If a restaurant appears to have added GST incorrectly, refused a proper bill, or collected a tax amount you cannot reconcile, first preserve the bill and payment evidence and ask the restaurant for an itemised explanation. For a consumer-facing grievance, use the National Consumer Helpline (NCH): call 1915 or 1800-11-4000, or submit the complaint through its official digital channels. NCH is a pre-litigation grievance service, not a guarantee that a tax investigation, refund or penalty will follow.
Choose the complaint route that matches the problem
There is no single consumer form that automatically treats every disputed restaurant tax line as GST evasion. The right route depends on what actually went wrong.

| Problem | Primary route | What the route does | Follow-up reference |
|---|---|---|---|
| A disputed GST amount, refusal to provide a bill, or another consumer billing grievance | National Consumer Helpline (NCH) | Records and forwards a consumer grievance during pre-litigation redressal | NCH docket or grievance number |
| Login, access, transaction or other technical difficulty on the GST portal | GSTN Self Service Portal | Searches issue-specific guidance and creates a support ticket when the problem remains unresolved | GSTN ticket reference |
| A separate unlawful service charge added to a restaurant bill | Department of Consumer Affairs service-charge procedure | Provides consumer-remedy and escalation options for the service-charge issue | NCH, Consumer Commission or other authority record |
GSTN’s helpdesk and CBIC’s listed CBIC Mitra contact are described for GST-system and ACES-GST-related issues. They should not be presented as universal hotlines for reporting a restaurant’s suspected tax under-collection or overcharging.

Separate the tax line from the total price
A high total does not, by itself, establish that GST was charged unlawfully. Restaurant tax treatment depends on the transaction facts and the rules in force for the relevant supply. Record the exact amount, the label used on the bill (for example, “GST”), and how that amount was calculated. Do not assume that a particular rate is wrong merely because the final price seems high.

Ask for an itemised bill or tax invoice
Ask the restaurant to identify the food or service items, their values, the disputed tax amount and any other charge. If practical, make the request in writing through the restaurant’s email, app or messaging channel so that you can retain the response.
CBIC invoice rules list prescribed particulars for a registered supplier’s tax invoice, including:
- the supplier’s legal name, address and GSTIN;
- a unique, consecutive invoice number for the financial year;
- the invoice issue date;
- a description and value of the supply; and
- the applicable tax information.
Individual fields can be subject to transaction-specific rules and exceptions. A missing field, an illegible receipt or an unexplained line is a reason to request clarification or a proper invoice; it is not conclusive proof of tax evasion.

CBIC’s FAQ explains that a registered person issues a GST tax invoice, while an unregistered person cannot issue a GST tax invoice and may instead issue an ordinary commercial invoice. The FAQ’s older threshold examples should not be treated as current legal advice. If the restaurant’s registration status matters to your complaint, verify the GSTIN through current official GST tools or records and describe the issue as suspected until that check is complete.
Do not apply packaged-goods MRP rules to a restaurant meal automatically
GST Council FAQ material says that MRP for packaged goods includes GST and discusses complaints about charging above MRP. That guidance does not decide the GST rate or legality of every restaurant bill. A packaged product bought from a restaurant and a prepared meal are not automatically governed by the same analysis.
Questions to ask the restaurant first
A short, neutral request often resolves a mistake faster than an accusation. Ask:
- What are the pre-tax values of each food or service item?
- Which line is GST, and what amount was used to calculate it?
- Is the business issuing a GST tax invoice or an ordinary commercial invoice?
- What GSTIN, legal name and address should appear on the invoice, if the supplier is registered?
- Is any additional amount a service charge, packaging charge or another fee rather than GST?
- Can the restaurant issue a corrected bill or explain why a correction is not being made?
Ask for the answer in writing where possible. Keep the original response, including a message that says the restaurant will not provide a bill. Do not threaten staff or alter a receipt; a calm chronology is more useful to a reviewer.

1. Request a correction or explanation
Before filing, ask the restaurant for an itemised bill or tax invoice and a written explanation of the disputed tax line. State the date, branch, bill number if available, amount paid and the precise correction you want. A request can resolve a simple billing misunderstanding and creates a clear record if the restaurant refuses.

