The correct way to fund an Indian property purchase depends first on who is sending the money and whether it is moving into India or out of India. For an NRI or OCI buying permitted Indian immovable property, the Reserve Bank of India (RBI) framework allows payment through banking channels or eligible funds held in a non-resident account. A resident individual sending money abroad is instead subject to the Liberalised Remittance Scheme (LRS), including its USD 250,000 financial-year limit and documentation rules.
Do not use the LRS limit as the rule for an NRI or OCI’s inward payment. Confirm the buyer’s status, property classification, source of funds, receiving account and current bank checklist before transferring money. Tax, withholding and reporting obligations require transaction-specific advice; the rules cannot be safely reduced to one universal tax rate or certificate.

Start with the direction of the transfer
Most mistakes happen because two different RBI frameworks are treated as one. The first is an inward-payment rule for a non-resident Indian (NRI) or an Overseas Citizen of India (OCI) acquiring qualifying property in India. The second is the LRS framework for a resident individual remitting money from India to another country.

How an NRI or OCI can fund a permitted Indian property purchase
Which property can be acquired
The cited RBI property regulation permits an NRI or OCI to acquire immovable property in India other than agricultural land, a farm house or plantation property. That exclusion matters before any remittance is initiated. A transaction described informally as a “plot” or “house” still needs to be classified correctly under the applicable rules and local documentation.
If the property is agricultural land, a farm house or a plantation property, do not assume that the ordinary NRI/OCI route applies. Stop and obtain advice on the specific property and buyer before sending consideration.
Permitted payment channels
For an eligible acquisition, consideration may be paid from funds received in India by inward remittance through banking channels or from funds held in a non-resident account maintained under the governing rules. The receiving bank and conveyancer should confirm the account type and payment instructions for the particular sale.
Recommended Free Tools
This is why an NRE-account question cannot be answered safely with a blanket yes or no. An NRE account is a non-resident account, but the bank must verify that the account, the account holder, the property and the proposed payment satisfy the current rules and its compliance controls. Ask the bank to confirm the acceptable account and beneficiary details in writing before the transfer.
Modes that are not permitted under the cited clause
The regulation does not allow the consideration to be paid by traveler’s cheque, foreign-currency notes or another mode outside the specified channels. In the RBI’s wording: “no payment for any transfer of immovable property shall be made either by traveler’s cheque or by foreign currency notes or by any other mode other than those specifically permitted under this clause.”
Cash carried across a border, an informal handover, a payment to an unrelated personal account or a transfer whose purpose cannot be documented can create avoidable FEMA, bank-compliance and conveyancing problems. Use the beneficiary and purpose supplied by the receiving bank and seller’s authorized representative.

