You can sell a home for cash safely, but treat an unsolicited “cash offer,” mortgage-rescue proposal, or sale-leaseback as a contract and title transaction—not as free financial help. Before signing anything, confirm who will own the property, whether your mortgage remains your responsibility, exactly how much you will receive and when, and whether an independent local lawyer or settlement professional has reviewed the documents. A cash sale itself is not proof of fraud; the danger is the combination of a sharply discounted price, pressure, misleading promises, unusual payment instructions, or a deed transfer that leaves you with obligations you did not expect.
Start by identifying what is actually being offered
People use “sell my house for cash” to describe several very different arrangements. The legal and financial risk changes depending on whether you are making an ordinary sale, transferring the deed as part of a mortgage-relief pitch, or selling and renting the home back.
As an Amazon Associate I earn from qualifying purchases.
| Arrangement | What happens to ownership | What can happen to your mortgage | Key question before signing |
|---|---|---|---|
| Ordinary cash sale | You transfer the home under a purchase contract and receive the agreed proceeds at closing. | Your loan is normally paid or otherwise handled from the closing proceeds under the contract and local settlement process; obtain local advice on the exact procedure. | Is the buyer, price, deposit, closing date and payoff procedure written in a contract you understand? |
| Equity-skimming or deed-transfer pitch | You may sign over the deed and move out, while the other party controls the property. | Transferring the deed does not transfer the mortgage. You can lose ownership and still owe the loan. | Why would you give up title before receiving documented sale proceeds, and who is legally responsible for the loan? |
| Sale-leaseback | You sell the home and become a renter from the buyer. | The sale may not erase every debt or obligation. Your ability to stay depends on the lease and your ability to pay rent and fees. | What are the rent, increases, fees, lease term, renewal rules and eviction consequences? |
| Mortgage-relief service presented as a sale or rescue | The company may seek fees, control of documents or the deed while promising lender relief. | You remain responsible for communicating with and paying your lender unless a valid, documented arrangement says otherwise. | Is this a genuine purchase, a regulated mortgage-relief service, or both—and what written lender offer exists? |
The Federal Trade Commission (FTC) summarizes the central deed risk plainly: “Transferring the deed doesn’t change the fact that the mortgage is yours.” A promise that you can rent the home or buy it back later does not restore the control you gave away when you signed the deed.
Recognize the scam patterns before you negotiate
Equity skimming disguised as a quick cash purchase
In the pattern described by the FTC, a promoter offers substantially less than comparable homes in the neighborhood, asks the owner to sign over the deed and leave, and promises a share of the profit when the property is resold. The promoter may rent the home, keep the resale proceeds or stop making payments. The original owner can lose the house and remain liable for an unpaid mortgage. A future-profit promise is not a substitute for a clearly documented purchase price paid through a controlled closing.

Another version says you can transfer title, remain in the property as a renter and buy the home back later. Once title changes hands, the buyer controls the property. Rent, buyback pricing, deadlines and penalties can make the promised return impossible. If the written terms do not guarantee a specific, affordable right that you have had independently reviewed, assume you do not have one.
Mortgage-relief offers that demand money or silence
The FTC’s Mortgage Assistance Relief Services (MARS) guidance covers companies offering help with mortgage relief, not every ordinary home sale or every legal service. For covered services, a company generally cannot charge until it has provided a written offer of relief from the lender and you have accepted it. The company must disclose important information about the lender’s offer, its total fee and the risk that missed payments could cost you the home or damage your credit.
Warning signs include an upfront fee, instructions to stop contacting your lender, or a demand that you send mortgage payments to the intermediary instead of the lender. A company cannot tell you to cut off communication with your lender. Call the servicer directly and ask what options are available; do not rely on the promoter’s description of a supposed approval.

