Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsRead the notice first: identify the assessment year or tax year, the exact loan credits questioned, the evidence requested, the response channel and the deadline. Then reconcile every amount to your books and bank records, explain the loan’s nature and source, and provide records that also address the lender’s nature and source of funds where the law requires it. Submit through the channel named in the notice, save the acknowledgement, and obtain advice from a qualified Indian tax professional if the facts or legal position are disputed.
What a Section 68 loan notice is asking you to prove
Section 68 of the Income-tax Act, 1961 applies when a sum is credited in books maintained by a taxpayer for a previous year. If the taxpayer gives no explanation of the credit’s nature and source, or the Assessing Officer considers the explanation unsatisfactory, the amount may be charged to tax as income of that previous year.

“Where any sum is found credited in the books of an assessee maintained for any previous year, and the assessee offers no explanation about the nature and source thereof or the explanation offered by him is not, in the opinion of the Assessing Officer, satisfactory, the sum so credited may be charged to income-tax as the income of the assessee of that previous year.”

A loan entry therefore needs more than a label such as “unsecured loan” in the ledger. Your reply should connect the entry to a real lender, a real transfer or receipt, agreed terms, and a credible explanation of where the lender obtained the money. For certain loan or borrowing credits, the person named as lender in your books must also explain the nature and source of the sum, and the Assessing Officer must find that explanation satisfactory. Departmental guidance states that this loan proviso applies from Assessment Year (AY) 2023-24.
#1 Best Overall
The notice is not proof that the credit is taxable. It is a request for an explanation and supporting material. The outcome depends on the notice, the tax year, your records, the lender’s evidence and the Assessing Officer’s assessment of whether the explanation is satisfactory.
First determine which law and tax year apply
Do not name the provision in your response until you identify the relevant year. India’s Income-tax Act, 2025 came into force on 1 April 2026. Transitional rules keep the Income-tax Act, 1961 applicable to tax years beginning before that date, including proceedings initiated or pending after the 2025 Act commenced. For years governed by the 2025 Act, Section 102 is the successor provision titled “Unexplained credits.”
| Question | What to check | Why it matters in the reply |
|---|---|---|
| Which period is covered? | The assessment year, previous year or tax year printed in the notice. | The same credit can be described under a different statutory framework depending on the period. |
| Did the tax year begin before 1 April 2026? | If yes, transitional rules generally keep the 1961 Act relevant, even if the proceeding continues after that date. | Section 68 may be the correct reference for a pre-1 April 2026 tax year. |
| Is the year governed by the 2025 Act? | Check whether the tax year begins on or after 1 April 2026 and how the notice identifies the provision. | Section 102 is the corresponding unexplained-credits provision. |
| Does the notice allege a loan or borrowing? | Read whether it invokes the lender-side explanation requirement. | For loan credits covered by the proviso, evidence about the lender’s source is material, not just your receipt of the money. |
If the notice uses a section number that appears inconsistent with the period, do not silently ignore it. State the period you understand, identify the provision you believe applies, and ask for clarification or obtain professional advice before filing a substantive legal objection.

Step 1: verify the notice and its deadline
Access the official e-Filing portal independently rather than relying only on an email link or a forwarded document. In the portal, check Pending action / e-Proceedings and match the online communication with the document you received. The e-Proceedings service is used to view and submit responses to notices, intimations and letters and to upload attachments.
- Confirm authenticity and authority. Record the issuing authority, document identification details and proceeding type. Check that the communication appears in the taxpayer’s portal account.
- Record the period and amount. Note the assessment year or tax year, each credit or aggregate amount questioned, and the date on which the notice was issued.
- List every requested item. Separate questions about the loan agreement, lender identity, bank movement, books, interest, repayment, source of funds and any mismatch with information held by the department.
- Mark the response deadline and channel. A portal response, a separate written submission or another route may be specified. Follow the route stated in the communication.
- Check submission availability early. The e-Proceedings FAQ says the submit option can close before the proceeding’s limitation date, depending on the proceeding, although the authority may re-enable it in some cases. Do not assume that the final statutory date means the upload button will remain available until midnight.
- Plan for the no-edit rule. In the described e-Proceedings workflow, a submitted response cannot be edited or withdrawn. Review the text, annexure index and files before selecting submit.
Save the notice as received, including all pages and annexures. Preserve the portal location and a dated copy so you can prove which questions you answered.

