If your deceased spouse’s federal return was filed late, first file every required return and read the IRS penalty notice line by line. The notice identifies the penalty, tax period, amount and response method. Then ask for the relief route that fits—automatic administrative relief if the period qualifies, reasonable-cause abatement when circumstances prevented timely compliance, or another process if the dispute concerns joint tax liability rather than lateness. Death by itself does not automatically cancel a penalty.
Start by separating the returns and the problem
A surviving spouse or the decedent’s personal representative may have to file a late return for a year before death as well as the final return for the year of death. Those are separate filing obligations. The final federal return generally follows the ordinary filing rules, with the appropriate deceased-taxpayer notation and signature based on whether a personal representative was appointed. The Internal Revenue Service explains the final-return process in Filing a final federal tax return for someone who has died, Publication 559, and its signing-the-return guidance.

A late prior-year return is not made current merely because the final return was filed. List each delinquent year, whether a return was filed, the tax shown or paid, and every IRS notice you received. Penalty relief is requested for a particular penalty and period, not for a vague account balance.
Recommended Free Tools
Separate the filing task from the penalty task. A return can remain required even if the estate believes no tax is owed, and an abatement request does not replace a missing return. If several years are involved, create a worksheet with the tax form, filing deadline, actual filing date, tax due, payments, notice number and current balance for each year.

Read the IRS notice before choosing a form or phone call
The IRS’s starting instruction is to follow the notice you received. Its Penalty relief page says the notice tells you what penalty was assessed, for which period, the amount, and how to respond. Some requests can be handled by phone. If the IRS cannot approve relief by phone, it may tell you to submit a written request; a written request is often made on Form 843 when that form fits the penalty.
Make a working copy of the notice and mark:
- the tax form and tax period covered;
- whether the charge is failure to file, failure to pay, failure to deposit, or another penalty;
- the response deadline and mailing or telephone instructions;
- the amount of penalty, tax and interest shown separately; and
- any authorization, signature or documentation the notice demands.
Use the address or telephone route printed on the notice rather than guessing at a general IRS destination. Keep proof of mailing, fax transmission or an online submission confirmation. If you call, record the date, representative identification if provided, topics discussed and any instruction to send additional documents. A phone conversation does not eliminate the need to file the return or make payments that are not in dispute.
Identify the relief route that matches your facts
| Situation | Possible route | What controls the result |
|---|---|---|
| Eligible original return and clean prior compliance history | Automatic Exemption from Penalty (AEP), during the IRS’s 2026 transition | Eligibility rules for the tax period, timely filing and payment history, and the penalties covered by AEP |
| Illness, death-related disruption, missing records or another event prevented timely compliance despite ordinary care | Reasonable-cause relief | The complete facts, dates, corrective actions and supporting evidence; the IRS decides case by case |
| Written abatement request for a penalty that Form 843 covers | Form 843, Claim for Refund and Request for Abatement | The form’s exclusions, the notice instructions, representative authority and required signatures |
| Dispute is about a joint return’s understated tax or unpaid joint liability, rather than a late-filing or late-payment penalty | Innocent-spouse, separation-of-liability or equitable-relief process, generally Form 8857 | The joint-liability facts and the requirements described by the IRS |
These routes address different problems. Do not use an innocent-spouse request to replace a late-return penalty-abatement request, and do not send Form 843 until you know the notice and the form instructions permit it. Identify the tax period first, because an administrative program may cover one period while another requires a fact-specific written explanation.

File each unfiled prior-year return
Prepare and submit every return the decedent was required to file for earlier years. Use the tax law and filing status that applied to each year, not merely the rules for the year of death. If records are incomplete, reconstruct income, withholding, deductions and payments from available statements and request transcripts through the IRS procedures available to the authorized representative. The return should be filed even while a penalty dispute is pending; an abatement request does not substitute for a missing return.
Attach explanations only where the return instructions call for them. Do not hold a completed return indefinitely while waiting for the IRS to decide an abatement request. Filing establishes the missing compliance record and lets the IRS calculate the penalty accurately.

Prepare the final return separately
The final return reports income through the date of death and is filed under the ordinary rules, with the deceased notation and the signature required for the estate’s representative or surviving spouse. IRS final-return guidance and Publication 559 explain when an executor, administrator or other personal representative signs and when a surviving spouse may sign.
Confirm who has authority to act
Gather the appointment document or other proof of representative authority. The IRS’s signing guidance distinguishes a court-appointed personal representative from a person acting under other authority. That status matters for both the return and a later penalty-abatement submission. Keep the authority document consistent with the name and capacity used on the return, notice response and any Form 843.

