Random freezes, missing sound and display glitches usually trace back to one bad driver. Find and replace yours safely.Free scan · under a minuteIn the United States, you usually cannot take your existing mortgage rate to a different house. The loan normally stays secured by the home named in the mortgage. Your practical choices are to have the buyer qualify to assume that loan (if the loan permits it), buy the next home while qualifying for both homes, use carefully evaluated temporary or home-equity financing, or sell first and coordinate the move around the proceeds. A low rate has real value, but preserving it should not lead you into unaffordable overlapping payments, an expensive bridge loan, or debt secured by a home you are trying to sell.
This guide covers U.S. mortgage practice. Servicer rules, lender overlays, state contract law, title procedures and available products vary. Confirm the current terms with your servicer, lender, real-estate professionals and, when appropriate, an attorney or tax professional.

First, separate the mortgage rate from the house
A mortgage is generally tied to the property that secures it, not to you as a portable line of credit. When you sell, the existing loan is ordinarily paid off from the sale proceeds. The replacement home normally requires a new mortgage with its own rate, fees, underwriting and closing date.
That is why “porting” a low rate is usually not an option in U.S. residential lending. The relevant exception is an assumption: an eligible buyer takes over the existing loan on the same property. An assumption is not a transfer of your old mortgage to the house you want to buy. The buyer must satisfy the servicer’s requirements, and you must find out whether you will be released from future liability.

Before choosing a strategy, establish three facts:
- What kind of mortgage you have and whether the note permits a third-party assumption on sale.
- Whether you qualify for the replacement mortgage while the current home is still legally yours.
- When sale proceeds will actually be available and what financing covers any gap.
The Consumer Financial Protection Bureau (CFPB) explains that most loans do not allow assumptions. Your note and servicer, not a general internet rule, determine the answer for your loan.
Path 1: Find out whether the buyer can assume your current loan
What an assumption does
In an assumption, the buyer takes responsibility for the existing mortgage on the existing property, including its remaining balance, interest rate and other loan terms, subject to the servicer’s approval process. The buyer usually needs to qualify based on income, credit, assets and debts, just as with a new mortgage. The sale price and the loan balance also have to be reconciled: if the price is higher than the assumed balance, the buyer needs cash or separate financing for the difference.
Ask the servicer two separate questions: “Is the loan assumable on a sale to a third party?” and “What document releases me from liability after the assumption?” A buyer’s payment performance does not automatically eliminate your legal responsibility. Obtain the servicer’s written requirements, fees, review timeline and release procedure before representing an assumption in a contract.
Loan type matters
| Loan category | What the cited guidance indicates | What you still must verify |
|---|---|---|
| FHA-, VA- or USDA-insured or guaranteed loans | Fannie Mae’s consumer guidance says these government-backed loans may be assumable by an acquiring owner. | Buyer eligibility, servicer approval, any agency or program conditions, fees and the written release of your liability. |
| Conventional fixed-rate loans | Fannie Mae says assumptions are generally limited to certain protected situations. Freddie Mac says third-party assumptions are rare and most conventional mortgages do not permit them. | The exact due-on-sale and assumption language in your note, the servicer’s process and whether a specific exception applies. |
Do not advertise a home as “transferable” merely because the rate is attractive or because another homeowner had an assumable loan. The buyer and servicer need a formal determination for this mortgage.
When an assumption can help—and when it cannot
An assumption can make your low rate an advantage to a buyer and may reduce the replacement financing needed for that buyer. It does not let you keep the old mortgage on your next home, and it may not close quickly enough for your purchase timetable. The buyer must also have enough funds for your equity, closing costs and any difference between the sale price and assumed balance.

If the servicer will not approve the assumption, or the buyer cannot qualify, treat the old loan as a payoff at closing and evaluate the other paths below.
Path 2: Buy before selling only after underwriting the overlap
How lenders count two homes
If you buy the replacement home before title to the current home transfers, the lender may have to count both housing obligations. Fannie Mae’s Selling Guide, dated September 2, 2026, states: “If the borrower’s current principal residence is pending sale, but the transaction will not close with title transfer to the new owner prior to the subject transaction, and the borrower is purchasing a new principal residence, the current PITIA and the proposed PITIA must be used in qualifying the borrower for the new mortgage loan.” PITIA means principal, interest, taxes, insurance and applicable association dues.

