An effective employee AI policy does five things: defines which tools and tasks are permitted, prevents sensitive information from being sent to unsuitable services, requires appropriate human review, assigns ownership and training, and gives workers a clear way to report problems. Build it as a risk-based operating rule rather than a blanket ban or a one-page promise that “someone will check the output.”

NIST’s AI Risk Management Framework (AI RMF), its Generative AI Profile, and the accompanying Playbook offer voluntary, adaptable guidance for this work. They do not replace legal advice. Employment, privacy, financial-services, consumer-protection, intellectual-property, records-retention, and sector rules depend on your jurisdiction, industry, data, and use case.

What an employee AI policy must answer

Before writing clauses, list the decisions an employee or manager must be able to make without guessing. A usable policy answers:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • What counts as AI? Include generative text, image, audio, video and code tools; embedded assistants in business software; automated scoring or recommendations; and systems used by contractors when they handle company work.
  • Which uses are allowed? Separate low-risk assistance from uses that can affect a person’s employment, finances, rights, safety or access to a service.
  • Which tools are approved? Name the owner of the approved-tools list and the process for adding, suspending or removing a service.
  • What information may be entered? Give examples of prohibited, restricted and permitted data rather than relying on the phrase “confidential information.”
  • Who remains accountable? Identify the person responsible for checking an output and making the final decision.
  • What must be disclosed? Decide when material AI assistance should be disclosed to colleagues, customers, applicants, regulators or other affected people.
  • How are errors and incidents reported? Specify a channel, response expectations and the information employees should preserve.
  • How does the policy change? Set review triggers for new tools, changed vendor terms, incidents, legal developments and evidence that a control is not working.

NIST describes acceptable-use policies as a way to reduce misuse, abuse, inappropriate repurposing and misalignment between systems and users. That makes the policy an operating control, not merely an HR acknowledgement.

Define the scope before you define the rules

Covered people and work

State whether the policy covers employees, temporary workers, interns, contractors, consultants and vendors performing work for the organization. Explain whether it applies on company devices and networks, on personal devices used for work, and when a worker uses a free public service outside the corporate environment to complete a company task.

Covered systems

Include public AI services, employer-provided applications, plug-ins and browser extensions, AI features built into email or office suites, customer-support bots, coding assistants, recruiting tools, fraud or credit models, transcription services and any system that generates or ranks content. A narrow definition that covers only a branded chatbot will miss the embedded features employees actually use.

Covered business functions

Assign an owner in each function that may use AI. NIST notes that third-party generative AI can affect HR, legal, compliance, IT and other enterprise functions. Finance teams also need to consider payment instructions, account information, forecasts, tax records, payroll data and client financial information.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Assign governance and approval ownership

One person should be able to answer, “Is this tool approved for this task today?” In a small employer that may be the head of IT or compliance. In a larger organization, establish a cross-functional group with representatives from security, privacy, legal, procurement, HR, finance and the affected business unit.

Minimum responsibilities

  • Policy owner: maintains the policy, publishes changes and coordinates periodic review.
  • Tool approver: evaluates proposed services and keeps the approved-tools register current.
  • Data owner: decides what information a business unit may place in an approved tool.
  • Human decision owner: remains accountable for an output or decision, even when an AI system produced a recommendation.
  • Security and privacy contacts: assess access, retention, logging, incident and privacy implications.
  • Procurement and legal contacts: review contracts, service-level commitments, intellectual-property terms and sector-specific obligations.
  • Training owner: tracks completion and updates examples when tools or rules change.
  • Incident coordinator: receives reports, preserves evidence and routes events for containment and remediation.

Publish an escalation route that does not require an employee to seek permission from the same manager whose decision may be affected. Anonymous or confidential reporting can be useful for sensitive employment matters.

Create a risk-based approved-use process

A single “allowed” or “banned” list is too blunt. Use a short intake form and classify the proposed task by the sensitivity of the data, the impact of the decision and the degree of human control.