How the resident LRS route differs
The USD 250,000 limit
RBI’s LRS direction permits a resident individual to remit up to USD 250,000 in one financial year, running from April through March, for permitted current-account transactions, permitted capital-account transactions or a combination, subject to the scheme and applicable conditions. This is an outward-remittance framework for a resident individual.
The figure is not an inward-funding allowance for an NRI or OCI buying property in India. A resident’s attempt to send funds abroad and an NRI’s receipt of funds in India should therefore be reviewed under different questions, even if both transfers are denominated in dollars.
Core LRS documents identified by RBI
The RBI FAQ states that PAN is required for an LRS remittance. The authorized dealer should also obtain the previous year’s bank statement to satisfy itself about the source of funds. If that statement is unavailable, the bank may obtain a recent income-tax assessment order or a filed return instead.
Form A2 is used in the LRS process. Banks may accept it online or in physical form and can require connected documents under their own procedures. A completed form does not remove the bank’s obligation to verify the purpose, source, account and other details.
Step-by-step process for an NRI or OCI inward payment
- Confirm the buyer’s status. Establish whether the purchaser is an NRI or OCI for FEMA purposes, not merely whether the person holds a foreign passport or lives abroad. If there are joint buyers, companies, trusts or other entities, have the bank and property lawyer review the ownership structure.
- Classify the property. Obtain the property description from the sale agreement and confirm that it is not agricultural land, a farm house or plantation property under the applicable classification. Resolve any uncertainty before paying a deposit.
- Ask the receiving bank to pre-clear the route. Provide the buyer’s identification and residence/status details, the seller or escrow beneficiary, property address, agreement value, currency, proposed remitter account and receiving account. Request the current inward-remittance and property-payment checklist.
- Verify beneficiary instructions independently. Match the account name, number, bank, branch and any purpose or reference required by the bank and conveyancer. Do not rely solely on a changed email instruction from a seller or intermediary.
- Send through a traceable banking channel. Use an authorized banking route accepted by the receiving institution. The payment description should identify the genuine property purpose without adding informal wording that conflicts with the sale agreement.
- Capture the transfer evidence. Save the originating bank’s transfer advice, date, amount, currency, remitter and beneficiary details, transaction reference and any purpose code. Obtain the receiving bank’s credit confirmation.
- Match the credit to the contract. Give the credit evidence to the conveyancer or authorized recipient and obtain a receipt or acknowledgement that identifies the installment or consideration paid. Keep the agreement, invoices or payment schedule with the bank records.
- Check tax and closing requirements before the next installment. Ask a tax adviser which returns, certificates, withholding records or reporting forms apply to the buyer, seller and payment. Do not assume that a successful bank transfer completes the tax file.
Step-by-step process for a resident individual using LRS
- Check that the sender is resident for the relevant rules. The bank will assess the customer under FEMA and its KYC procedures. A person’s citizenship alone does not answer the residence question.
- Confirm the transaction is permitted under LRS. Explain the purpose, recipient, country, amount and whether the remittance is current-account, capital-account or a combination. The bank—not an informal online calculator—determines whether the proposed purpose fits its current LRS process.
- Calculate the financial-year usage. Add earlier LRS remittances made from 1 April through 31 March. The USD 250,000 ceiling is for the resident individual’s permitted remittances in that financial year and remains subject to scheme conditions.
- Prepare PAN and source-of-funds evidence. Supply PAN, the previous year’s bank statement and any additional evidence requested. If the statement is unavailable, ask whether a recent assessment order or filed return will satisfy the bank’s source check.
- Complete Form A2. Enter the purpose and recipient exactly as instructed. Submit it through the bank’s online or physical process and retain the submitted version and acknowledgement.
- Review the final debit and confirmation. Check the debited amount, currency, exchange-rate information supplied by the bank, fees, beneficiary details and transaction reference. Keep the confirmation with the LRS documents and tax records.
Documents to assemble before speaking with the bank
Information for the transfer conversation
- Buyer’s legal name, identification, FEMA residence and NRI or OCI status where applicable.
- Remitter’s account details and the proposed receiving account.
- Seller, escrow agent or other authorized beneficiary details.
- Property address, classification, agreement or booking reference and payment purpose.
- Amount, currency, installment number and contractual payment deadline.
- Evidence explaining the source of funds and, for an LRS remittance, PAN, Form A2 and the bank’s requested statements or tax documents.
This is a preparation list, not a universal RBI checklist. The authorized dealer or receiving bank can ask for other KYC, ownership, valuation, source-of-funds or transaction documents.
Records for the purchase file
- Signed sale agreement, allotment letter or other purchase documentation.
- Written payment instructions and any later instruction change validated through a trusted channel.
- Originating-bank transfer advice and transaction reference.
- Receiving-bank credit evidence.
- Seller, escrow or authorized recipient receipts and acknowledgements.
- A schedule showing each payment against the contractual consideration.
Keeping these records together demonstrates how the regulated transfer relates to the property payment. The cited RBI text does not present this collection as a complete mandatory list, so confirm the exact file requirements with the bank and conveyancer.

