This guide assumes the notice was issued under India’s income-tax system. The title alone cannot establish the country, tax authority, notice provision, tax year, or kind of jurisdiction challenge involved. Read those details from the notice itself before relying on any deadline or procedure. The practical objective is to file a complete, timely response while clearly reserving the objection that the officer or office lacks jurisdiction. That reservation is not automatic, and participating in the merits does not by itself guarantee that an objection has been preserved.
Start with the notice, not the argument
A reassessment response is controlled by the document served on you. Before drafting, make a working copy and record the following facts exactly as they appear:
As an Amazon Associate I earn from qualifying purchases.
- the issuing authority and office;
- the notice provision and date shown on the notice;
- the date and method of service;
- the tax year or assessment year covered;
- the response deadline stated in the notice;
- any earlier show-cause notice, information request, order, or reassessment communication; and
- the submission channel and file-format instructions.
Use the notice’s terminology. “Tax year” and “assessment year” are not interchangeable labels for every proceeding, and an apparent mismatch can affect which statute applies. Save the original electronic message or downloaded notice, including its metadata where available.

The Income Tax Department’s Reassessment Proceedings FAQ says that the Income-tax Act, 2025 applies to tax years beginning on or after April 1, 2026, identified there as Tax Year 2026–27 and later. Reassessment for tax years beginning before April 1, 2026 remains under the Income-tax Act, 1961. Proceedings started under the 1961 Act and still pending on April 1, 2026 continue under that repealed Act.
#1 Best Overall
Do not move a step, section reference, or deadline from a 2025-Act proceeding into an older-Act matter merely because the notice was received after the transition date. Determine the tax year and when the proceeding began, then have a practitioner check the current statutory text and transition rules.
Identify what “jurisdiction” means in your objection
“The officer lacks jurisdiction” can describe materially different arguments. State the precise authority you challenge; a general protest may fail to preserve the point you actually intend to make.
Territorial or case-assignment objection
This type of objection says the matter was assigned to the wrong geographic jurisdiction, taxpayer category, or administrative charge. The facts may include a change of address, a different principal place of business, an incorrect taxpayer profile, or an assignment inconsistent with the applicable allocation rules. Gather the address records, registration data, prior orders, and correspondence that support the factual proposition. An assignment dispute can have different timing and remedies from a challenge to the officer’s statutory power.

This argument says the statutory conditions for the officer to act were never present, or that the officer could not lawfully exercise the reassessment power in the circumstances. It is not the same as saying that the correct officer should have been another officer. The notice provision, mandatory preconditions, approval requirements, and the chronology of the proceeding all matter.

