How to Respond to an Income Tax Notice and Meet the Deadline

Use the notice itself as your source of truth. Before replying, identify the issuing agency, notice number, tax year, issue, requested action, deadline and permitted submission channel. Verify unexpected correspondence through the agency’s official website or a published phone number, then choose the route that matches your position: provide information, accept the change, formally dispute it, pay, or request time. A document response is not automatically a formal appeal, so follow the procedure named in your specific notice.

Start with the notice, not a generic deadline

Tax agencies issue different letters for information requests, processing questions, proposed adjustments, final assessments, payment demands and appeal rights. Each can carry a different time limit. There is no universal “30-day” or “90-day” response period for every income tax notice, and a deadline cannot be calculated safely without the notice, jurisdiction, taxpayer type and trigger date.

Extract the six facts that control your response

  1. Issuing authority: Confirm the agency and whether the letter concerns federal, state, provincial, territorial or local tax.
  2. Notice or reference number: Record the exact CP, LTR, reference, assessment or account number printed on the letter.
  3. Tax year and issue: Note the return, transaction or period under review and the specific item the agency questions.
  4. Requested action: Determine whether the agency wants documents, a written explanation, payment, an amended return, an objection or another filing.
  5. Due date: Write down the date exactly as printed and identify what must be received or submitted by then.
  6. Response channel: Copy the address, portal, fax number, upload instructions or other method named in the notice.

Keep the complete notice while you work. Instructions on later pages may contain the address, form, payment method or appeal language that is absent from the first page.

Verify suspicious correspondence before using its contact details

If the letter is unexpected, asks for unusual payment, contains a threatening message or appears altered, verify it independently. For U.S. Internal Revenue Service correspondence, search the CP or LTR number in the IRS notice system and use a phone number published by the IRS if the letter looks suspicious. Do not call a number or open a link supplied only by an unverified message. Canadian taxpayers should likewise confirm the letter and its contact route through the Canada Revenue Agency’s official channels.

Understand which kind of deadline you have

The following examples illustrate why the notice controls. They are federal examples from the United States and Canada, not rules for every country, state, province, taxpayer or notice.

Situation What the taxpayer normally does Time rule described by the agency
IRS math or clerical error notice Tell the IRS you disagree and provide records that may correct the error. For the certain notices covered by IRS taxpayer-rights guidance, 60 days to disagree.
IRS proposed adjustment followed by a Tax Court petition Use the notice’s dispute process; if petitioning the U.S. Tax Court is the chosen route, file the petition within the statutory period. 90 days from the notice, or 150 days when the notice is addressed outside the United States, in the described situation.
CRA request for more information Quote the reference number and send the requested reply and document copies to the address or electronic channel in the letter. The letter sets the response date. Calling the number on the letter may allow more time, but any extension should be requested and recorded.
CRA individual objection to an income-tax assessment Submit a formal objection through a CRA secure portal or by mail or fax using Form T400A or a sufficiently detailed letter. The later of 90 days after the notice of assessment, reassessment or redetermination, or one year after the filing deadline for the return (April 30 or June 15 where the CRA decision tree applies).
Appeal of a CRA objection decision Appeal to the Tax Court of Canada, or use the route described by the CRA if it has not decided the objection within the applicable period. The CRA guide describes a 90-day period after the date it sends the objection decision.

These periods are tied to particular notices and taxpayer categories. For example, the CRA’s individual-objection formula does not automatically apply to corporations, trusts or every type of determination.

Choose the correct response route

Your position Action What can go wrong if you choose the wrong route
You agree with the notice Take the requested action, such as paying, sending the requested records or accepting the adjustment. Reply only if the notice asks for a reply. Avoiding a required action can lead to collection activity, delayed processing or loss of a procedural opportunity.
You disagree with a factual or calculation issue Follow the notice’s dispute instructions, state the facts and reasons clearly, and attach relevant evidence. A routine document upload may not count as a formal objection or preserve a court-appeal right.
You need more information or more time Use the official contact route promptly and ask exactly what extension, clarification or filing is available. A phone conversation may not change a written deadline unless the agency grants relief and you obtain confirmation.

A safe response workflow

  1. Make a deadline line. At the top of your work file, write the agency, notice number, tax year, printed due date, response method and the consequence the notice describes. Add separate dates for payment, objection and court action if the letter lists more than one.
  2. Compare the disputed item with your return and records. Match the agency’s figures to the filed return, information slips, invoices, receipts, withholding records, payment confirmations and correspondence for that year. Do not send unrelated personal records.
  3. Decide whether the letter asks for evidence or a legal challenge. A request for receipts may require a document response. A proposed adjustment or assessment may require an explanation, a formal objection or a petition. Read the appeal paragraph rather than assuming that one response serves all purposes.
  4. Prepare a focused explanation. Identify the notice item, state whether you agree or disagree, describe the facts in chronological order, show the calculation where useful and list each enclosure. If a number is wrong, show the corrected number and how you reached it.
  5. Send copies unless the notice expressly requires originals. Keep originals in your records. Label attachments with your name, account identifier, tax year and notice number so they can be matched to the case.
  6. Submit before the last day. Allow time for portal outages, file-size limits, fax failures, postal delays or an address error. Use only the portal, address, fax number or other channel specified by the agency.
  7. Preserve proof. Save the final response, every enclosure, the date-stamped upload or submission confirmation, postal tracking record, fax receipt and any agency confirmation. Record the name or identifier of an official contact and the terms of any extension.

