The receiving Roth IRA must belong to the 529’s designated beneficiary, the 529 generally must have been open at least 15 years, contributions (and related earnings) from the most recent five years are excluded, and the transfer must be a direct trustee-to-trustee rollover. The amount is also constrained by the beneficiary’s Roth IRA contribution limit for that year and a $35,000 lifetime ceiling for all such rollovers.
This is not a way to move any 529 balance to any relative’s Roth IRA, and a personal withdrawal followed by a deposit is not the same transaction. Use the workflow below to identify eligible dollars, coordinate both custodians and preserve the records needed to support tax-free treatment.

What the 529-to-Roth IRA rollover is
SECURE 2.0 created a special exception for qualified tuition programs (QTPs), commonly called 529 plans. For distributions made after December 31, 2023, an eligible amount can be rolled from a 529 directly into a Roth IRA for that account’s designated beneficiary. The provision is intended for money left after education needs change, not as a general-purpose 529 withdrawal strategy.

A compliant rollover is excluded from federal gross income and does not trigger the additional tax that can apply to a nonqualified 529 distribution. That result depends on meeting every condition: the correct Roth IRA owner, the 15-year account test, the five-year contribution exclusion, the annual Roth limit, the $35,000 lifetime limit and the direct-transfer requirement. Missing one condition can make some or all of the transaction ineligible.

“For this special rollover to be tax-free, the rollover amount must be paid through a direct trustee-to-trustee transfer, is subject to the Roth IRA annual contribution limit and a $35,000 lifetime limit, must be distributed from a QTP account that has been open for at least 15 years as of the date of the distribution, and may not exceed the amount contributed to the QTP (and attributable earnings) before the 5 year period ending on the date of the distribution.” — Internal Revenue Service, Topic no. 313, Qualified tuition programs (QTPs), current guidance.
Who may receive the money
The designated beneficiary must own the Roth IRA
The receiving Roth IRA is for the 529’s designated beneficiary. If a parent owns the 529 as account owner but names a child as beneficiary, the child—not the parent—is the intended Roth IRA owner for this special rollover. The rule does not authorize a transfer from the child’s 529 to a sibling’s, parent’s or grandparent’s Roth IRA merely because that person is an eligible family member.
Changing the beneficiary before a rollover is a separate planning decision. A beneficiary change can affect which person is eligible to receive a later rollover, while the account’s age and contribution history still need to be documented. Ask the plan administrator how it records beneficiary changes and account history before relying on a 15-year calculation.
The beneficiary must otherwise qualify for a Roth IRA contribution
The beneficiary must satisfy the applicable Roth IRA contribution rules, including the compensation requirement. The 529 rollover does not eliminate other eligibility rules that apply to Roth IRAs. The cited IRS guidance establishes that the annual Roth limit controls the rollover, but it does not provide one universal 2026 compensation example; confirm the beneficiary’s compensation and any income-based Roth restrictions for the applicable tax year with the IRS rules or a qualified tax professional.
Five tests that determine whether a rollover is tax-free
1. The 529 must have been open for at least 15 years
The QTP must have been maintained for at least 15 years as of the distribution date. The relevant date is the plan account’s history, not the age of the beneficiary or the number of years since the last deposit. A distribution before the account reaches that threshold does not qualify under this special provision.
Record the account-open date in writing. Plans can have different record systems, and IRS guidance does not resolve every issue involving beneficiary-change records. Request the administrator’s interpretation of how it counts the 15-year period when an account has had a beneficiary change, a successor account number or a rollover between 529 programs.

2. Contributions from the latest five years are excluded
The rollover cannot include amounts attributable to contributions made during the five-year period ending on the distribution date, including the earnings associated with those contributions. This is a contribution-age test, not simply a statement that the account has existed for five years.
For example, if the trustee-to-trustee transfer occurs on October 1, 2026, the plan must identify contributions made during the five-year lookback period ending on that date and remove those contributions and related earnings from the eligible pool. The administrator’s contribution-history and earnings calculation should control; do not estimate the exclusion from the current account balance alone.
3. The annual Roth IRA contribution limit caps the transfer
The special rollover amount for a tax year cannot exceed the Roth IRA annual contribution limit for that year. Any other Roth IRA contributions the beneficiary makes during the same year use that same annual capacity. A beneficiary who has already contributed part of the annual limit cannot add a full-limit 529 rollover on top of those contributions.
Because the applicable dollar limit changes by tax year and the cited guidance does not state a single 2026 figure, verify the current IRS limit before authorizing the transfer. Ask the Roth custodian to confirm how it will code the transaction and how much annual capacity remains after all of the beneficiary’s regular Roth IRA contributions.
4. The beneficiary has a $35,000 lifetime ceiling
All special 529-to-Roth rollovers for the beneficiary together are capped at $35,000. The ceiling applies across accounts and years, not separately to each 529 plan. A beneficiary who has already completed $12,000 of qualifying special rollovers has $23,000 of lifetime capacity remaining, subject to the annual limit and the other tests.
The $35,000 amount is in SECURE 2.0 and 26 U.S.C. section 529 and is reflected in Internal Revenue Service 2025/2026 guidance. Keep a cumulative ledger of every special rollover, including the date, amount and 529 account, so a future administrator does not assume the lifetime allowance is still unused.

