How to Respond to an Income Tax Notice About an Undisclosed Property Purchase

First, verify the communication in your income-tax e-Filing account and read the complete notice before replying. “Undisclosed property purchase” may describe an information mismatch or a request to explain funding; it is not, by itself, a finding that you concealed income or committed a tax offence. Your response depends on the issuing authority, notice section, tax year, exact question, and deadline shown in the official portal.

1. Verify the notice before doing anything else

Do not use a login link in an unexpected email or text message. Open the Income Tax Department’s e-Filing portal independently, sign in, and look for the communication in the relevant Pending Actions or e-Proceedings area. Download the notice PDF and save the portal status page.

Check these details exactly as displayed:

  • the issuing authority and office;
  • the notice section or communication type;
  • the assessment year or tax year concerned;
  • the property address, registration details, consideration and ownership information quoted;
  • the response deadline and any instructions about the submission route;
  • the document identification number (DIN), reference number or other identifier, if stated; and
  • the precise information, explanation or documents requested.

The e-Proceedings user manual explains how registered users and authorised representatives can view and download supported notices, submit a response and attach documents. A message that cannot be found in your account should be independently verified with the Department before you disclose personal or financial information.

2. Identify what kind of communication you received

The Department uses several separate services. An automated information prompt is handled differently from a statutory assessment or reassessment proceeding. Treating every message as a final accusation can lead to an unnecessarily defensive response; ignoring a formal notice can cause missed deadlines and adverse action.

Communication or route What it generally seeks How to approach it
AIS or TIS information Review of transaction information reported by financial institutions, registrars or other reporting entities Check whether the property entry is accurate and use the available feedback or response facility shown in the portal.
SFT preliminary response Confirmation or correction of information reported under the Statement of Financial Transactions framework Compare the reported particulars with the deed, payment records and ownership share; answer the specific fields requested.
E-campaign or e-Verification prompt Clarification of information that appears inconsistent with the Department’s records Provide a factual explanation and relevant records through the route attached to the communication.
Request for information or documents Particular records or explanations sought by an assessing authority Reply point by point and attach only documents that answer the listed questions.
Assessment proceeding Examination of income, transactions or return particulars under a statutory proceeding Follow the notice section, procedural directions and deadline; obtain professional advice when facts or law are disputed.
Reassessment communication Possible reassessment of an earlier tax year under the law applicable to that year Check the tax year and transition rules before relying on any section number, notice period or remedy.

The Department’s portal lists AIS, TIS, SFT preliminary response, e-campaign, e-Verification and e-Proceedings as distinct service areas. Select the exact item attached to your communication rather than choosing a general response option.

3. Check which tax law applies to the year in the notice

Do not copy a section number or deadline from a current article or an older notice without checking the relevant tax year. The Income-tax Act, 2025 reassessment provisions apply to tax years 2026–27 and later, according to the Department’s current reassessment guidance. Earlier tax years may continue under the Income-tax Act, 1961, subject to transition provisions.

That distinction matters because the governing Act can affect the statutory section, notice conditions, limitation rules and available procedural responses. Write the tax year at the top of your working file, then use the section and instructions printed in your own notice. If the communication covers more than one year, treat each year separately and do not assume that one response or one deadline applies to all of them.

4. Reconcile the property transaction

Build a chronology before drafting an explanation. Use the registered conveyance deed or agreement, registration records, bank entries and loan documents to create one consistent account of what happened.

Record the transaction dates and terms

  • agreement date and registration date;
  • date and amount of each instalment or advance;
  • date of possession, construction stage or handover, where relevant;
  • stated consideration, registration charges and other amounts referred to in the notice; and
  • the exact buyer names and ownership shares.

Compare the notice with the deed

Mark every mismatch instead of writing that the purchase was simply “disclosed.” For example, the notice may show the full consideration against one buyer even though two people own the property, may use a booking date rather than the registration date, or may contain an incorrect address or payment amount. State the precise difference, explain why it occurred, and attach the record that resolves it.

