Do not file a restoration application merely because an order says “monetary limit.” First obtain the complete signed order, identify the forum and appellant, read the legal provision or instruction cited, verify exactly which amount was counted, and record the date the order was communicated. Only then can you determine whether the decision concerns a statutory GSTAT admission rule, a departmental litigation policy, a pre-deposit issue, or another procedural defect—and which deadline or remedy may apply.
Section 112(10) of the Central Goods and Services Tax Act, 2017 mentions an application for restoration and a prescribed fee, but it does not guarantee restoration in every case. A departmental monetary-limit instruction is also not automatically a rule for an appeal filed by a taxpayer. The order and the governing text control.

Begin with the dismissal order, not the phrase “monetary limit”
A short order can conceal several legally different outcomes. Before deciding what to do, make a working copy of the signed order and extract the following facts:
- Issuing forum: determine whether the order came from an Appellate Authority, a GST Appellate Tribunal (GSTAT) Bench, a High Court, or another body.
- Appellant: confirm whether the filing was made by a taxpayer or by a government department. A policy governing departmental litigation cannot be assumed to govern a taxpayer’s appeal.
- Operative result: record whether the order says dismissed, rejected, withdrawn, disposed of, or otherwise closed. Those words can point to different procedural consequences.
- Reason and authority: copy the section, rule, notification, circular, practice direction, or case-management order cited. If no authority is identified, that omission itself should be raised with your adviser.
- Amount counted: identify whether the figure is disputed tax, input tax credit (ITC), interest, a fine, a fee, a penalty, or a combination. Check whether the order explains the calculation.
- Communication date: record when the order was served or otherwise communicated to the appellant, not merely the date printed on the order.
- Pending protection: note any direction about recovery, pre-deposit, stay, refund, or further filings.
Preserve the portal download, email, physical envelope, acknowledgment, and any service log. A limitation period may depend on communication or receipt, and a dispute about that date is easier to address when the original evidence is available.

Identify which kind of monetary limit was used
Statutory GSTAT admission threshold
Section 112 of the CGST Act governs appeals to GSTAT from orders under sections 107 or 108. Its text says the Tribunal may, in its discretion, refuse certain appeals when the tax or ITC difference, or the fine, fee, or penalty involved, does not exceed ₹50,000. This is a statutory Tribunal admission provision. It is not a general rule that every GST dispute below ₹50,000 ends automatically, and it should not be treated as the same thing as a government litigation policy.
Read the order to see which category was used and whether the amount was calculated per issue, per period, or for the entire proceeding. A ₹50,000 reference in section 112(2) is therefore not proof that a separate departmental instruction was applied correctly.
Departmental litigation instructions
CBIC’s Judicial Cell listing identifies an instruction titled “Enhancement in Monetary Limits” dated 6 August 2024. The operative text, thresholds, exceptions, affected appeal levels, and treatment of appeals already dismissed were not available for verification in the materials used for this guide. Do not rely on summaries that supply a number or claim that every low-value appeal must be withdrawn or restored.
If the order relies on that instruction or another departmental direction, obtain the complete instruction and test each condition against the case. Establish whether it applies only to appeals filed by the department, whether it is prospective or retrospective, whether it contains exceptions, and whether it authorizes dismissal, withdrawal, non-filing, or some other action. Until those questions are answered, no particular restoration result can be promised.
A different procedural defect described loosely as a limit
Some orders use informal language. The real problem may be an unpaid statutory pre-deposit, an incorrectly stated amount, a filing outside limitation, a missing document, or a direction limiting the issues that can be heard. Compare the heading, reasoning, and operative paragraph. If the court or Tribunal dismissed for non-compliance with payment requirements, treat that as a pre-deposit analysis rather than assuming a monetary-limit remedy.