How the IRS examples work

Read the IRS notice category and CP or LTR number

The IRS says notices may concern a balance, a changed refund, a question about a return, identity verification, a return correction or a processing delay. Its notice guidance says: “If we ask you to respond, act by the due date.” If the IRS asks for no reply, follow the payment or other action instructions instead of sending an unnecessary letter.

If you agree with the IRS

Take the action the notice requests. If an amount is due, the IRS advises paying by the due date even when you cannot pay in full, because payment can reduce additional interest and penalty charges. Use the payment instructions in the notice and keep the confirmation. A payment problem and a disagreement about the assessment are separate decisions; follow the notice’s dispute instructions if you also contest the amount.

If you disagree

Follow the response or reconsideration route printed in the notice and include copies of records that support your position. Explain the specific line, year or transaction at issue rather than sending a broad narrative. The IRS states, “To guarantee your appeal rights, reply by the due date.” Treat that date as controlling unless the IRS gives you written or otherwise verifiable relief.

Special periods for certain IRS notices

IRS taxpayer-rights guidance says that, for certain math or clerical error notices, you have 60 days to tell the IRS you disagree and provide records that may correct the error. If the IRS does not agree and issues a proposed adjustment, the guidance describes a U.S. Tax Court petition deadline of 90 days from the notice, or 150 days when the notice is addressed outside the United States. Those periods apply to the described notice situations; they are not a general IRS deadline for every letter.

How the CRA examples work

Replying to a CRA information request

A request for information is not the same as a formal objection. Quote the reference number, answer the questions, and send the requested receipts or other document copies to the address in the letter or through the electronic channel it names. If time is short, call the number on the letter and ask whether more time can be granted for that specific request. Record the extension date and how it was authorized.

Objecting to an individual income-tax assessment

For an individual, CRA decision-tree guidance describes the deadline as whichever is later: 90 days after the notice of assessment, reassessment or redetermination, or one year after the filing deadline for the return. The filing deadline shown in that guidance is April 30 or June 15, as applicable. Use the exact notice date and taxpayer category; do not apply this formula automatically to a corporation, trust or other determination.

A formal objection may be filed through a CRA secure portal or by mail or fax using Form T400A or an appropriately detailed letter. Include:

  • your name and address;
  • a daytime telephone number;
  • the date of the assessment, reassessment or redetermination;
  • the tax year;
  • your account identifier;
  • the facts and reasons for the objection;
  • copies of supporting documents; and
  • representative details, if someone is acting for you.

Sign and date the objection. The CRA guide says secure-portal filing provides a case number and may reach an appeals officer sooner. Keep that case number with your submission records.

Discussing the issue before filing

The CRA recommends first calling or writing to discuss a disputed assessment because some disagreements can be resolved through an explanation. That conversation does not replace a formal objection when one is needed. File the objection by the applicable deadline unless the CRA confirms another procedure that protects your rights.

If you cannot meet the deadline

Contact the agency immediately

Use a verified official phone number or portal, explain which deadline is approaching or has passed, and ask three precise questions: whether an extension is available, what filing is required to preserve appeal rights, and how the agency will confirm the decision. Do not assume that leaving a voicemail, making a payment or having an informal conversation changes the deadline.

CRA objection extensions

The CRA guide says an extension application must be made as soon as possible and no later than one year after the objection deadline, subject to eligibility conditions. The application must include the facts and reasons for the delay and the objection; the cited Income Tax Act provision also sets a one-year outer limit and requires the objection. An extension is not automatic, so seek official guidance promptly.

When the problem is payment rather than disagreement

If the notice demands money you cannot pay in full, follow its payment instructions and ask the agency what arrangement or relief is available. For an IRS amount due, paying what you can by the due date may reduce interest and penalty charges. Keep payment discussions separate from any objection or appeal filing so that a payment request does not displace a required dispute document.

Common mistakes and the fix for each

  • Using a generic deadline: Replace internet rules of thumb with the date and trigger stated in your notice.
  • Sending documents to an unverified address: Confirm suspicious correspondence through the agency’s official website or published number.
  • Ignoring later pages: Read the entire notice, including appeal, payment and enclosure instructions.
  • Submitting an explanation without a formal objection: Check whether the notice requires a named form, signed letter or portal filing.
  • Missing the tax year: Put the year and notice number on the response and every attachment.
  • Sending originals: Send copies unless originals are expressly required and retain the originals.
  • Waiting until the due date: Submit early enough to resolve upload, fax, mailing or delivery problems.
  • Relying on an unrecorded phone promise: Ask for the extension or decision in a verifiable form and keep the reference number.
  • Arguing every tax year at once: Address the issue and period identified in the notice, then respond separately to any other letters.

When professional help is sensible

Consider a qualified tax professional or lawyer when the amount is substantial, the notice involves fraud or penalties, several years are affected, records are incomplete, a business or trust is involved, a court petition may be required, or the deadline is imminent. Give the adviser the complete notice, your filed return, relevant records, prior correspondence and proof of any submission. You remain responsible for meeting the deadline unless the agency confirms a different arrangement.

A final pre-submission checklist

  • The notice is authentic and the agency’s contact details were independently verified if needed.
  • The notice number, tax year, disputed item, requested action and due date are written on your response plan.
  • You selected the procedure that matches your position: information reply, payment, formal objection, extension request or court petition.
  • Your explanation answers each question and ties each factual statement to a relevant document.
  • Attachments are legible copies, labeled and limited to what the notice requests or what is needed to prove your position.
  • The submission uses the exact channel and address named by the agency.
  • You have proof of submission and a calendar reminder for the next agency or court deadline.
