File the first appeal in Form 35, disclose that it is late, explain the delay chronologically under the “grounds for condonation of delay” field, and attach records supporting that explanation. Under section 249(3) of the Income-tax Act, 1961, the Commissioner (Appeals) may admit a late appeal only when satisfied that sufficient cause prevented timely filing. Condonation is discretionary, not automatic. Before using that section, confirm which tax year, Act and limitation rule govern your order, because the 1961 Act was repealed from 1 April 2026 but transition rules preserve it for specified earlier-year proceedings.
What a condonation request does
Condonation is permission to have a late appeal admitted despite expiry of the ordinary filing period. It does not decide whether the assessment, penalty or other order is correct. The appellate authority first considers whether the delay should be excused; only an admitted appeal proceeds to examination of the grounds challenging the order.

Section 249(3) of the Income-tax Act, 1961 says the Commissioner (Appeals) may admit an appeal after the prescribed period if satisfied that the appellant had “sufficient cause” for not presenting it within that period. The wording gives the authority judgment rather than creating an entitlement. The statutory text is available from the Income Tax Department.

Check the governing Act and tax year first
Do not copy a section number or deadline into a filing until you identify the relevant assessment or tax year, the order date, and the date the order or demand was served. The Income-tax Act, 1961 was repealed with effect from 1 April 2026. The Department’s transition FAQ states that proceedings relating to tax years beginning before 1 April 2026 continue under the 1961 Act, including appeals initiated on or after that date, subject to the transition provisions.
| Question | Why it matters | What to record |
|---|---|---|
| When did the relevant tax year begin? | It helps determine whether the 1961 Act framework continues under the transition rules. | The first day of the tax year and the applicable transition provision. |
| What order is being challenged? | The order type determines the limitation trigger and the documents required. | Assessment, penalty or other order; issuing authority; reference number; order date. |
| When was it served? | The 30-day period generally runs from service of the notice of demand for an assessment or penalty, and from service of the order in other cases. | Service date, method and proof such as portal delivery, email or acknowledgment. |
| Had the period already expired before 1 April 2026? | The transition FAQ says expiry before commencement is not revived merely because a new Act has a different or longer period. | Original deadline, date it expired and any available basis for a section 249(3) request. |

Calculate the ordinary deadline and the delay
The Department’s Form 35 information states a general first-appeal period of 30 days. For an appeal concerning an assessment or penalty, the period generally runs from service of the related notice of demand. In other cases, it generally runs from service of the order. The exact statutory trigger, permissible exclusions and any special rule must be checked against the particular order.

- Locate the operative document. Keep the order, notice of demand and service record together. An assessment appeal may use the demand notice date rather than the signature date on the assessment order.
- Identify day one. Record the service date that the applicable rule uses. If the portal shows multiple delivery events, preserve each record and explain which one you treated as service.
- Work out the 30-day period or other applicable period. Use the governing Act and order type, not a generic online calculator. Check whether a statutory exclusion applies.
- Compare the deadline with the actual filing date. Count the elapsed period precisely and state the number of days of delay in Form 35 and in your written explanation.
- Keep the calculation sheet. It lets the authority reconcile your statement with the service evidence and prevents an avoidable arithmetic objection.
If the period has not expired, file Form 35 within time and do not ask for condonation. If it has expired, file the appeal with the delay disclosure and grounds rather than sending only a separate letter.
Who decides the request
For the covered first appeals, the decision-maker is the Commissioner of Income Tax (Appeals) or Joint Commissioner (Appeals), as applicable. The e-Filing form routes the appeal to the authority with jurisdiction. Form 35 is not a substitute for an appeal to a different forum, such as a later-stage tribunal proceeding; confirm that your order is one for which Form 35 is prescribed.
Because section 249(3) uses “may,” the authority can reject a late appeal even when the underlying tax dispute appears arguable. A strong merits case does not by itself prove sufficient cause, and a request for condonation does not pause every other statutory consequence. Continue complying with any payment, stay or response requirement that applies to the order unless a competent authority grants relief.