| Question | What to extract | Why it matters |
|---|---|---|
| Who issued the order? | Appellate Authority, GSTAT State or Principal Bench, High Court, or another forum | Each forum has different jurisdiction and possible next steps. |
| Who filed? | Taxpayer, department, or another aggrieved person | A departmental policy may not govern a taxpayer’s appeal. |
| What legal source is cited? | Section, rule, notification, circular, instruction, or case direction | The source determines whether the dismissal is statutory, administrative, or procedural. |
| What amount was used? | Tax, ITC, interest, fine, fee, penalty, or a combined figure | Different provisions count different components. |
| What is the operative verb? | Dismissed, rejected, withdrawn, disposed of, or restored | The filing vehicle may differ for a final dismissal and a withdrawal. |
| When was it communicated? | Portal date, email date, delivery date, or acknowledged receipt | Potential limitation periods are date-sensitive. |
Keep pre-deposit rules separate from monetary-limit dismissal
Sections 107 and 112 contain conditions for filing an appeal, including payment of the admitted amount and a prescribed portion of disputed tax, subject to the applicable statutory cap. The current statutory text also contains a penalty-only pre-deposit proviso. The exact percentage, cap, and amendment version must be checked against the provision applicable to the proceeding.
Once the statutory payment condition is satisfied, the Act deems recovery of the balance amount stayed while the appeal is pending. That deemed stay protects against recovery; it does not itself reopen an appeal that has already been dismissed. Conversely, paying a pre-deposit does not cure a dismissal based on a separate admission threshold unless the order and governing law say so.

1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesFor proceedings involving only a penalty, verify the version of the Act in force for the relevant filing. The CBIC portal records that the penalty-only pre-deposit provisos in sections 107 and 112 took effect on 1 October 2025. The portal also records 2024 changes to the maximum pre-deposit caps. An old online explainer may therefore state a rule that no longer matches the applicable text.
Section 107(12) requires a written disposal order that states the points for determination, the decision, and the reasons. The statutory wording is: “The order of the Appellate Authority disposing of the appeal shall be in writing and shall state the points for determination, the decision thereon and the reasons for such decision.” If the order does not explain how the amount was calculated or why the cited limit applies, show that omission to counsel; do not assume that an unexplained order is automatically void.
Map the possible procedural routes by forum
There is no universal “monetary-limit appeal.” The route depends on the issuing forum, the party that filed the case, the statutory source of dismissal, and the dates.

| Order or issue | Potential route to examine | Important qualification |
|---|---|---|
| GSTAT order dismissing an appeal | Application for restoration under the Tribunal’s governing framework, including section 112(10) | Section 112(10) recognizes a restoration application and prescribed fees; it does not establish automatic restoration or settle every limitation and forum-practice question. |
| GSTAT State Bench order involving a substantial question of law | High Court appeal under section 117 | The High Court must be satisfied that a substantial question of law is involved. This is not a general appeal on every factual or procedural disagreement. |
| Principal Bench GSTAT order, or a High Court judgment certified fit for further appeal | Supreme Court route under section 118 | Section 118 is limited to the specified statutory situations; it is not an automatic second appeal. |
| Appellate Authority order under section 107 | Check the appeal pathway and limitation applicable to the type of order | Do not transplant the GSTAT threshold or a departmental instruction onto a section 107 order without reading the cited authority. |
| Departmental appeal affected by an administrative limit | Obtain the complete CBIC instruction and examine any withdrawal, review, or reopening mechanism it provides | The 6 August 2024 instruction’s operative text, exceptions, and treatment of already-dismissed matters must be verified before choosing a filing. |
A restoration request, a statutory appeal, a review, and an application seeking clarification are not interchangeable. Use the name and legal basis that the applicable rules recognize, and ask the filing lawyer to explain why that vehicle fits the order.
Quick wins for a faster PC:
Repair Windows errors before they cause bigger problemsFix Now →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Clear out junk files and repair common Windows errorsFree Scan →Calculate dates from the applicable text
Write every relevant date in one chronology. Include the original adjudication order, each appeal filing, payment of any pre-deposit, hearing dates, the dismissal order, communication of that order, and any later recovery notice. Then identify which provision supplies the next period.
| Provision | Period stated in the statutory framework | What to verify |
|---|---|---|
| Section 107 appeal to the Appellate Authority | Three months from communication; a further month may be allowed for sufficient cause | Communication date, statutory start rule, and whether the condonable period remains available. |
| Section 112 appeal to GSTAT | Three months, subject to the applicable statutory start-date wording and later-notified-date rules | The notified date governing the proceeding and any amendment in force when the appeal arose. |
| Section 117 appeal to High Court | 180 days from receipt, with a sufficient-cause proviso | Receipt evidence, substantial-question-of-law requirement, and the High Court’s procedural rules. |
| Restoration or other Tribunal application | Not resolved by section 112(10) alone | Prescribed rules, fee, limitation, exclusions, and the exact wording of the dismissal order. |
Do not reuse the section 107 three-month period for a section 117 appeal, or assume that a restoration request automatically pauses another limitation period. If two possible routes exist, ask counsel whether a protective filing is needed while the legal characterization is being resolved.
Build the record before contacting the Tribunal or court
Send the adviser a complete, indexed file rather than only a screenshot of the dismissal message. Include:
- the signed dismissal order and every page of its annexures;
- proof of communication, such as portal records, email headers, delivery acknowledgments, or the envelope;
- the original adjudication order and the appeal memorandum;
- the department’s or taxpayer’s statement of disputed tax, ITC, interest, fine, fee, and penalty;
- challans, electronic liability ledger extracts, and proof of admitted-amount or pre-deposit payments;
- the hearing notice, written submissions, and any written objections to the monetary-limit point;
- the exact circular, instruction, notification, or rule cited in the order;
- portal error messages or filing acknowledgments; and
- any recovery notice issued after dismissal.
Ask for a written calculation showing how the order reached its figure. If the order combines tax, ITC, interest, and penalty, have the calculation separated by component and period. A threshold may apply to one category but not another.