2. Preserve the evidence
Keep the original bill or invoice, a clear photograph or scan, payment confirmation, and notes made soon after the incident. Your record should identify:
- the restaurant’s name and branch or full location;
- the date and approximate time;
- the bill or order number;
- the pre-tax amount, stated GST amount and total paid;
- whether you requested a GST invoice and what the restaurant supplied;
- the response to your request for clarification or correction; and
- any relevant order, card, bank, wallet or delivery-app reference.
Keep copies in their original form. Do not edit a screenshot in a way that removes the date, amount or merchant details. If the receipt is paper, photograph the whole page and retain it.
3. Contact the National Consumer Helpline
Use NCH for the consumer grievance: call 1915 or 1800-11-4000, or submit through the official NCH digital channels. The current contact information lists service daily from 08:00 to 20:00, except national holidays; check the live NCH contact page because hours and channels can change.
The Department of Consumer Affairs announced a GST-related complaint category in NCH in 2025. Select the category that most closely describes your problem, then provide the restaurant and transaction details in plain language. NCH is a pre-litigation grievance channel. It can communicate the complaint to the business and help pursue a consumer response, but it does not promise that a tax authority will open enforcement proceedings or that you will receive a particular refund or compensation.
4. Describe facts, not conclusions
Write what you can demonstrate. Include the amount billed, the tax label, whether a tax invoice was requested or received, what the restaurant said, and the remedy you requested. Use wording such as “suspected incorrect GST charge” when the facts do not establish deliberate evasion. Avoid alleging fraud solely because a receipt is incomplete or the total seems high.
5. Upload supporting records and save the docket number
Attach the bill, payment proof and relevant correspondence through the channel you use. Save the NCH docket or grievance number, the date submitted and copies of everything sent. If the business contacts you, keep the response and record whether the bill was corrected, a refund was offered or the explanation resolved the issue.
6. Follow up without changing your account
Use the same docket number when replying to NCH. If the restaurant sends a corrected invoice, compare it with the original and retain both. If it offers only a verbal explanation, make a dated note of who spoke with you and what was said. Do not submit contradictory versions of the transaction; explain any correction openly if you discover that your original figures were wrong.

How to verify a restaurant’s GST details
If the bill displays a GSTIN, check it through the current official GST tools or records rather than relying on a search result, a social-media post or a number supplied verbally. Compare the displayed legal name and address with the branch that served you and with the invoice. A mismatch is a useful fact to report, but it still does not by itself prove intentional evasion: a restaurant may operate under a different legal entity, use a registered head office or have made a clerical error.

If no GSTIN appears, ask whether the supplier is registered and request the appropriate invoice. An unregistered person cannot issue a GST tax invoice, although an ordinary commercial invoice may be issued. Do not copy an old turnover threshold from an FAQ and use it to decide the restaurant’s present registration obligation. Registration, exemptions and invoicing can depend on current law and transaction facts.
When GSTN’s Self Service Portal is the right place
GSTN’s Self Service Portal is for a problem with the GST portal itself—for example, access, a portal transaction or another user-facing technical issue. It is not a substitute for a consumer complaint against a restaurant.
- Open the GSTN Self Service Portal.
- Search the issue category that matches the portal problem.
- Read the related frequently asked questions and instructions.
- If the guidance does not resolve the problem, lodge a support ticket through the portal.
- Save the ticket reference and use it for follow-up.
For example, if you cannot use a GST portal function while checking a GSTIN, GSTN support is appropriate. If the portal works but a restaurant appears to have charged GST incorrectly, file the consumer grievance with NCH instead. CBIC Mitra listings similarly concern ACES-GST and related system support, not a general restaurant tax-fraud reporting line.

A service charge is a separate issue from the GST amount. A bill may contain both, and disputing one does not automatically prove the other is unlawful. Department of Consumer Affairs restaurant guidance gives these options for a service-charge complaint:
- Ask the restaurant to remove the service charge and issue a corrected bill.
- Contact NCH with the bill and payment evidence.
- File a case with a Consumer Commission, including through the electronic filing facility where available.
- Complain to the District Collector or the Central Consumer Protection Authority (CCPA).
Label the complaint accurately. If your objection concerns a line marked “service charge,” use the service-charge procedure; if it concerns the tax amount or refusal to issue an invoice, explain that separate GST-billing problem. If both appear on the same bill, list each amount separately and state the remedy sought for each.
What outcome should you request?
State a practical remedy rather than asking an intermediary to impose a penalty. Depending on the evidence, you can request:
- a corrected itemised bill or tax invoice;
- a written explanation of the tax calculation;
- refund of an amount demonstrably charged in error;
- removal of a separately disputed service charge; or
- referral or guidance on the appropriate authority if the consumer grievance is not resolved.
NCH’s role is grievance redressal before litigation. The materials establishing the NCH GST category do not promise a tax audit, prosecution, recovery or a fixed response time. If you need a formal adjudicatory remedy after the business does not resolve the matter, consider the Consumer Commission route described by consumer-affairs guidance. Keep evidence that shows the loss you are claiming and explain how the requested amount was calculated.

