Reply to a Section 74 GST show-cause notice (SCN) in writing through FORM GST DRC-06 when the notice summary is in DRC-01. Your submission should answer every allegation invoice by invoice, reconcile the department’s figures with your books and returns, and address the separate ingredients of fraud, wilful misstatement or suppression of facts. Attach only records that exist, identify each annexure, and preserve the portal acknowledgement.

Section 74 is not triggered by every input-tax-credit (ITC) mismatch. It applies where the alleged wrong availment or utilisation is said to result from fraud, wilful misstatement or suppression of facts to evade tax. The exposure can include the disputed tax, statutory interest under Section 50 and a penalty equal to the tax specified. Have a qualified Indian GST professional review a high-value notice or any allegation of fabricated invoices, circular trading or deliberate concealment. Verify the current CGST Act, Rules, portal labels and any Section 74A or other amendments that apply to your tax period.

What a Section 74 notice alleges

Section 74 is the aggravated demand route under the CGST Act. The proper officer must connect the unpaid, short-paid or erroneously refunded tax, or the wrongly availed or utilised ITC, to one of three stated causes: fraud, wilful misstatement or suppression of facts to evade tax. A notice that merely identifies a data difference does not, by itself, prove any of those mental or conduct elements.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Section 74 says that where it appears to the proper officer that tax was not paid, was short paid, was erroneously refunded, or ITC was wrongly availed or utilised “by reason of fraud, or any wilful-misstatement or suppression of facts to evade tax,” the officer shall serve notice.

The notice normally identifies the tax period, the legal provision, the proposed tax, interest and penalty, and the material relied upon. DRC-01 is the electronic summary; it asks for the facts and grounds of the demand and the figures for tax, interest and penalty. Treat every field as something to verify, not as an established fact.

What is at stake

  • Tax: the ITC alleged to have been wrongly availed or utilised, after correcting for valid credits, reversals and duplicate entries.
  • Interest: the amount computed under Section 50, with the period and method stated in the notice.
  • Penalty: Section 74 provides for a penalty equivalent to the tax specified, subject to the statutory payment and adjudication provisions that may apply to the particular case.
  • Procedure: an order can be passed after considering your written representation and hearing rights. A defective notice, wrong jurisdiction or unsupported computation can be material objections.

First actions after service

Do not wait until the response date to assemble records. Download the complete notice, every relied-upon document and the DRC-01 summary from the common portal, then create a controlled working copy. Keep the date and mode of service because limitation and hearing arguments often depend on the notice and order dates.

  1. Record the identifiers. Note your GSTIN, legal name, DRC-01 reference, tax period, date of service, issuing officer and office, statutory section and response deadline.
  2. Freeze the evidence set. Preserve purchase registers, ledgers, tax invoices, debit and credit notes, goods-receipt notes, stock records, transport documents, e-way bills where relevant, service deliverables, bank statements and supplier correspondence. Export read-only copies of GSTR-2A, GSTR-2B and the relevant GSTR-3B filings.
  3. Recalculate independently. Recreate the notice’s tax, interest and penalty table in a spreadsheet. Mark duplicates, wrong tax periods, wrong tax heads, credits already reversed and arithmetic errors.
  4. Check the legal frame. Confirm that the notice invokes the correct provision for your period, identifies the alleged conduct and is issued by an officer with authority. Check limitation and date fields against the current Act and Rules.
  5. Obtain missing relied-upon material. If the notice refers to a statement, investigation report, supplier profile or data extract that was not supplied, request a copy and reserve your right to supplement the response after disclosure.
  6. Choose an interim strategy. Payment or reversal through DRC-03 may be appropriate for an admitted, well-quantified error, but it is not automatically the best response to a fraud allegation. Compare the evidence, amount, limitation, cash-flow effect and litigation objective before paying.
  7. Set an internal sign-off. Have the person responsible for finance, procurement and tax each verify the relevant records. A professional should review a large demand, related-party transaction, alleged fake invoice or case involving multiple registrations.

Build the written reply around the notice

A persuasive submission follows the officer’s allegations in the same order as DRC-01. Use a searchable PDF with page numbers and an index. Avoid a general denial that leaves individual invoices unanswered.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

1. Heading and preliminary statement

Start with the GSTIN, legal name, notice number, tax period, date of service and the officer’s designation. State that the reply is filed under Section 74 and Rule 142 in FORM GST DRC-06. Identify the documents attached and, if necessary, explain that a detailed supplement will follow once undisclosed relied-upon material is supplied.