Tax and filing records
Retain relevant tax returns, assessment records, payment receipts and any certificates or filings that a tax adviser or bank says apply. Store the records for the period required by the applicable law and by the professionals handling the transaction. Do not discard bank confirmations simply because the seller has acknowledged receipt.
Tax, withholding and reporting: what you can and cannot conclude
The available RBI material establishes remittance channels and some LRS documentation; it does not settle every buyer’s income-tax, withholding or tax-collected-at-source obligation. Those duties can depend on the buyer and seller, whether the seller is resident, the transaction value, ownership structure, consideration, payment timing and the law in force for the relevant year.
An Income Tax Department result concerning remittance-reporting forms does not, by itself, answer the tax treatment of purchasing Indian property. Do not print a tax percentage, promise that no certificate is needed or treat a bank’s remittance approval as a tax clearance. Ask a qualified Indian tax adviser to identify the filings and evidence for the actual parties and payment schedule, then keep copies of whatever is submitted or issued.
Comparing practical transfer routes
There is no single “best” route independent of the buyer’s status and the bank’s acceptance. Compare a proposed route on compliance first, then on operational details.
| Route or arrangement | Compliance question | Operational checks | Records to retain |
|---|---|---|---|
| Direct overseas bank transfer to an Indian bank account | Does it fit the NRI/OCI inward-payment rule and the receiving bank’s beneficiary and purpose controls? | Exchange-rate basis, fees, cut-off times and payment deadline supplied by the banks | Transfer advice, reference, credit confirmation and property receipt |
| Cross-border remittance service accepted by the receiving bank | Is the service permitted for this sender, purpose, currency and beneficiary, and will the Indian bank accept the resulting credit? | Total fee, exchange-rate margin, delivery estimate and cancellation or recall procedure | Service receipt, sender and beneficiary details, bank credit evidence and seller acknowledgement |
| Payment from an eligible non-resident account in India | Does the account qualify for this purchaser and property, and does the bank permit the debit? | Available balance, account mandate, payment reference and installment timing | Account statement, debit advice, beneficiary receipt and contract schedule |
| Resident individual’s outward LRS remittance | Does the purpose fit LRS and is the sender within the financial-year limit and bank checks? | Previous LRS usage, PAN, Form A2, source documents and bank processing requirements | Submitted form, source evidence, debit confirmation and any bank acknowledgement |
Fees, exchange-rate margins and delivery times vary by provider and date. They were not established here, so do not rank a bank or remittance service without checking its current terms and the receiving institution’s acceptance.

Applying the LRS limit to an NRI’s inward transfer
Why it fails: LRS governs permitted outward remittances by resident individuals, while the NRI/OCI property rule concerns payment into India.

Relying on an old remittance limit or FAQ
Why it fails: Historical RBI guidance can concern a different transaction, such as repatriation of NRO balances or property-sale proceeds, rather than a current purchase payment.
Correction: Treat older figures as context only. For example, an older RBI FAQ references USD 1 million per financial year for certain remittances; that figure should not be presented as the current rule for funding an Indian property purchase without checking the current regulation and bank.
Treating a completed transfer as the end of the tax process
Why it fails: Remittance approval and tax compliance are separate questions.
Correction: Have a tax adviser review the parties, consideration, seller status, timing and ownership structure, and preserve every resulting filing or certificate.

A practical decision checklist
- Identify the sender’s FEMA residence and whether the person is an NRI, OCI or resident individual.
- Identify the direction of money: into India or out of India.
- Classify the property and rule out agricultural land, a farm house or plantation property where the NRI/OCI permission is being used.
- Confirm the account and beneficiary with the receiving bank and conveyancer.
- For an NRI/OCI inward payment, use only a banking channel or eligible non-resident-account funds accepted by the bank.
- For a resident LRS remittance, check the April–March total, USD 250,000 ceiling, PAN, Form A2 and source-of-funds evidence.
- Obtain transfer advice and receiving-bank credit confirmation.
- Match every payment to the agreement and obtain a receipt.
- Ask a tax adviser what withholding, reporting, certificates and record-retention requirements apply.
- Reconfirm the bank’s current rules immediately before sending a large or time-sensitive installment.
What to confirm before releasing the money
Before the first transfer, and again if the beneficiary or installment changes, ask the authorized dealer or receiving bank to confirm the applicable rule, account route, purpose description, required documents, expected evidence of credit and escalation contact for a delayed or rejected payment. Keep that confirmation with the sale agreement.
The safest approach is not to search for a generic “India property remittance limit.” Identify the person, property, account and direction of travel, then document the route the bank has accepted. That process separates the NRI/OCI inward-payment rule from resident LRS, protects the payment trail and leaves tax questions with the adviser who can review the complete transaction.