Do not merge separate grounds
List each ground under its own heading. Explain the fact that supports it, the legal rule you say applies, and the relief requested. If you are uncertain whether a point is territorial, assignment-based, or an inherent-authority challenge, say so in your instruction to counsel rather than making an unsupported legal conclusion in the filing.
Check timing without assuming a universal one-month rule
A case summary discussing section 124(3) of the Income-tax Act, 1961 describes a one-month restriction for certain objections to an Assessing Officer’s jurisdiction after specified notices. That discussion is not a universal deadline for every jurisdiction challenge, every notice, or every proceeding. The underlying statutory text and binding authority must be checked for the actual notice and objection.
The practical rule is stricter than relying on a possible grace period: raise the objection promptly, in writing, and no later than the deadline printed in the notice unless qualified advice establishes a different requirement. If the notice gives a shorter date, treat that date as controlling for the immediate response and seek advice at once.
Build a chronology
- Enter the date of each notice, show-cause communication, order, approval, and response.
- Mark the date of service, not merely the date printed on the document.
- Record every extension request and whether it was granted.
- Identify when the reassessment proceeding began and whether it was pending on April 1, 2026.
- Highlight the date on which the jurisdiction objection first became apparent.
This chronology lets a professional test limitation, transition, and waiver questions against the actual record instead of a general summary.
Rank #3
Draft a reservation that is specific and without prejudice
Your response should do two things at once when required: preserve the jurisdiction objection and answer the procedural or substantive request by its deadline. Put the reservation near the beginning, repeat it in the relief section, and identify the exact notice.
Elements to include
- the notice date, provision, tax year or assessment year, and reference number;
- the authority or office whose jurisdiction is challenged;
- the factual basis, with document references;
- the legal basis, stated as an argument rather than an assumed conclusion;
- a request that the authority decide the jurisdiction issue before taking further merits action, where legally available;
- an express statement that any factual, procedural, or merits response is submitted without prejudice to the objection; and
- a reservation of rights and remedies under the applicable law.
Illustrative wording
The following is drafting language, not a form that guarantees preservation:
Subject: Response to [notice reference] for [tax year/assessment year]
At the outset, the taxpayer objects to the jurisdiction of [identified officer/office] on the factual and legal grounds set out below. This objection is made expressly and before any submission on the merits. Any information, explanation, return, document, or participation supplied in response to this notice is provided without prejudice to, and does not waive, the jurisdiction objection or any associated statutory remedy.
The taxpayer requests that the jurisdiction objection be decided in accordance with the applicable law and that no adverse inference be drawn from the taxpayer’s response on the merits while the objection is pending.
Replace every bracketed item with the exact information from the notice before filing. Do not claim that “without prejudice” wording defeats a statutory time bar or cures a late objection. It records your position; whether the law gives it effect depends on the objection, notice, statute, and controlling decisions.

Answer the notice on the merits when a response is required
Preserving jurisdiction does not necessarily excuse a missed substantive deadline. If the notice asks for information, documents, a return, or an explanation, provide the required response by the stated date while maintaining the reservation.

Separate the two tracks
- Jurisdiction track: identify the authority challenged, facts, legal grounds, and requested decision.
- Merits track: answer each numbered question, identify the supporting document, and state when a requested item does not exist or is not in your possession.
Use headings and a paragraph-by-paragraph response so the officer can see that an answer on the merits is not an admission that jurisdiction exists. Avoid language such as “the officer has jurisdiction” or “we accept the proceedings” unless that is genuinely your position and your adviser has considered the consequences.
Attach an indexed evidence set
- Create a short index with document number, description, date, and the paragraph of the response it supports.
- Use readable PDF files unless the notice specifies another format.
- Keep the files in the same order as the index.
- Redact information that is irrelevant and legally protected where appropriate, but do not alter the substance of a record.
- Retain the unredacted originals and the exact versions submitted.
Submit through the channel named in the notice
The Income Tax Department describes e-Proceedings as a channel for viewing notices and submitting responses, including attachments. If your notice directs you to e-Proceedings, sign in to the correct taxpayer account, open the matching proceeding, and verify the tax year and reference number before uploading anything.
- Open the notice or proceeding identified in the communication.
- Read the response instructions and deadline again immediately before drafting the final upload.
- Upload the jurisdiction objection, merits response, and indexed attachments in the permitted formats and size limits.
- Review the rendered text and every attachment after upload. Check that pages are legible and that no file belongs to another taxpayer or year.
- Submit only after the final review.
- Download or print the acknowledgement, submission number, timestamp, and complete filed copy.
The Department’s FAQ says an e-Proceedings response cannot be edited or withdrawn once submitted. Treat the final confirmation as irreversible: do not upload a draft simply to meet a deadline. If a material error is discovered, preserve the original acknowledgement and obtain advice on the correct way to notify the authority.
Keep a defensible record of preservation
Create a contemporaneous file containing the served notice, service proof, draft versions, final response, attachments, acknowledgement, and all follow-up correspondence. Record who approved the filing and when it was submitted. Keep screenshots only as a supplement; the official acknowledgement and downloaded filed response are more useful evidence of what was submitted.
Best Value
- It can be a gift option
- Comes with secure packaging
- Helpful in various ways
If the portal fails, take dated screenshots of the error, save the error message, note the time and attempted action, and use the alternate channel expressly authorized by the notice. Do not assume that an email, help-desk ticket, or draft upload counts as a filed response unless the authority confirms it.

