To set up a spendthrift trust for an adult child, you create a written trust with a settlor, trustee, beneficiary, trust property and distribution rules; add a spendthrift provision that complies with the law governing the trust; sign the document as required; and transfer assets into the trust. The trustee—not your child—then controls trust property and makes distributions under those terms.
This is a general U.S. roadmap, not a single national procedure. Trust statutes differ on required wording, creditor exceptions, execution formalities and administration. A Pennsylvania statute cited below illustrates one approach; it is not a rule for every state. Have a state-licensed estate-planning attorney or trusts-and-estates lawyer review the document, the assets and the law that will govern the trust.

What a spendthrift trust does
A spendthrift trust is an arrangement in which a trustee holds and manages property for a beneficiary under written terms. A spendthrift clause is intended to restrict the beneficiary’s ability to voluntarily transfer the trust interest and to limit a creditor’s ability to reach the beneficiary’s undistributed interest or a distribution before the beneficiary receives it.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsThe practical objective is usually controlled stewardship of an inheritance or gift. Instead of giving an adult child unrestricted ownership immediately, you place assets under a trustee’s control and specify when, why and how money may be distributed. The arrangement can address concerns such as poor money management, pressure from others or a beneficiary’s exposure to claims, but it is not a promise that assets are immune from every creditor or legal claim.

For example, Pennsylvania’s statute provides that a term stating that a beneficiary’s interest is held subject to a “spendthrift trust,” or words of similar import, is sufficient to restrain both voluntary and involuntary transfer of that interest. That wording appears in 20 Pa.C.S. § 7742(b); subsection (b) was amended in 2024. Pennsylvania law and its exceptions do not automatically apply to a trust governed by another state’s law.
Protection generally concerns property that remains in the trust. Once the trustee distributes money or property to your child, it belongs to the child and may be exposed to the child’s creditors, judgments, divorce claims or spending decisions under the applicable law. The New York City Bar Association and Kiplinger both emphasize that spendthrift protection is limited and jurisdiction-specific.
Decide whether this structure fits your goal
Define the transfer you want to make
Start by identifying what you are trying to accomplish and when the transfer will occur. Common purposes include:
- Holding an inheritance until your child reaches specified ages or milestones.
- Making lifetime gifts while retaining a trustee’s oversight of investment and distribution decisions.
- Providing a long-term source of support without giving the beneficiary immediate control of the principal.
- Managing property that you want distributed under conditions rather than in one lump sum.
List the assets you may contribute, such as cash, securities, real estate or an ownership interest in a business. The available authorities do not establish a universal transfer method, tax result or recommended asset mix. Each asset may require its own deed, account retitling, assignment, consent or other procedure, so identify those steps with counsel before signing.
Separate ordinary spendthrift planning from special-needs planning
If your adult child has a disability or receives Medicaid, Supplemental Security Income or another means-tested benefit, stop before using a standard distribution design. The American Bar Association’s discussion of special-needs planning explains that trustee decisions may need to avoid affecting eligibility and that spendthrift language should be used only if state law permits it. A special-needs trust is not interchangeable with a generic spendthrift trust.
Ask a lawyer who handles both trusts and benefits planning to analyze the child’s benefits, living expenses, public-program rules and the source of the property. Do not assume that discretionary language preserves eligibility or that a particular trust type is appropriate without reviewing the child’s facts and the governing state’s rules.

Identify the governing law and get state-specific advice
Before choosing language, determine which state’s law will govern the trust and where the trustee will administer it. Relevant factors can include the trust’s express governing-law clause, the settlor’s residence, the trustee’s location, the beneficiary’s residence, the location of real estate and the place where administration occurs. These connections can be legally complex; an attorney should determine the governing law rather than relying on a form from another state.

- What wording qualifies as a spendthrift provision.
- Whether the clause must restrain both voluntary and involuntary transfers.
- Which creditors or claimants have statutory exceptions.
- How and when a creditor may bring a claim against a trust interest or distribution.
- Signing, witnessing, notarization and acceptance requirements.
- Trustee powers, accountings, notices, modification and termination procedures.
The Pennsylvania General Assembly’s Chapter 77, including §§ 7742 and 7743, is a useful example of enacted language, not a nationwide template. The Uniform Trust Code is model legislation; only the version enacted in the relevant state, together with other applicable law, controls your trust.
Choose the trustee and a successor plan
The trustee owns the legal title to trust assets, follows the document, keeps records, evaluates requests and makes distributions. Choose for capability and reliability, not simply because the person is a relative. The trustee must be able to separate personal interests from fiduciary duties and continue administration for as long as the trust lasts.
| Consideration | Individual trustee | Bank or trust company |
|---|---|---|
| Financial and administrative competence | May know the family well, but skills and time vary by person. | Usually has dedicated staff, procedures and investment or accounting resources; confirm the institution’s powers and services. |
| Neutrality | A family member may understand the child but may face pressure or conflicts. | An institutional fiduciary may provide greater distance from family disputes, subject to its policies and conflicts review. |
| Continuity | Requires a practical replacement plan if the person dies, resigns or becomes unable to serve. | Institutional succession can be more predictable, but the trust should still address resignation, removal and replacement. |
| Family knowledge | Often has direct knowledge of the beneficiary’s needs and history. | May need written guidance and regular communication to understand family circumstances. |
| Cost | Fees depend on the person’s arrangement with the family; no universal amount is established. | Fees and minimum-account requirements vary by institution; the available sources do not provide comparative fee data. |
A parent can name an individual, a professional fiduciary or co-trustees if state law and the trust terms permit. Co-trustees can combine family knowledge and professional administration but may slow decisions or create disagreement. Ask each candidate about availability, recordkeeping, investment oversight, tax-document coordination, communication practices and willingness to serve.
Write a realistic successor provision
Name one or more successors and state how a replacement is selected if the first trustee cannot serve. The document can address resignation, incapacity, removal, conflicts and the role of a court or designated person. Do not assume a bank will accept appointment or that a named individual will remain willing for decades; confirm willingness and institutional requirements in advance.