Sale-leasebacks that turn equity into rent obligations
The FTC describes a sale-leaseback as selling your home and becoming a renter. These offers can look attractive because they provide cash while allowing you to stay, but you give up ownership. The fine print may include fees, rent increases, short lease terms, renewal conditions and eviction risk if you cannot pay. Read the sale contract and lease together: the cash price, rent and occupancy promise are one financial decision, not separate paperwork.
Use a deliberate process instead of an urgent signature
A legitimate buyer should tolerate verification and review. Use this sequence before accepting funds or transferring title.
- Ask for the complete proposal in writing. Require the buyer’s legal name, purchase price, deposit, closing date, property address, inspection or cancellation terms, treatment of liens and mortgage payoff, and every fee. If the proposal includes renting back or buying back the home, demand the separate lease or option agreement at the same time.
- Identify the transaction type. Ask directly whether this is an outright purchase, a deed transfer with a future resale promise, a sale-leaseback, or mortgage-relief assistance. Do not accept a verbal explanation that conflicts with the documents.
- Check the person and company independently. Use contact information you obtain from an official, independently verified source—not a number or link in an unexpected message. If someone claims to represent your lender, government agency or another organization, call that organization through its known website or existing account statement.
- Compare the price without assuming a national rule. Obtain a local valuation or advice from a licensed professional you choose. The FTC materials establish that an unusually low offer can be part of equity skimming; they do not provide a nationwide formula for fair market value. Compare the net amount after commissions, fees, liens, taxes and moving costs, not only the headline price.
- Protect the deed and other signed documents. Read every page before signing. Look for language that conveys title, creates a tenancy, grants a power of attorney, assigns future proceeds, or imposes a buyback obligation. Never sign a blank deed, incomplete contract or document you are told will be “filled in later.”
- Get independent legal review. Choose the lawyer rather than using only a lawyer supplied by the buyer. The FTC recommends obtaining the lawyer’s name, the state or states and license number, checking with the state bar, and getting the work, price and payment schedule in writing. A lawyer’s presence is not, by itself, proof that the offer or company is legitimate.
- Use a controlled closing. Ask who will coordinate documents, collect and disburse funds and arrange recording. Depending on the location, that role may be performed by a title company, escrow company or attorney. Confirm the settlement agent independently and verify wiring instructions by calling a trusted number; do not change payment instructions solely because of an urgent email or text.
- Verify the final numbers before completion. Obtain a written settlement statement showing the purchase price, mortgage payoff, liens, taxes, fees and the amount you will receive. Do not authorize recording or hand over keys until your questions are answered and the agreed funds and obligations are clear.
Terms that deserve special scrutiny
| Document or promise | What to verify | Why it matters |
|---|---|---|
| Deed | Whether it transfers ownership now, to whom, and for what consideration. | A deed transfer can remove your ownership while leaving the mortgage in your name. |
| Purchase contract | Price, deposit, closing date, contingencies, cancellation rights and responsibility for liens. | Verbal assurances do not control if the signed contract says something else. |
| Resale-profit promise | The exact calculation, payment deadline, security for payment and what happens if the property is rented or sold another way. | Future proceeds may never be paid; the FTC identifies this structure in equity-skimming scams. |
| Leaseback agreement | Rent, increases, fees, security deposit, term, renewal, maintenance duties and eviction provisions. | You become a tenant and can lose the right to stay if you cannot meet the lease. |
| Buyback or option agreement | Exercise deadline, price formula, financing requirements, penalties and whether the option is actually enforceable. | A promised future purchase may be unaffordable or contain conditions you cannot satisfy. |
| Mortgage-relief agreement | The lender’s written offer, total fee, timing of payment and instructions about lender communication. | Covered MARS providers generally cannot collect before a written lender offer is provided and accepted. |
How to handle mortgage distress while considering a sale
If missed or unaffordable payments are driving the decision, contact your mortgage servicer or lender directly and explain the situation. Ask about available options and the documents required. Keep making payments as instructed unless your lender gives you different written directions. The FTC also points homeowners toward certified housing counselors for mortgage-distress assistance.

This advice addresses mortgage distress; it is not a universal checklist for an ordinary cash sale. A counselor can help you understand lender options, while a locally licensed lawyer can explain the consequences of a deed, leaseback or other transfer. No intermediary should require you to stop communicating with the lender.

A settlement agent generally coordinates transaction obligations, prepares or collects transfer documents, receives and disburses funds according to the contract and arranges recording. The CFPB describes these functions in the context of a mortgage-financed purchase; the same labels are not a nationwide legal checklist for every cash sale. Depending on your location, a title company, escrow company or attorney may handle the closing.
Local rules determine matters the reviewed federal guidance does not settle, including seller disclosures, deed formalities, title procedures, taxes, recording requirements and which professional must conduct the closing. Ask local counsel or a qualified settlement professional what applies to your property and transaction. Do not assume that a cash buyer eliminates title work, lien payoff or required disclosures.

Pressure tactics and payment red flags
The Consumer Financial Protection Bureau says common fraud warnings include someone asking for money or personal information, pressuring you to act quickly, or pretending to be a person or organization you trust. Treat these behaviors as reasons to pause, not as evidence that you are about to lose the deal.
- A demand for an immediate signature, same-day deed or “today only” price.
- Instructions not to tell your lender, lawyer, family member or housing counselor.
- Requests for upfront fees, gift cards, cryptocurrency, cash delivered to an individual, or payment to an account unrelated to the written contract.
- Unexpected changes to wiring instructions or a request to send sensitive identity documents through an unverified link.
- A price far below local comparable homes paired with a promise that you will share later profits.
- Documents that are incomplete, unusually complicated, inconsistent with the sales pitch or written in a language you cannot understand.
- A claim that a lawyer, government agency or lender has “approved” the deal without verifiable written confirmation.
If you suspect a scam or have already signed
Stop sending money and do not sign additional documents until an independent lawyer reviews what happened. Preserve the advertisement, texts, emails, call records, contracts, deeds, payment receipts and account details. Contact your mortgage servicer promptly if the property or loan may have been transferred, payments were redirected or you were told to stop paying. Ask what records they have and what immediate steps protect the account.
Do these 3 things before closing this tab:

Reporting does not replace legal advice, title review or lender contact, but it creates a record and may help investigators identify related conduct.

A practical decision rule
Proceed only when all of these conditions are true:
- You know whether ownership transfers, whether you become a renter and who remains responsible for the mortgage.
- The price and net proceeds are written, with fees, liens and payoff treatment explained.
- You have had enough time to read the documents and obtain independent advice.
- The buyer’s identity, settlement professional and payment instructions were verified through channels you selected.
- No one is demanding secrecy, an unusual upfront payment or a halt to lender communication.
- You understand the consequences if a leaseback rent payment, buyback deadline or future-profit promise does not work as described.
If any condition is missing, pause the transaction. A genuine buyer can wait for verification; surrendering the deed or sending money under pressure can be difficult or impossible to reverse.