Ask the lender to model the exact period in which you could owe both payments. Approval depends on your income, assets, other debts, reserves, proposed loan, credit profile and timing—not merely on the expected equity in your current home.
Documents to prepare for the lender
- Recent pay statements, tax returns or other income documentation the lender requests.
- Statements for checking, savings, investments and retirement accounts showing funds for down payment, closing costs and reserves.
- The current mortgage statement, property-tax and homeowners-insurance information, and association dues if applicable.
- The proposed purchase price, estimated new PITIA, rate, loan type and expected closing date.
- The current home’s listing agreement, accepted offer, scheduled closing date and any sale contingency, if the lender requests them.
- Statements for credit cards, student loans, auto loans and other recurring obligations.
Request a written preapproval that explicitly states how the lender treats the current home before its title transfer. A prequalification based on a quick income estimate is not the same analysis.
Path 3: Cover the timing gap with temporary or home-equity financing
Bridge financing
CFPB Regulation Z describes a temporary bridge loan with a term of 12 months or less as including a loan used to finance a new dwelling when the borrower plans to sell the current dwelling within 12 months. This is a regulatory description, not a promise that a lender offers a bridge product or that its terms will be favorable. Read the regulation’s definition and ask each lender for its actual product terms.

Before signing, obtain the complete rate and fee schedule, payment amount and schedule, maturity date, required payoff source, extension policy, minimum equity, appraisal requirements and consequences if the old home sells late or for less than expected. A loan that appears affordable for a few months can become a lump-sum crisis when the deadline arrives.
Home-equity loan
A home-equity loan is generally a lump-sum loan secured by your current home. CFPB notes that it may involve upfront fees and that failing to repay can expose the home to foreclosure. CFPB’s explanation is a useful starting point, but your lender’s disclosure controls.
Because the proceeds are borrowed against the home you intend to sell, include the new payment in the replacement-mortgage qualification analysis. Confirm whether the loan must be paid in full at the sale, whether there is a prepayment charge, and how much net equity remains after both mortgages, selling costs and the new loan are paid.
HELOC
A home equity line of credit is a second mortgage when a first mortgage already exists. It normally has an adjustable rate, and the payment can change as the balance and interest rate change. The amount you can borrow may also be reduced or frozen under the lender’s terms. CFPB contrasts home-equity loans and HELOCs.
Compare a HELOC with a bridge loan and a fixed home-equity loan on total interest, annual or transaction fees, rate-change limits, draw and repayment periods, required payoff timing and the collateral at risk. A lower initial payment is not proof of a lower total cost.