2. Preliminary objections supported by the record

Raise only objections you can substantiate. Possible issues include invalid or unproved service, an incorrect statutory section, a notice that does not disclose the factual basis for fraud or suppression, an incorrect tax period, limitation, lack of jurisdiction, an officer acting outside the applicable assignment, or relied-upon documents that were withheld. Explain the prejudice caused and request a corrected notice or disclosure rather than listing technical points without facts.

3. Allegation-by-allegation table

Notice allegation Your position Evidence and explanation
Supplier invoice not reflected in the department’s data Admitted, denied or partly admitted Invoice, supplier GSTIN, receipt proof, 2A/2B extract, payment record and supplier correspondence; explain timing or amendment.
ITC claimed in the wrong period Explain the correct period and any reversal Purchase register, GSTR-3B for both periods, reversal entry and later re-availment, if made.
Invoice allegedly unsupported by receipt Deny if goods or services were received Goods-receipt note, stock or consumption record, e-way bill, transport document or service deliverable.
Fraud, wilful misstatement or suppression alleged Address each element separately Disclosures in returns and books, consistent ledgers, approval controls, correspondence and the absence of concealment or fabricated records.

Quote or accurately paraphrase each allegation, state whether it is admitted, denied or partly admitted, and cross-reference the exact annexure and page. Distinguish a clerical error, timing difference or supplier amendment from deliberate concealment. If one invoice is defective, do not concede a larger group without testing each entry.

4. Invoice-level ITC reconciliation

Prepare a schedule that lets the officer trace every disputed amount from the notice to your records and returns. Include at least these columns:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Field What to show
Invoice identity Invoice number, invoice date, debit or credit note reference and supplier GSTIN.
Value and tax Taxable value, IGST, CGST, SGST or UTGST and the total ITC claimed.
Receipt or completion Date and evidence that goods were received or the service was completed and used for business.
Payment Payment date, bank reference or ledger settlement; explain advances, credit periods or set-offs.
Return trail GSTR-2A or 2B status for the relevant period, GSTR-3B table and month of availment.
Corrections Reversal, re-availment, debit or credit note, amendment or tax paid through DRC-03, with date and reference.
Conclusion Valid, not eligible, already reversed, duplicate, wrong period or requiring a quantified adjustment.

Explain data-timing issues: a supplier may upload or amend an invoice after your claim period, and a 2B result may differ from the contemporaneous purchase register. A portal mismatch is evidence to investigate, not a substitute for the statutory conditions and transaction records. Conversely, a matching 2B entry does not by itself prove receipt or business use; provide the operational evidence as well.

5. Answer the Section 74 ingredients

Make a separate section for each alleged basis. For fraud, identify the specific act said to be deceptive and show why the transaction records, counterparties and controls do not support it. For wilful misstatement, distinguish an intentional false statement from a typographical, classification or timing error and identify the correct disclosure. For suppression of facts to evade tax, show where the transaction was recorded in books, returns, reconciliations or correspondence and why there was no concealment intended to evade tax.

Do not argue only that the supplier was registered. Demonstrate the complete chain: a genuine invoice, receipt of goods or service, business use, tax treatment, payment or settlement and accurate return disclosure. If the department relies on a supplier investigation, address the particular invoice and your knowledge or participation; another party’s default is not automatically proof of your fraud, but unexplained circular transactions require a specific factual response.

6. Reconcile tax, interest and penalty separately

Attach a computation with one row per invoice and a totals page. Identify the tax head, period, amount already reversed or paid, interest start and end dates, rate used and penalty basis. Flag any duplicate invoice, wrong registration, wrong month, credit note, ineligible component or amount counted both as availment and utilisation. Ask the officer to provide the calculation if the notice gives only a lump sum.

7. Alternative submission under Section 75(2)

Seek complete dropping of the Section 74 demand first. In the alternative, state that if the officer does not establish fraud, wilful misstatement or suppression to evade tax, the matter must be re-determined as if the notice were issued under Section 73(1), as contemplated by Section 75(2). Apply that alternative to the corrected tax and interest computation rather than conceding the Section 74 penalty. The alternative preserves your position while giving the officer a legally coherent route for any genuine non-fraud error.