What to ask when the order cites the ₹50,000 GSTAT threshold
Section 112(2) describes a discretionary refusal where the tax or ITC difference, or the fine, fee, or penalty involved, does not exceed ₹50,000. Questions for review include:
- Which of those statutory categories did the Tribunal use?
- Was the figure measured against the entire appeal or a particular issue?
- Did the order treat a tax or ITC difference as distinct from interest, fine, fee, or penalty?
- Does the order say the Tribunal exercised discretion, or does it incorrectly describe the threshold as an automatic bar?
- Was the appeal filed under the version of section 112 that applied on the relevant date?
- Does another provision, notification, or binding direction affect the admission decision?
These questions do not predict the result. They identify whether the order used the statutory wording and whether a restoration or appellate argument can be framed on the actual record.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.How to handle a CBIC monetary-limit instruction
If the dismissal cites CBIC’s 6 August 2024 “Enhancement in Monetary Limits” instruction, obtain the signed or officially published text from the issuing authority. Check its definitions, threshold amounts, exceptions, effective date, covered forums, and directions for pending, filed, withdrawn, or already-dismissed cases.
Do not infer a taxpayer’s remedy from a departmental policy. A policy may instruct government officers about whether to file or continue litigation; that is conceptually different from a statutory provision allowing a Tribunal to refuse an appeal. The order must show why the instruction applies to this appellant and this proceeding.
Because the operative text and any later directions were not verified here, a responsible response is to preserve the deadline, request the full instruction, and obtain case-specific legal advice. Avoid quoting a threshold taken from an online summary.