Design the distribution terms
Distribution language determines how much control the trustee has and how predictable the child’s access will be. The governing law and the family’s purpose should drive the choice.

Scheduled or milestone distributions
A schedule can direct fixed amounts or percentages at stated ages or dates—for example, staged principal payments rather than one immediate transfer. Predictability can help a beneficiary plan, but a rigid schedule may not adapt to disability, illness, unemployment, inflation or a sudden need. The document should explain what happens if a scheduled date arrives when circumstances have materially changed, subject to legal limits on the trustee’s authority.
Discretionary distributions
A discretionary design gives the trustee authority to decide whether and when to distribute under a stated standard or the trustee’s discretion. It can respond to changing needs and may keep more property inside the trust, but the beneficiary cannot rely on a fixed payment and the trustee must understand the scope of the discretion. Define the standard, relevant factors, documentation and any limits clearly enough for consistent administration.
Hybrid designs
A trust can combine a baseline payment with discretionary distributions for education, housing, health care or other purposes. The sources do not establish a universally recommended formula. Your attorney should align the standard with the trust’s purpose, the beneficiary’s circumstances and any benefit-program rules.
| Design | Primary advantage | Primary trade-off |
|---|---|---|
| Scheduled payments | Predictable cash flow and easier planning for the beneficiary. | Less flexible when needs, prices or family circumstances change. |
| Trustee discretion | Allows decisions to respond to changing needs and preserve assets in trust. | Less certainty for the beneficiary and greater responsibility for the trustee’s judgment and records. |
| Hybrid | Combines a defined baseline with flexibility for unusual needs. | More drafting complexity and more provisions for the trustee to administer. |
Specify the trust’s duration and remainder beneficiaries
State when the trust ends or what event permits termination, subject to the governing law. Name who receives property that remains when the trust ends or the beneficiary dies. Remainder beneficiaries can be people, charities or other permitted recipients. Include a plan for what happens if a named remainder beneficiary dies first.
Include a legally effective spendthrift provision
The clause must be drafted for the governing jurisdiction. In the Pennsylvania example, language referring to a “spendthrift trust,” or words of similar import, can restrain voluntary and involuntary transfers under the statute. Other states may use different wording or apply different definitions and exceptions.
A properly drafted clause generally addresses both sides of the restriction:

- Voluntary transfer: the beneficiary cannot sell, assign, pledge or otherwise transfer the beneficiary’s trust interest before receiving it, to the extent the governing law permits.
- Involuntary transfer: a creditor or assignee generally cannot attach the beneficiary’s undistributed interest or a trustee-held distribution before receipt, subject to statutory exceptions.
Do not describe the result as “creditor-proof” or protected from all claims. Exceptions vary by state and may involve specific categories of creditors, court orders or other circumstances. The New York City Bar’s public guidance and Kiplinger’s overview both caution that protection is not absolute. Have counsel identify the actual exceptions and procedures in the governing jurisdiction.

Draft the trust instrument
The document should be tailored to the people, property and law involved. At minimum, it normally identifies:
- The settlor (the person creating and funding the trust).
- The trustee and successor trustee or appointment mechanism.
- Your adult child as beneficiary, plus any additional or contingent beneficiaries.
- The property initially contributed and the process for adding property later.
- The distribution standard, trustee discretion and any scheduled payments.
- The spendthrift provision in wording permitted by the governing state.
- Trustee powers for investing, selling, leasing, borrowing, paying expenses and maintaining records, as allowed by law.
- Accounting, notice, communication and dispute procedures.
- Duration, termination events and remainder beneficiaries.
- Resignation, removal, incapacity and successor-trustee procedures.
Decide with counsel whether the trust should be revocable or irrevocable for your purpose and under the governing law. The available authorities do not establish a universal recommendation. A spendthrift clause by itself does not accomplish tax planning, Medicaid planning, divorce planning or self-settled asset protection.
Sign the document correctly
Execution requirements are jurisdiction-specific. Your lawyer should confirm whether the trust requires notarization, witnesses, particular signatures, beneficiary consent, trustee acceptance or additional formalities. Use the final version reviewed for the governing state, follow the signing sequence exactly and retain the original and any accepted amendments in a secure location.
Ask the attorney to identify every document that must be signed alongside the trust, such as deeds, assignments, account forms, trustee acceptances, beneficiary notices or a pour-over will. A signed trust that is never properly funded may not control the assets you intended to place under it.
Fund the trust by transferring assets
Funding means changing ownership or control so the trustee holds the intended property for the trust. The trust document alone does not automatically move every asset into the trust. The transfer process depends on the asset and may require a new account title, deed, assignment, transfer agent instruction, consent or other filing.