5. The transfer must be direct
Request a direct trustee-to-trustee transfer from the 529 administrator to the beneficiary’s Roth IRA custodian. The money should move between the institutions under their transfer procedures. Do not treat a check payable to the beneficiary followed by a personal redeposit as equivalent; that approach can create a distribution that fails the special-rollover conditions or exceeds the allowed timing and amount.
How to calculate the amount before you request it
Think of the eligible amount as the smallest of several ceilings, after removing the ineligible five-year dollars:
- The 529 balance attributable to contributions and earnings outside the five-year lookback period.
- The beneficiary’s remaining Roth IRA annual contribution capacity for the tax year.
- The beneficiary’s remaining amount under the $35,000 lifetime special-rollover cap.
- The amount the beneficiary is otherwise permitted to contribute to a Roth IRA under applicable compensation and income rules.
These limits apply simultaneously. A large, old 529 balance does not create extra annual Roth capacity, and unused annual capacity does not increase the $35,000 lifetime maximum.
Illustrative calculation
Assume a plan administrator identifies $18,000 of old contributions and related earnings as eligible after excluding all contributions made during the five-year lookback. The beneficiary has $9,000 of annual Roth IRA capacity remaining after other Roth contributions and has $20,000 of lifetime special-rollover capacity left. The requested direct rollover cannot exceed $9,000, because the annual limit is the smallest applicable ceiling. The unused $9,000 remains in the 529 or can be addressed through another permitted option; it does not carry forward as additional Roth capacity.
The figures in this example are illustrative. Use the administrator’s actual contribution tracing, the current tax-year limit and the beneficiary’s documented lifetime rollover history.
Step-by-step process for a compliant transfer
- Confirm the beneficiary and Roth owner. Compare the 529 beneficiary’s legal name and identifying information with the owner of the receiving Roth IRA. Resolve any mismatch before requesting money.
- Obtain the account-open date. Ask the 529 administrator for written confirmation of when the QTP account was established and how it treats beneficiary changes, successor accounts and any plan-to-plan rollover history.
- Request a contribution-history statement. You need deposits by date and the earnings attributable to them. Specifically identify contributions made during the five-year period ending on the planned distribution date and exclude those amounts and associated earnings.
- Determine annual Roth capacity. Verify the IRS annual contribution limit for the tax year, then subtract the beneficiary’s regular Roth IRA contributions and any other contributions that count toward that limit. Include contributions made to other Roth IRAs.
- Check the lifetime ledger. Add every prior special 529-to-Roth rollover for the beneficiary. Subtract that total from $35,000 to find the remaining lifetime ceiling.
- Confirm general Roth eligibility. Check compensation and any other applicable Roth IRA contribution restrictions for the beneficiary’s tax year.
- Contact both institutions. Tell the 529 administrator and Roth custodian that the transaction is a SECURE 2.0 special rollover and ask for their direct trustee-to-trustee forms, coding instructions and processing timeline.
- Authorize only the calculated amount. Instruct the 529 administrator to send the amount directly to the beneficiary’s Roth IRA custodian. Do not combine the transfer with a personal withdrawal.
- Review confirmations. Verify the amount, distribution date, receiving Roth account and tax-year coding on confirmations from both institutions. Correct errors promptly rather than trying to repair an incorrectly issued personal distribution.
- Retain the file. Keep the 529 opening-date evidence, contribution and earnings statement, annual-limit calculation, lifetime ledger, transfer forms, confirmations and tax forms. These records support the position that the rollover met each limit.
Timing and tax-year designation
The distribution date controls the five-year lookback and the tax year in which the annual Roth limit is tested. Coordinate the transfer date with both custodians because processing can cross a calendar year.