Documents to assemble before opening Form 35
- Complete copy of the order being challenged, including annexures and computation sheets.
- Notice of demand for an assessment or penalty, plus proof of its service.
- Service records for the order or demand: portal download history, email headers, acknowledgment, or other reliable evidence.
- Statement of facts explaining the dispute in a neutral, chronological way.
- Numbered grounds of appeal that identify each legal or factual error relied upon.
- Evidence for every material part of the delay explanation, arranged in date order.
- Authority documents if a representative, legal heir, company officer or other signatory files the appeal.
- Working sheet showing the statutory deadline, actual filing date and days of delay.
- Readable copies of every attachment in the file format and size accepted by the portal.
The Department’s Form 35 User Manual identifies the order and demand notice, statement of facts, grounds of appeal and documentary evidence as core parts of the submission. Check the live portal instructions for current attachment limits and validation rules.
How to complete the late Form 35 filing
- Open Form 35 in the income-tax e-Filing portal. Select the appeal type and jurisdiction that correspond to the Assessing Officer’s order. Verify the taxpayer identification details before entering substantive information.
- Enter the order and service details. Use the reference number, date and service information from the records you assembled. Select the correct order category, because it affects the limitation trigger.
- Indicate that there is a delay. The Form 35 workflow asks whether the appeal is filed after the prescribed period. Answer truthfully and enter the calculated length of delay.
- Complete “grounds for condonation of delay.” Give a concise chronology in the form and use an attached signed statement if the portal field is too short. Explain the causal link between each event and the inability to file.
- Upload the supporting material. Attach the order, demand notice, statement of facts, grounds of appeal and evidence supporting the condonation explanation. Name files clearly and ensure scans are legible.
- Finish verification and e-filing. Complete the applicable verification by the taxpayer or authorized representative, submit the form and complete any electronic verification step required by the portal.
- Save the acknowledgment. Download the acknowledgment number, timestamp, submitted Form 35, condonation statement and attachment list. Keep the exact files that were transmitted.

How to draft convincing grounds for condonation
The explanation should be a truthful, dated account rather than a conclusion such as “there was a genuine difficulty.” Start with the service event, identify when the obstacle arose, describe what prevented filing, state when it ended, and show what you did next. The authority can then test whether the circumstances actually covered the whole period of delay.
Use a chronology
Present events in order and attach a matching record for each important date. If several events contributed, separate them instead of combining them into an undated paragraph. Say how the event affected access to records, instructions, a digital account, a signatory or professional assistance. Explain any gap between the end of the obstacle and the eventual filing.
Connect facts to the missed deadline
A medical record, travel document, technical notice or internal communication is useful only when the statement explains why it made timely filing impossible or impracticable. Avoid claiming that an event caused the entire delay if it accounts for only part of it. If the obstacle was discovered late, state when it was discovered and what immediate steps followed.
Show diligence after the obstacle ended
State when advice was sought, documents were collected, access was restored or instructions were obtained, and when Form 35 was prepared. Prompt action after the impediment ceases supports the factual account, but it does not guarantee admission.

Use a structured attachment
A separate statement can follow this format, with the actual dates and facts inserted in the code block:
Subject: Request under section 249(3) for condonation of delay in Form 351. Order and limitation: I received the [order or demand] on {{service_date}}. The applicable filing deadline was {{deadline}}. Form 35 is being filed on {{filing_date}}, resulting in {{days_of_delay}} days of delay.2. Chronology: {{event_1_with_start_and_end_dates}}; {{event_2_with_start_and_end_dates}}.3. Effect on filing: {{explain_how_each_event_prevented_preparation_or_submission}}.4. Prompt action: When the impediment ended on {{end_date}}, I {{steps_taken}} and filed at the earliest practicable opportunity.5. Evidence: The attached documents numbered {{document_numbers}} support these dates and circumstances.6. Request: I request that the Commissioner (Appeals) exercise discretion under section 249(3) and admit the accompanying appeal.
Remove statements that are not true and do not leave template markers in the filed document. The statutory test is sufficient cause, not a prescribed list of excuses; the Department has not published a universal catalogue of reasons that must be accepted.
Evidence that makes the chronology verifiable
Evidence should support the specific dates and mechanism of the delay. Depending on the facts, useful records may include a hospital or treatment certificate showing the relevant period, proof of a death or incapacity affecting the person responsible for filing, correspondence showing when an authorized representative was engaged, portal error records, service or access logs, or documents showing when essential order papers became available. Submit only material relevant to the explanation and protect unrelated personal information.

