer is missing, pause rather than relying on a logo, an app-store review, or a recommendation from someone online.
- Who is the legal operator? Record the company’s exact legal name, physical address, customer-service contact, and the entity that will hold or process your money.
- Is that entity registered for this activity? Search the CFTC’s registration records and, where relevant, National Futures Association (NFA) information. Match the legal name, not just a trading brand or domain name.
- Did you reach the genuine website? Type the address yourself or use a bookmark. Do not use a link from a direct message, unsolicited email, social post, or a person you recently met online.
- Is the mobile app genuine? Install it only from a download link on the operator’s verified website. App-store availability by itself is not proof of authenticity; counterfeit apps can appear in stores.
- Can you explain the contract? Before making a deposit, find the outcome definition, payout, expiration, settlement source, fees, dispute process, and withdrawal rules in the contract or customer agreement.
Save screenshots of those pages, the registration result, your deposit method, and the account agreement. They become important evidence if the site changes its terms, rejects a withdrawal, or disappears.

Verify the operator, domain, and app
Match the legal entity to regulator records
The CFTC’s customer guidance says, “Only trade with registered entities.” A legitimate-looking trading interface can still be operated by an unregistered company or an impostor using a similar name. Start with the legal name in the site’s customer agreement, risk disclosures, or footer. Search that name in the CFTC’s records and check whether the registration covers the type of service being offered. A registration for one business does not automatically authorize every product, affiliate, or mobile application using the same branding.
Look for consistent details across the website, agreement, payment page, and regulator record. A mismatch in spelling, corporate suffix, address, support email, or telephone number is a stop signal. Do not assume that a familiar financial term, a U.S. mailing address, or a claim that a platform is “federally regulated” is evidence of registration.
Use a clean path to the website
Type the domain into your browser or obtain it from an independently verified regulator record. Examine the address character by character: criminals use look-alike domains, extra hyphens, substituted letters, and cloned login pages. Avoid entering credentials after clicking a link in a social-media message, group chat, text, or email that creates urgency.

Authenticate a mobile application
The CFTC advises customers to ensure that websites and mobile apps belong to CFTC-registered entities. Follow the app-store link from the verified operator website and compare the developer name, privacy policy, support address, and version history. Be cautious when an app asks you to install a file outside the official store, disable security settings, or deposit through a separate chat.
Do not treat download counts, star ratings, screenshots, or a blue verification badge as proof. Fraudsters can copy branding, buy reviews, or direct victims to a counterfeit app that captures passwords and payment details.
Read the event contract instead of betting on a headline
An event contract is generally a derivative—often a swap—whose value depends on a specified event. Many prediction-market contracts are yes/no instruments with a fixed payout, commonly $1, and a defined expiration. The contract, not the election headline or an advertisement, controls what you receive and when.

How to interpret a quoted price
Suppose a yes contract trades at 70 cents and the corresponding no contract at 30 cents. Those prices express traders’ perceived probabilities; they do not certify that the event has a 70% chance or guarantee a 30-cent profit. The price can move, and fees and taxes reduce returns. If the contract pays $1 at settlement, buying yes at $0.70 produces a gross $0.30 difference if yes wins, before costs; losing the contract can reduce the position to zero. Read the platform’s own payoff and fee calculation rather than relying on that illustration.

What CFTC regulation does—and does not—tell you
Registered exchanges and intermediaries go through an application process and periodic examinations. They must follow market-integrity requirements, monitor for manipulation and insider trading, and maintain customer-protection controls. Order books generally display bids and asks, and customers may be able to trade out before settlement. These controls reduce certain risks; they do not guarantee a profit, a particular price, uninterrupted technology, or a favorable legal ruling.
An unregistered entity may provide little or no customer protection. The CFTC warns that customers who trade with unregistered entities operating outside the United States “may have little or no protections.” Recovery can be difficult if the operator is anonymous, holds funds offshore, or changes its name. Registration also does not prove that a particular election contract is permitted in your state or country.
Why legality depends on the product and your location
U.S. prediction markets have a long history: the Iowa Presidential Stock Market began in 1988 as an academic experiment, and the CFTC’s historical timeline says it began regulating U.S. prediction markets in 2004. Those facts do not settle the legal status of every modern election contract.

The CFTC has asserted exclusive federal authority in that dispute. Connecticut Attorney General William Tong, as quoted by the Associated Press, called the contracts “plainly unlicensed illegal gambling under time-worn state law.” Those competing positions show why the word “regulated” is insufficient by itself. Check the specific contract, the state or country where you reside, any location restrictions in the customer agreement, and current regulator or court information before depositing.