Step 2: reconcile every questioned credit
Prepare a working schedule with one row for each credit. Reconciliation is the backbone of the reply: it lets the officer move from the notice to your books, from the books to the bank, and from the bank to the lender’s explanation without guessing.
| Schedule field | What to enter | Supporting source |
|---|---|---|
| Credit date | Date posted in the ledger and, if different, date funds reached the bank account. | Ledger, journal entry and bank statement. |
| Amount | Exact amount challenged, including whether the notice groups several entries. | Notice, trial balance and ledger. |
| Lender | Name exactly as recorded, with the identifying details available in your records. | Loan agreement, confirmation and account records. |
| Account and reference | Ledger account, bank narration, transfer reference or cheque details. | Books and bank statement. |
| Purpose and terms | Commercial or personal purpose, tenure, interest terms, security and repayment conditions, if applicable. | Agreement, correspondence and board or partner records where relevant. |
| Repayment and interest | Dates and amounts repaid, interest charged or paid, and the accounting treatment. | Bank statements, repayment schedule, interest ledger and tax records. |
| Lender-source evidence | How the lender obtained the funds relevant to the questioned advance. | Records supplied by the lender that address the notice’s specific question. |
| Variances | Any difference between the notice, books, lender confirmation and bank entries. | A short explanation with cross-referenced documents. |
Reconcile totals as well as individual entries. If the notice amount does not equal your ledger balance, explain whether the difference reflects opening balance, repayment, interest, a reversal, a duplicate entry or an error. Leaving an unexplained difference can make an otherwise genuine transaction appear incomplete.
Step 3: assemble evidence that fits the question
The following records are practical examples, not an official universal checklist. The statute requires an explanation; it does not make any single document automatically conclusive. Provide only genuine records, and never create, alter or backdate documents.
Books and financial statements
- Ledger extracts for the lender’s account and the relevant period.
- Journal entries showing receipt, interest, repayment, conversion or adjustment.
- Relevant audited financial statements, schedules and notes, where maintained.
- A reconciliation showing how the figure in the notice appears, or does not appear, in the books.
Documents identifying the loan
- A loan agreement, promissory note or other contemporaneous record of the advance.
- A lender confirmation describing the amount, date, terms, outstanding balance and repayments.
- Evidence of the commercial or personal purpose and the chronology of the transaction.
Bank and payment trail
- Your bank statement showing the incoming credit and the relevant transaction reference.
- The lender’s payment record or other evidence connecting the lender to the transfer.
- Repayment and interest entries, if the loan has been serviced.
Evidence about the lender’s source
Where the loan proviso applies, ask the lender for records that answer the specific source question raised in the notice. Depending on the facts, this may include financial or tax records, bank evidence, or documents explaining a preceding transaction. Do not claim that a lender’s tax return, a confirmation or a bank transfer alone automatically discharges the burden. The strength of the explanation comes from the complete, consistent trail and the answers to the notice’s actual questions.
Step 4: address the lender-side requirement
For a credit described as a loan, borrowing or similar amount, the person in whose name the credit is recorded must also explain the nature and source of the sum. This is a separate issue from showing that money reached your bank account. Your reply should therefore identify what the lender has explained and where the supporting records appear.
Rank #3
Ask the lender to review the proposed submission before you file it. Names, dates, amounts, account numbers, tax identifiers and descriptions should agree across the confirmation, bank statement and your ledger. If the lender cannot provide a requested record, say so plainly and explain what alternative evidence exists. Do not present an assumption about the lender’s finances as a verified fact.