Separate ownership from payment

Prepare a schedule showing each owner’s percentage, the amount that person was required to contribute and the payments actually made. Where one co-owner paid on behalf of another, explain the arrangement and provide the transfer or reimbursement trail. A deed can establish ownership and consideration, but it does not by itself establish the tax source of every payment.

5. Trace the money with contemporaneous evidence

The central question in many property inquiries is not only whether the asset exists, but how the purchase was funded. Gather records that match your actual sources; there is no universal document bundle that fits every notice.

Bank and payment records

  • bank statements for the accounts from which instalments, advances, registration charges or related payments were made;
  • account-to-account transfer details, cheque images or payment confirmations where available; and
  • a reconciliation tying each payment to its date, amount, payer, payee and supporting statement page.

Borrowed funds

If a loan financed all or part of the purchase, include the sanction letter, loan account statement and lender disbursement evidence. Match each disbursement to the corresponding seller or developer payment. If the lender paid directly, say so rather than presenting the transaction as a transfer from your personal account.

Sale proceeds or earlier assets

For funding from a previous sale, identify the asset, sale date, consideration received and account into which the proceeds were credited. Include the earlier purchase or ownership record and the sale agreement or deed when relevant to the question. Your income-tax returns or capital-account records may help explain the availability of funds if the notice asks about accumulation or declared income.

Gifts, inheritance and co-owner contributions

Use a gift deed, bank trail and donor details where a genuine gift was involved. For inherited money or assets, provide the probate, succession, will, family settlement or other record that actually exists. For a co-owner’s contribution, identify the co-owner, amount and transfer path. Do not label an unexplained credit as a gift or inheritance merely because that description would be convenient.

Explain gaps instead of recreating records

Older accounts may be closed, statements may be incomplete, or a developer may have issued revised receipts. Describe the gap, state what corroborating evidence is available and request additional time only through the route permitted by the notice. Never create documents after the fact, alter a statement or make an unsupported source-of-funds assertion.

6. Use an evidence schedule that the officer can follow

An indexed reconciliation is usually more useful than a large, unlabelled upload. Create a table in your working papers and refer to its row numbers in the response.

Payment date Amount Payer and account Purpose Funding source Attachment reference
Use the date shown on the bank or payment record Use the exact amount and currency Name the account holder and masked account reference Advance, instalment, registration charge or other stated purpose Salary savings, loan, sale proceeds, gift, inheritance or another factual source Use a consistent file name or page reference

Attach the registered deed or agreement, proof of consideration, ownership-share evidence, bank and transfer records, loan papers, and other source documents only when they relate to the notice. Remove irrelevant personal data where the portal or law permits, but do not obscure information needed to match the transaction.

7. Draft a point-by-point response

Mirror the notice’s numbering. A clear response lets the officer see what is accepted, what is disputed and which attachment supports each sentence.

  1. Identify the communication. State the reference number, tax year, property and date of the notice.
  2. Answer each question separately. Put the answer immediately below the corresponding question or allegation.
  3. State agreed facts. Confirm accurate details such as the registration date, consideration and ownership share.
  4. Describe each discrepancy precisely. Give the correct figure or date and explain the source of the mismatch.
  5. Explain the funding trail. Summarise the payment schedule and identify the attached bank, loan, sale, gift or inheritance records.
  6. Address missing or unavailable records. Explain why a record is unavailable and identify alternative evidence rather than guessing.
  7. Follow any special instruction. If the notice asks for a return, correction, declaration or particular form, comply only after checking that the action is legally available for that tax year.
  8. List attachments. Use file names that match the references in the text and keep a copy of the complete submission.

Do not use a generic statement such as “the property was disclosed” when the question concerns the source of money. Conversely, do not volunteer an admission that is not supported by the records. Be accurate, concise and complete.

8. Submit through the correct portal route

Open the communication in Pending Actions or e-Proceedings and use the response button shown for that item. Depending on the communication, the portal may provide fields for a written explanation, document uploads, a declaration and submission or verification. Follow the on-screen file-size, format and naming requirements.

