Do not ignore the notice or assume that insolvency cancels the tax issue. First identify whether the document is a show-cause notice, an adjudication order or a recovery action; then record service and tax-period dates, map the periods against the insolvency commencement date and any resolution-plan approval, answer the GST computation on its merits, and separately assert the Insolvency and Bankruptcy Code (IBC) consequences that actually apply. Because deadlines, moratorium scope and plan treatment are fact-specific, have an Indian GST and insolvency professional review an active matter—especially an order, recovery step or approved plan.
What to do first
Preserve the complete electronic and paper record before drafting anything. Download the notice and every annexure from the GST portal, save the portal acknowledgement and communication history, and retain the email, physical-delivery record or other evidence showing when and how the company received it. The date of issue is not always the date from which a reply or appeal is calculated.

At the same time, obtain the insolvency file: the National Company Law Tribunal (NCLT) admission order, insolvency commencement date, moratorium order, resolution professional’s (RP’s) details, claim invitation, the GST department’s claim and any resolution-plan approval or liquidation order. A company being financially distressed, or merely having filed an application, does not by itself prove that the corporate insolvency resolution process (CIRP) has commenced.

Classify the GST communication before choosing a remedy
| Document or stage | What it usually does | Immediate response |
|---|---|---|
| Show-cause notice or statement proposing tax, interest or penalty | Invites a representation before an order is made. Rule 142 materials refer to electronic summaries such as DRC-01 or DRC-02 for covered notices or statements and DRC-06 for a representation; confirm the current rule and the form shown in the notice. | File a point-by-point reply through the currently prescribed channel by the stated or statutory deadline, attach evidence, and request a personal hearing in writing where appropriate. |
| Adjudication order or demand summary | Confirms an amount or otherwise decides the proceeding. It may be accompanied by a DRC-07 or DRC-07A summary. | Check communication date, payment or recovery instructions, rectification possibilities and the separate appeal route under section 107. Do not treat a reply to the old notice as an appeal. |
| Recovery communication or attachment step | Seeks collection of an amount already treated as payable, or acts against property, accounts or receivables. | Identify the legal authority and person targeted, raise any applicable moratorium or plan issue immediately, and obtain urgent advice on a stay, appeal or other remedy. |
Write down the statutory section cited, document number, issue date, actual service or communication date, tax periods, tax heads, interest and penalty calculation, reply deadline, previous replies, and any earlier order. The official CGST Rules text contains the Rule 142 framework and forms, but the form and rule version displayed on the current portal and in the notice control your filing mechanics.

Build a single insolvency and tax timeline
Create a dated chronology before arguing either law. At minimum, include:
- GST registration details, return periods and the first date of each alleged default;
- audit, inspection, investigation, demand or correspondence dates;
- CIRP admission and insolvency commencement date;
- moratorium order and any later modification or termination;
- RP appointment, contact details and claim-invitation deadline;
- the GST department’s claim submission, revisions, admission or rejection and supporting schedules;
- resolution-plan submission and approval date, or liquidation commencement date; and
- the date of the new notice, order, recovery action or implementation communication.
Then label every GST line item as (1) before CIRP commencement, (2) during CIRP, or (3) after plan approval or another later insolvency event. A demand can contain several periods, so do not apply one insolvency conclusion to the entire amount.
Understand what the moratorium does—and what it does not do
IBC section 14 addresses specified proceedings and recovery actions against the corporate debtor, subject to the section’s terms and exceptions. It is not a universal prohibition on every GST letter, inquiry or proceeding, and it does not automatically protect directors, guarantors, transferees or other third parties. The correct analysis asks:
- Is the corporate debtor, or someone else, the person named?
- Does the act impose or recover a pre-CIRP claim, concern a later tax period, or perform an administrative function?
- Is the step a notice, adjudication, attachment, sale or another form of recovery?
- Does section 14 contain an applicable exception, or has an NCLT or appellate court order addressed the point?
Use the official IBC text and the actual moratorium order rather than relying on a broad statement that “all GST action is stayed.” If an officer continues a coercive step against the corporate debtor, have counsel send the order, chronology and claim details to the officer and RP promptly and consider the appropriate NCLT or appellate remedy.
Separate pre-CIRP dues from later tax periods
CBIC Circular No. 134/04/2020-GST, dated 23 March 2020, gives the central administrative position for GST dues arising before CIRP. It states: “The dues of the period prior to the commencement of CIRP will be treated as ‘operational debt’ and the claims may be filed by the proper officer before the NCLT in accordance with the provisions of the IBC.” Read the complete CBIC Circular 134/04/2020-GST.