8. Relief and personal hearing

Request that proceedings be dropped for unsupported invoices and that the computation be corrected for any admitted adjustments. Ask for deletion or reduction of interest and penalty only to the extent permitted by law and the facts. Request copies of all relied-upon material, an opportunity to file a supplementary reply after disclosure, and a personal hearing where the statute and procedure provide one. Identify the authorised representative and attach the authority letter when someone else signs or appears.

Evidence that can prove genuine ITC

Use a document only if it relates to the disputed transaction and is authentic. Redact irrelevant personal data, label every annexure and keep the unredacted original securely.

  • Commercial records: tax invoices, debit and credit notes, purchase orders, contracts, quotations and approval records.
  • Receipt and movement: goods-receipt notes, inward registers, stock ledgers, production or consumption records, transport documents and e-way bills where applicable.
  • Services: statements of work, attendance or milestone records, deliverables, acceptance emails, timesheets and evidence of business use.
  • Payments: bank statements, payment vouchers, vendor ledgers, settlement notes and explanations for credit periods, advances or set-offs.
  • GST trail: supplier GST registration details, GSTR-2A or 2B extracts, your GSTR-3B and relevant electronic liability or credit ledgers.
  • Corrections: reversal journal entries, DRC-03 challans and acknowledgements, supplier amendments, later re-availment and prior replies.
  • Governance: tax-review checklists, maker-checker approvals, reconciliation policies and correspondence showing that discrepancies were investigated.

Organise the files in the same order as the reconciliation schedule. A concise index should state the annexure number, document description, date, invoice range and pages. Do not create retrospective documents or alter an invoice; explain a missing record and provide corroboration instead.

How to file the reply in DRC-06

Rule 142(4) provides that the representation referred to in Section 73(9) or Section 74(9) is furnished in FORM GST DRC-06. The exact portal labels can change, so compare the screen with the current GST common-portal instructions before submission.

  1. Sign in to the GST common portal with the correct GSTIN and authorised credentials.
  2. Open the notices or orders area, locate the DRC-01 reference and select the response option for that notice.
  3. Choose FORM GST DRC-06, enter the facts and grounds in the text fields and ensure the tax, interest and penalty figures agree with the attached schedule.
  4. Upload a legible, searchable PDF of the reply, annexure index and evidence. If the portal imposes a file-size limit, split files logically and identify each part in the index.
  5. Review the declaration, authorised signatory details and service address. Submit using the permitted electronic verification method.
  6. Download the submitted text or PDF, ARN or acknowledgement, timestamp and list of uploaded files. Save a screen capture and the portal-generated copy in your case folder.

Keep proof that the response was served before the deadline and preserve any error message or failed-upload record. If the portal is unavailable, document the outage and use the legally permitted alternative channel only after obtaining professional guidance; never rely on an unacknowledged email as the sole filing.

Using DRC-03 for payment or reversal

Rule 142 also provides the DRC-03 payment pathway and related acknowledgements or closure forms. Use it only after deciding whether the amount is truly admitted and correctly quantified. A payment entry should identify the tax period, tax head, tax, interest and penalty components and explain the corresponding invoices or reversal. Retain the challan, debit details and any acknowledgement. Payment does not convert an unsupported Section 74 allegation into proof of fraud; the legal and commercial consequences should be reviewed before submission.

Contest, pay, or combine the approaches?

The right choice depends on the notice and evidence, not on a universal rule. You may contest the fraud characterization while voluntarily reversing a clearly ineligible invoice, provided the reply states exactly what is admitted and what remains disputed.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Approach When it may fit Main advantages Risks and checks
Contest in full Records show receipt, business use, return disclosure and no evidence of deliberate conduct; computation or jurisdiction is defective. Preserves the right to challenge tax, interest and the Section 74 penalty; no immediate cash outflow for disputed amounts. Requires a complete evidence file, hearing preparation and possible litigation; keep limitation and service objections precise.
Voluntary payment or reversal An invoice or portion is plainly ineligible, duplicated or already accepted as an error and the amount is reliably calculated. Can limit further interest exposure and simplify an admitted portion. Payment affects cash flow and may have consequences for penalty or settlement provisions; do not pay a lump sum without allocating tax, interest and penalty.
Partial admission with contest A small, quantifiable error exists but the fraud allegation or remaining invoices are unsupported. Separates a genuine correction from the disputed Section 74 theory and gives the officer a clear computation. Use unambiguous wording so an admission is not read as accepting every allegation.