A difficult fact is better addressed directly than concealed; unexplained gaps invite further questions.
Step 5: draft the response in the notice’s question order
A clear indexed submission allows the officer to test each credit without searching through an unstructured bundle. Use stable attachment names and cross-references.
- Heading and scope. State the taxpayer, proceeding reference, relevant assessment year or tax year and the date of the notice.
- Short factual explanation. Explain what each credit represents, who advanced it, why it was received and its current status.
- Reconciliation table. Give one row per questioned credit and cross-reference the ledger, bank entry, agreement and lender evidence.
- Nature and source explanation. Describe the transaction and identify the records showing the lender’s source where the loan proviso is relevant.
- Answer each numbered question. Follow the notice’s sequence. If a requested item is not applicable, say why rather than leaving a blank.
- Deal with discrepancies. Explain different dates, partial repayments, opening balances, spelling differences or amounts that do not match.
- Annexure index and declaration. List every attachment, page range and language of the record. Distinguish facts supported by documents from matters still being verified.
Use plain, specific sentences. “The loan is genuine” is a conclusion; “The lender transferred the amount on 14 July, the receipt appears in the bank statement at Annexure B, and the ledger entry is at Annexure A” is an explanation that can be checked.
Step 6: submit correctly and preserve proof
- Convert files to the format and size accepted by the portal or specified in the notice. Keep the original records in an unchanged folder.
- Use the response route stated in the communication, including the relevant e-Proceedings item.
- Attach the indexed reply and supporting records in the same order used in the text.
- Review the complete submission, because the described workflow does not allow editing or withdrawal after submission.
- Submit before the portal closes and download the acknowledgement or confirmation screen.
- Save the final response, every uploaded file, the acknowledgement and a dated record of submission.
- Recheck the proceeding after submission for additional queries or notices. The portal allows submitted responses to be viewed and may display further queries there.
A successful upload is not a decision on the merits. Continue monitoring the proceeding and respond to later communications within their own deadlines.

Common weaknesses and how to handle them
The bank trail is incomplete
Explain whether the account was closed, the statement is unavailable, the amount was routed through another account or the notice refers to a different reference. Obtain a bank-generated statement or transaction confirmation where possible. Do not substitute a recreated spreadsheet for a bank record without explaining its status.
The ledger name and lender confirmation differ
Identify whether the difference is a spelling variation, a trade name, a change in legal status or a bookkeeping error. Correct the record only through a proper accounting process and disclose the correction. Do not silently alter historical entries.
The lender cannot immediately provide source records
State what has been requested, what is available now and what remains outstanding. Provide the evidence that exists and explain its limits. If the deadline is approaching, consider requesting an extension through the available portal process, but do not treat a request as an automatic grant.
There was no written agreement
Say that directly and assemble other contemporaneous records: bank entries, correspondence, board or partner approvals, confirmations, repayment history and accounting treatment. A later-created document should be identified by its actual date and purpose.

The notice appears to rely on incorrect information
Quote the disputed date or amount, show the corresponding book and bank entries, and attach the record that demonstrates the difference. Ask for the incorrect premise to be considered, while still answering the substantive questions that apply if the premise is accepted.
When to request more time or professional representation
If records cannot be assembled before the deadline, use the available portal process to request an extension and explain the concrete reason, documents being obtained and expected date. Filing an extension request does not itself extend the deadline; comply with any direction that follows.
Consider representation by a qualified Indian chartered accountant or tax advocate when the amount is material, several years or entities are involved, the lender’s source is disputed, records conflict, the notice proposes an adverse adjustment, or you need to challenge the legal provision or procedure. An adviser can review the notice and evidence, but remains dependent on complete and accurate facts from you and the lender.

- The assessment year or tax year and governing Act have been verified.
- Every questioned credit has a row in the reconciliation schedule.
- Books, bank entries, agreements, confirmations and repayments agree or each variance is explained.
- The response addresses the lender’s nature and source where the loan proviso applies.
- Facts are separated from assumptions and unavailable records are identified honestly.
- Attachment names and page references work from the answer to the evidence.
- The submission route and deadline in the notice have been followed.
- A complete copy and portal acknowledgement have been saved.
- The proceeding will be monitored for further queries.
A defensible response is therefore a dated, indexed explanation that lets the Assessing Officer trace each credit from the notice to your books, from your books to the bank, and from the lender to the lender’s source of funds. Whether that evidence is satisfactory remains case-specific.