| Financing path | Typical structure described by the guidance | Questions that determine risk |
|---|---|---|
| Bridge loan | Temporary financing for the purchase while the current home is expected to sell; CFPB’s cited regulatory description uses a term of 12 months or less. | Exact maturity, extension rights, payoff deadline, fees, rate, payment and what happens if the sale is delayed or short. |
| Home-equity loan | Lump-sum second loan secured by the current home, generally with upfront fees. | Fixed or variable rate, total interest, payoff at sale, fees, qualification impact and foreclosure exposure. |
| HELOC | Revolving second mortgage, usually with an adjustable rate and payment that changes with the balance or rate. | Draw and repayment periods, rate caps, payment resets, fees, line-freeze provisions and required payoff at sale. |
Path 4: Sell first, buy first or coordinate the closings
| Timing strategy | Advantages | Costs and constraints |
|---|---|---|
| Sell first | Sale proceeds and the old mortgage payoff are known before you finance the purchase; you avoid carrying two homes. | You may need temporary housing, storage or a second move, and you could be buying in a changing market. |
| Buy first | You can move once and avoid making your purchase dependent on finding a buyer for the current home. | You must qualify for overlapping PITIA and may need bridge, home-equity or other temporary financing. |
| Closings close together | A coordinated sale and purchase can reduce the period between transactions and may make proceeds available for the purchase. | Every lender, title or closing provider, buyer, seller and contract deadline must align; a delay in one transaction can disrupt the other. |
There is no universal rule that a seller will accept a home-sale contingency or that one is legally worded the same way in every state. Ask a local real-estate professional and, when needed, an attorney about the contingency’s deadlines, notice requirements, inspection and financing provisions, and what happens if your home does not sell.
A decision process that protects the low-rate value
- Get the current loan file. Obtain the latest mortgage statement, note, riders, payoff instructions and servicer contact information. Ask specifically about third-party assumptions, due-on-sale provisions, fees and liability release.
- Estimate realistic sale proceeds. Start with a conservative sale price, then subtract the mortgage payoff, commissions or other transaction charges, taxes or assessments due, repairs or concessions and any home-equity or bridge balance. Do not treat gross listing price as cash available for the purchase.
- Ask a lender to underwrite both timing cases. Request one scenario in which the old home closes before the purchase and another in which it does not. Have the lender state the PITIA used for each property, required reserves and documentation.
- Price every financing offer by its full life. Compare origination and annual fees, rate type, payment changes, maturity, extension terms, payoff penalties and total interest—not only the first monthly payment.
- Choose a contract timetable that can survive a delay. Coordinate inspection, appraisal, underwriting, title work, recording and possession dates. Leave enough time for lender conditions and a late sale without assuming that an extension will be granted.
- Put critical promises in writing. An assumption approval, liability release, bridge extension, sale contingency, rent-back or post-sale principal payment should be documented by the responsible servicer, lender or contract professional. A verbal assurance is not a closing condition.
- Recheck the numbers immediately before closing. Review the lender’s final disclosure, payoff figures, cash to close, escrow items and any new debt. The CFPB’s Closing Disclosure explainer describes the document used to show final loan terms and closing costs.
How to compare the choices on one worksheet
Use the same assumptions for each path so a low rate does not hide a high transition cost. Record:
- Current mortgage balance, rate, monthly PITIA and estimated payoff date.
- Expected sale price as a range, not a single optimistic number.
- Estimated selling expenses and the net cash available at closing.
- New purchase price, down payment, loan amount, rate, closing costs and new PITIA.
- Months of overlap and the cash reserve required for that period.
- Bridge, home-equity or HELOC fees, interest, payment changes and final payoff deadline.
- Potential rate-lock extension charges or other costs if either closing moves.
- What happens if the current home sells later, sells for less, or requires a price reduction.
Then compare the amount of cash remaining after the sale, the highest required monthly payment, the largest balloon or payoff obligation and the home securing each debt. A strategy that preserves a low first-mortgage rate but leaves no reserves for repairs, moving costs or a delayed sale may be less resilient than a new mortgage with a higher rate.
Questions to ask before you list or make an offer
Ask the current servicer
- What type of loan do I have, and does my note permit a third-party assumption on sale?
- If assumption is permitted, what must the buyer provide, what fees apply, how long does review take and how do I obtain a written release from liability?
- What exact payoff amount and per-diem interest should the closing agent use?
- Does the note or servicer policy permit a post-sale principal payment or recast on a future loan? If not, what alternative applies?
Ask the replacement lender
- If I buy before my current sale closes, will you count both current and proposed PITIA, and what reserves are required?
- What income, asset, debt and sale-contract documents must I provide?
- Do you offer bridge, home-equity or HELOC financing, and what are the rate, fees, term, payment schedule, payoff deadline and collateral?
- What if my home sells later than expected or for less than expected?
- Will a new loan permit a post-sale principal curtailment or recast? What minimum amount, fee, timing and payment recalculation apply?
- Which closing dates can your underwriting, title and closing teams support?
Ask the real-estate and closing professionals
- What sale and purchase dates leave a workable buffer?
- What contingency language, notice deadlines and remedies apply in this jurisdiction?
- Can the sale proceeds be delivered in time for the purchase, and what happens if recording is delayed?
- Are possession, rent-back, inspection, appraisal and repair obligations aligned across both contracts?
Common failure points and safer responses
“The buyer can just take over my rate.”
Only an approved assumption on the existing property can do that, and most loans do not permit one. Ask the servicer before marketing the feature, and obtain the release-of-liability terms.
Recommended Free Tools
“My accepted offer means the old payment no longer counts.”
Not necessarily. If title has not transferred before the new transaction, the stated Fannie Mae guidance requires current and proposed PITIA in the specified qualification situation. Have the lender document its treatment instead of relying on an offer date.

“The bridge loan will be repaid when the house sells.”
That plan fails if the sale is late, the price is reduced or the transaction falls through. Build a backup source of repayment, understand extension and default terms, and keep reserves for the full possible term.
“A HELOC payment is low, so it is safer.”
A HELOC commonly has an adjustable rate and changing payment, and it adds debt secured by the current home. Compare the worst-case payment and payoff timing, not just the initial draw-period payment.
“I can always recast the new mortgage after selling.”
No universal fixed-rate recast right is established here. Confirm the new lender’s note and servicing policy, including minimum principal reduction, fee, deadline and whether the payment will actually be recalculated. Do not base the purchase on an assumed recast.

Protect the value of the low rate without overextending
A below-market rate is worth considering, but its value is only one part of the move. An assumption may benefit the buyer while leaving you with a normal payoff and a new mortgage. Buying first may avoid two moves but requires documented ability to carry both homes. Bridge and home-equity borrowing can solve a timing problem while adding fees, variable payments, deadlines and foreclosure exposure. Selling first provides cleaner proceeds but may require temporary housing.
The sound choice is the path whose timing, qualification, repayment plan and reserves still work if the current home takes longer to sell or sells for less than hoped. Have the servicer and replacement lender analyze the actual loan documents and both closing scenarios before you make an offer or commit to a purchase date.
