Do not reply with a generic statement that the jewellery is “within the permitted limit.” First identify the notice, the year and provision it cites, and the exact allegation. Then prepare an itemised ownership-and-source reconciliation, attach genuine evidence, answer every question separately, submit through the channel and deadline stated in the notice, and preserve the acknowledgment. The familiar 500-gram, 250-gram and 100-gram figures relate to non-seizure guidance during search operations; they are not a general ownership cap or automatic tax exemption.
What the notice is actually asking
An income-tax communication about gold jewellery can arise at several procedural stages. It may be a preliminary information request, a scrutiny query, a notice proposing an addition, an assessment order, a penalty notice or a demand communication. It may also refer to a search or survey inventory. These documents require different responses and remedies, so read the notice itself before deciding what to submit.

Record the controlling details
- Issuing authority and designation.
- Assessment year or tax year and the financial year involved.
- Provision or provisions cited.
- Issue date and response deadline.
- Whether the document asks for information, proposes an adjustment, records an order, starts a penalty proceeding or raises a demand.
- The jewellery description, quantity, valuation and ownership assumption used by the department.
- Every document, explanation and format specifically requested.
Download the communication from the official Income Tax e-Filing portal and keep the downloaded file. Do not assume that a notice concerning jewellery is automatically a section 69A proceeding or a search-related seizure matter. Check the enactment and provision actually cited for the relevant year; do not substitute a familiar section number from a different year or proceeding.
When section 69A can become relevant
Section 69A of the Income-tax Act, 1961 addresses a situation in which an assessee is found to own money, bullion, jewellery or another valuable article, the item is not recorded in books maintained for a source of income (if any), and the assessee either provides no explanation about the nature and source of acquisition or the Assessing Officer considers the explanation unsatisfactory. The money or value of the article may then be deemed income for that financial year.

The wording matters. Jewellery is not automatically taxable merely because it is un-invoiced, old, inherited or found in a home. The factual questions are who owns each item, how and when it was acquired, what funded it or transferred it, and whether the evidence makes that account credible. The notice controls which allegation must be answered.
What must be explained
- Ownership: identify the person who owns each item rather than treating all household jewellery as belonging to the person who received the notice.
- Nature of acquisition: distinguish purchase, inheritance, gift, marriage or other family transfer, and gradual accumulation from household savings.
- Source: connect the acquisition to disclosed income, exempt income such as agricultural income, reasonable household savings, inheritance or another documented source that actually fits the facts.
- Timing: state the approximate acquisition period and explain honestly when an exact date is unavailable.
- Quantity and value: reconcile the item count, weight and valuation used in the notice with available records.
Government of India guidance issued through the Press Information Bureau on 1 December 2016 said that jewellery acquired from explained sources, including inheritance, is not subject to a general holding limit. That is a statement about explained-source holdings, not proof that any particular taxpayer has explained a particular item.
Do not treat the 500 g, 250 g and 100 g figures as a tax allowance
The same 2016 clarification described CBDT Instruction No. 1916 as guidance for search operations: jewellery up to 500 grams for a married woman, 250 grams for an unmarried woman and 100 grams for a male family member would ordinarily not be seized. An officer could also decide not to seize larger quantities after considering factors such as family customs and traditions.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsThose quantities are about whether jewellery is seized during a search. They are not:
- an ownership ceiling;
- a tax-free or income-tax exemption;
- a rule that proves the source is explained; or
- a safe-harbour amount that answers a notice without evidence.
Conversely, explained holdings are not limited to those weights. If your reply relies on the 2016 figures, describe them precisely as search non-seizure guidance and then address ownership and source separately. An inventory above or below a stated quantity does not, by itself, establish taxable income.
A practical response plan
1. Verify the communication and deadline
Use the e-Filing portal to confirm that the document appears in your account and to download the complete communication and annexures. Note the proceeding status and the response facility available. A query, proposed addition, final order and demand require different forms of relief; a generic “clarification” may not preserve the right response. If an email or message contains only a link, rely on the authenticated portal record and not an unverified attachment.
2. Build an item-wise reconciliation
Create a schedule that follows the notice’s inventory as closely as possible. Use one row per item or a clearly defined family-member grouping where individual identification is impossible. Include:

| Field | What to record |
|---|---|
| Reference | Notice item number, inventory number or description. |
| Person claiming ownership | Name, relationship and basis for treating that person as owner. |
| Item description | Type of ornament and distinguishing details. |
| Weight and valuation | Figure in the notice, your record and the method or document supporting each. |
| Acquisition route | Purchase, inheritance, gift, marriage-related transfer or accumulated savings. |
| Approximate date | Exact date where documented; otherwise a clearly labelled estimate. |
| Funding or transfer evidence | Invoice, payment trail, inheritance record, gift document or other corroboration. |
| Open issue | Missing record, ownership dispute, quantity mismatch or valuation disagreement. |
Do not convert an estimate into a false precise date or weight. If the notice combines household items, explain the allocation and identify which parts remain uncertain. Keep gross weight, net gold weight, stones and making charges distinct if the records use those categories.
3. Gather evidence that fits the actual history
Collect only material that relates to the item and the person who owned or acquired it. Depending on the facts, useful records may include:
- purchase invoices, jeweller statements and payment records;
- bank withdrawals or other funding records tied to the purchase;
- inheritance documents, wills, probate material or family settlement records;
- gift deeds or contemporaneous transfer records;
- earlier income-tax returns and other tax records showing disclosed income;
- records supporting exempt income, including agricultural income where that is the asserted source;
- family records, marriage records, photographs or other contemporaneous material that helps establish longstanding possession and ownership; and
- any valuation report or inventory prepared at the relevant time.
A checklist is not a promise that every document is required or sufficient. Explain why an expected record is unavailable and provide genuine corroboration instead of manufacturing a replacement. Arrange documents chronologically, identify the relevant page for each assertion, and redact unrelated sensitive information only where doing so will not obscure the evidence.
4. Answer each allegation separately
Use the notice’s numbering. For every item or question, state the fact, the evidence attached and the conclusion you ask the officer to draw. Reconcile contradictions directly: for example, explain why the notice attributes an ornament to one person while family records identify another, or why its weight differs from an invoice.
If the department’s valuation is disputed, quote the valuation used in the notice and set out the factual basis for an alternative figure. Do not invent a valuation. A material valuation dispute may require advice from an appropriately qualified professional. Explain whether a difference results from purity, stones, making charges, a market-date difference or a simple transcription error.
5. Prepare an indexed submission
Organise the reply in this order:
- Covering response identifying the notice, year, proceeding and deadline.
- Short factual chronology.
- Ownership-and-source table cross-referenced to notice items.
- Answer to each question or proposed adjustment.
- Document index and legible attachments.
- Statement identifying estimates, unavailable records and unresolved points.
- Specific request, such as accepting the explanation, correcting an inventory mismatch or allowing a further hearing where the procedure permits.
Keep the tone factual. Avoid asserting that a gram threshold automatically settles the matter or that possession alone proves ownership. If several family members are involved, explain each person’s position consistently and avoid submitting conflicting statements without identifying the dispute.
6. Submit through the prescribed channel
The Income Tax Department’s e-Proceedings manual describes a workflow to view and download notices, submit written remarks and attach documents. A successful submission generates a transaction ID and acknowledgment. The workflow may also allow an adjournment request or addition of an authorised representative, subject to the proceeding and options displayed in the account.

After submission, save the notice, final reply, every attachment, transaction ID, acknowledgment and any subsequent portal message in more than one secure location. If an adjournment is needed, request it through the available facility before the deadline and explain the reason briefly; do not assume that an oral request or an email automatically extends time.
7. Check everything before clicking submit
Portal help states that a submitted response cannot be edited. Check the taxpayer name, assessment year, provision, item numbers, weights, values, dates, attachment order and consistency with earlier filings. Confirm that scans open and are readable. The response option can depend on the due date or proceeding status; if it is disabled, use the appropriate official channel promptly rather than waiting for the deadline to pass.
How to compare competing accounts in the record
When the notice and your records tell different stories, compare the accounts using the same criteria. This helps expose the precise issue instead of arguing generally that the jewellery is old or customary.
| Comparison point | Questions to resolve |
|---|---|
| Ownership | Who owned the item when acquired and who owns it now? Is the person named in the notice merely holding it for a family member? |
| Source and date | Was it purchased, inherited, gifted or accumulated, and what period does each account assign? |
| Link to funds or transfer | Does a bank record, invoice, inheritance paper or family record connect the source to the item? |
| Quantity and valuation | Are gross weight, net gold weight, stones, making charges and valuation methods being compared on the same basis? |
| Consistency | Does the explanation fit tax returns, bank records, family history and earlier statements? |
| Procedural stage | Is this an information request, proposed addition, order, penalty matter or demand requiring a different remedy? |
Common factual patterns and how to document them
Inherited jewellery
Identify the predecessor, the approximate transfer date, the family relationship and the documents or records showing inheritance. If no formal instrument exists, explain that limitation and provide available corroboration rather than presenting an unsupported legal conclusion. Where several heirs exist, explain why the particular items were held by the taxpayer and whether any family arrangement changed ownership.
Jewellery accumulated from household savings
Set out the relevant earners, the period of accumulation and the income or savings history that makes the amount plausible. Link the explanation to disclosed or exempt income where applicable. “Family savings” by itself is a label; the reply should show whose savings, over what period and why the amount is reasonable. Avoid claiming that every historical cash saving can be reconstructed exactly; identify the limits of the records.
Quick wins for a faster PC:
Clear out junk files and repair common Windows errorsFree Scan →Scan for outdated or missing drivers - takes under a minuteDriver Scan →Gifts or marriage-related transfers
Identify donor, recipient, relationship, occasion and approximate date. Attach a gift document or contemporaneous family evidence where available, and distinguish the recipient’s ownership from the person in whose premises the jewellery was found. If the gift was made long ago, explain what evidence survives and why a formal deed is unavailable.
Purchase records are missing
Say so plainly. Use secondary evidence such as bank entries, older tax records, jeweller correspondence or family records only to the extent it genuinely supports the account. Do not create invoices, backdate transfers or select only convenient records. A missing invoice does not automatically prove unexplained acquisition, but it makes the surrounding evidence and a coherent chronology more important.

