Respond promptly, preserve the complete record, authenticate the document through the Income Tax Department’s official facilities, and obtain advice from an Indian chartered accountant or tax lawyer. Section 34(1A) belongs to the Income-tax Act, 1922. It is a historical reassessment provision, not the current section 148A procedure under the Income-tax Act, 1961. The text of section 34(1A) concerns previous years falling wholly or partly between 1 September 1939 and 31 March 1946, where escaped income amounted, or was likely to amount, to at least one lakh rupees.
A document citing this unusually old provision requires careful authentication and case-specific legal review. The existence of the historical text does not, by itself, prove that a notice received today is genuine, legally available, correctly served, within time, or unaffected by later laws and court orders.

What section 34(1A) is—and why the citation matters
Section 34(1A) was part of the Indian Income-tax Act, 1922. The Income Tax Department’s reproduced statutory text begins: “If, in the case of any assessee, the Income-tax Officer has reason to believe—”. The provision addressed reassessment where income had escaped assessment for a covered historical year.
The reproduced subsection identifies two defining limits:

- The relevant previous year had to fall wholly or partly between 1 September 1939 and 31 March 1946.
- The escaped income for one or more of those years had to amount, or be likely to amount, to one lakh rupees or more.
It authorized the Income-tax Officer to serve the assessee—or, for a company, its principal officer—with a notice containing requirements that could be included under section 22(2), and then to assess or reassess income for the covered year or years.
Those historical elements are useful for checking whether the notice’s stated facts even resemble the statutory wording. They are not a decision on the notice’s present validity. A lawyer or chartered accountant must examine the complete document, service history, assessment years, underlying material, and any later legislation or court orders that may affect the case.
What to do immediately after receiving the notice
- Preserve every part of the record. Save the notice PDF, envelope or delivery record, email headers, portal message, attachments, annexures, and all earlier correspondence. Record when and how you received each item. Do not rename files in a way that removes the original date or document number.
- Do not miss the stated deadline. Treat the response date printed in the notice as controlling unless the issuing authority confirms a change in writing. A request for more time does not automatically extend the deadline.
- Do not reply through an unverified link. Independently open the official Income Tax Department portal and use its notice-authentication and compliance facilities. An unexpected email, text message, or attachment should not be treated as genuine merely because it uses government-looking wording.
- Obtain professional review quickly. Give the adviser the original files, proof of service, tax records, and any prior proceedings. Because section 34(1A) is historical, a generic modern reassessment response may be inappropriate.
If several people receive copies, nominate one person to maintain the master file and calendar. Duplicate or inconsistent replies can create avoidable confusion. Keep a simple log showing who received each communication, what action was taken, and when the next action is due.

Before drafting anything, make a factual worksheet from the document. Record the following without paraphrasing dates or statutory references:
| Field | What to record | Why it matters |
|---|---|---|
| Taxpayer identity | Name, PAN, address and, for a company, the named principal officer | Shows who is being called upon to respond |
| Issuing authority | Officer’s name, designation, office and contact details | Allows independent verification of the sender and response route |
| Legal citation | Act, section, subsection and any connected provision | Separates the 1922 Act provision from current 1961 Act procedures |
| Assessment or previous year | Every year identified in the notice | Lets an adviser test the year against the historical period stated in section 34(1A) |
| Issue and service | Date of issue, date received, and method of service | Service and chronology can affect procedural analysis |
| Response deadline | The exact date and time, if specified | Determines the immediate compliance task |
| Information requested | Each question, document request and format requirement | Supports a complete, item-by-item reply |
| Referenced material | Any approval, order, report, statement or proceeding cited | Identifies material the adviser may need to obtain and examine |
Check whether the notice uses “previous year,” “assessment year,” or another label, and copy the wording exactly. Do not silently convert one year designation into another. If the notice lists multiple years, create a separate line for each and identify which documents relate to which year.
How to check whether the notice is genuine
The Income Tax Department’s current portal provides notice or order authentication and links to compliance and e-Proceedings resources. Use the portal by navigating to it independently, rather than relying solely on a link in the message that delivered the notice.
- Open the official Income Tax Department portal using a trusted bookmark or a manually entered government address.
- Choose the portal’s notice or order authentication facility and enter the identifiers requested by that facility.
- Check whether the notice details correspond with the PDF: taxpayer identity, document number, issuing office, date, section cited and assessment year.
- Review the portal’s compliance or e-Proceedings area to see whether this particular notice is available for response.
- Save screenshots or downloaded confirmation where permitted, and retain the authentication result with the original notice.
Authentication confirms that a document is represented in the Department’s system; it does not settle every legal question. A notice can still require advice on jurisdiction, service, historical applicability, limitation, evidence, or the effect of later laws. Conversely, a document that does not appear in the portal should not simply be ignored: preserve the evidence and ask the Department through an independently verified channel and your adviser how to proceed.