Before a reassessment notice: show-cause stage
The Department’s description of the 2025-Act sequence begins with information suggesting escaped income, followed by a show-cause notice and an opportunity to respond. The authority then considers the reply and issues a reasoned order on whether reassessment is fit, followed, subject to stated exceptions, by a reassessment notice. If you are at this stage, put the jurisdiction objection in the show-cause response and explain why the authority should not proceed. Do not assume that a later reassessment notice creates a new opportunity to cure an omitted objection.
After a reassessment notice
Identify the notice provision and respond by its stated deadline. Preserve the objection in the first response after service, then address the requested merits. Ask counsel whether the law permits an immediate challenge, requires participation in the assessment, or provides another route. The answer can differ between a territorial assignment point and an inherent-authority point.

If the proceeding was initiated under the 1961 Act and remained pending on April 1, 2026, the Department’s FAQ says it continues under that repealed Act. Record the commencement history and do not substitute 2025-Act terminology merely because the matter is being handled after the transition date.
Common mistakes and how to correct them
| Mistake | Why it creates risk | Safer response |
|---|---|---|
| Using a generic “lack of jurisdiction” sentence | The record may not show which authority, facts, or legal rule is challenged. | Name the officer or office, classify the objection, and attach supporting facts. |
| Waiting for a final reassessment order | A limitation or waiver rule may apply earlier, and the notice deadline may expire. | Raise the objection in the first written response and obtain advice promptly. |
| Relying on the one-month section 124(3) discussion for every case | The case summary concerns certain objections after specified notices, not all jurisdiction theories. | Check the current statutory text, notice, and binding authority for your exact objection. |
| Filing a merits response without a reservation | The filing may be characterized as acceptance or may obscure the objection. | Use a clearly labelled, express without-prejudice reservation. |
| Submitting an unreviewed portal draft | The Department says a submitted e-Proceedings response cannot be edited or withdrawn. | Complete a final file-and-attachment review before selecting submit. |
| Assuming an email or upload error extends time | Only the authorized channel and official acknowledgement establish filing. | Preserve error evidence and follow the notice’s approved fallback process. |
| Mixing 1961-Act and 2025-Act procedures | Transition rules depend on tax year and commencement history. | Determine the governing Act before citing steps or provisions. |
A practical same-day checklist
- Download and preserve the complete notice.
- Write down the service date, deadline, tax year, notice provision, and reference number.
- Locate every earlier show-cause notice, order, and response.
- Determine whether the matter is under the 1961 Act or 2025 Act using the tax year and commencement history.
- Classify the objection as territorial or assignment-based, inherent statutory authority, or both as separately stated grounds.
- Prepare a factual chronology and document index.
- Draft the express jurisdiction objection before the merits section.
- Answer every required question by the notice deadline, stating when an item is unavailable.
- Insert the without-prejudice reservation in the opening and relief sections.
- Review names, tax years, reference numbers, page order, and attachments.
- Submit through the directed channel and save the acknowledgement, timestamp, and filed copy.
- Send the complete record to a qualified tax practitioner or tax lawyer for advice on the next procedural step.
When professional advice is essential
This is a procedural framework, not individualized legal advice. Obtain a qualified tax practitioner or tax lawyer’s review when the deadline is close, the notice cites an unfamiliar provision, the objection concerns inherent statutory authority, the proceeding spans April 1, 2026, a prior response may have waived or limited the point, or the Department has already issued an adverse order. Give the adviser the notice, service proof, complete chronology, prior filings, portal acknowledgements, and every document supporting the jurisdiction facts.
A professional can determine whether the objection is timely, whether section 124(3) is relevant, whether a different statutory remedy applies, and whether participation on the merits should be accompanied by a particular reservation. No general wording can guarantee that an objection has been preserved or will succeed.