- Prepare an asset inventory. List each intended contribution, its current owner, account or title information, location and any restrictions.
- Confirm transferability. Ask counsel and the institution or registrar whether the asset can be transferred, whether consent is needed and what forms or tax documents apply.
- Use the trust’s exact legal name. Retitle accounts and prepare deeds or assignments using the name, date and trustee designation shown in the executed instrument.
- Obtain evidence of completion. Keep account statements, recorded deeds, acceptance letters, assignments and confirmations showing that the trustee—not merely the settlor—holds the property for the trust.
- Check for assets that require a different plan. Some property may pass by beneficiary designation, contract or other method. Coordinate those designations with the trust and the rest of the estate plan.
- Review after funding. Reconcile the trust’s inventory with statements and titles, and update it when assets are sold, replaced or newly acquired.
The Illinois State Bar Association’s guide to living trusts discusses funding and the possible use of a pour-over will for property that remains outside a living trust. A pour-over will is not a substitute for completing asset-specific transfers, and it may involve probate. Have counsel determine which funding method applies to each asset.
Plan for administration after funding
Once property is in the trust, the trustee must administer it under the document and applicable fiduciary law. Establish practical procedures before the first distribution:
- Open accounts in the trust’s name and keep trust money separate from personal funds.
- Maintain a ledger of contributions, income, expenses, investments and distributions.
- Set a process for your child to request distributions and for the trustee to document decisions.
- Provide required notices and accountings to beneficiaries or other persons.
- Review investments, insurance, property condition and liquidity needs periodically.
- Document conflicts of interest and obtain advice when a transaction may benefit the trustee or a related person.
- Coordinate with tax and accounting professionals about returns, reporting and records; the sources here do not establish your trust’s tax treatment or filing obligations.
Tell the trustee what information is useful without attempting to direct decisions in a way that conflicts with the trust or fiduciary duties. If family circumstances change, ask counsel whether the document can be amended, decanted, modified by consent or changed through a court process under the governing law.

Distributions leave the trust
When the trustee pays money or transfers property to your child, that asset is no longer held by the trust. The child’s ownership, spending choices and exposure to claims then depend on the child’s circumstances and applicable law. A clause cannot retroactively keep a distributed asset inside the trust.
Exceptions vary by jurisdiction
Some states recognize exceptions that can permit claims despite a spendthrift term. The categories, procedures and limitation periods are not uniform. A creditor’s ability to reach an interest can depend on the type of claim, whether a distribution is due, the trustee’s discretion and the governing statute. Obtain a state-specific opinion rather than relying on a general internet explanation.
Self-settled and other specialized goals are different
A trust created and funded by a person for that person’s own benefit may be treated differently from a parent-created trust for a child. Do not assume that adding a spendthrift clause creates self-settled asset protection. Likewise, the clause alone does not determine estate-tax treatment, Medicaid eligibility, divorce outcomes or protection from every judgment.
Practical setup checklist
- Write down the transfer’s purpose, timing and intended assets.
- Identify the child’s financial, family, disability and benefit circumstances.
- Determine the likely governing state and retain a local estate-planning attorney.
- Interview an individual trustee, professional fiduciary or institution and confirm willingness to serve.
- Name successors and decide how resignation, incapacity, removal and replacement will work.
- Choose scheduled, discretionary or hybrid distributions and state the trust’s duration.
- Name remainder beneficiaries and address what happens if one dies first.
- Have counsel draft a state-compliant spendthrift provision and review exceptions.
- Decide whether revocable or irrevocable structure fits the purpose; do not infer the answer from the spendthrift label.
- Sign, witness and notarize the instrument exactly as required.
- Transfer each asset using the correct title, deed, assignment or account process.
- Keep proof of funding, separate records and a trustee administration calendar.
- Schedule periodic reviews after moves, marriages, divorces, births, deaths, disability changes, major asset changes or legal amendments.
When professional review is essential
Use a state-licensed attorney when the child has significant debt, a pending claim, a disability, means-tested benefits, a business interest, real estate in another state, a prior divorce, a blended-family inheritance or a need for long-term discretionary support. Those facts can change the governing law, distribution design, funding method and beneficiary consequences.

Bottom line
A spendthrift trust for an adult child works only when all of its parts fit together: an appropriate purpose, a capable trustee and successor, clear distribution terms, a spendthrift provision valid under the governing state’s law, proper execution and completed asset transfers. It can keep undistributed property under trustee management and may limit some voluntary and involuntary transfers, but protection is neither universal nor permanent. Because state law, creditor exceptions, benefits rules and funding requirements control the result, have a local estate-planning attorney draft and review the trust before you transfer assets.
