Read the notice carefully, identify the assessment year and governing law, and note the exact response date printed in it. For a Section 148 notice governed by the Income-tax Act, 1961, the Income Tax Department says the return must be furnished within the period specified in the notice, subject to a maximum of three months from the end of the month in which the notice was issued. Submit the return or response through the e-Filing portal’s e-Proceedings service, answer the points raised, upload relevant documents, and preserve the transaction ID and acknowledgment.
Do not assume that every document mentioning Section 148 follows the same timetable. A Section 148A show-cause notice is a pre-notice opportunity to explain your position; a Section 148 notice is the subsequent notice requiring a return. The assessment year, transition rules, notice wording and issue date determine what you must do.

- The statutory section cited, including whether the document is under Section 148A or Section 148.
- The date on which the notice was issued and how it was served.
- The response deadline printed in the notice.
- The information, transactions or potential escaped income identified by the Assessing Officer.
- Any instructions about the return form, supporting documents or manner of response.

Which Income-tax Act applies after 1 April 2026?
India’s transition to the Income-tax Act, 2025 makes the assessment year especially important. The Income Tax Department’s reassessment FAQ states that reassessment provisions in the 2025 Act apply to tax years 2026–27 and later. Tax years beginning before 1 April 2026 remain under the Income-tax Act, 1961 for reassessment purposes.
Proceedings that were pending under the 1961 Act when the 2025 Act commenced continue under the old-Act framework. The Department also explains that the old-Act return-filing framework applies to a Section 148 notice for an earlier year even when the taxpayer furnishes the return after 1 April 2026. The filing date by itself does not move an old proceeding into the new Act.
Check the year and transition position in your own notice before selecting a form or relying on a procedural explanation. The expression “Section 148 notice” does not, on its own, establish which set of provisions governs every case.

How do I tell a Section 148A notice from a Section 148 notice?
These are separate procedural stages. Confusing them can lead to submitting the wrong document or believing that a show-cause reply has replaced the return later required by a Section 148 notice.

| Section 148A show-cause notice | Gives you an opportunity to explain why the proposed reassessment should not proceed. | A written reply addressing the information cited, with relevant supporting records. | Use the response period printed in the show-cause notice. The Department’s FAQ does not establish one universal number for every Section 148A notice. |
| Section 148 notice | Requires a return for the assessment year identified in the notice. | The applicable income-tax return and any remarks or documents requested through e-Proceedings. | Use the period stated in the notice, subject to the old-Act maximum described below where that framework applies. |
The Department describes the ordinary old-Act sequence as a Section 148A(1) show-cause notice, consideration of the taxpayer’s reply, a reasoned order under Section 148A(3), and issuance of a Section 148 notice if the case is found fit for reassessment. Statutory exceptions can alter that sequence, so do not assume that every notice must follow an identical path.
What is the time limit to respond to a Section 148 notice?
For a Section 148 notice under the Income-tax Act, 1961, the Department says you must furnish the return within the time specified in the notice. That period cannot exceed three months from the end of the month in which the notice was issued. This is a statutory ceiling, not an automatic entitlement to the full three months.
For example, a notice may specify a date earlier than the maximum permitted period. The date printed in your notice remains the working deadline. The exact calculation requires the notice’s issue date and the stated response period, so do not rely on a generic online calculator or a date inferred from when the notice reached your inbox.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsIf the date is unclear, the notice appears inconsistent, or the deadline has passed, contact the Income Tax Department promptly and obtain professional tax advice. Filing a response does not automatically extend a deadline, stop reassessment or guarantee a particular outcome.

How do I submit my response to a Section 148 notice online?
The Department’s e-Proceedings manual gives taxpayers and properly authorised representatives an online route to view the notice and submit remarks and attachments.
- Sign in to the e-Filing portal. Use the taxpayer account concerned. An authorised representative can use the representative option after the required authorisation is in place.
- Open the proceeding. Go to Dashboard → Pending Actions → e-Proceedings → Self, then select the relevant notice.
- Read and download the notice. Review the notice and attachments before choosing a response option. Confirm that you are working in the correct assessment year and proceeding.
- Choose “Submit Response.” Follow the on-screen instructions for the particular proceeding. The interface described in the manual permits a partial or full response, depending on what the notice requests.
- Enter written remarks. Explain, in a factual sequence, how each point in the notice relates to your records. If you disagree, identify the specific statement or transaction and give the reason, rather than uploading documents without an explanation.
- Select document categories and attach files. Choose the category that best matches each document and upload only relevant, legible records in the formats and size limits shown by the portal.
- Review before submission. Check the assessment year, remarks, attachments and response selection. Keep a local copy of the final response package.
- Submit and save the proof. A successful submission displays a transaction ID and acknowledgment number. Download or print the confirmation and retain it with the notice and all uploaded files.
A submitted response cannot be edited according to the Department’s e-Proceeding FAQ. The same FAQ says that, while a proceeding is open, the Submit Response option is available only until seven days before the proceeding limitation date, up to 6 PM. The authority may re-enable the option in some circumstances, but that possibility is discretionary. Submit well before the portal cut-off instead of waiting for the last day.
What documents and explanations should you provide?
There is no universal evidence list for every reassessment. Match your documents to the issue identified in the notice and explain the connection in your written remarks. Depending on the allegation or information described, you may need to reconcile the notice with:
- The income-tax return and computation originally filed for the relevant assessment year.
- Tax payment records, certificates and information statements available to you.
- Bank statements, investment statements, contract notes, loan records or property documents relevant to the transaction.
- Invoices, books of account, ledgers, confirmations or correspondence that explain a receipt, payment or deduction.
- Earlier replies, orders or acknowledgments connected with the same assessment year.
Use the records that actually address the notice. Do not send a large unindexed bundle that leaves the officer to discover your explanation. Label files clearly, refer to them in your remarks and ensure scans are readable. If a document is unavailable, state what is missing, why it is unavailable and what substitute evidence you are providing; do not create or alter records.