Illustrative use tiers

Tier Typical task Default treatment Required controls
Low impact Brainstorming generic ideas, reformatting nonconfidential text, creating a first draft from public material Permitted in an approved tool Follow data rules; review for accuracy, originality and appropriateness before use
Moderate impact Summarizing internal documents, drafting customer communications, analyzing operational data Permitted only with the data owner’s approval for that tool Use the approved configuration; limit inputs; verify facts and calculations; retain the human reviewer
High impact Hiring, promotion, discipline, termination, credit or eligibility recommendations, safety decisions, or advice that could materially affect a person Restricted pending documented review Qualified human decision-maker; legal, privacy or compliance review as applicable; testing, monitoring and disclosure decisions documented
Prohibited Entering secrets or regulated data into a service that has not been approved for it; making an automatic employment decision without required human oversight; bypassing security controls Not permitted Stop the activity and report an attempted or completed use through the incident channel

These tiers are an implementation pattern, not a universal legal classification. Adjust them to your organization’s risk tolerance and obligations.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What an approval record should contain

  • Tool name, provider, version or feature and business owner.
  • Approved tasks and explicitly excluded tasks.
  • Data classes allowed as inputs and outputs.
  • Account type, access method, retention setting and administrator.
  • Human review standard and named decision owner.
  • Vendor assessment status, contract date and next review date.
  • Monitoring, incident and suspension procedures.

Require reapproval when a vendor changes its terms, model, data-use settings, subprocessors, storage location or material functionality.

Set information-handling boundaries

Employees need a rule for the exact information they are about to paste, upload or connect. NIST warns that third-party integrations can create intellectual-property, data-privacy and information-security risks, so do not assume that two tools treat inputs alike.

Build a data-use matrix

Information category Examples Policy treatment
Public Published product descriptions, public filings, material already released by the company May be used in an approved tool, subject to accuracy, copyright and disclosure review
Internal Nonpublic procedures, internal plans, ordinary business correspondence Use only in a tool approved for internal data; apply access and retention controls
Confidential Trade secrets, pricing plans, unreleased financial results, negotiation strategy, source code Do not submit unless the specific tool and workflow are expressly approved by the data owner and security or privacy reviewers
Personal or regulated Employee records, applicant information, customer identifiers, account details, health information, credentials, payment data or tax records Use only where the service, contract, jurisdiction and workflow have been reviewed for that data; otherwise keep it out

Tell employees not to paste passwords, API keys, private encryption material, payment-card details, full customer files or identifiable personnel records into an unapproved service. Mask or aggregate information only when the transformation genuinely prevents re-identification and the workflow permits it; replacing a name with an initial may not be enough.

Address connections and outputs

A risk review must cover more than the chat box. A plug-in that can read a mailbox, cloud drive, customer system or code repository may expose far more information than a single prompt. Limit permissions to the minimum needed, document connected systems and revoke access when a tool or worker no longer needs it.

Outputs can also contain confidential material, personal information or copyrighted content. Apply the same classification, access, retention and sharing rules to generated files, transcripts, prompts and logs.

Require human review and preserve accountability

“Human in the loop” is meaningful only when the reviewer has time, competence and authority to reject the output. Write the review duty in operational terms.

Minimum checks for ordinary work

  • Verify names, dates, numbers, calculations, citations, quotations and links against reliable source material.
  • Check that a summary did not omit a qualification or reverse the meaning of the original.
  • Test code, formulas, configurations and spreadsheet logic in a safe environment before deployment.
  • Check for unsupported claims, fabricated references, biased language, confidential information and inappropriate tone.
  • Confirm that the output matches the intended audience, accessibility requirements and business instructions.

Higher-impact decisions

For hiring, performance evaluation, discipline, termination, customer eligibility, lending, insurance, fraud, safety or other consequential decisions, require a qualified human to make or approve the decision. Document the evidence considered, the AI system’s role, material disagreements and the reason for the final outcome. Do not let a score or recommendation become an automatic decision merely because it appears objective.

Decide whether affected people should be told that AI materially contributed to an interaction or decision. The answer can vary by use case and jurisdiction; obtain local legal review before promising a disclosure standard.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Review vendors and contracts before deployment

Procurement is part of AI governance. NIST identifies due diligence, service-level agreements and transparency measures as possible approaches to third-party risk management.