For those pre-CIRP amounts, ask the RP for the GST claim as filed, the period-wise computation, documents relied on and status in the claims register. Compare that schedule with the notice. The circular also addresses coercive action against the corporate debtor for pre-CIRP dues during the relevant insolvency process and says GST registration should not be cancelled merely because CIRP has commenced, while noting that suspension may be considered where needed. Those statements do not decide the merits of the tax or the treatment of every later-period liability.
Tax arising from supplies, returns or events during CIRP may have a different treatment from an old operational-debt claim. Keep current-period returns, invoices, e-way records, payment challans and RP instructions separate so that a dispute about an historical claim does not obscure ongoing compliance.
Test the demand on GST merits, line by line
Insolvency status is not a substitute for a tax defence. Build a reconciliation that a tax officer, RP and appellate authority can audit:
| Notice allegation | Company’s factual check | Evidence to attach | Requested result |
|---|---|---|---|
| Short payment or turnover difference | Match the allegation to outward-supply returns, sales ledger, invoices, credit notes and payment records. | Return extracts, invoice register, ledger, bank or challan proof and reconciliation. | Delete unsupported turnover, correct arithmetic or accept only the verified amount. |
| Input-tax-credit reversal or ineligibility | Match each disputed invoice to purchase records, supplier data where relevant, receipt of goods or services and reversal already made. | Invoices, goods-receipt records, purchase ledger, payment proof, reversal workings and correspondence. | Allow eligible credit or recalculate the disputed portion and related interest. |
| Interest or penalty | Recompute from the legally relevant dates and identify payments, amendments and voluntary reversals. | Challans, return filing logs, interest computation and payment allocation. | Remove amounts not supported by the cited provision or correct the calculation. |
| Classification, exemption or place-of-supply issue | Compare the facts of each supply with the cited statutory entry and contractual documents. | Contracts, invoices, shipping or service records and explanatory schedules. | Apply the correct classification, rate, exemption or place-of-supply rule. |
For every disputed item, state the amount, the factual correction, the document proving it and the legal reason. Quote the notice paragraph or annexure number so the reply can be checked quickly. If the proposed determination could be adverse, make a clear written request for a personal hearing where the applicable provision allows or requires one. The general CGST adjudication framework requires the order to remain within the amount and grounds set out in the notice; verify the exact provision and current wording in the official CGST Act text before relying on a particular subsection.
If a resolution plan has been approved
Obtain the complete resolution plan and NCLT approval order, not just a summary or the successful-resolution-applicant’s letter. Mark:

- the GST periods covered;
- the amount claimed by the department and the amount admitted or disputed;
- the amount provided for, compromised or omitted;
- conditions for payment, release or extinguishment; and
- any direction concerning pending assessments, appeals, records or implementation.
IBC section 31 makes an approved plan binding on specified stakeholders, including government authorities, but the practical outcome depends on the plan, approval order, claim history, tax period and the identity of the person proceeded against. The Supreme Court’s discussion of Ghanshyam Mishra & Sons explains the binding effect and the treatment of claims; read the official judgment PDF with the actual plan and order.
Do not write that every demand automatically disappears after approval. A demand may concern a period or person outside the plan, a claim may not have been lodged or may be disputed, and a later assessment can raise a separate procedural question. Ask the jurisdictional officer to apply the plan and approval order to the exact demand, while preserving all merits objections.
CBIC Circular No. 187/19/2022-GST, dated 27 December 2022, addresses a specific mechanism: where the IBC outcome reduces statutory dues underlying a confirmed demand summary in DRC-07 or DRC-07A, the jurisdictional Commissioner should issue DRC-25 to intimate the reduction. Compare the demand summary, plan treatment and approved amount, then request the appropriate DRC-25 action. The circular is available at CBIC Circular 187/19/2022-GST.
Choose the procedural route that matches the stage
Show-cause notice
- Confirm the reply deadline and filing channel shown on the portal or notice.
- Explain threshold objections, period errors, limitation issues only after checking the current law, and each factual and computational correction.
- Attach an indexed reconciliation and insolvency chronology.
- State the CIRP date, moratorium order and RP details without presenting insolvency as the only defence.
- Request a personal hearing in writing where appropriate and preserve the acknowledgement.
Adjudication order
Read the order against the notice: identify additions, new grounds, arithmetic changes, interest and penalty. Then calculate the appeal deadline from the date the order was communicated, not merely its issue date. Section 107 generally provides three months from communication for an appeal by an aggrieved person, with a possible further period not exceeding one month where sufficient cause is shown. The section also requires payment of admitted amounts and a pre-deposit calculated on the disputed tax for the specified appeal. The exact amount, cap, later amendments and portal steps must be checked before filing in the current version of the CGST Act and the CBIC appeal rules and forms.
Do not wait for negotiations with the RP or department to consume the appeal period. A plan discussion, claim correction or request for DRC-25 does not automatically extend the statutory deadline.