Section 74 compared with Section 73

Issue Section 74 allegation Section 73 treatment if Section 75(2) applies
Conduct required Fraud, wilful misstatement or suppression of facts to evade tax must be established as the reason for the ITC error. Non-fraud short payment, wrong availment or similar error is determined under the Section 73 framework.
Reply strategy Answer the transaction and separately disprove each aggravated element. Focus on eligibility, corrected tax, interest and the statutory non-fraud consequences.
Penalty exposure Section 74 specifies a penalty equivalent to the tax, subject to applicable statutory options. Penalty treatment is governed by the Section 73 provisions and the facts.
Alternative request Seek dropping of the Section 74 demand, then request re-determination under Section 75(2) if the fraud element fails. Quantify only the amount that remains legally payable after corrections.

Do not assume that a favorable Section 75(2) argument automatically eliminates tax or interest. It changes the legal route when the aggravated ingredients are not established; eligibility and computation still have to be proved.

Self-preparation versus professional representation

Factor Self-prepared reply Professional assistance
Suitable for Low-value, clearly documented mismatch with a short invoice list and no fraud allegation beyond a bare label. High-value demand, multiple periods or registrations, alleged fake invoices, supplier investigation, limitation dispute or likely appeal.
Strength Fast access to internal records and lower external cost. Independent legal analysis, controlled computation, hearing advocacy and preservation of appellate issues.
Required discipline Use the allegation and reconciliation tables, verify every figure and keep filing evidence. Give the adviser complete records, a timeline and authority; review the final factual assertions before signing.
Risk An accidental admission, missed limitation point or poorly indexed annexure can weaken the case. Delay, cost or an adviser who relies on generic submissions rather than your transaction evidence.

Common failure points and fixes

Generic denial

Problem: “All ITC is valid” does not answer an invoice list or a fraud theory. Fix: use a row-by-row schedule and state the legal and factual reason for each conclusion.

Relying only on GSTR-2B

Problem: a matching or non-matching statement does not establish receipt, business use or deliberate conduct. Fix: combine return data with invoices, receipt or service evidence, payment and ledger records.

Ignoring the computation

Problem: a valid defence can be obscured by duplicate invoices, wrong periods or credits already reversed. Fix: rebuild tax, interest and penalty separately and show the corrected total.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Conceding fraud by careless wording

Problem: calling an entry “fraudulent” when you mean “clerical error” can undermine the Section 75(2) alternative. Fix: describe the precise error, correction date and control failure without admitting an intent to evade unless that is truly your position.

Missing the filing record

Problem: an uploaded file without an acknowledgement is difficult to prove later. Fix: download the DRC-06 submission, ARN, timestamp, annexure list and service evidence immediately.

Paying before deciding the objective

Problem: an unallocated DRC-03 payment can create uncertainty about what was admitted and whether the dispute remains. Fix: obtain a written computation and state the scope of any admission in the reply.

What happens after filing

Monitor the portal and the registered communication channel for a hearing notice, request for information or adjudication order. Keep a chronology of every submission and response. If a hearing is offered, prepare a short speaking note keyed to the allegation table, the invoice schedule and the Section 74 elements; take originals or verifiable copies and be ready to explain discrepancies without changing your factual position.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If the officer supplies new material, ask for reasonable time to respond and identify which conclusions depend on it. Compare the eventual order with your submissions: it should address the evidence, computation and legal grounds. Obtain advice promptly on any rectification, appeal or recovery step because statutory periods and forms depend on the order date and the current law.

A practical reply outline

  1. Title, GSTIN, notice reference, period and service date.
  2. Preliminary objections supported by documents.
  3. Brief facts and business process for purchasing or receiving the services.
  4. Allegation-by-allegation table with annexure references.
  5. Invoice-level ITC reconciliation and corrected computation.
  6. Separate response to fraud, wilful misstatement and suppression.
  7. Section 75(2) alternative if the Section 74 ingredients are not proved.
  8. Relief sought, request for relied-upon documents and personal hearing.
  9. Declaration, authorised signatory details and annexure index.

Use this outline as a navigation aid, not as a substitute for the facts in your notice. The strongest reply is internally consistent: each invoice in the computation appears in the evidence index, each allegation has a stated position, and every payment or reversal is clearly allocated.
