How to Roll Over a 401(k) to an IRA Without Triggering Taxes

To move an eligible 401(k) balance to an IRA without current tax in most cases, open or identify a traditional IRA and request a direct rollover from the 401(k) plan. The plan should send the money straight to the IRA trustee, either electronically or by a check payable to that trustee for your benefit. You do not take possession, so the usual 20% mandatory withholding on an eligible taxable distribution paid to you does not apply to the amount transferred directly. The rollover is generally tax-free but still must be reported. Moving untaxed 401(k) money to a Roth IRA is generally a taxable conversion in the year of the transfer.

What a tax-free 401(k)-to-IRA rollover actually requires

A rollover is not automatically tax-free simply because the money came from a 401(k). The distribution must be eligible, the money must reach an eligible receiving account under the applicable method and deadline, and the destination must match the tax treatment you want. The Internal Revenue Service describes the core rules in its rollover guidance.

As an Amazon Associate I earn from qualifying purchases.

For most people trying to preserve tax deferral on pretax 401(k) savings, the lowest-risk route is a trustee-to-trustee transfer to a traditional IRA. A direct rollover avoids the 20% withholding that generally applies when an eligible taxable distribution is paid to the participant. It also avoids having to meet the 60-day contribution deadline that applies when the participant receives the money.

Route Who receives the money first? Withholding and deadline Usual tax result for untaxed money
Direct rollover to a traditional IRA The receiving IRA trustee No mandatory 20% withholding on the amount transferred directly; no participant 60-day deposit is required Generally remains tax-deferred when the distribution is eligible and the rollover is completed correctly
60-day rollover to a traditional IRA You receive the plan distribution Generally 20% is withheld from an eligible taxable distribution; you must deposit eligible funds within 60 days Generally tax-deferred only to the amount properly rolled over
Direct or 60-day transfer to a Roth IRA The Roth IRA trustee, or you first in a 60-day rollover The same withholding and deadline rules apply to the payment method Untaxed amounts are generally included in gross income for the rollover year

These are general federal rules. Your plan document, the source of the money in the account and your personal circumstances determine which amount can actually be rolled over.

Check whether the distribution is eligible before requesting it

Ask the 401(k) administrator or payor to identify the portion eligible for rollover. Do not assume that every dollar in a distribution check qualifies. The IRS lists general distribution rules for participants in its 401(k) participant resource guide and for plan sponsors in its plan-sponsor resource guide.

Payments commonly excluded from rollover

  • Required minimum distributions (RMDs).
  • Hardship distributions.
  • Corrective distributions, such as certain excess-contribution or excess-deferral refunds.
  • Some substantially equal periodic payments made over a specified long period or over your life expectancy.
  • Other categories that federal law specifically excludes.

If a payment contains both eligible and ineligible parts, the administrator should tell you how the amounts are separated. An ineligible amount cannot be made eligible merely by depositing it into an IRA.

Confirm why the plan is paying the money

A separation from employment is a common trigger for a distribution, but plan rules control when a former employee can take money out. The IRS discusses termination-of-employment considerations in its retirement topics guidance. Ask whether the distribution is a full balance, a partial distribution, an RMD, a hardship payment or another special type before you give rollover instructions.

Identify pretax and after-tax money

Your account may contain pretax employee deferrals, employer contributions, earnings and after-tax employee contributions. Those components can have different rollover treatment. Obtain the plan’s breakdown and any basis information before authorizing a transfer. The IRS explains special rules for after-tax amounts in Rollovers of after-tax contributions in retirement plans.