A practical response plan
- Day one: preserve evidence. Download the order, save service records, and note the exact time and date received.
- Day one or two: freeze the chronology. List every prior order, filing, payment, hearing, and communication.
- Day one or two: identify the forum and appellant. Mark whether the case is a taxpayer appeal or departmental appeal.
- Immediately: classify the ground. Label it statutory GSTAT threshold, departmental policy, pre-deposit, limitation, or unclear until the text supports a final classification.
- Immediately: obtain the cited authority. Request the complete circular, instruction, rule, or notification, not a paraphrase.
- Before drafting: recalculate the amount. Separate tax, ITC, interest, fine, fee, and penalty and attach source records.
- Before the earliest plausible deadline: obtain a forum-specific opinion. Ask counsel to compare restoration, statutory appeal, clarification, review, or any other recognized vehicle.
- Ask about protective action. If the characterization is uncertain, ask whether a protective filing or application is legally available and what fee applies.
- Check recovery separately. Confirm whether deemed stay from a valid pre-deposit applies to the pending proceeding; do not treat it as automatic reversal of dismissal.
- Monitor the portal and service address. Keep acknowledgments, diary numbers, defects, and hearing notices in the file.
Common mistakes that can make the position worse
- Assuming every monetary limit is the ₹50,000 GSTAT rule. The Act’s discretionary threshold and a CBIC departmental instruction are separate sources.
- Using the order date instead of the communication date. Limitation analysis can turn on when the order was received.
- Counting the wrong component. Tax, ITC, interest, fine, fee, and penalty may be treated differently.
- Calling a pre-deposit defect a monetary-limit dismissal. Payment compliance and admission thresholds have different consequences.
- Filing an unspecified “restoration” request. Section 112(10) mentions restoration and fees but does not answer every procedural question.
- Waiting for the instruction to be clarified. Preserve the earliest plausible deadline while obtaining the missing text.
- Assuming a departmental policy binds a taxpayer. Verify the appellant, covered proceedings, and operative language.
- Relying on an old summary. The CBIC portal records changes to section 107 and section 112, including 2024 cap amendments and penalty-only provisos effective 1 October 2025.
- Ignoring jurisdiction. A High Court appeal under section 117 requires a substantial question of law, and section 118 limits the Supreme Court route to specified cases.
Illustrative scenarios
Scenario 1: Taxpayer’s GSTAT appeal is dismissed under section 112(2)
The order says the disputed ITC difference is below ₹50,000 and that the Tribunal declines admission. The taxpayer should preserve the communication date, verify that the amount is an ITC difference as described by section 112(2), check whether the Tribunal exercised discretion, and ask counsel whether the Tribunal’s order can be challenged or restored under the applicable framework. Paying an additional amount does not, by itself, establish a right to admission.
Scenario 2: Departmental appeal is closed under a CBIC instruction
The order cites the 6 August 2024 enhancement instruction and says the department will not pursue a low-value matter. The taxpayer should not assume that the same instruction creates a restoration right or extinguishes the underlying tax demand. Obtain the instruction, determine what the order actually disposes of, and separately check recovery and any surviving statutory rights.
Scenario 3: The order calls the issue a monetary limit but records unpaid pre-deposit
The operative paragraph refers to a shortfall in the required payment. The response should focus on the statutory pre-deposit calculation, payment evidence, and any permitted cure or challenge. A section 112(2) threshold argument may be irrelevant if payment compliance was the actual ground.
Scenario 4: A State Bench order raises a legal interpretation issue
If the order is from a GSTAT State Bench and the proposed challenge presents a substantial question of law, section 117 may provide a High Court route within 180 days from receipt, subject to sufficient cause and the High Court’s procedure. A disagreement only about evidence or factual computation may not satisfy that jurisdictional requirement.
Questions to put to a GST appeals practitioner
- What exact provision or instruction authorizes this dismissal?
- Does it apply to this appellant, forum, tax period, and type of amount?
- What is the legally operative communication date?
- What is the earliest deadline for each plausible route?
- Does section 112(10) support restoration on these facts, and what rule and fee govern the application?
- Is there a substantial question of law for a section 117 appeal?
- Does section 118 apply at all?
- Are any recovery proceedings continuing, and what protection actually exists?
- Would a protective filing be lawful and useful while the monetary-limit instruction is being verified?
- What documents and certified copies must accompany the filing?
Bottom line
A GST appeal dismissed on “monetary-limit” grounds is not a single legal category. The forum, appellant, cited authority, amount counted, operative wording, and communication date determine the response. Separate the section 112(2) discretionary ₹50,000 GSTAT provision from departmental monetary-limit instructions, separate both from pre-deposit compliance, and calculate every deadline from the provision that actually governs the proceeding. Section 112(10) makes restoration an issue to investigate—not an automatic entitlement. Have a qualified GST appeals practitioner review the signed order and current rules before any application is filed.