Internal Revenue Service Publication 590-A gives a specific prior-year example: a distribution made after December 31, 2025 and before April 15, 2026 can be rolled over by April 15, 2026 and designated as a 2025 contribution. Treat that as the publication’s example for that filing period, not as a guarantee that every later year will use identical dates or procedures. Ask the Roth custodian how it will designate the transaction before the transfer is initiated.

| Choice | Federal tax and penalty exposure | Timing and control | State-tax considerations | Paperwork |
|---|---|---|---|---|
| Roll to the designated beneficiary’s Roth IRA | Can be tax-free when all SECURE 2.0 conditions are met; annual and lifetime limits apply. | Direct transfer only; beneficiary controls the Roth IRA after the rollover. | State conformity is not established by the federal rule; check the beneficiary’s state and the 529 program’s rules. | Account-age proof, contribution tracing, limit calculations and two-custodian transfer records. |
| Change the 529 beneficiary to another eligible family member | Generally keeps the funds in the qualified-program framework, but the federal rollover limits do not answer every beneficiary-change or state-tax issue. | Useful when another family member has future qualified education expenses; no Roth contribution capacity is used. | State treatment and eligible-family-member definitions can vary; verify with the plan and state authority. | Beneficiary-change form and updated family and education planning records. |
| Use the balance for qualified education | Qualified expenses preserve the 529’s intended tax treatment under applicable rules. | Funds remain available for the beneficiary or another eligible student’s education; timing follows the education expense. | State rules may define qualified expenses differently in some circumstances. | School invoices, account statements and expense substantiation. |
| Take a nonqualified distribution | Earnings may be subject to federal income tax and an additional federal tax; the special rollover protections do not apply. | Immediate access, but the beneficiary or account owner loses the tax-advantaged purpose of the funds. | Possible state recapture or other state tax effects require separate review. | Distribution statement and records supporting basis, earnings and any exception claimed. |
The best choice depends on whether the beneficiary has compensation and Roth capacity, whether another family member may need education funding, and how the beneficiary’s state treats the transaction. Federal eligibility alone does not establish identical state treatment.
State-tax and reporting cautions
SECURE 2.0 is a federal rule. A state may conform automatically, conform later, or apply different rules to 529 deductions, recapture or Roth rollovers. Check the state in which the contributor claimed a 529 tax benefit, the state sponsoring the plan and the beneficiary’s current state of residence. Ask the plan administrator or a qualified tax professional how the state will report a direct rollover before sending the money.
Do not assume that a federal form or a custodian’s automated tax code settles the state result. Keep the federal eligibility analysis and the state analysis as separate work papers, especially when contributions were made under a different state’s plan.

Ignoring recent contributions
An account can be more than 15 years old while still containing deposits inside the five-year exclusion window. Obtain dated contribution and earnings information; do not rely on the total balance or the account’s opening date alone.
Exceeding annual capacity
Subtract all of the beneficiary’s regular Roth IRA contributions for the year, including contributions to other Roth IRAs. If the planned transfer is too large, reduce it before processing rather than expecting the custodian to correct an excess automatically.
Losing track of the $35,000 lifetime limit
The lifetime ceiling follows the beneficiary across 529 accounts. Maintain a running ledger and obtain confirmations for prior rollovers, including transactions completed by another account owner.

A check payable to the beneficiary can create a different type of distribution and may not satisfy the direct-transfer requirement. Ask for the institution’s trustee-to-trustee method and have the receiving custodian provide exact payee instructions.
Assuming the 15-year test is obvious after a beneficiary change
IRS guidance does not settle every account-history question created by beneficiary changes. Ask the administrator how it counts the original account and preserve its written answer with the account-opening records.
Treating the federal rule as a state guarantee
Before transferring, check state conformity and any recapture risk. A federally tax-free rollover can still require state-specific reporting or produce a different state result.
Records to keep after the rollover
- Written confirmation of the QTP account-open date and beneficiary history.
- Contribution dates, amounts and earnings allocations showing which dollars fall outside the five-year exclusion.
- The beneficiary’s annual Roth contribution calculation, including other Roth IRA contributions.
- A lifetime ledger showing every special rollover and the remaining amount below $35,000.
- Direct-transfer forms, institution correspondence, transaction confirmations and tax forms.
- State-tax research or advice supporting the treatment in the relevant states.
Keep the records for as long as needed to substantiate the Roth IRA’s basis and the 529 distribution history. If the institutions issue conflicting forms, contact both custodians promptly and obtain corrected reporting before filing.

When professional help is worthwhile
Consider a qualified tax professional when the account has changed beneficiaries, received inbound rollovers, contains many years of mixed contributions, spans multiple states or has already completed one or more special rollovers. A professional can reconcile contribution tracing, annual Roth capacity, compensation eligibility and state treatment. The plan administrator and Roth provider should still confirm their own forms and operational requirements; tax advice does not replace the custodians’ transfer procedures.