The IRS states that you may qualify when you tried to comply with tax laws but were unable because of circumstances beyond your control. Its reasonable-cause guidance says the determination is made case by case, considering all facts and circumstances. A concise chronology is more useful than a general statement that the taxpayer died.
- State the penalty and period. Quote the notice number, tax form, year or period, penalty type and amount. Ask for abatement of that penalty under reasonable cause.
- Give the dates. Explain when the spouse became ill or incapacitated, when death occurred, when records became available, when an executor or other responsible person was appointed, and when the return was filed and tax paid.
- Explain responsibility and the obstacle. Identify who normally maintained records and handled tax filings, what changed because of illness or death, and why ordinary care and prudence could not overcome the disruption.
- Describe your response. List attempts to obtain records, contact preparers or institutions, secure authority, reconstruct information, file the return and pay the tax. Explain what remained impossible and why.
- Show prompt correction. State when the obstacle ended and how soon afterward the return was filed, payment arranged or missing information supplied.
- Attach supporting records. Include documents that substantiate the dates and actions described, such as medical or death records, representative-appointment papers, correspondence about unavailable records, filing confirmation and payment evidence. Keep originals and send copies unless the notice says otherwise.
Write the explanation for the specific tax year. A family’s disruption may explain one late return but not automatically every later period; explain the facts separately when the dates or responsible people changed. If the return was filed late because tax records were held by a preparer, bank or former adviser, identify the requests you made and the dates of follow-up rather than simply blaming the third party.
Understand the penalties before asking for relief
The IRS’s collection-procedural FAQ says the failure-to-file penalty is generally 5% of unpaid tax for each month or part of a month, capped at 25%. When failure-to-pay also applies in the same month, the combined monthly rate is generally 5%—4.5% failure to file plus 0.5% failure to pay—subject to the applicable caps. The minimum failure-to-file penalty after a return is more than 60 days late varies by tax year; the FAQ gives $525 for returns required to be filed in 2026. These are general rules, not a calculation of your notice. See the IRS collection procedural questions for the qualifications and current figures.

Check whether the notice lists more than one penalty. Relief for failure to file does not automatically remove a separate failure-to-pay or failure-to-deposit charge; address each listed penalty under the route that applies. The amount can also change as payments are credited or the IRS adjusts the return.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesPenalty relief does not usually erase the underlying tax. The IRS says interest charged on a penalty is reduced or removed when the related penalty is reduced or removed, but other tax and interest liabilities can remain. Check the notice’s account transcript or updated balance after any abatement is processed. Continue paying undisputed tax or maintain an approved payment arrangement while the request is pending.
Check the 2026 automatic-relief transition carefully
In a July 30, 2026 announcement, the IRS said Automatic Exemption from Penalty (AEP) is replacing the longstanding First Time Abate administrative relief for eligible periods. The announcement describes AEP for eligible original returns beginning with tax year 2025. It requires a history of filing on time and paying tax due for the previous three years, or 12 consecutive quarters for quarterly filers, and covers specified failure-to-file, failure-to-pay and failure-to-deposit penalties. Read the IRS announcement, Eligible taxpayers may receive automatic penalty relief, together with your notice.
The transition is period-sensitive. The IRS says some eligible taxpayers may still receive notices while the system changes and may contact the IRS about First Time Abate. If you do not qualify for AEP, you may still request reasonable-cause relief. Do not claim AEP eligibility solely because the spouse died or because the account has no recent penalties; verify the covered return, penalty and compliance history. A clean history must be measured against the program’s stated three-year or 12-quarter period, not just against the years for which you personally handled the estate.
Use Form 843 only when its instructions fit
Instructions for Form 843 (12/2024) describe the form as a vehicle for abating certain penalties, but instruct taxpayers not to use it to abate income tax, estate tax or gift tax. The notice may prescribe a different response. If the IRS tells you to make a written claim, complete the current form, identify the penalty and period, explain the legal and factual basis, and attach the notice and evidence requested.