Calling an incomplete receipt proof of evasion
Invoice rules contain prescribed particulars, but exceptions and transaction details matter. Treat a missing GSTIN or invoice number as a question to clarify unless additional evidence supports a stronger allegation.
Using GSTN as a restaurant complaint inbox
A GSTN ticket records a portal-support issue. It does not turn a consumer billing allegation into an enforcement case. Use NCH for the consumer grievance and GSTN only for the portal problem.
Confusing GST with a service charge
Tax and service charge are different lines with different complaint routes. Identify each one separately and attach the complete bill.
Relying on old threshold or rate examples
Older FAQs can explain the narrow distinction between a GST tax invoice and an ordinary commercial invoice, but their threshold examples may not reflect current law. Do not use an old example to decide whether a present-day restaurant was required to register or which rate applies.
Expecting a guaranteed refund
A complaint can prompt a response without producing the exact remedy requested. Keep the docket number, follow the channel’s instructions and escalate through a Consumer Commission when a formal consumer remedy is needed.
Uploading incomplete or altered evidence
Crop only duplicate blank space, not the merchant name, date, amount, tax line or payment reference. Submit the complete bill and identify which page contains the disputed entry. Altered or partial screenshots can make a straightforward complaint harder to assess.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.A concise complaint format you can adapt
Use a factual chronology such as:
Date and branch: [date, restaurant name and location]
Bill/order number: [number, if shown]
Amount paid: [total]
Disputed line: [label and amount]
What I requested: [itemised bill, GST invoice, explanation or correction]
Restaurant response: [exact response or refusal]
Documents attached: [bill, payment confirmation and correspondence]
Remedy requested: [correction, refund or written explanation]
Replace each bracketed field with your own information before submitting. Keep the wording neutral and identify what the documents prove. If the bill contains both GST and service charge, add two separate disputed-line entries instead of combining them.
When to verify before escalating
Pause and re-check the bill when the dispute is based only on a surprising total, a tax label you do not recognise, or a receipt that omits details. Ask the restaurant to explain the calculation, compare the payment confirmation with the final bill, and verify any GSTIN through current official GST records. Escalate with the phrase “suspected incorrect GST charge” unless the evidence supports a more definite statement.

If the restaurant refuses any bill, will not identify the tax amount, or declines to correct a demonstrable error, include that refusal and the complete record in your NCH complaint. If the only disputed amount is a service charge, follow the Department of Consumer Affairs route rather than presenting it as a GST-rate complaint.
Practical decision checklist
- Tax amount or no bill: request an invoice, preserve evidence and contact NCH.
- GST portal malfunction: use GSTN Self Service, follow its FAQ and ticket process, and retain the reference.
- Service charge: request removal, then use NCH, a Consumer Commission, the District Collector or CCPA as appropriate.
- Uncertain rate or registration status: verify current official information and describe the concern as suspected.
- Any submission: save the docket or ticket number and all uploaded documents.
Bottom line
For a restaurant GST billing complaint in India, preserve the bill and payment record, ask for a proper explanation, and use NCH at 1915, 1800-11-4000 or its official digital channels. Use GSTN Self Service only for a GST-portal problem. Treat service-charge disputes separately, and do not call a confusing receipt or high total proof of tax evasion without transaction-specific evidence.
Frequently Asked Questions
How do I complain about a restaurant charging GST without a bill?
Ask for an itemised bill or tax invoice first and keep proof of the request. Save the payment record, restaurant details and any refusal, then contact the National Consumer Helpline at 1915 or 1800-11-4000, or use its official digital channels. Describe the charge as a suspected incorrect GST or missing-invoice issue unless the evidence establishes more.

Where can I report wrong GST on a restaurant bill?
Use the National Consumer Helpline for the consumer billing grievance. Include the complete bill, payment confirmation, date, branch, disputed tax line and the response to your request for correction. NCH is a pre-litigation channel and does not guarantee a tax investigation or refund.
Can I complain if a restaurant refuses a GST invoice?
Yes. Record when and how you requested the invoice and what the restaurant supplied instead. A registered supplier’s tax invoice has prescribed particulars, while an unregistered person cannot issue a GST tax invoice and may issue an ordinary commercial invoice. Verify the GSTIN through current official records and report the facts neutrally.
Is GSTN’s complaint portal for reporting a restaurant?
Generally no. GSTN’s Self Service Portal is for access, transaction and other technical problems on the GST portal. It uses issue searches, FAQs and support tickets with a reference number. A suspected incorrect restaurant charge belongs in a consumer grievance to NCH, not a GSTN technical ticket.
What if the restaurant added both GST and a service charge?
List the two amounts separately. Ask the restaurant to explain or remove the service charge and issue a corrected bill. For the service-charge issue, Department of Consumer Affairs guidance allows NCH, a Consumer Commission including electronic filing where available, or a complaint to the District Collector or CCPA. Use the GST-billing route for the separate tax question.
Does a missing GSTIN prove tax evasion?
No. Invoice requirements, exceptions and transaction details matter, and an incomplete receipt alone is not conclusive proof of evasion. Request clarification, verify any displayed GSTIN through current official records and use wording such as “suspected incorrect GST charge” unless stronger evidence exists.
What remedy should I request from NCH?
Ask for a corrected itemised bill or tax invoice, a written explanation, a refund of an amount demonstrably charged in error, or removal of a separately disputed service charge. Keep the NCH docket number. If pre-litigation efforts do not resolve the matter and a formal remedy is needed, consider the Consumer Commission route.
The Bottom Line
Preserve the complete bill and payment proof, request an explanation, and take a consumer-facing restaurant GST complaint to the National Consumer Helpline at 1915, 1800-11-4000 or its official digital channels. Reserve GSTN Self Service for GST-portal problems, and handle service-charge disputes under the separate consumer-affairs procedure.