Arrange attachments in the same order as the chronology and refer to each by a number in the statement. If a record is unavailable, say what was sought, why it cannot be produced and what alternative evidence supports the date. Unsupported assertions, concealment of an earlier notice, or contradictory dates can undermine credibility. The authority decides whether the complete account amounts to sufficient cause.
What the authority is likely to examine
- Length of delay: The exact number of days and whether the explanation covers all of them.
- Specificity: Dates, people, actions and documents are more useful than general statements of hardship.
- Causation: Whether the stated event genuinely prevented timely presentation of this appeal.
- Continuity: Whether unexplained gaps remain between events or after the obstacle ended.
- Good faith: Whether the account is consistent with portal records and other filings.
- Promptness: Whether the appellant acted without avoidable further delay once able to file.
- Merits and prejudice: These may be part of the overall context, but the merits alone do not establish sufficient cause.
These are practical drafting considerations derived from the statutory standard and Form 35 evidence requirements, not a guaranteed legal test or a prediction of outcome.
Common filing errors and how to correct them
Using the wrong trigger date
Counting from the order date when the rule uses service of the notice of demand can produce an incorrect deadline. Recheck the order category, service record and applicable provision before submitting a revised calculation.
Rank #4
Submitting only a condonation letter
A letter without the substantive Form 35 appeal does not present the grounds against the order. File the prescribed appeal and include the condonation request within the workflow.
Giving a conclusion instead of facts
“The delay was unavoidable” does not tell the authority what happened. Replace it with a dated chronology and a document reference for each material event.
Leaving part of the delay unexplained
If the evidence covers 10 days but the delay is 42 days, explain the remaining period or correct the calculation. A transparent admission of a short residual gap is safer than an overstated claim.
Attaching unreadable or unrelated files
Check that scans open, pages are complete and filenames identify their contents. Remove duplicate material that obscures the chronology and retain the originals for later verification.
Assuming filing creates an automatic stay
Condonation and stay are separate issues. Filing the appeal does not, by itself, establish that collection or other consequences are suspended; seek any available stay or payment direction through the proper channel.

- Store the exact Form 35 data, condonation statement and attachments in a read-only case folder.
- Monitor the e-Filing portal and registered contact details for defect notices, requests for clarification or an admission order.
- Respond by the stated date if the authority asks for additional evidence or a corrected attachment.
- Keep proof of every response and do not assume that silence means the delay has been condoned.
If the portal rejects a file for a technical reason, preserve the error message, correct only the identified defect and resubmit through the permitted process. A technical rejection is different from an order refusing condonation; obtain professional advice if the deadline or legal remedy is affected.

How the 2026 transition can affect a late appeal
For a tax year beginning before 1 April 2026, the Department says the 1961 Act framework continues for related proceedings under the transition provisions, even where the appeal is initiated on or after that date. That means section 249(3) may remain the relevant condonation provision for such a proceeding.
The same transition FAQ says a limitation period that expired before commencement is not revived merely because the replacement Act prescribes a different or extended period. It describes condonation under the old Act as potentially available when sufficient cause is established. Therefore, do not recalculate an already expired period using a newer rule and assume the delay disappeared. Record the original deadline, determine which transition clause applies and explain the delay under the governing law.
Cases involving a tax year beginning on or after 1 April 2026, or orders issued under the replacement legislation, may follow different forms, authorities or limitation provisions. Confirm the current form and statutory section on the Department portal before filing.
When professional advice is especially useful
Consider a qualified Indian tax professional when service dates conflict, the order spans more than one tax year, a representative or legal heir is signing, the delay is substantial, the portal shows a jurisdiction mismatch, or transition provisions could change the governing Act. Provide the adviser with the complete chronology and original service records; do not ask anyone to manufacture a reason or backdate a document. Professional assistance can improve accuracy, but no adviser can promise that the authority will condone the delay.
Final filing checklist
- Tax year and governing Act confirmed, including any 2026 transition rule.
- Correct appellate authority and Form 35 eligibility confirmed.
- Service date and limitation trigger documented.
- Deadline and exact days of delay calculated and checked.
- Order, demand notice, statement of facts and grounds of appeal attached.
- Chronological condonation statement explains the entire delay.
- Evidence is numbered, legible and tied to the stated dates.
- Verification completed by the proper person.
- Acknowledgment and complete submission package saved.
- Portal notices and any separate stay or payment obligations are being monitored.
The essential request is narrow: admit the accompanying Form 35 appeal despite lateness because documented circumstances constituted sufficient cause. Present the facts accurately, file as soon as practicable and let the Commissioner (Appeals) or Joint Commissioner (Appeals) exercise the discretion provided by the applicable law.