Step-by-step: complete a direct rollover to a traditional IRA

  1. Decide on the receiving account. For a rollover intended to avoid current federal income tax on eligible pretax savings, identify a traditional IRA. If you intentionally want a Roth conversion, use a Roth IRA only after deciding how you will pay the resulting income tax.
  2. Open or identify the IRA. Obtain the receiving institution’s exact legal name, mailing address, electronic-transfer instructions, account number and any required reference or registration language. The receiving institution can tell you whether it accepts rollovers and how it wants a check addressed.
  3. Ask the 401(k) administrator for a direct rollover. Use the plan’s distribution form, telephone process or secure website and select direct rollover rather than payment to you. Name the receiving IRA trustee exactly as instructed. If the plan issues a paper check, it should generally be payable to the receiving trustee, sometimes with wording showing it is for your benefit, rather than payable to you personally.
  4. Verify the amount and sources. Confirm whether the entire balance is eligible, whether the plan will transfer pretax and after-tax portions separately and whether any RMD or other excluded payment is being removed first.
  5. Track the transfer. Keep the submission confirmation, the plan’s distribution statement, the check or electronic-transfer details and the IRA deposit confirmation. Check that the full eligible amount arrived in the intended IRA and that the receiving account identifies it as a rollover contribution.
  6. Retain tax documents. The plan generally reports the distribution, and you must follow the federal return instructions for the tax year. A properly completed direct rollover is generally not taxable, but it is still reportable. The IRS rollover page explains the reporting framework and documentation expectations.

A direct rollover can be sent electronically or by check. The key feature is that the plan pays the receiving trustee directly, rather than making the eligible taxable distribution payable to you.

If the 401(k) check is payable to you: the 60-day rollover

When you receive an eligible plan distribution personally, the general rollover period is 60 days from the date you receive it. IRS Topic No. 413 describes the deadline and related tax rules. The 60-day period is not a recommendation to wait; deposit the money as soon as possible and keep proof of the date.

How the 20% withholding trap works

For an eligible taxable distribution paid to you, the plan generally must withhold 20% for federal income taxes. That withholding is a payment toward tax, not necessarily your final tax rate. To roll over the entire gross distribution, you must contribute the withheld amount from other funds before the 60-day deadline. The IRA receives the full gross amount, while the 20% withheld is credited as tax paid on your behalf.

IRS illustration Amount What happens
Eligible distribution $10,000 The plan pays you the distribution and withholds $2,000
Cash you receive $8,000 If you deposit only this amount, $2,000 was not rolled over
Amount needed for a full rollover $10,000 Deposit the $8,000 received plus $2,000 from other funds within 60 days
Tax treatment of the shortfall $2,000 The amount not rolled over is generally taxable and could also face the 10% additional tax if no exception applies

The $10,000 and $2,000 figures are the IRS’s example, not a prediction of your tax bill. If you cannot replace the withholding, only the amount actually rolled over is generally deferred; the unrolled portion remains subject to the normal income-tax rules.

What to do immediately after receiving the check

  1. Record the date you received the distribution; that starts the general 60-day period.
  2. Ask the receiving IRA trustee for its rollover-contribution instructions and deadline requirements.
  3. Calculate the gross eligible distribution, the amount withheld and the amount you must add from other funds to roll over the full gross amount.
  4. Submit the rollover contribution promptly and retain a dated receipt.
  5. Compare the plan’s distribution statement with the IRA’s deposit confirmation and keep both for your tax records.

Choose the destination: traditional IRA or Roth IRA

Traditional IRA: preserve deferral on eligible pretax amounts

A traditional IRA is generally the destination for an eligible rollover when your goal is to avoid current income tax on pretax 401(k) money. The amount remains tax-deferred in the IRA, and later withdrawals are taxed under the rules that apply to traditional IRA distributions. This assumes the distribution is eligible and the rollover is completed under the applicable direct-transfer or 60-day rules.

Roth IRA: a deliberate taxable conversion for untaxed money

Moving untaxed 401(k) money to a Roth IRA generally converts that amount. The untaxed portion is generally included in your gross income for the year of the rollover. It is not a tax-free rollover merely because the money moved directly. The IRS’s current materials, including Internal Revenue Bulletin 2026-06, should be read with the plan and IRA facts that apply to you.

A Roth destination can be intentional when you want future qualified Roth treatment and are prepared for the current tax cost. Before choosing it, estimate the taxable amount, consider whether withholding would leave enough money to complete the transfer and plan how you will pay the income tax without reducing the amount converted.

Question Traditional IRA Roth IRA
Current tax on eligible pretax 401(k) money Generally none when rolled over correctly Generally included in income as a conversion
Purpose Continue tax deferral Pay tax now to move money into Roth treatment
Can the plan transfer directly? Generally, if the plan and receiving trustee accept the rollover Generally, but direct transfer does not remove the conversion tax
Key decision Whether preserving pretax status fits your retirement plan Whether the current taxable income is acceptable and affordable

Handling after-tax contributions and mixed balances

After-tax employee contributions are not the same as pretax salary deferrals. A plan may permit different portions to go to different destinations, and earnings associated with after-tax contributions can have their own tax treatment. The IRS describes permitted approaches and accounting requirements in its after-tax rollover guidance.