Representative and signature issues
The Form 843 instructions require a legal representative filing for a decedent to provide evidence of authority or, in specified circumstances, a statement that representative status continues. The instructions also reference Form 1310. For an abatement relating to a joint return, the instructions say both spouses must sign. A deceased spouse cannot sign, so do not improvise a signature or assume the surviving spouse’s signature is enough; confirm the correct procedure with the current instructions and the IRS using the representative status shown on the return and notice.
Mail a complete package
- Place the signed Form 843 and a copy of the penalty notice first.
- Identify the return, period, penalty type and amount in the explanation.
- Attach the reasonable-cause chronology and supporting documents in date order.
- Include proof of authority for the estate representative and any other form the instructions require.
- Use the notice’s mailing address and retain a complete copy and delivery proof.
If more than one year is involved, send a clearly labeled package for each notice unless the notice expressly permits consolidation. Keep a log showing what was sent, when it was sent and which IRS notice it answers.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Do not confuse penalty abatement with spouse-liability relief
Penalty abatement concerns charges for filing, paying or depositing late. A different problem arises when a joint return understated tax because of a deceased spouse’s erroneous income, deductions or credits, or when the IRS seeks unpaid joint-return tax. The IRS describes innocent-spouse, separation-of-liability and equitable relief on its Equitable relief page and identifies Form 8857 for that process. Form 8857 does not replace a request to remove a late-filing or late-payment penalty.
Common failure points and how to correct them
- Filing only the final return: Make a year-by-year list and submit earlier delinquent returns separately.
- Assuming death automatically waives the charge: Explain the specific circumstances, ordinary-care efforts and dates; the IRS applies a case-by-case standard.
- Sending Form 843 automatically: Follow the notice first and check the form’s exclusions.
- Ignoring representative status: Include appointment or authority evidence and resolve the deceased-spouse signature issue before mailing.
- Requesting relief for the wrong issue: Use Form 8857-related spouse-liability procedures for an understatement or joint tax balance, not for lateness.
- Using one explanation for every year: Tie each request to the facts and period shown on that year’s notice.
- Overstating what happened: State only what records support; unexplained gaps in the timeline can undermine an otherwise valid request.
- Stopping after filing the request: Keep paying or arranging payment of undisputed tax and monitor notices; an abatement request does not automatically suspend every collection action.
A practical submission checklist
- Every required prior-year return and the final return filed or ready to file.
- Each IRS notice, with penalty type, period, amount and response deadline highlighted.
- A chronology covering illness or death, records, authority, filing and payment.
- Evidence supporting the chronology and prompt corrective action.
- Representative appointment or other authority documents.
- Current Form 843 only when the notice and instructions call for it, or the IRS confirms it is appropriate.
- A separate Form 8857 analysis if the real dispute is joint-return tax liability.
- Copies of everything sent, delivery proof and a log of IRS contacts.
When several years are delinquent, records are contested, or the estate has multiple representatives, a qualified tax professional can help map each return, penalty and signature requirement before submission.

Frequently Asked Questions
Does a spouse’s death automatically remove IRS late-filing penalties?
No. The IRS considers reasonable cause case by case. Explain the illness, death-related disruption, responsibility for records, efforts to comply and how promptly the return was filed after the obstacle ended.

Do I file the final return and the late prior-year return together?
They are separate obligations. File every required prior-year return and prepare the final return for income through the date of death under the ordinary filing rules.
Can I ask for penalty relief by phone?
Some notices permit a telephone request. Follow the contact instructions on the notice. If the IRS cannot approve relief by phone, it may direct you to make a written request, often on Form 843 when appropriate.
When is Form 843 appropriate?
Form 843 covers certain penalty-abatement claims, but its instructions exclude abating income, estate or gift tax. Check the notice and current instructions before using it.
What evidence supports reasonable cause?
Provide a dated chronology and copies of supporting records, such as medical or death documentation, appointment papers, correspondence showing attempts to obtain records, filing confirmation and payment evidence.
What is AEP, and does it replace First Time Abate?
The IRS announced in July 2026 that Automatic Exemption from Penalty is replacing First Time Abate for eligible periods. For eligible original returns beginning with tax year 2025, it generally requires timely filing and payment history for the prior three years, or 12 consecutive quarters for quarterly filers. Verify the current notice and eligibility.
Does penalty abatement eliminate the tax and all interest?
Usually not. Interest charged on a reduced penalty may also be reduced, but the underlying tax and other interest can remain due.
What if the problem is my deceased spouse’s joint-return tax liability, not lateness?
Consider innocent-spouse, separation-of-liability or equitable relief, generally requested on Form 8857. That process is separate from abating a late-filing or late-payment penalty.