How should you write the explanation?
A concise, issue-by-issue response is easier to verify than a general denial. A practical structure is:
- Identify the proceeding: state your name, PAN, assessment year, notice date and section.
- State your position: say whether you accept, partly accept or dispute the information in the notice.
- Address each item: quote or paraphrase the transaction or issue, then give the relevant facts and figures from your records.
- Cross-reference evidence: identify the attachment supporting each factual statement.
- Explain corrections: if income, a deduction or another item was reported incorrectly, describe the correction and follow the return-filing instructions in the notice.
- Request appropriate consideration: ask the officer to consider the explanation and documents, without claiming that submission alone determines the result.
Keep the tone factual. Do not omit an unfavourable fact if the notice has already identified it, and do not make legal or factual assertions that your records cannot support.

The Department’s general material cannot determine whether a particular notice satisfies limitation, service, information, approval or other statutory requirements. Those questions depend on the actual notice, underlying information, dates and facts.

What should you do if the deadline is close or has already passed?
When the deadline is approaching
- Download the notice and begin the portal response immediately.
- Prioritise the requested return or reply and the records directly tied to the stated issue.
- Check the portal’s displayed proceeding date and the seven-day, 6 PM submission cut-off described by the Department for open proceedings.
- Arrange professional review at once if the facts are complex or the potential tax exposure is substantial.
When the deadline has passed
Do not assume that an expired date makes the matter disappear. Check whether the proceeding is still visible and whether the portal accepts a response. Contact the Department promptly to understand the available channel, and obtain professional advice about the procedural and tax consequences. Keep evidence of any portal error, attempted submission and communication with the Department.
What records should you keep after filing?
Retain a complete, dated file containing:
- The original notice and every attachment.
- Your submitted return or written response in the exact form filed.
- Every uploaded document and the file names used in the portal.
- The transaction ID and acknowledgment number.
- Portal messages, emails, delivery records and any later communication.
- Notes identifying who prepared or reviewed the response and when it was submitted.
These records let you prove what was submitted and help a professional adviser respond to later queries. Because the Department says an online response cannot be edited after submission, review the final package before pressing Submit Response.
Common mistakes to avoid
- Using the filing date to choose the law: the assessment year and transition rules govern; filing after 1 April 2026 does not automatically move an old proceeding into the 2025 Act.
- Treating Section 148A and Section 148 as the same: the first is a pre-notice opportunity to explain; the second requires the return specified in the notice.
- Assuming the maximum deadline: three months from the end of the issue month is a cap for the old-Act Section 148 return, not a guarantee that your notice grants that much time.
- Replying to the wrong proceeding: confirm the assessment year and notice details in e-Proceedings before uploading anything.
- Submitting unsupported assertions: connect each material statement to a relevant, legible record.
- Waiting for the final day: the portal cut-off can occur seven days before the proceeding limitation date and at 6 PM.
- Failing to preserve proof: save the transaction ID, acknowledgment and final attachments immediately after submission.
When should you involve a tax professional?
Prompt advice from a qualified Indian tax professional or chartered accountant is sensible when the notice involves substantial tax exposure, several years or entities, complex transactions, unclear information, a potentially missed deadline, or a dispute about limitation, approval or service. Professional review is also valuable when the records do not reconcile with the information in the notice.
Bring the complete notice, attachments, prior returns, relevant books and statements, portal history and any earlier correspondence. A professional can assess the facts and applicable law; no general article can determine whether your individual notice is valid or predict the reassessment result.
Quick Recap
Key points to remember
- Read the assessment year, issue date, section and response date before taking action.
- Use the transition rules to determine whether the Income-tax Act, 1961 or the Income-tax Act, 2025 framework applies.
- For an old-Act Section 148 notice, file within the period printed in the notice and never assume more than the stated statutory maximum.
- Submit through Dashboard → Pending Actions → e-Proceedings → Self, or through an authorised representative where applicable.
- Answer the notice’s specific points, attach relevant evidence and retain the transaction ID and acknowledgment.
- Act early because the portal response window may close before the proceeding’s limitation date.