Before giving instructions, request a written breakdown of:

  • pretax employee contributions and employer contributions;
  • after-tax employee contributions and the plan’s recorded basis;
  • earnings on each category;
  • any RMD, hardship or corrective amount that must be paid separately; and
  • which portions can be sent to a traditional IRA, Roth IRA or another eligible plan.

Do not assume that depositing a mixed check into one IRA will preserve the treatment you want. Ask the plan administrator and receiving trustee how they will code and document each component.

Reporting the rollover on your tax return

Tax-free does not mean invisible. The plan generally issues Form 1099-R for a reportable distribution, and the rollover must be reflected according to the federal return instructions for that tax year. The IRS identifies Form 1099-R and the federal return as relevant reporting records in its rollover guidance.

Keep the following together:

  • the plan distribution statement and Form 1099-R;
  • the direct-rollover request or confirmation;
  • the check image or electronic-transfer confirmation;
  • the IRA deposit receipt showing the rollover amount and date;
  • records of any after-tax basis; and
  • proof of any withholding, including the amount treated as tax paid.

If the plan paid you personally, the tax form may show the gross distribution and withholding even when you later roll over some or all of it. Report the transaction using the instructions for the year involved rather than treating it as an unreported deposit.

What happens when something goes wrong

You miss the 60-day deadline

Missing the general deadline can make the amount taxable unless relief applies. The IRS describes limited relief routes, including self-certification in qualifying circumstances and an IRS waiver, in its 60-day rollover waiver FAQs. Relief is fact-specific and is not automatic. Document the reason for the delay, the steps you took to complete the rollover and the date the money was ultimately deposited.

You roll over only the net check

If 20% was withheld and you deposit only what reached your bank account, the withheld amount generally was not rolled over. That portion can be taxable and may incur the 10% additional tax if you are under age 59½ and no exception applies. The IRS explains the additional-tax rule in Topic No. 413. Replacing the withholding from other funds before the deadline is the usual way to roll over the full gross distribution.

The plan sends an ineligible amount

An RMD, hardship distribution or corrective distribution generally cannot be fixed by depositing it into an IRA. Ask the plan to separate the ineligible amount and obtain corrected paperwork if the distribution was processed incorrectly.

The check is payable to you when you requested a direct rollover

Do not deposit it blindly. Contact the plan and receiving trustee immediately. A check payable to the receiving trustee for your benefit is generally treated differently from one payable to you; the payee wording determines whether the payment was made directly to the trustee or to you.

The IRA deposit is late or recorded incorrectly

Request written confirmation of the date received, the amount and the contribution type. Compare it with the plan’s distribution statement and ask the receiving trustee to correct an administrative coding error promptly. Keep every confirmation in case the tax form and account record do not match.

Early distributions and the possible 10% additional tax

If an eligible amount is not rolled over and remains taxable, an additional 10% tax may apply when you are under age 59½, unless a statutory exception applies. This additional tax is separate from ordinary income tax and separate from the 20% withholding that may have been taken from the payment. Withholding is only a prepayment; it does not determine whether the additional tax applies or what your final liability will be.

Because exceptions depend on facts such as the type and timing of the distribution, do not assume that age alone resolves the issue. Review the applicable IRS instructions or obtain qualified tax advice when an amount was paid to you, only partly rolled over or distributed before age 59½.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A final pre-submission checklist

  • Is the payment an eligible rollover distribution, with RMDs, hardship amounts and corrective distributions excluded?
  • Have you identified pretax, after-tax and earnings components?
  • Is the receiving account a traditional IRA for a tax-deferred rollover, or are you intentionally choosing a taxable Roth conversion?
  • Did you give the plan the receiving trustee’s exact payee and transfer instructions?
  • Will the plan send the money directly to the trustee rather than to you?
  • If you already received the money, have you calculated the 60-day deadline and the amount needed to replace withholding?
  • Do you have confirmations showing the distribution, withholding, deposit amount and deposit date?
  • Will you report the distribution and rollover using Form 1099-R and the federal return instructions for the relevant tax year?