Never disclose passwords, one-time codes, bank credentials or unrelated personal information to a sender merely because the message claims to be from the Department. Use the portal’s own sign-in page and check that the proceeding shown there matches the paper or PDF notice. If a caller pressures you to transfer money or install software, stop the interaction and obtain independent confirmation.

Prepare a document-indexed response
Unless your adviser directs another approach, organize the reply so that an officer can match every answer to the corresponding request. Keep factual statements narrow and support them with an index of attachments.
Use the notice’s sequence
Number the response paragraphs in the same order as the notice. Quote or accurately identify each request, then provide the answer and the attachment reference. Do not replace a requested document with a general narrative when the record exists. If one document answers several questions, identify the relevant page or section for each question.
Separate facts from legal objections
Identify what you can establish from records—such as dates, payments, ownership, filings or correspondence—separately from legal positions about whether section 34(1A) can be invoked. A qualified adviser should formulate objections concerning authority, service, limitation, statutory transition and evidence.

If a document cannot be located, say what searches were made, why it is unavailable, and whether another record supports the same fact. Do not create a replacement, backdate a statement, or imply that an attachment exists when it does not. If records are held by a bank, former accountant, custodian or successor company, identify the request made and its date.
Make attachments usable
- Use legible scans and a consistent file name for each attachment.
- Number the attachments and refer to those numbers in the body.
- Keep an identical copy of the filed response and every file uploaded.
- Save the submission receipt, acknowledgement number, timestamp and any portal-generated confirmation.
- Do not send irrelevant personal data or duplicate files that obscure the documents actually requested.
Where and how to submit
Use the response channel actually specified for the notice. The Department’s portal may make a notice available through compliance or e-Proceedings, but the availability and workflow can depend on the document. Follow the notice’s stated instructions and retain proof of filing.
- Sign in to the official portal using the taxpayer’s authorized credentials, if the notice is presented there.
- Open the matching proceeding and verify the notice number and assessment year before uploading anything.
- Upload the response and attachments in the formats and size limits shown by that proceeding.
- Submit only after checking that every requested item is addressed.
- Download or print the acknowledgement immediately and store it with the case record.
If the notice directs a different verified channel, use that channel and preserve delivery evidence. If the portal is unavailable or rejects a file, take dated screenshots, keep the error message, and contact the issuing office through independently verified details while seeking professional guidance. Do not allow a technical problem to become an undocumented missed deadline. If a physical submission is required, obtain a stamped receiving copy or other reliable delivery proof.
Asking for more time
Make an extension request in writing through the official channel identified in the notice, preferably before the deadline. State the notice number, the specific material still needed, the steps already taken to obtain it, and the additional time requested. Attach evidence where useful, such as a request sent to a bank or a record custodian.
Continue preparing the response while the request is pending. Unless the authority confirms an extension, assume the original deadline remains effective. An extension request is not a substitute for responding to information already available. If only some records are missing, submit the available information and clearly identify the outstanding items rather than waiting silently.

Is a section 34(1A) notice automatically valid or invalid?
No. The historical statutory wording alone cannot answer that question. The validity of a particular purported notice may depend on matters including:
- whether the document is authentic and was issued by the stated authority;
- whether the person or entity named is the correct assessee or principal officer;
- whether the identified previous year falls within the period stated in the reproduced subsection;
- whether the notice sets out a factual basis connected to escaped income of at least one lakh rupees, as the historical text describes;
- how and when the notice was served;
- what later legislation, procedural rules, judicial decisions or orders affect the old provision; and
- whether the Department’s stated procedure and the evidence supplied support the proposed assessment or reassessment.
These are case-specific legal issues, not conclusions that can be drawn from the citation alone. Do not ignore the notice, and do not concede its validity merely by sending an unqualified response. A response can preserve factual cooperation while expressly reserving legal objections, but the wording should be settled by an adviser who has reviewed the whole file.
Do not apply section 148A deadlines to section 34(1A)
Section 148A is a current provision under the Income-tax Act, 1961. The Income Tax Department’s current section 148A guidance describes a show-cause process before a section 148 notice, with a reply period of not less than seven days and not more than thirty days from issue, unless extended on an application. It also describes consideration of the taxpayer’s reply before the decision order.