Recovery action
Identify the exact recovery provision, property or account affected, amount demanded and person named. Send the officer and RP the relevant moratorium or plan documents, but also seek urgent advice on a stay, appeal, rectification or NCLT application. If the action is against a director, guarantor, transferee or another person, analyse that person’s independent liability; the corporate-debtor moratorium does not answer every third-party question.
Use this response-file checklist
- Complete notice, annexures, DRC summary and portal communication history.
- Proof of actual service or communication and a deadline calculation.
- Period-wise return, invoice, ledger, input-tax-credit and payment reconciliation.
- Earlier audit, investigation, reply, order, appeal and payment records.
- CIRP admission and moratorium orders, RP appointment and contact details.
- GST claim filed with the RP, acknowledgements, admission or rejection and correspondence.
- Full resolution plan, NCLT approval order and implementation or liquidation documents.
- Any DRC-25, recovery notice, bank attachment or other enforcement correspondence.
- Proof of every portal filing, email delivery, hearing request and acknowledgement.
Use one index and consistent file names. Keep the tax-period schedule in an editable format so the RP, tax adviser and counsel work from the same numbers. Preserve the original portal downloads and metadata; a later screenshot without service evidence may not establish when the clock began.

Assuming “insolvency” means no reply is needed
A notice can still require a merits response, and an order can still trigger an appeal deadline. File the procedural response while separately invoking the relevant IBC position.
Treating the moratorium as a blanket shield
Section 14 is targeted and conditional. Check the action, period, named person and exceptions rather than asserting that every communication is void.

Relying on a plan summary
Only the operative plan and approval order reveal what was claimed, admitted, provided for or released. Obtain both before requesting deletion or reduction of a demand.
Using an outdated limitation rule
The official CBIC Act page reviewed for this guidance presents sections 73 and 74 but does not establish the current section 74A text, commencement or transitional application. Before stating which demand provision or limitation period governs, check the consolidated CGST Act and amendment or commencement material against the tax period and notice issue date.
Ignoring third-party exposure
A proceeding naming a director, guarantor, transferee or another person requires a separate analysis of that person’s liability, defences and deadlines. Do not assume the corporate debtor’s moratorium resolves it.

| Key fact | Likely priority | Evidence or question to resolve |
|---|---|---|
| Notice only, deadline still open | File a reasoned GST reply and hearing request; include the insolvency chronology. | Service date, form, statutory section and period-wise reconciliation. |
| Order communicated recently | Protect the section 107 appeal period and calculate pre-deposit while evaluating merits and plan treatment. | Communication proof, admitted tax, disputed tax and current filing rules. |
| Pre-CIRP claim during moratorium | Verify the RP claim and challenge coercive recovery against the corporate debtor where the IBC and circular apply. | Claim register, moratorium order, department computation and named debtor. |
| Approved plan covers the demand | Compare plan, approval order, claim and DRC-07/DRC-07A; request DRC-25 where Circular 187 applies. | Exact period, admitted amount, plan provision and Commissioner’s jurisdiction. |
| Recovery against another person | Obtain individual legal advice immediately; do not rely solely on the corporate moratorium. | Noticee identity, statutory basis, guarantee or transfer documents and separate deadlines. |
When professional review is essential
Obtain advice from a practitioner experienced in both Indian GST and insolvency when the notice is near its deadline, an order has already been passed, recovery has begun, the amount is material, the plan was approved, the department’s claim differs from the notice, or the action names anyone other than the corporate debtor. Give the adviser the indexed file rather than a narrative alone. The adviser should verify the current CGST provision, transitional rules, appeal pre-deposit, portal procedure, moratorium scope and the plan’s binding language before recommending a filing.
Official texts and dates to verify
- Central Goods and Services Tax Act, 2017 (CBIC text) — verify the provision and current amendments for the relevant tax period and notice date.
- CGST Rules PDF (India Code) — Rule 142 and related forms; confirm the current version.
- Insolvency and Bankruptcy Code, 2016 (India Code) — sections 14 and 31, subject to the enacted text and later amendments.
- CBIC Circular 134/04/2020-GST — dated 23 March 2020; pre-CIRP GST claims and related treatment.

- Supreme Court judgment PDF — discussion of the binding effect of an approved plan under section 31.
- CBIC appeal rules and forms — verify the current filing mechanics.
These materials do not replace advice on a live dispute. The legally safe response is a coordinated one: protect the GST deadline, prove the tax computation, submit or verify the insolvency claim, and apply the moratorium or approved plan only to the periods, persons and actions that the documents actually cover.