Questions for a vendor assessment

  • Will prompts, uploaded files or outputs be used to train or improve a shared model?
  • Where are data and backups stored, and which subprocessors can access them?
  • How long are inputs, outputs, logs and account records retained, and can retention be disabled?
  • What security controls, identity options, audit logs and deletion processes are available?
  • How are model, feature, subprocessor and terms-of-service changes communicated?
  • What support and incident-notification commitments apply, and are they written into the contract?
  • Who owns inputs and outputs, and what restrictions or indemnities apply to generated material?
  • Can the organization export data and safely terminate the service?

Record unanswered questions as risks rather than treating silence as approval. A free service may have materially different data terms from an enterprise edition; approve the exact account type and configuration employees are allowed to use.

Train employees for the decisions the policy requires

Training should be practical and role-specific. At onboarding and at a defined refresher interval, demonstrate the approved-tools list, data matrix, prompt and upload rules, review duties, disclosure expectations and reporting route.

Role-based examples

  • Finance: never expose account credentials, payment instructions, payroll files or unreleased financial information; verify every generated calculation and journal-supporting explanation.
  • HR: treat applicant and employee data as sensitive; do not use an unapproved model to rank candidates or recommend discipline.
  • Managers: do not treat an AI-generated summary as a performance record without checking the underlying evidence.
  • Developers and IT: review generated code for security defects, licenses, secrets and dependencies before use.
  • Customer-facing staff: verify factual and financial claims and follow any disclosure rule before sending generated text.

Use a short scenario exercise and a knowledge check, then retain completion records. Retrain when a major tool, data rule or incident changes the work.

Monitor use and handle incidents

Monitoring should test whether the policy works without collecting more employee content than necessary. Depending on the tool and local rules, useful signals may include approved-tool access, unusual uploads, permission changes, review records for high-impact workflows, reported errors, customer complaints and vendor notices.

Define reportable events

  • Confidential, personal or regulated information was entered into an unapproved service.
  • A generated output contained a material error, fabricated citation, discriminatory content or harmful instruction.
  • An employee relied on an output without the required review.
  • A tool account, plug-in or connected repository was accessed unexpectedly.
  • A vendor changed data use, retention, model behavior or subprocessors without the required review.
  • An AI-assisted decision may have produced unfair or legally impermissible treatment.

Incident-response sequence

  1. Contain: stop the workflow, revoke tokens or connections when appropriate and prevent further sharing.
  2. Preserve: save the prompt, output, time, tool, account, recipients and relevant source material, subject to privacy and retention rules.
  3. Assess: determine what data, people, systems and decisions were affected.
  4. Escalate: notify security, privacy, legal, HR, compliance or the business owner according to the event.
  5. Remediate: correct or withdraw the output, notify affected parties when required, and address access or vendor weaknesses.
  6. Learn: update the approved-tools list, training, controls or policy and record the decision.

Set response times by severity in the internal procedure. Do not promise a universal deadline unless it reflects your legal and contractual obligations.

Choose a policy structure that employees can use

Two common approaches are a single broad policy and a broad policy supported by task-specific standards.

Criterion Single broad policy Broad policy plus task standards
Role clarity Simple to find, but may leave finance, HR or engineering questions unanswered More precise instructions for each role or workflow
Risk handling Efficient for low-risk use; can be too vague for sensitive data or consequential decisions Allows stronger controls where data or impact is higher
Keeping rules current One document is easy to revise, but every change can affect the whole workforce Approved-tool and task standards can change independently, with version control
Training and enforcement Fast initial training and simpler acknowledgement More training effort, but clearer evidence of what a role was expected to do

For most employers, a short enterprise policy paired with an approved-tools register, data-handling standard, high-impact-use standard and incident procedure gives a workable balance. NIST’s guidance is risk-based and adaptable; it does not prescribe this exact document structure.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Draft the policy in an implementation sequence