Search or survey inventory
Match your schedule to the inventory and separate the question of seizure from the question of taxability. The non-seizure instruction does not decide ownership or source. Explain family customs or longstanding possession only as facts that support the evidentiary account, not as an automatic exemption. Record any discrepancy between the signed inventory, photographs and later valuation.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Common pitfalls that weaken an otherwise valid explanation
- Using the 500/250/100 gram figures as if they were a tax exemption.
- Answering only for jewellery found in the taxpayer’s room while ignoring items owned by other family members.
- Giving one total weight without reconciling the notice’s item descriptions.
- Claiming inheritance or a gift without identifying the predecessor or donor.
- Submitting an unsigned, unreadable or unindexed collection of attachments.
- Ignoring a question because an invoice is missing instead of explaining the gap and supplying secondary evidence.
- Assuming that a response to a query automatically challenges a later assessment, penalty or demand.
- Waiting until the last day to discover that the portal response option is unavailable.
What happens if the explanation is rejected
An assessing officer may propose or make an addition involving section 69A when the source explanation is considered absent or unsatisfactory. A tribunal decision illustrates that a dispute can also involve section 115BBE, but that case is not a universal tax-rate rule. The applicable provisions, year, procedure and outcome depend on the notice and facts. Do not infer an automatic rate or result from a case excerpt.
If an assessment, penalty or demand has already been issued, read the order for the appeal or rectification route and deadline. A reply to an earlier query is not necessarily the remedy for a final order. Have the complete record reviewed before choosing the next procedural step, and preserve proof of every earlier submission.
When professional review is warranted
Arrange case-specific review by an Indian chartered accountant or tax lawyer when the amount is substantial, the notice follows a search or survey, family ownership is disputed, records conflict, valuation is material, or an assessment, penalty or demand already exists. An authorised representative can be added through the portal workflow where that option is available. Professional assistance should be based on the actual notice and evidence; no generic template can determine the correct defence.
Final submission checklist
- Notice downloaded and authenticated in the e-Filing account.
- Assessment year, provision, deadline and proceeding stage confirmed.
- Every jewellery item matched to an owner or clearly marked as unresolved.
- Acquisition route, approximate date, quantity and valuation stated without invented precision.
- Evidence indexed, legible and consistent with prior tax and banking records.
- Missing documents and estimates disclosed honestly.
- Search non-seizure gram figures not presented as an exemption or ownership limit.
- Response reviewed for names, numbers, attachments and requested relief.
- Transaction ID, acknowledgment and complete submission preserved.
Frequently Asked Questions
Is jewellery below 500 grams automatically exempt from tax?
No. The Government of India’s 1 December 2016 clarification described 500 grams for a married woman, 250 grams for an unmarried woman and 100 grams for a male family member as quantities ordinarily not seized during a search under CBDT Instruction No. 1916. They are not ownership limits, tax exemptions or proof that the acquisition source is explained.
Does inherited jewellery have to be within the gram limits?
No general holding limit applies to jewellery acquired from explained sources, including legal inheritance, according to the Government clarification. You should still identify the predecessor, approximate transfer period, owner and available inheritance or family evidence.
What if I have no purchase invoice?
State that the invoice is unavailable and explain why. Support the account with genuine secondary evidence such as bank records, older tax records, jeweller correspondence, family records or photographs, without creating or backdating documents.

Can I explain all household jewellery as family savings?
A label alone is weak. Identify the relevant earners, accumulation period, ownership of each item and income or savings history that makes the amount plausible. Connect the explanation to disclosed or exempt income where that is the factual source.
What should I do if the portal will not let me respond?
Check the due date and proceeding status, save a screenshot or other record of the problem, and contact the appropriate official channel promptly. Do not wait until the deadline expires, and do not assume an email by itself substitutes for the prescribed submission.
Can I edit a response after submitting it?
Portal help states that a submitted response cannot be edited. Review the year, section, figures, names, attachments and requested relief carefully before submission, then preserve the transaction ID and acknowledgment.

No. They relate to search non-seizure guidance. The notice may concern a different proceeding, provision, year or valuation issue, so the document and applicable law control the response.

The Bottom Line
Respond to the allegation in the notice, not to the 500/250/100-gram myth. Identify each owner, explain the acquisition source and timing, reconcile quantity and valuation, disclose missing records honestly, attach genuine corroboration, and submit a carefully checked response through the prescribed portal before the deadline. Preserve the acknowledgment and obtain case-specific professional advice when the dispute is material or has moved beyond an initial query.