Red flags that point to a scam
Promises that remove risk
- Guaranteed election wins, fixed returns, “risk-free” picks, or claims that you cannot lose.
- “Free money,” unusually large sign-up bonuses, or a countdown pressuring you to deposit immediately.
- Requests to pay a “tax,” “unlock fee,” or additional deposit before a withdrawal is released.
Every genuine market has uncertainty, price movement, operational risk, and contract rules. A promise of certainty is a sales tactic, not a feature of an event contract.
Borrowed credibility
- Celebrity or political endorsements that cannot be verified on the person’s official channels.
- Glowing testimonials with no independently verifiable identity or transaction history.
- Recommendations from people met through social media, dating apps, investment groups, or encrypted chats.
The CFTC specifically advises caution around big-payoff promises, free money, celebrity endorsements, glowing reviews, and recommendations from people recently met online.
Suspicious payment and account behavior
- Instructions to send funds to a personal bank account, an unfamiliar payment processor, a cryptocurrency wallet, or gift cards.
- Pressure to increase your deposit, recruit friends, or move the conversation off the platform.
- Support that exists only in a chat account, refuses to provide a legal entity, or keeps changing the withdrawal explanation.
- A sudden requirement to install remote-access software, share a one-time security code, or provide a wallet seed phrase.
Stop sending money when a withdrawal is blocked or the terms change. Do not try to “unlock” funds with another payment.
A defensible due-diligence process
- Capture the offer. Save the advertisement, referral message, domain, app listing, and the exact contract name. Record the date and time because prices and terms can change.
- Identify the operator. Read the customer agreement and privacy policy for the legal company, jurisdiction, and contact details. Compare those details with the regulator record.
- Confirm registration independently. Use the CFTC’s records and, where applicable, NFA information. Do not rely on a badge, press release, or the platform’s own claim.
- Check availability where you live. Read geographic restrictions and confirm current state, federal, or national guidance. A venue accessible from your browser may still prohibit residents of your jurisdiction.
- Read the entire contract. Locate settlement source, definitions, expiration, payout, fees, early-exit rules, dispute procedures, and withdrawal conditions. Screenshot each page.
- Test the account without concentrating funds. Complete required identity checks through the verified site, enable multifactor authentication, and use a payment method you can monitor. Never deposit money needed for rent, bills, taxes, or emergency savings.
- Review the order book and liquidity. Check the bid-ask spread, trading volume, and whether you can realistically exit. A displayed price is not necessarily available for your order size.
- Make a small, documented transaction only if all checks pass. Save the confirmation, ledger entry, and withdrawal instructions. Avoid adding money simply because a promotion is expiring.
Compare venues using the same questions
If you are evaluating more than one venue, use a written comparison rather than choosing the one with the most attractive headline odds.

If a venue cannot provide a clear answer to one of these questions, “not stated” is a risk finding, not an invitation to guess.
If you already sent money or cannot withdraw
- Stop further payments. Do not pay a release fee, send more cryptocurrency, or accept instructions to move funds to another account.
- Preserve evidence. Keep the account agreement, contract screen, deposits, withdrawals, wallet addresses, transaction IDs, emails, chats, phone numbers, and screenshots. Export statements before closing the account.
- Secure your access. Change reused passwords, enable multifactor authentication, revoke unfamiliar sessions, and contact your bank or card issuer about unauthorized transactions. If you installed a suspicious app, remove it and run the device maker’s security checks.
- Use the platform’s documented complaint channel. Send a concise written request for the withdrawal status and the contractual reason for any restriction. Keep the ticket number and deadline.
- Escalate to the appropriate authorities. The CFTC identifies the broker, designated contract market, NFA, and CFTC complaint process as possible routes. Which route fits depends on the entity and product.
- Report payment fraud promptly. Your bank, card issuer, payment service, and local law-enforcement or consumer-protection agency may have time limits or recovery procedures.
Do not give a caller remote access, a password, a multifactor code, or a cryptocurrency recovery phrase to “recover” your funds. Recovery scammers often target people who have already reported a loss.
Keep market, technology, and legal risks separate
A registered venue can still expose you to three different kinds of risk. Market risk is the possibility that the contract price moves against you or that the event does not occur as expected. Operational risk includes outages, account compromise, payment delays, and errors in a mobile app or data feed. Legal and jurisdictional risk concerns whether the product is authorized where you live and whether a regulator or court changes its treatment.
Do not infer safety from an election contract’s familiar language, a high trading volume, or a large company name. Verify each risk separately, retain records, and limit any position to money you can afford to lose completely. Fees and taxes must be included in your calculation, and local tax treatment may require advice from a qualified professional.
Bottom line for a safe decision
Use the operator’s legal name—not its slogan—to verify registration; reach the site and app through an independently confirmed path; read the settlement and withdrawal rules; and check the product’s status in your jurisdiction. Walk away from guaranteed returns, urgency, social-media solicitations, personal-wallet payments, and any platform that will not identify the entity responsible for your money. Because CFTC rulemaking and federal-state litigation were active in 2026, recheck regulator records and court information immediately before trading.