  1. Inventory current use. Ask each function which AI tools, embedded features and contractors are already being used, for what tasks and with what data.
  2. Set scope and definitions. Define AI, generative AI, approved tool, sensitive information, human review, high-impact use and incident.
  3. Classify tasks. Apply impact and data-sensitivity tiers; identify prohibited activities.
  4. Approve tools and configurations. Complete vendor, security, privacy, legal and procurement checks; record the exact account type and permitted data.
  5. Write review and accountability rules. Name the reviewer, decision owner, evidence to retain and disclosure expectations for each higher-risk workflow.
  6. Publish reporting and enforcement steps. Give employees a practical channel, explain non-retaliation expectations where applicable and describe consequences proportionately.
  7. Train and acknowledge. Use role-specific scenarios, record completion and provide a contact for questions.
  8. Test the controls. Run a tabletop incident, sample approved-use records and check whether employees can find the current tool list.
  9. Schedule maintenance. Review on a set cadence and whenever a tool, vendor term, law, incident or business process changes.

Sample clauses to adapt

The following wording is a drafting starting point, not legal advice:

Best Value

  • Twin-Ball Design : Hiacry gel pen features a double ball conical tip that reduces writing resistance and provides a stable and smooth writing experience. 0.7mm quick drying black ink ensures no jumping, leakage or seepage.
  • Quick-Dry Long Lasting Ink:0.7mm black ink can slide effortlessly, dry immediately, & is not easily dirty. It has a high-capacity reservoir (up to 1300 meters), which is very suitable for left-handed & right-handed users.
  • Sleek Design for Journaling & Planning: Engineered with a low center of gravity and precision tip for steady ink flow, these journaling pens excel at note-taking, sketching, planning, and more. They combine stylish pens with top-tier performance.

  • Comfortable Non-Slip Grip:The ergonomic pen barrel has a soft rubberized coating for a comfortable, non-slip grip, so you won't get fatigued even after long hours of writing.
Use only AI tools and features listed in the current approved-tools register, and only for the tasks and information categories listed for that tool.
Do not enter passwords, access tokens, confidential company information, personal information, customer records, regulated data or source code into an unapproved service.
The employee who uses an AI output remains responsible for checking its accuracy, completeness, legality, security and suitability before relying on it or sharing it.
AI may not make a final employment, eligibility, customer, financial or safety decision without the required qualified human review and documented approval.
Report suspected data exposure, harmful output, unauthorized access, material error or unapproved use promptly through the incident channel. Preserve relevant prompts, outputs and source records when permitted by retention rules.

Have counsel adapt these clauses to employment agreements, collective-bargaining requirements, privacy notices, records schedules and sector rules.

Legal boundaries and NIST guidance

NIST AI RMF 1.0 is intended for voluntary use, and NIST describes its Generative AI Profile and Playbook suggestions as voluntary and adaptable. NIST has also stated that the AI RMF is being revised; check the current official status when adopting or updating your framework.

Federal guidance cited for risk-based access, training and protection of government information applies to federal agencies. It can inform a private employer’s discussion, but it does not by itself create private-sector obligations.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Because the appropriate legal standard depends on location, industry, employee and customer data, and the use case, obtain jurisdiction- and sector-specific review before deployment. A policy cannot authorize conduct that another law, contract or professional rule forbids.

Maintenance checklist

  • Is the owner and approval authority named?
  • Does the approved-tools register identify permitted tasks, data classes, configurations and review dates?
  • Can an employee tell immediately whether a proposed prompt contains restricted information?
  • Are human-review duties specific enough to audit?
  • Are high-impact employment and customer decisions separately controlled?
  • Have vendor retention, training use, subprocessors, security, deletion and incident terms been reviewed?
  • Can workers report an incident without relying on the tool owner to investigate it alone?
  • Have training records and policy acknowledgements been retained?
  • Has the organization tested an incident scenario and corrected gaps?
  • Is there a trigger for reviewing model, feature, contract, legal or business changes?

A policy is ready for release when an employee can identify an approved tool, determine what data may be entered, understand what must be checked, know who owns the final decision and report a problem without guessing.