  1. Review the response against the downloaded notice and your evidence schedule.
  2. Upload the relevant attachments and confirm that each file opens correctly.
  3. Submit using the portal’s final submission control and complete any verification step requested.
  4. Download or print the acknowledgement, submitted text, attachment list and transaction ID.
  5. Store the notice, response and proof together with a record of the submission date and time.

The Income Tax Department’s e-Proceedings FAQ says a response cannot be edited after it is submitted. Treat the final review as irreversible. If you discover an error afterward, use the communication’s available follow-up or contact route; do not assume that uploading a second response replaces the first one.

9. Do not wait for the last day

The deadline printed in the notice is not the only practical constraint. The Department’s current e-Proceeding help information says that, for an open proceeding, online submission may stop seven days before the proceeding’s limitation date at 6 PM, although the authority may re-enable submission. The notice screen and any officially granted extension control your case.

Submit well before both the stated deadline and any portal shut-off shown on screen. Technical failures, rejected attachments, missing verification and a need to obtain a bank or lender record can consume several days. Take a screenshot or download confirmation if the portal reports a successful submission, and retain the transaction ID.

10. Decide when to appoint a professional

A qualified Indian chartered accountant or tax lawyer with assessment and reassessment experience is sensible when the facts or potential consequences are significant. An authorised representative can respond through e-Proceedings after the required authorisation is completed.

Professional help is especially important when:

  • the notice alleges unexplained investment, undisclosed income or concealment rather than asking for a simple correction;
  • payments came from several people, cash-intensive activities, overseas accounts, trusts or layered transfers;
  • bank records, AIS or third-party information conflict with the deed or your return;
  • the matter is a formal assessment or reassessment, or more than one tax year is involved;
  • a penalty, prosecution or other enforcement consequence is mentioned;
  • the response deadline is close and records are incomplete; or
  • you are unsure whether a revised return, updated return, objection or other remedy is legally available.

Representation does not guarantee that tax, interest, penalty or other consequences will disappear. Give the adviser the complete notice, portal history, chronology, returns and source documents, not just the first page or a summary email.

11. Common mistakes and the safer alternative

Mistake Why it creates risk Safer approach
Replying from an email link without checking the portal You may disclose information to a fraudulent sender or miss the real proceeding Sign in independently and verify the communication in your account.
Assuming “undisclosed” proves wrongdoing The issue may be a data mismatch, timing difference or co-owner allocation Identify the exact allegation and answer the factual question asked.
Sending only the deed The deed may show ownership and consideration but not the source of payment Add the payment and funding trail relevant to the notice.
Uploading every financial record you possess Irrelevant material can obscure the explanation and expose unnecessary personal data Use an indexed, question-by-question set of attachments.
Copying a deadline or section from another case Tax-year rules and notice types differ Use the section, tax year and deadline printed in your communication.
Waiting until the final day Portal cut-offs, file errors or missing records may prevent submission Prepare and submit early, then preserve the acknowledgement.
Submitting a rushed response and planning to edit it later The Department says submitted responses cannot be edited Proofread the final text and attachment list before submission.
Inventing a source for an unexplained credit An unsupported explanation can create a larger credibility and tax problem State what is known, provide corroboration and obtain professional advice.

12. A practical decision path

  1. Can you find the notice in the official portal? If not, verify its authenticity before responding.
  2. Is it an information prompt, e-campaign or e-Verification item? Use that service’s response screen and correct or explain the data requested.
  3. Is it a statutory assessment or reassessment notice? Note the section and tax year, then consider professional advice before making admissions or choosing a remedy.
  4. Is the property detail wrong? Lead with the deed, registration and ownership mismatch, supported by records.
  5. Is the property correct but the funding unclear? Lead with the payment schedule and source-of-funds evidence.
  6. Can the full response be supported before the portal deadline? Submit the complete, indexed response early; if not, follow the notice’s extension or communication procedure rather than remaining silent.

Keep the final notice, chronology, reconciliation, attachments, acknowledgement and transaction ID in one case file. If another communication arrives about the same property, compare its reference and tax year with the earlier submission before responding.