That “7 to 30 days” range is section 148A guidance. It is not a deadline that automatically controls a notice citing section 34(1A) of the 1922 Act. Read the actual notice and the law applicable to that proceeding.
| Point | Section 34(1A) | Section 148A |
|---|---|---|
| Statute | Income-tax Act, 1922 | Income-tax Act, 1961 |
| Period described in the available statutory text | Previous years wholly or partly between 1 September 1939 and 31 March 1946 | Current reassessment show-cause framework |
| Historical income threshold | Escaped income amounting, or likely to amount, to one lakh rupees or more | The available section 148A guidance does not establish this historical threshold |
| Reply timing | Must be taken from the actual notice and applicable law | Generally 7 to 30 days from issue, unless extended on application, according to current Department guidance |
The Supreme Court judgment dated 3 October 2024 discusses the modern reassessment framework and transition issues under sections 148A, 149 and 151 of the 1961 Act. It can provide background on why dates and procedure matter, but it does not decide the validity of an unspecified notice under historical section 34(1A).
Documents to give your tax adviser
- The complete notice, including every page, annexure and referenced order.
- Envelope, email, portal and delivery records showing service.
- Authentication results and portal screenshots.
- All prior returns, assessments, appeals, correspondence and settlements connected with the identified years.
- Ledgers, bank statements, contracts, invoices, ownership records and other documents relevant to the alleged escaped income.
- A chronology listing each event by date, from the earliest referenced transaction to the latest communication.
- A copy of the response filed and its acknowledgement.
Ask the adviser to assess the notice as a complete procedural history rather than relying on a single sentence or date. Confirm that the adviser is familiar with Indian reassessment matters and can distinguish the 1922 and 1961 Acts. A professional review is especially important where the taxpayer is a company, the named principal officer has changed, or records are held by a dissolved or reorganized entity.

Ignoring an implausibly old notice
Risk: You lose time to authenticate it and preserve objections. Safer approach: verify it independently, record service details, and obtain advice without conceding validity.

Risk: It may fail to answer specific requests or preserve the factual record. Safer approach: answer in sequence and map each statement to an attachment.
Relying only on an email link
Risk: You may disclose information to an impostor or miss the genuine proceeding. Safer approach: navigate independently to the official portal and verify through the Department’s facilities.
Assuming an extension request stops the clock
Risk: The original deadline may remain in force. Safer approach: request time before the deadline and continue preparing a response unless an extension is confirmed.
Uploading an incomplete or unreadable file
Risk: The officer may be unable to match evidence to the questions, and the taxpayer may have no reliable record of what was submitted. Safer approach: check every scan, preserve the exact uploaded files, and keep the acknowledgement.

Monitor the same verified portal or communication channel for acknowledgements, further questions, hearing notices or orders. Do not assume that an acknowledgement means the matter is closed. Forward every subsequent communication to the adviser promptly and update the chronology.
If the Department asks for clarification, answer only the questions asked, correct any factual error in the earlier response, and identify superseded documents. Keep proof of each follow-up. If no acknowledgement appears, contact the issuing office through independently verified details and retain the date, method and substance of that contact.

What years does section 34(1A) mention?
The reproduced statutory text refers to a previous year falling wholly or partly between 1 September 1939 and 31 March 1946, and to escaped income amounting or likely to amount to at least one lakh rupees.
Can I use the seven-to-thirty-day section 148A deadline?
Do not assume so. The seven-to-thirty-day range is current Department guidance for section 148A under the Income-tax Act, 1961. A notice citing section 34(1A) of the 1922 Act must be assessed according to its own wording and applicable law.
Where do I respond to an income tax notice online?
Use the official Income Tax Department portal’s compliance or e-Proceedings facility if the particular notice appears there, or use another verified channel specified in the notice. Navigate independently rather than relying on an unexpected message link, and retain proof of filing.
What if the notice cannot be found on the portal?
Do not ignore it. Save the document and delivery evidence, record the failed authentication or search, contact the Department through independently verified details, and ask a qualified adviser how to respond while the deadline is protected.
Should I request more time?
If records genuinely cannot be obtained by the deadline, request an extension in writing through the stated official channel, explain what is missing and what steps you have taken, and continue preparing the available response. Treat the original deadline as effective unless an extension is confirmed.
What should a company do if its principal officer is named?
Preserve the notice and corporate service records, verify the named principal officer and the relevant years, collect predecessor-company records, and obtain professional advice. The notice’s identification of a principal officer should not be treated as resolving the company’s legal position.
The Bottom Line
Do not treat a section 34(1A) citation as either genuine or invalid without checking. Preserve the complete record, compare the notice with the historical 1922 Act wording, authenticate it through the Income Tax Department’s official facilities, meet the stated deadline or request time in writing, submit a document-indexed response, and have an Indian tax professional review service, dates, evidence and the effect of later law.
